BOARD MEMBERS PRESENT: Spencer, Eadie, Gerarden BOARD MEMBERS ABSENT: None AGENDA"ITEMS TO BE CONTINUED: CONDITIONAL EXCEPTION NO. 73-7 - Continued Applicant: Willard D. Barnes To permit an encroachment of 2 ft. into the required 5 ft. sideyard in lieu of S. 9163.2 of the Ordinance Code. In Conjunction With USE PERMIT NO. 73-19- Continued Applicant: Willard D. Barnes To permit the construction of an addition to an existing dwelling pursuant to S. 9719 of the Huntington Beach Ordinance Code located on the west side of England Street 200 ft. north of Yorktown Avenue in the R2 Medium Density Residential District. The hearing was opened to the audience. Mrs. Barnes, wife of applicant, was present. She presented the Board with a copy of computations done in surrounding area with regard to existing side yard setbacks on the properties. She stated that she felt the addition would upgrade the property in keeping with general area, and that it would not encroach into any usable vacant area now existing. The Board discussed their visit to this area and noted the vary in setbacks. The consensus of the Board was that the request for additional area would not give proper justification. Gerarden stated that the Board did not wish to set a precedent for the area. The Acting Secretary pointed out that the 2 foot shown in the kitchen would not create a hardship, and that the 5 ft. wide yard would not be considered open space but intended as a buffer between houses. The public hearing was closed. There was a discussion concerning windows along the wall and the Chairman pointed out that they would not be allowed. ON MOTION BY GERARDEN SECOND BY EADIE CONDITIONAL EXCEPTION NO. 73-7 WAS DENIED FOR THE FOLLOWING REASONS BY THE FOLLOWING ROLL CALL VOTE: 1. The Board found that the applicant had failed to demonstrate a justifiable hardship. 2. The Board does not wish to set precedent in this area. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The plot plan received 2/5/73 shall be the approved layout. 2. Elevations shall be compatible with existing architectural design. 3. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 4. Soil reports as -required by the Building Department and the Department of Public Works shall be submitted to the City. S. The addition shall conform to the required side yard setbacks. 6. England Street shall be -dedicated to City Standards at the time each parcel is developed. B. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. England Street shall be fully improved including street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 2. All utilities shall be installed underground. 3. Off-street parking facilities shall conform to Article 979. C. TO BE COMPLETED PRIOR TO ISSUANCE OF CERTIFICATE OF OCCUPANCY: 1. Water supply shall be through the City of Huntington Beachts water supply system. 2. Sewage disposal shall be through the City of Huntington Beach's sewage system. 3. The property shall participate in the local drainage assessment district. 4. No structures, other than those shown on the approved plot plan, shall be constructed within the project. S. All applicable City Ordinances shall be complied with. Board of Zoning Adjustments Wednesday, March 21, 1973 Page 3 ON MOTION BY EADIE AND SECOND BY SPENCER ADMINISTRATIVE REVIEW NO. 73-28 WAS CONTINUED TO APRIL 4, 1973 MEETING BY THE FOLLOWING ROLL CALL VOTE: AYES: Spencer, Eadie, Gerarden NOES: None ABSENT: None USE PERMIT NO. 73-13 - Continued Applicant: Harold I. Ewell To permit construction of a two bedroom apartment above an existing garage pursuant to S. 9719 of the Huntington Beach Ordinance Code located on the northwest.corner of Olive Street and 16th Street in the R4 high density residential district. The hearing was opened to the audience. Mr. Harold Ewell, applicant, was present. There was a discussion on open space. It was the consensus of the Board that required parking would reduce the open space. The Acting Secretary stated that the addition of a wall would not be adding harmony to existing corner. The Acting Secretary stated that when additional plans were submitted by the applicant for the purpose of checking open space, the plans conflicted with the plans on file for the Use Permit. Therefore a check on open space requirement could not be done. The planner, Dan Bruening, was called into the meeting and verified this. The public hearing was closed. ON MOTION BY GERARDEN SECOND BY SPENCER USE PERMIT NO.73-13 WAS DENIED FOR THE FOLLOWING REASONS BY THE FOLLOWING ROLL CALL VOTE: 1. The parking required for additional unit would infringe on portions of the required open space. 2. Access and egress from the interior court parking area would not be conveniently accessible. March To permit a kitchen addition to an existing restaurant in the C2 Community Business District pursuant to Section 9430 of the Huntington Beach Ordinance Code located west of Bolsa Chica Street approximately 400 ft. north of Warner Avenue. John F. March, applicant, was present. A discussion by the Board followed. The Acting Secretary inquired of the applicant his plans for the area to the rear of the property. Applicant stated that it would be used for parking. He explained that he was requesting approval for minimum parking to get started and in June a new set of plans for an addition will be submitted. Bolsa Chica Street shall be dedicated to City standards at the time each parcel is developed. 3. The water, sewer, and fire hydrant system shall be ap- proved by the Department of Public Works and Fire Department. 4. Soil reports as required by the Building Department and the Department of Public Works shall be submitted to the City. B. TO BE COMPLETED PRIOR TO FRAMING INSPECTION: 1. A landscaping plan shall be submitted to the Planning Department for review and approval action. 2. Rooftop mechanical equipment shall be screened from view. Said screening plan shall be approved by the Board of Zoning Adjustments. 3. -All signs for the proposed development shall be sub- mitted to the Board of Zoning Adjustments for review and approval. 4. A lighting plan indicating illumination equal to lighting on public streets shall be submitted to the Department of Public Works for approval. S. Fire alarm system conduit and appurtenances shall be installed by the developer at locations and to speci- fications provided by the Fire Department. 6. Parking compounds shall be screened with a combination of fencing and landscaping. Said plans shall be sub- mitted to the Planning Department for review and approval. Fencing and landscape plans shall include the following information: a. A list including quantities and sizes for each species of plants and all ground cover material. b. Irrigation layout to include meter location, pipe sizes, sprinkler head types, etc. c. Fencing materials and detail drawing. C. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. Bolsa Chica Street shall be fully improved including street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 2. All utilities shall be installed underground. 3. -.Off-street parking facilities shall conform to Article 979. 4. A masonry wall shall be constructed along the rear property line. Sewage disposal shall be through the City of Huntington Beach's sewage system. 3. Easements for utilities or walkways shall be.provided to Department of Public Works standards. 4. The property shall participate in the local drainage assessment district. S. No structures, other than those shown on the approved plot plan, shall be constructed within the project. 6. Sommerfeld To permit the 24 hour care of two (2) non -related persons in the R1 Low Density Residential District pursuant to S. 9730.26 of the Huntington Beach Ordinance Code, located on the north side of Melbourne Drive approximately 230 ft. east of Hanover Lane. The hearing was opened to the public. Elona B. Sommerfeld, applicant, was present. The applicant stated to the Board that she currently has two licenses, one for full time care of -two foster children, and one for day care children. There was a discussion by the Board. The public hearing was closed. ON MOTION BY EADIE AND SECOND BY SPENCER ADMINISTRATIVE REVIEW'NO. 73-39 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING ROLL CALL VOTE: 1. Approval shall be limited to 2 non -related charges. 2. All applicable City and County laws relating to care of non -related shall be complied with. AYES: Spencer, Gerarden, Eadie NOES: None ABSENT: None USE PERMIT NO. 73-19A Applicant: Centinela Bank To permit the construction and operation of a bank pursuant to S. 9472 of the Huntington Beach Ordinance Code. Board of Zoning Adjustments Wednesday, March 21, 1973 Page 6 ADMINISTRATIVE REVIEW NO. 73-40 Applicant: Centinela Bank To permit the establishment of a temporary banking quarters pending construction of proposed permanent quarters pursuant to S. 9730.17 of the Huntington Beach Ordinance Code located on the east side of Brookhurst Street approximately 150 ft. south of Garfield Avenue in the C4 Highway Commercial District. The hearing was opened to the public. Mr. Chad Twichell, representing the applicant, was present. Gerarden stated that Walt Lipps, Building Department, had run a field check on site for computation of existing parking and found that there was more than adequate parking space. It was noted by the Board that the Agenda erroneously listed Use Permit No. 73-19 when it should be Use Permit No. 73-19A. There was a discussion of signs and the applicant was informed that separate application has to be made for signs. There was a discussion on fire department requirements. The public hearing was closed. It was stated that revised plot plan shall be submitted to BZA prior to issuance of building permits. ON MOTION BY GERARDEN AND SECOND BY SPENCER USE PERMIT NO. 73-19A WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING ROLL CALL VOTE: A. Mr. Slater, the applicant, was present. A discussion by the Board and Mr. Slater followed. Gerarden pointed out that only food grown on the site could be offered for sale. The Acting Secretary stated that the plot plan received March 13, 1973 was approved. Violation of the conditions of approval or applicable City Code shall void approval of Administrative Review No. 73-41 and the stand shall be removed and the operation terminated. 4. Agreement required by S. 9730.15 (f) shall be approved by City Attorneys office and an approved copy shall be placed in Administrative Review file. S. Sterling Buck & Associates To permit construction of a hotel and restaurant pursuant to 9451 of the Huntington Beach Ordinance Code located on the north side of Pacific Coast Highway between 9th and 10th Streets. Mr. Sigurdson, owner, Mr. Lindborg, and Mr. John Cowles, of Sterling Buck $ Associates, were present to represent the applicant. Applicant submitted revised plans which were discussed. The Acting Secretary requested a plan containing rear view of elevation for the benefit of the Commission. Lindborg stated that such a rendering would be furnished. Lindborg stated that present plans call out slumpstone for exterior of building. There was a dis- cussion concerning entry from an alley which was not intended for such usage. There was a discussion on having a restaurant in the facility and the resulting amount of parking space and entry and exit from alley. Gerarden indicated to applicants that prior to permits being issued elevations must be submitted. Gerarden stated that parking for this project.is at minimum now and some difficulty may be encountered due to the location of structural columns within the parking compound. Lindborg stated that he understood this and that it was an engineering problem which was for the applicant to solve. Lindborg stated that he was told by a member of planning department that he couldn't enter and exit from the Coast Highway, hence the alley would have to be used. The Acting Secretary stated that he felt the Planning Commission should review the project due to its magnitude. ON MOTION BY SPENCER AND SECOND BY GERARDEN ADMINISTRATIVE REVIEW, NO. 2_3__48 WAS REFERRED TO THE PLANNING COMMISSION t A discussion between applicant's representatives and the Board followed wherein applicant's representatives requested a meeting with representatives of the Planning Department and Building Department and Public Works Department to ascertain more specific requirements to bring plans up to code, with further study being made on traffic problem.
