Applicant: Ventura G. & Barbara J. Banuelos
To permit the repair of boats and sale of accessory items
in an existing industrial building pursuant to S. 9511.1
(b), (c) of the Huntington Beach Ordinance Code, located
on the south side of Hamilton Street approximately 66 ft.
east of Newland Street in the M1-A-0 District.
The meeting was opened to public hearing.
Mr. Banuelos, the applicant, was present.
Mrs. Leslee Bennett, representing adjacent property owners,
was also present.
The conditions of approval were reviewed with Mr. Banuelos.
The Acting Secretary stated that Mr. Tarnutzer, the developer
of the industrial buildings, had agreed to submit sign plans
which would carry a common theme for all the buildings in
the project.
In response to Mr. Gerarden's question about fiberglassing
on the premises, Mr. Banuelos stated there would not be
any fiberglassing, that the work would primarily consist
of working on new boats, installing engines, rudders, etc.
Mr. Gerarden stated for a point of information that the
building's current construction type would not permit
such operations due to a lack of required fire resistive
construction.
Mrs. Bennett asked if there would be any fiberglassing or
noises created by engine testing, and Mr. Banuelos stated
there would not.

Mr. Gerarden asked how many boats the building would
accommodate. Mr. Banuelos replied that two at the most
WOUld be on the premises. lie further stated that if
there were more than two boats he would provide additional
inside storage for them within the complex.
The public hearing was closed.
ON MOTION BY EADIE AND SECOND BY GERARDEN, USE PERMIT
NO. 73-22 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY
THE FOLLOWING ROLL CALL VOTE:
1. The plot plan received March 8, 1973 shall be the
approved layout.
2. The floor plan received March 27, 1973 shall be the
approved layout.
3. All conditions of Administrative Review No. 72-27
shall be complied with.
4. S. 9511.1(b) shall be complied with.
S. Boat repair shall be limited to replacement of parts,
but in no case shall engines be overhauled or tested.
6. All storage of boats shall be within the building.
7. All signs for the proposed development shall be sub-
mitted to the BZA for approval. Signs shall reflect
a common theme with respect to design, materials, and
colors which are compatible with the architectural
theme of the proposed project.
8. Violation of any condition or ordinance shall be cause
for revocation action.
9. Application shall be subject to review in one year.
10. All applicable City Ordinances shall be complied with.

To permit the construction of a hotel pursuant to 9453 of
the Ordinance Code, located north of Pacific Coast Highway
between 9th and 10th St.
The applicant or his representative were not present.
The :acting Secretary indicated to the Board that on April 3,
1973, the Planning Commission requested that this application be
referred from the Board of Zoning Adjustments to the Planning
Commission. After due consideration to this request it was
the consensus of the Board to decline to act and to refer
said application to the Planning Commission for the following
reason:
The Board felt that the magnitude and the location of the
project warranted the Planning Commission's considerat-ior.

CONDITIONAL EXCEPTION NO. 73-14
Applicant: heath & Co., Inc.
To permit the construction of a pole sign and a roof' sign
to a height of 35 ft. pursuant to S. 9764.4.4 and in lieu
of the S. 9764.3.2 of the Huntington Beach Ordinance Code,
located on the south side of Warner Avenue approximately
150 ft. west of Goldenwest Street in the C4 Highway Com-
mercial District.
The meeting was open to public hearing.
Mr. Eugene Briesemeister and Mr. Joe Finkelberg, represent-
ing the applicant, were present.
Board discussion was held concerning the delay in putting
up signs which had been previously approved with said ap-
proval expiring before signs were installed. The representatives
related to the Board that the column to hold up the sign had
been coordinated with engineers and architects in initial
plans and was considered in the design of the building so that
it would look uniform.
There being no further comment, the public hearing was closed.
The Acting Secretary asked the applicants if they could show
a hardship which would be required before a Conditional Exception
could be approved. The applicants stated that they were aware
when original sign permits were obtained that the code was in the
process of being changed and that they had assumed that in four
or five years when conformance to sign code became mandatory that
they would at that time change their sign to meet current sign
code requirements.
ON MOTION.BY GERARDEN AND -SECOND BY SPENCER CONDITIONAL EXCEPTION
N0::73-14 WAS DENIED FOR THE FOLLOWING REAWNS, BY THE FOLLOWING
ROLL CALL VOTE:
1. No hardship was demonstrated by the applicant.
2. The fact that the applicant obtained permits to erect these
signs,prematurely and allowed said permits to expire was
not acceptable to the Board as demonstrating a hardship.

USE PERMIT NO. 73-28
Applicant: Richard L. Tom, A.I.A.
To permit the construction of a three (3) story residence pur-
suant to S. 9102.6.1.2 of the Huntington Beach Municipal Code,
located on the northeast corner of Gilbert Drive and Somerset
Lane in an R1, low density residential district.
The meeting was opened to the public.
Mr. Richard Tom, the applicant, was present.
Mr. Wolf, representing opposition to the application, was
present.
Mr. Wolf presented petitions containing 66 signatures in
opposition to the project. lie further questioned the,legality
of a 3 story unit on the property. Mr. Tom stated that the
height of the building was not in excess of code limits, and
that it did not actually fall into a 3 story unit category
since only two stories would be actual living space. Ile displayed
an architectural rendering of the project and offered to show
it to any of the opposition. Mr. Wolf stated that it did not
conform to the rest of the homes.

Mr. Gerarden pointed out that all the homes in that area
were custom designed and that architectural conformance
to the area was literally impossible.
There was a discussion on fencing and Mr. Tom stated
that the normal fencing was proposed.
There being no further parties to speak in favor of or in
opposition to the application, the public hearing was
closed.
The Board reviewed the location of windows and other open-
ings and how they related to adjacent properties. Mr. Spencer
stated that he felt unless neighbors approved this he would
not feel it should be approved. Mr. Tom stated that to his
knowledge they had not seen the actual rendering but had
assumed that since it was 3 story it would be detrimental
to the area. Wolf stated that of the 66 signatures 12
were a husband and wife situation.
ON MOTION BY EADIE AND SECOND BY GERARDEN USE PERMIT NO. 73-28
WAS APPROVED BY THE FOLLOWING ROLL CALL VOTE:

FOR THE FOLLOWING REASONS:
1. Dwelling will not have a detrimental effect upon the
general health, welfare, safety and privacy of persons
residing in the neighborhood.
2. Location, site layout, and design is harmonious and
compatible with the streets and adjacent dwellings
in the neighborhood.
The Chairman explained to Mr. Wolf the 10 day appeal period.
Mr. Tom stated that he would welcome exhibiting the plans
and going over them with the people who were in opposition
to them.
MISCELLANEOUS
ADMINISTRATIVE REVIEW NO. 73-53
Applicant: B. G. Williams and P. D. Thomas
To permit the construction of two (2) apartment dwelling
units pursuant to S. 9161.2 of the Huntington Beach
Municipal Code, located on the southeast corner of 13th
St. and Palm Avenue in an R2 medium density residential
district.
Mr. B. G. Williams, the applicant, was present.
There was a discussion about right -of. -way dedication and
the Acting Secretary stated that more plot plans will be
needed eventually. Mr. Williams stated that he would like
to get conditional approval subject to ,alley dedication.
There was a discussion of the plans.
ON MOTION BY GERARDEN AND SECOND BY SPENCER ADMINISTRATIVE
REVIEW NO. 73-53 WAS APPROVED WITH THE'FOLLOWING CONDITIONS,
BY THE FOLLOWING ROLL CALL VOTE:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. A revised Plot Plan shall be submitted to the Board
of Zoning Adjustments for Approval Action. Such
plan shall indicate the realignment of the entryways
as discussed.
