AGENDA ITEMS CONTINUED: ADMINISTRATIVE REVIEW NO. 73-61 - Continued from 4/11/73 Applicant: El -Don Development, Inc. To permit the construction of a four (4) unit apartment building in an R3 Medium High Density Residential District pursuant to S. 9201.2 of the Huntington Beach Municipal Code, located on the east side of 19th St. approximately 100 ft. south of Orange Ave. The Acting Secretary stated that a letter had been received from the applicant requesting a continuance for the reason that his architect would be unable to have plans ready for April 18th meeting. Andrade To permit the 24 hour care of six (6) non -related persons pursuant to S. 9730.26 of the Ordinance Code, located on the south side of Paddock Circle approximately 240 ft. east of Johnson Lane in the R1 Low Density Residential District. The Acting Secretary stated that applicant had concurred with a continuance because a fire clearance report has not been received. ON MOTION BY EADIE AND SECOND BY GERARDEN ADMINISTRATIVE REVIEW NO. 73-59 WAS CONTINUED TO'MAY 9, 1973 BY THE FOLLOWING ROLL CALL VOTE: AYES: Spencer, Gerarden, Eadie NOES: None ABSENT: None USE PERMIT NO. 73-25 - Continued from 4/11/73 Applicant: Fox -Stanley Photo Products To permit the establishment of a drive through kiosk for photo processing service pursuant to S. 9472 of the Ordinance Code located on the north side of Edinger Avenue approximately 1275 feet east of Goldenwest Street in the C4 Highway Commercial_ District. There was a discussion on the signs. New photos of the kiosk were presented to the Board. The hearing was closed to the public. There was a discussion of flag poles and it was stated by the Board that the pennant flag would not be permitted. ON MOTION BY SPENCER AND SECOND BY GERARDEN USE PERMIT NO. 73-25 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOW- ING ROLL CALL VOTE: 1. Revised plan to be submitted to the Planning Department indicating the building to be moved from the setback and showing deck marked with arrows. 2. All existing codes and ordinances be complied with. 3. Landscaping to be modified to satisfaction of Planning Staff. 4. Sign copy received 4/18/73 shall be the approved copy, subject to compliance with Article 976 (Sign Code). AYES: Spencer, Gerarden, Eadie NOES: None ABSENT: None ADMINISTRATIVE REVIEW NO. 72-87 - Continued from 1/17/73 Applicant: Earl and Esther Hoffman To permit the care of six (6) non -related persons located on, the east side of Glenhaven Lane approximately 100 ft. north of Arnet Street. The hearing was opened to the public. The Acting Secretary stated that this application had been continued four times and that he had been unable to contact applicant. The public hearing was closed. ON MOTION BY EADIE AND SECOND BY SPENCER ADMINISTRATIVE REVIEW NO. 72-87 WAS DENIED FOR THE FOLLOWING REASONS BY THE FOLLOWING ROLL CALL VOTE: 1. Applicant moved from city. 2. Applicant did not submit a withdrawal letter. AYES: Spencer, Gerarden, Eadie NOES:- None ABSENT: None CONDITIONAL EXCEPTION NO. 73-15 Applicant: Richard E. Looney To`permit a one foot encroachment into the required 25 ft. turning radius in lieu of S. 9166.4 of the Huntington Beach Ordinance Code, located on the west side of Ash Street approximately 200 ft. south of Cypress Street in the R2 Medium.Density Residential District. There was no one present representing the applicant. The opposition expressed their reasons for not wishing to have two story dwellings in the area, and pointed out that there would be a traffic problem and parking problem if this application was approved. The Board pointed out that the application before it was for a Conditional Exception and that the project proposed was a permitted use in the R-2 zone. There was a discussion on the zoning in the area and the procedure for requesting a change in zoning. The public hearing was closed. It was the consensus of the Board that there was no hardship indicated sufficient to grant a Conditional Exception to the applicant. It was also the consensus of the Board that there were many areas in the plans that were questionable. ON MOTION BY GERARDEN AND SECOND BY SPENCER CONDITIONAL EXCEPTION NO. 73-15 WAS DENIED FOR THE FOLLOWING REASONS BY THE FOLLOWING ROLL CALL VOTE: 1. Substantial neighborhood opposition. 2. Applicant not present to demonstrate hardship; and 3. Applicant has failed to respond to Board's invitation to review his proposal, and; 4. There are multiple questions whether or not this proposed project can meet other code requirements. AYES: Spencer, Gerarden, Eadie NOES: None ABSENT: None ADMINISTRATIVE REVIEW NO. 73-63 Applicant: William J. Byrne To permit the construction of 6 ft. high wall in the front yard of an existing single family residence, pursuant to 9104.5 of the Huntington Beach Municipal Code located on the south side of Gate Hill Circle approximately 200 ft. southwest of Evening Hill Drive. Mr. William J. Byrne, applicant, was present. He explained his request for a wall, and described its structure. Due to the fact that this subdivision is still in the construction phase, the Board felt that the Administrative Review was the appropriate application to be filed pursuant to S. 9201.2 of the Huntington Beach Ordinance Code. ON MOTION BY GERARDEN AND SECOND BY SPENCER ADMINISTRATIVE REVIEW NO. 73-63 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING ROLL CALL VOTE: 1. Plan received April 9, 1973 shall be approved plan. 2. Wall location, materials, color, and design shall be in conformance with the plan received April 9, 1973, and shall match the existing dwelling. Salmonson To permit the construction of a four (4) unit apartment build- ing in an R3 medium high density residential district pursuant to S. 9201.2 of the Huntington Beach Municipal Code, located on the southeast corner of 20th St. and Pecan Ave. Mr. Salmonson, applicant, was present. There was a discussion by the Board with applicant on the recreation area and the requirements to meet code. It was sug- gested by the Board that the applicant's architect could meet with the Board to work out plans which would implement re - disposition of open space to provide more active recreation area. ON MOTION BY EADIE AND SECOND BY GERARDEN ADMINISTRATIVE REVIEW NO. 73-64 WAS CONTINUED TO MAY 2, 1973 BY THE FOLLOWING ROLL CALL VOTE: AYES: Spencer, Gerarden, Eadie NOES: None ABSENT: None ADMINISTRATIVE REVIEW NO. 73-65 Applicant: Richard N. There was a discussion concerning recreation area. Gerarden stated that sign conforms with all requirements. Photograph was presented of the building and color chips were shown. Plans dated April 12, 1973 were approved. The Acting Secretary indicated he had been in contact with Mr. Jim Camboor, leasing agent, who indicated that all signs for the office building shall be blue lettering on a white background. The Board suggested a master plan of signing be obtained.
