BOARD MEMBERS PRESENT: ACCEPTANCE OF MINUTES: Spencer, Gerarden, Eadie On motion by Gerarden and second by Eadie, the Minutes of January 17 and 24, 1973 were accepted as transcribed and mailed by the Secretary. AGENDA ITEMS TO BE CONTINUED OR WITHDRAWN: USE PERMIT NO. 73-1 - Continued Applicant: Carole Boling To permit the construction of a carport in the R1 zone, pursuant to S. 9106 of the Huntington Beach Ordinance Code, located on the east side of Melody Lane, approximately 360 ft. south of Edinger Avenue. The Acting Secretary informed the Board that the applicant indicated possible withdrawal of said use permit. A MOTION WAS MADE BY EADIE AND SECONDED BY SPENCER TO CONTINUE USE PERMIT NO. 73-1 TO MARCH 7, 1973 IN ORDER TO RECEIVE A LETTER OF WITHDRAWAL. CONDITIONAL EXCEPTION NO. 73-7 - Continued Applicant: Willard Barnes To permit an encroachment of 2 ft. into the required 5 ft. sideyard in lieu of S. 9163.2 of the Ordinance Code located on the west side of England Street approximately 150 ft. north of Yorktown Avenue in the R2 Medium Density Residential District. The Acting Secretary informed the Board that this application should be continued in order to be heard in conjunction with a use permit application. The Acting Secretary informed the Board that the applicant submitted a letter requesting continuance of said application to March 7, 1973. Kordick To permit the construction of an office building pursuant to S. 9530 of the Huntington Beach Ordinance Code, located on the east side of Crystal Street approximately 255 ft. south of Garfield Avenue in the M1 Light Industrial District. Martin Kordick, applicant, addressed the Board and explained the proposal. The Board discussion followed. A MOTION WAS MADE BY GERARDEN AND SECONDED BY SPENCER TO APPROVE ADMINISTRATIVE REVIEW NO. 73-23 UPON THE FOLLOWING CONDITIONS AS AMENDED: A. TO BE CONSTRUCTED PRIOR TO ISSUANCE OF BUILDING PERMITS! 1. A revised plot plan shall be submitted to the Board of Zoning Adjustments for approval action. 2. Crystal Street shall be dedicated to City standards at the time each parcel is developed. 3. Elevations of the proposed plan shall be submitted to the Board of Zoning Adjustments for review and approval action. 4. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. S. TO BE COMPLETED PRIOR TO FRAMING INSPECTION: 1. A landscaping plan shall be submitted to the Planning Department for review and approval action. 2. Rooftop mechanical equipment shall be screened from view. Said screening plan shall be approved by the Board of Zoning Adjustments. 3. All signs for the proposed development shall be submitted to the Board of Zoning Adjustments for review and approval. 4. Fire alarm system conduit and appurtenances shall be.installed by the developer at locations and to specifications provided by the Fire Department. S. Parking compounds shall be screened with a com- bination of fencing and landscaping. Said plan shall be submitted to the Planning Department for review and approval. Fencing and landscape plans shall include the following information: a. A list including quantities and sizes for each species of plants and all ground cover material. b. Irrigation layout to include meter location, pipe sizes, sprinkler head types, etc. c. Fencing materials and detail drawing. C. TO BE COMPLETED PRIOR TO FINAL INSPECTION:' 1. Crystal Street shall be fully improved including street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 2. All utilities shall be installed underground. 3. Off-street parking facilities shall conform to Article 979. 4. A solid gate of wall height shall be provided. S. Surfacing: With exception of driveways, the entire storage yard shall be oiled. Application of said oil shall be 0.25 gallons of SC-70 per square yard on sterilized soil. 6. There shall be no fence, structure or landscaping constructed or maintained over 3 1/2 feet h:.gh within a 10 ft. by 10 ft. triangular area at: the intersection of driveways and streets or wi-:hin a 25 ft. by 25 ft. triangular area at the intersection of streets. 7. No structures, other than those shown on the approved plot plan, shall be constructed within the project. 6. Gerarden, Eadie ADMINISTRATIVE REVIEW NO. 73-24 - Continued Applicant: Green Medallion Nursery To permit a building addition to an existing nursery building pursuant to S. 9430 of the Huntington Beach Ordinance Code, located on the west side of Beach Blvd. approximately 630 ft. south of Garfield Ave. in the C2 Community Business District. Mr. Reed, applicant, addressed the Board and explained the request. Mr. Reed also submitted photographs of the existing nursery. Board discussion followed. A MOTION WAS MADE BY EADIE AND SECONDED BY GERARDEN TO APPROVE ADMINISTRATIVE REVIEW NO. 73-24 UPON THE FOLLOWING CONDITIONS AS, AMENDED . r A. Beach Blvd. shall be dedicated to City and/or State standards at the time each parcel is developed. 3. Willits To permit a two (2) ft. encroachment of the standard 20 ft. required minimum open space dimension pursuant to S. 9103.3.1.1.2 of the Huntington Beach Ordinance Code, located north of La Cresta Circle, approximately 350 feet west of Pier View Street in the R1 Low Density Residential District. The hearing was opened to the audience. Mr. Willits, applicant, addressed the Board and explained the request. There being no other comment, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY GERARDEN AND SECONDED BY SPENCER TO APPROVE CONDITIONAL EXCEPTION NO. 73-8 FOR THE FOLLOWING REASONS: 1. The lot provides more open space - 117.0 sq. ft. - than the Code requires. 2. The applicant is unable to provide a minimum dimension required for open space due to the narrow width of this lot and is thus being deprived of a development right that adjacent R1 zoned parcels enjoy. -5- 2/28/73 - BZA Minutes: II.B. ROLL CALL VOTE: AYES: Spencer, NOES: None ABSENT: None THE MOTION CARRIED. ORAL COMMUNICATION: Gerarden, Eadie Home Occupation Affidavit - Dog Grooming 9701 Flounder Drive Huntington Beach, Calif. Susan Haycraft, applicant, addressed the Board and submitted a petition signed by adjacent property owners endorsing said request. Mr. Dave Eadie, Acting Secretary, informed the Board that he had contacted the Health Department and the Attorneys office regarding this request and was informed that there are no State laws or City ordinances prohibiting this request. The Board recommend that the Planning.Department reconsider their denial of this request for home occupation and noted that if complaints were registered the use should not continue. ADMINISTRATIVE REVIEW NO. 73-11 Applicant: Donald L. Bren Company The Board reviewed the modified plot plan pertaining to the construction of a sales model complex located on the east side of Newland Street, approximately 670 f t. south of Yorktown Avenue. DISCUSSION: Gerarden, Eadie The Board discussed the modification of wall design for Tract No. 6808. It was the consensus of the Board to continue this item to March 7, 1973 for further study. ADMINISTRATIVE REVIEW NO. 73-33 Applicant: June Blair The Board reviewed the parking requirement for an existing building to be used as a County Health Agency office at 307 Main Street. It was noted that the applicant will provide 5 parking spaces at 316 Fifth Street which is within the 300 ft. distance required by the Huntington Beach Ordinance Code. A MOTION WAS MADE BY GERARDEN AND SECONDED BY SPENCER TO APPROVE ADMINISTRATIVE REVIEW NO. 73-33 UPON THE FOLLOWING CONDITIONS: 1. The applicant shall comply with all applicable City Ordinances. 2. A lease rental agreement for said parking spaces shall be renewed and submitted to the City prior to occupancy of said building. 3. This Administrative Review shall become null and void at the same time as such lease agreement for required parking becomes null and void. SIGN PERMITS: Diversified Shopping Centers Brookhurst and Hamilton The Board reviewed the proposed pole sign having 270 sq. ft. and total height of 25 ft. No action on the appli- cation was taken. Charles Geers 230-232-234 Adams Avenue Huntington Beach, Calif. The Board reviewed a new pole sign of 75 sq. ft. and the total height being 17 ft. 6 in. No action was taken on said application. WIR Developers Tract No. 7930 The Board reviewed temporary subdivision directional.sign located 30.0 ft. east of Beach Blvd. and Terry Dr. No action was taken. DISCUSSION: It was the consensus of the Board to meet with the City Attorney and Building Director to discuss future policies regarding -review of signs by the Board.
