TUESDAY, APRIL 10, 1973 - 7:00 P.M. - STUDY SESSION COMMISSIONERS PRESENT: COMMISSIONERS ABSENT: Geiger, Porter, Wallin, Boyle, Boyle, Higgins Commissioner Bazil arrived at 7:22 P.M. Commissioner Wallin arrived at 7:30 P.M. Commissioner Kerins arrived at 7:40 P.M. None NOTE: A TAPE RECORDING OF THIS MEETING IS ON FILE IN THE PLANNING DEPARTMENT OFFICE. DISCUSSION Policy Plan - Environment and Resources Section Members of the Citizens' Goals and Objectives Steering Committee were present as well as members of the subcommittees of the various sections under discussion. Those sections were: Community Appearance; Parks, Recreation and Open Space; Natural Resources; and Shoreline. The objectives and principles of each section were reviewed by. the Commission and Committee. Amendments to the principles were mutually agreed to. Daryl Smith, Street Tree Supervisor, addressed the Commission and Committee, discussing the street tree program and some of the problems and limitations of the program relating to parkway width, weather and soil conditions. Planning Commission Chairman requested the Committee to review the report and submit any supplementary material which may have been inadvertently left out. RECESS The Chairman called a recess at 10:50 P.M. RECONVENE The Chairman reconvened the meeting at 11 P.M. RESCHEDULE AGENDA ITEMS The following items will be rescheduled to future study session agendas: Code Amendment No. 72-21 - Multi -Story Suffix Supplemental information was provided Commissioners. Code Amendment No. 73-9 - Consolidated Apartment Standards Code Amendment No. 73-13 - Density on Apartment Developments TENTATIVE TRACT NO. 7888 Taylor Avenue Right of Way Mr. Harpold and Mr. Hazeldine, attorney for Mr. Harpole, were present to discuss dedication of street right of way for Taylor Avenue, west of Beach Boulevard. Acting Secretary Jim Palin stated that Final Tract No. 7888 is scheduled for acceptance by the City Council on April 16, 1973. Final Tract No. 7888 abuts Taylor Avenue on the south, and Mr. Harpold's property abuts Taylor Avenue to the north. The question of providing access to Mr. Harpold's industrial property has not been resolved. It was the intent of the Commission that such access should not be taken from Taylor Avenue. It has been requested that Mr. Harpold dedicate his access rights to Taylor Avenue to the City. It had been proposed that the street right of way for Taylor Avenue be included within the boundaries of Tract No. 7888. The final map has not been amended to reflect this. Mr. Hazeldine addressed the Commission, stating that a deed has been submitted to the city, but not accepted, dedicating the street right of way, however, he is not willing to dedicate access rights. Planning Commission Tuesday, April 10, 1973 Page 3 Following discussion, it was the consensus of the Commission that the map on Tract 7888 must be amended to include the street right of way, with development of the street to be accomplished by the developer of Tract 7888. The developer must acquire title to the property for the street right of way and offer this property to the public for street purpose. The Deputy City Attorney was directed to determine whether the Director of Public Works is empowered by ordinance to regulate curb cuts on Taylor Avenue. THE MOTION FAILED BY THE FOLLOWING VOTE: AYES: Wallin, Porter NOES: Geiger, Bazil, Boyle, Higgins ABSENT: Kerins ON MOTION BY BAZIL SECOND BY HIGGINS, FINAL TRACT NO. 7888 IS TO BE ACCEPTED WITH THE TRACT BOUNDARY AMENDED TO INCORPORATE THE NORTH HALF OF TAYLOR AVENUE WHERE IT ABUTS THE SUBDIVISION, WITH STREET IMPROVEMENT TO BE ACCOMPLISHED BY THE DEVELOPER OF TRACT NO. 7888, FOR THE REASON THAT THE INDUSTRIAL PROPERTY TO THE NORTH OF SUBJECT TRACT HAS ACCESS TO TAYLOR AVENUE, REGARDLESS OF COMMISSION ACTION, BY THE FOLLOWING VOTE: AYES: Bazil, Geiger, Boyle, Higgins NOES: Wallin, Porter ABSENT: Kerins CODE AMENDMENT NO. 72 - 32 Code Amendment No. 72-32 proposes to establish a procedure to authorize certain uses that possess unique characteristics and special form as to make impractical their being included automatically within any classes of use as set forth in the various districts. ON MOTION BY BAZIL SECOND BY HIGGINS, STAFF WAS DIRECTED TO AMEND CODE AMENDMENT NO. 72-32 AND SET IT FOR PUBLIC HEARING, BY THE FOLLOWING VOTE: AYES: Geiger, Bazil, Porter, Wallin, Boyle, Higgins NOES: None ABSENT: Kerins CODE=:AMENDMENT NO. 73-6 Code Amendment No. 73-6 proposes to establish a Recreational Open Space District to provide for commercial recreational 3. Mr. Reynolds stated that the code requires a five foot setback for two stories and thirty foot height; also ten foot setback for three stories and thirty-five foot height. ON MOTION BY BAZIL SECOND BY GEIGER, STAFF WAS DIRECTED TO PREPARE A CODE AMENDMENT TO CLEARLY REFLECT THE COMMISSION'S INTENT THAT SIDE YARD SETBACKS IN THE R1 DISTRICT ARE TO BE BASED ON HEIGHT OF BUILDING, NOT THE NUMBER OF STORIES, BY THE FOLLOWING VOTE: AYES: Geiger, Bazil, Boyle, Higgins NOES: Wallin, Porter ABSENT: Kerins Categorical Exemptions Acting Secretary stated that copies of the categorical exemptions proposed for environmental impact statements have been provided each member of the Commission. These exemptions are proposed for adoption by the City Council on April 16, 1973. Environmental Review Board Commissioner Wallin suggested that a citizen be appointed a voting member of the Environmental Review Board. The Acting Secretary stated that he would convey her suggestion to the Board, however, it would be up to the City Council to make such a change in the composition of the Board. 4. Route 39 Freeway Chairman Porter stated that he would submit information to the staff for use in preparing a resolution for adoption by the Planning Commission relative to the southern extension and terminus of the Route 39 Freeway.
