The Acting Secretary stated that the Exemption Declaration
was given final approval on May 1, 1973 and action could be
taken on the application.
The Board discussed splitting the required landscaping for
the McFadden St. frontage and concurred that the applicant's
plan for distribution was esthetically pleasing.
The Board discussed the plans and conditions of approval.
ON MOTION BY GERARDEN AND SECOND BY SPENCER ADMINISTRATIVE
REVIEW NO. 73-56 WAS APPROVED CONDITIONALLY AS OUTLINED AND
AMENDED BELOW BY THE FOLLOWING ROLL CALL VOTE:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The elevations received April 19, 1973 shall be the
approved elevations.
2. The plot plan received April 19, 1973 shall be the
approved layout.
3. A revised Plot Plan indicating screening of the park-
ing area shall be submitted to the Board of Zoning
Adjustments for approval on materials for the wall.
4. Product, Producer & McFadden shall be dedicated to
City standards at the time each parcel is developed.
S. The water, sewer, and fire hydrant system shall be
approved by the Department of Public Works and Fire
Department.

6. Soil reports as required by the Building Department
and the Department of Public Works shall be submitted
to the City.
7. All conditions of approval for Tentative Tract 6948
for Final Map 7999 shall be complied with.
B. TO BE COMPLETED PRIOR TO FRAMING INSPECTION:
1. A landscaping plan shall be submitted to the Planning
Department for review and approval action.
2. Rooftop mechanical equipment shall be screened from
view. Said screening plan shall be approved by the
Board of Zoning Adjustments.
3. All signs for the proposed development shall be
submitted to the BZA for approval. Signs shall reflect
a common theme with respect to design materials and
colors which are compatible with the architectural
theme of the proposed project and the existing street
scene.
4. Fire alarm system conduit and appurtenances shall be
installed by the developer at locations and to
specifications provided by the Fire Department.
S. Parking compounds shall be screened with a combination
of fencing and landscaping. Said plan shall be sub-
mitted to the Planning Department for review and
approval. Fencing and landscape plans shall include
the following information:
a. A list including quantities and sizes for each
species of plants and all ground cover material.
b. Sprinklers shall be provided for required
irrigation.
c. Irrigation layout to include meter location,
pipe sizes, sprinkler head types, etc.
d. Fencing materials and detail drawing.
6. The structural street section of all private drives
shall be approved by the Department of Public Works.
C. TO BE COMPLETED PRIOR TO FINAL INSPECTION:
1. Product, Producer $ McFadden shall be fully improved
including street trees, street signs, street lights,
fire hydrants, sewer and water main extensions.
2. All utilities shall be installed underground.
3. Off-street parking facilities shall conform to
Article 979.
4. There shall be no fence, structure or landscaping
constructed or maintained over 3 1/2 feet high
within a 10 ft. by 10 ft. triangular area at the
intersection of driveways and streets or within a
25 ft. by 25 ft. triangular area at the intersection
of streets.

D. TO BE COMPLETED PRIOR TO ISSUANCE OF CERTIFICATE OF
OCCUPANCY:
1. Water supply shall be through the City of Huntington
Beach's water supply system.
2. Sewage disposal shall be through the City of Huntington
Beach's sewage system.
3. Easements for utilities or walkways shall be provided
to Department of Public Works standards.
4. The property shall participate in the local drainage
assessment district.
5. No structures, other than those shown on the approved
plot plan, shall be constructed within the project.
6. All applicable City Ordinances shall be complied with.
7. The applicant shall provide screening of the trash area.

Street.
There was no one present to represent the applicant.
The Acting Secretary stated that since the applicant had not
yet furnished a letter of authorization from the property owner
he would recommend a continuance.

Applicant: James R. Jones
To permit a 1 ft. 9 in. encroachment into the required ten
(10) ft. rear yard setback in lieu of S. 9103.3 of the Huntington
Beach Ordinance Code located on the south side of Sydney Drive
approximately 380 ft. west of Bolsa Park Lane in the R1 Low
Density Residential Zone.
Mr. Marvin Crocker, representing the applicant, and
Mrs. James R. Jones, applicant, were present.
The hearing was opened to the public.
Mrs. Jones stated that her reasons for filing the application
were that it would be more expensive to add on to the front.
The Board concurred in that they did not feel a hardship was
shown by lot size of configuration.

EXCEPTION NO. 73-16 WAS DENIED FOR THE REASON THAT PROPERTY
OWNER WAS NOT ABLE TO DEMONSTRATE A HARDSHIP, BY THE FOLLOWING
ROLL CALL VOTE:

CONDITIONAL EXCEPTION NO. 73-17
Applicant: Huntington Seacliff Corporation
To permit the construction of one off -site identification
sign located in an R1 Low Density Residential District
in lieu of S. 9761.9.3(b) and pursuant to S. 9763.4.4 of
Huntington Beach Ordinance Code. Said sign is proposed
to identify a golf course and clubhouse facility, located
on the northwest corner of Goldenwest & Palm.
Bill Bayless and Brian Lake, representing the applicant,
were present.
The hearing was opened to the public.
Mr. Bayless and Mr. Lake spoke in favor of the request and
explained that the sign will be an integral part of the
landscaped area. There was a discussion of the landscaped
mounds and placement of sign. Landscaping was discussed.
The Board discussed the sign in relation to a wall around
a residential tract. Lighting of the sign was discussed.
The applicant's representatives stated that sign would be
lit with soft indirect lighting.
Public hearing was closed.
Board discussion followed.
ON MOTION BY EADIE AND SECOND BY SPENCER CONDITIONAL
EXCEPTION NO. 73-17 WAS APPROVED WITH THE FOLLOWING CONDITIONS
AND BY THE FOLLOWING ROLL CALL VOTE:
1. Height of sign shall not exceed height of residential
wall and not exceed height of 7 ft. as requested.
2. Both signs shall be the same height.
3. The existing sign at the southeast corner shall be
removed.
AND FOR THE FOLLOWING REASONS:
1. Lack of identification for an arterial highway would
deprive subject use of privilege enjoyed by other golf courses.
2. Location of golf course precludes adequate exposure.
3. Conditional Exception will not be detrimental to
surrounding properties due to low type of signing
and wall in back.

Mr. James Montgomery, the developer, and Mr. Don Baker, represent-
ing the applicant, were present.
Board discussion followed. Mr. Montgomery and Mr. Baker spoke
favorably in behalf of the application. Conditions of approval
were discussed.
ON MOTION BY SPENCER AND SECOND BY GERARDEN DIVISION OF LAND
NO. 73-11 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE
FOLLOWING ROLL CALL VOTE:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The parcel map received April 5, 1973 shall be the
approved layout.
2. Milo Street and Sims Street shall be dedicated to City
standards at the time each parcel is developed.
3. Division of Land No. 73-11 shall not be effective
until a covenant and agreement is signed agreeing to
the conditions of approval.
B. TO BE COMPLETED PRIOR TO FRAMING INSPECTION:
1. A Parcel Map and the Covenant and Agreement shall be
filed with the City and recorded prior to framing
inspection of any structures on any parcel.
C. TO BE COMPLETED PRIOR TO OCCUPANCY OR ISSUANCE OF A

To permit the construction of a furniture store pursuant to
S. 9430 of the Huntington Beach Ordinance Code, located on the
north side of Warner Ave. approximately 415 f t. west of Magnolia
St. in a C2 Community -Business Zone.
Mr. Mantle, the applicant, was present.
Mr. Mantle addressed the Board and explained the plans. The
Board informed him he had to conform to Code with regard to
required setbacks. They requested that revised plot plans be
submitted for discussion prior to date set for continuance. It
was agreed that Monday, May 7 at 10 o'clock Mr. Mantle would
meet with the Staff to discuss plans and circulation in the
parking area.

The Board asked that she present to them her justification
of the Conditional Exception request. There was a discussion
concerning her reasons for not wishing to add on where the
existing flagstone patio is because of the expense of said
patio.
ON MOTION BY GERARDEN AND SECOND BY EADIE CONDITIONAL
EXCEPTION NO. 73-18 WAS DENIED FOR THE FOLLOWING REASONS
AND BY THE FOLLOWING ROLL CALL VOTE:
1. Applicant failed to demonstrate justifiable hardship.
2. There is sufficient area on property to add a room
addition of comparable size without violating provisions
of the Code.

To permit a five (5) ft. encroachment into the required ten
(10) ft. side yard setback in lieu of S. 9103.2.1(b) of the
Ordinance Code.
The Acting Secretary stated that the Planning Commission had
requested at their May 1, 1973 meeting that the BZA refer to
them for handling Conditional Exception No. 73-19 to be heard
concurrently with Use Permit No. 73-28.
ON MOTION BY SPENCER AND SECOND BY GERARDEN THE BOARD DECLINED
TO ACT ON CONDITIONAL EXCEPTION NO. 73-19 AND REFERRED IT TO
THE PLANNING COMMISSION FOR THE FOLLOWING REASONS AND BY THE
FOLLOWING ROLL CALL VOTE:
1. To be heard in conjunction with Use Permit No. 73-28
currently under Appeal by the Planning Commission.
2. Due to the fact that the Planning Commission has rendered
a motion of intent regarding the criteria for requiring
the 10' setback, the Board feels that it would be more
appropriate if the Planning Commission acted on this
application.
