Arterberry Conditional Exception No. 72-5 allows the continuance of an oil field salvage business on property located 300 ft. north of Clay Avenue and west of Crystal Street in the RA-0 Residential District combined with oil production, subject to an annual review. The Acting Secretary stated that the staff recommends that a landscape plan be prepared for approval action. Photographs of the site were shown and existing landscaping described. Mr. 011in Kitchen, representing the applicant was present, and stated that conditions of approval have been complied with. Mr. Kitchen stated that pursuant to the original conditions, a plan for landscaping has not been developed by the city nor discussed with him. TENTATIVE TRACT NO. 8025 Subdivider: Stellrecht-Bartoli Tentative Tract No. 8025 is a request for 24 lots on 5.6 acres of land located at the northeast corner of Slater Avenue and Goldenwest Street in the R1-CD Zone. Planning Commission Tuesday, April 3, 1973 Page 3 The Acting Secretary stated that Exemption Declaration No. 73-19 was granted by the Environmental Review Board. There was no public input or comment on the exerrption request. This project being in the Civic District, the Design Review Board will review the architecture of perimeter walls and elevations. Mr. Robert Stellrecht, applicant, was present and stated that he concurs with the conditions of approval recommended by the staff. ON MOTION BY KERINS SECOND BY WALLIN, TENTATIVE TRACT NO. 8025 WAS APPROVED SUBJECT TO THE FOLLOWING AMENDED CONDITIONS, BY THE FOLLOWING -ROLL CALL VOTE: 1. The revised tentative map dated March 13, 1973 shall be the approved layout. 2. A six (6) ft. high decorative slumpstone wall shall be constructed along the exterior side property lines of Lot 32 and along the exterior side property lines of Lots 27, 28, 35, 39 and 40. The material of said wall shall be the same as that used in the arterial wall along Slater Avenue and Goldenwest Street. 3. A six (6) ft. high masonry wall shall be constructed along the north and east property lines. 4. A landscape plan for the area at the west end of the service road, planter area within the raised median and planter at the entrance of "A" Street shall be submitted to the Planning Department and Department of Public Works for review and subject to approval action. 5. Full insulation of all exterior walls and ceilings of the dwelling units shall be required to help minimize the burden of heating and cooling systems. 6. Special attention shall be given to the side and rear elevation of houses siding and backing on Slater Avenue and Goldenwest Street. 7. All roofs shall be constructed with wood or tile materials. 8. Provision shall be made for prohibiting of rooftop T.V. antennas. Developer has indicated he will have built-in antennas. PC 4/3/73 3. __ Minutes: H.B. Developer will participate 50 percent, not to exceed $6000 on his share in an underground utilities district to achieve undergrounding of utilities on Goldenwest Street. 10. The applicable conditions of standard conditions of approval approved for tentative maps dated May 23, 1973 shall be complied with. A. & Caroline Alexander Little Bit of Mexico Site Plan No. 73-1 is a request to permit the on -sale beer pursuant to Section 9430.6 in the C4 Higway Commercial District. The applicant, Mr. G. A. Alexander was present. The Acting Secretary stated that the staff recommends continuance of the matter pending a report from the Police Department. ON MOTION BY KERINS SECOND BY BAZIL, SITE PLAN NO. 73-1 WAS CONTINUED TO APRIL 17, 1973 FOR A REPORT FROM THE POLICE DEPARTMENT, SAID REPORT TO BE SUBMITTED TO THE PLANNING COMMISSION PRIOR TO APRIL 17, 1973, BY THE FOLLOWING ROLL CALL VOTE: AYES: Geiger, Bazil, Kerins, Porter, Wallin, Boyle, Higgins NOES: None ABSENT: None PRESENTATION OF SCIENTIFIC RESOURCES SURVEY Archaeological Research, Inc. Mr. Michael Ahlering, Archaeological Research, Inc., presented the report to Commission. He stated that 120 man days had been worked by field crews in making the study. The survey includes three areas of investigation: Paleontological, Archaeological and Historical Resources. ON MOTION BY KERINS SECOND BY BOYLE, THE SCIENTIFIC RESOURCES SURVEY WAS RECEIVED, STAFF WAS DIRECTED TO INCLUDE THE AREAS DESIGNATED INTO THE CITY'S OPEN SPACE PLAN AND TO FORWARD THE SAMPLE ORDINANCE CONTAINED IN THE REPORT TO THE ENVIRONMENTAL COUNCIL AND HISTORICAL SOCIETY FOR THEIR REVIEW AND INPUT TO THE STAFF AND CITY ATTORNEY WITHIN 60 DAYS,.BY THE FOLLOWING ROLL CALL VOTE: AYES: Geiger, Bazil, Kerins, Porter, Wallin, Boyle, Higgins NOES: None ABSENT: None J 1 1 PC 4/3/73 4. Planning Commission Tuesday, April 3, 1973 Page 5 Following discussion, staff was directed to work with the Public Information Officer, Margaret Carlberg and Archaeological Research, Inc., to disseminate the report to the local schools and library and to submit a summary of the report to professional publications. Mrs. Margaret Carlberg, Environmental Council, addressed the Commission commending the Commission and Archaeological Research, Inc. on the completed report. CODE AMENDMENT NO. 73-4 Code Amendment No. 73-4 proposes to provide for minimum front and exterior side yard setbacks of ten feet in the M1 zone for the purpose of providing an area for landscaping. The Chairman opened the public hearing on Code Amendment No. 73-4. There being no one present to speak, either for or against the proposed code amendment, the Chairman closed the public hearing. ON MOTION BY BOYLE SECOND BY BAZII., CODE AMENDMENT NO. 73-4 WAS APPROVED BY THE FOLLOWING ROLL CALL'VOTE: AYES: Geiger, Bazil, Kerins, Porter, Wallin, Boyle, Higgins NOES: None ABSENT: None CODE AMENDMENT NO. 73-5 Code Amendment No. 73-5 proposes to permit agricultural uses and wholesale plant nurseries in the RA Residential Agricultural zone subject to the approval of a use permit by the Board of Zoning Adjustments. The Chairman opened the public hearing on Code Amendment No. 73-5. There being no one present to speak either for or against the proposed code amendment, the Chairman closed the public hearing. There being no one present to speak either for or against the proposed code amendment, the Chairman closed the public hearing. ON MOTION BY KERINS SECOND BY BAZIL, CODE AMENDMENT NO. 73-7 WAS APPROVED AS AMENDED, BY THE FOLLOWING ROLL CALL VOTE: AYES: Geiger, Bazil, Kerins, Porter, Wallin, Boyle, Higgins NOES: None ABSENT: None CODE AMENDMENT NO. 73-14 Code Amendment No. 73-14 proposes to amend the definition of an identification sign. The Chairman opened the public hearing on Code Amendment No. 73-14. Mr. Jerry Shea addressed the Planning Commission inquiring as to the intent of the proposed amendment. The Acting Secretary stated that the intent was to provide authority for the Board of Zoning Adjustments to review all sign permit applications prior to issuance. He stated that this was an interim measure until such time as the sign ordinance is completely revised. Mr. Shea then addressed the Commission in opposition to the proposed amendment. It was Mr. Shea's position that signs permitted under the code should not be subject to review by the Board. Mr. Shea stated that he feels that the Chamber of Commerce, when they have had the opportunity to review the proposed amendment, will be opposed to the proposed change. Mr. John O'Conner, Deputy City Attorney, commented on the proposed amendment, suggesting that to accomplish the intent the code be amended to expressly authorize Board of Zoning Adjustments review of all signs if that is the intent. There being no one further present to speak, the Chairman closed the public hearing. Planning Commission Tuesday, April 3, 1973 Page 7 MISCELLANEOUS Resolution No. 111S A Resolution of the Planning Commission of the City of Huntington Beach supporting Assembly Bill No. 196 re- lating to State acquisition of shoreline. ON MOTION BY BOYLE SECOND BY KERINS, RESOLUTION NO. 1115 WAS APPROVED BY THE FOLLOWING ROLL CALL VOTE: AYES: Geiger, Bazil, Kerins, Porter, Wallin, Boyle, Higgins NOES: None ABSENT: None The Maguire Partnership The Acting Secretary stated that a letter has been received from The Maguire Partnership requesting resolution of the conflict between the existing zoning and master plan on the Sunset Bay property. Mr. Howard Oxley, representing The Maguire Partnership, was present and addressed the Commission concerning the request for the zoning to be amended to reflect the existing master plan. Commission discussed the request and the Acting Secretary stated that no action need be taken by the Commission at this time. When the developer files for a change of zone the Commission can evaluate the request at that time. In such case, a full environmental impact statement will be required. If a zone change is not filed prior to June 30, 1973 the Planning Commission can initiate a master plan amendment. ORAL COMMUNICATIONS The Acting Secretary stated that Mr. Jeff Holmes was present to discuss a color problem on a perimeter wall. Color slides of the wall in question were shown. Mr. Holmes addresses the Commission, stating that two colors of block were used in the construction of the wall and requested that he be allowed to stain the wall all one color. Samples of the blocks and the staining were displayed. Minutes: H.B. Planning Commission Tuesday, April 3, 1973 Page S New Zoning Provisions Mr. Michael B. Jager, Frank H. Ayres $ Son Construction Co. addressed the Commission concerning a proposed code amendment with the concept of a zero foot side yard setback on twenty foot lots within the town lot area for single family residential development. Mr. Jaeger discussed the concept stating that his firm is prepared to draft a code amendment for consideration by the Commission. Commission discussion followed. The Chairman directed the staff to work with Frank H. Ayres & Son Construction Company to develop a proposed code amendment for Commission consideration. Alternative Zoning - 40 Acre Parcel East of the Railroad Track Chairman Porter discussed the use of the subject property, rezoning or alternative zoning on the 40 acre parcel. No action was taken by the Commission. Commercial 32" Screening Wall Slides of different wall treatment were shown. Commission discussion followed. The Chairman directed, staff to prepare a code amendment to provide for 6 ft. setbacks with averaging, 6 percent land- scaping and 32" combination of landscaping and/or fencing. COMMISSIONERS' COMMENTS Commissioner Kerins requested that a code amendment be prepared to require landscaping and screening wall on automobile and recreational vehicle sales lots. Commissioner Bazil requested that a code amendment be prepared to allow the high rise ordinance to prevail over the planned residential development ordinance with regard to diversification of building units types and other conflicts, in order to allow high rise residential development. In response to an inquiry by Commissioner Wallin, Deputy City Attorney John O'Conner and Acting Secretary Jim Palin, discussed environmental review board procedures with respect to tracts approved prior to establishment of the environmental review process. Chairman Porter directed the staff to refer the Administrative Review application on a proposed hotel development on Pacific Coast Highway to the Planning Commission for decision. PC 4/3/73 8.
