Mr. Joseph J. LaParle, applicant, was present. The Board discussed the plans and the conditions of approval with applicant. Applicant stated that no signing would be on building. ON MOTION BY SPENCER AND SECOND BY GERARDEN ADMINISTRATIVE REVIEW NO. 73-60 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING ROLL CALL VOTE: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: _� 1. The plot plan received May 2, 1973 shall be the approved layout. 2. Gothard St. and Cedar Ave. shall be dedicated to City standards at the time each parcel is developed. 3. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 4. All buildings on lots abutting a City easement shall be set back (5) feet from the edge of such easement. S. Fencing and landscape plans shall include the following information: a. A list including quantities and sizes for each species of plants and all ground cover material. b. Irrigation layout to include meter location, pipe sizes, sprinkler head types, etc. c. Fencing materials and detail drawing. d. Sprinkler system required. 6. The structural street section of all private drives shall be approved by the Department of Public Works. C. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. Cedar Ave. and Gothard St. shall be fully improved including street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 2. All utilities shall be installed underground. 3. Off-street parking facilities shall conform t,o Article 979. 4. There shall be no fence, structure or landscaping constructed or maintained over 3 1/2 feet high within a 10 ft. by 10 ft. triangular area at the intersection of driveways and streets or within a 25 ft. by 25 ft. triangular area at the intersection of streets. To permit the construction of a four (4) unit apartment building in an R3 medium high density residential district pursuant to S. 9201.2 of the Huntington Beach Ordinance Code located on the east side of 19th St. approximately 100 ft. south of Orange Ave. Mr. Larry Russell and Mr. Richard Donner, the applicants, were present. There was a discussion on open space. Conditions of approval were discussed. Mr. Gerarden pro- posed to amend conditions to include the fact that overhead doors shall not overlap. ON MOTION BY GERARDEN AND SECOND BY SPENCER ADMINISTRATIVE REVIEW NO. 73-61 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING ROLL CALL VOTE: A. The revised plot plan received April 30, 1973 shall be the approved layout. 2. 19th Street and alley shall be dedicated to City standards at the time each parcel is developed. 3. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 4. Soil reports as required by the Building Department and the Department of Public Works shall be submitted to the City. S. The overhead garage doors shall not overlap when in the open position. If this condition exists a roll -up garage door shall be installed. B. Bernauer To permit the construction of a 14 unit apartment building pursuant to S. 9202.3.1.3 of the Ordinance Code located on the west side of Green Street approximately 130 ft. north of Warner Avenue in the R3 medium high density residential district. The hearing was opened to the public. Mr. Bernauer, applicant, and Mr. Mueller, owner, were present. The Acting Secretary noted that the posting period had expired on Exemption Declaration No. 73-55 and application could be heard. Revised plan was discussed. Mr. Gerarden noted that proposed balconies lend themselves to architecture of the project. It was noted by the Board that plan met open space and parking requirements. There being no further questions from the audience the public hearing was closed. Board discussion followed. ON MOTION BY GERARDEN AND SECOND BY SPENCER USE PERMIT NO. 73-27 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING ROLL CALL VOTE: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The plot plan received May 3, 1973 shall be the approved layout. 2. Green Street shall be dedicated to City standards at the time each parcel is developed. 3. Elevations as submitted May 3, 1973 shall be the approved copy. 4. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 5. Soil and compaction reports as required by the Building Department and the Department of Public Works shall be submitted to the City. 6. There was a discussion on utilization of the space. Mr. Langer and Mr. Kahn pointed out that front doors facing Gothard are locked at all times and that office is used as display room, and that most customers know what they want when they come in. They pick color samples from those on display in office. Sign- ing was discussed. Mr. Kahn stated that they wanted a sign on the front of the building between the 2 front doors of maximum size permitted by Code. The Acting Secretary pointed out that the Planning Commission want signing that isn't cluttered. Mr. Gerarden pointed out the fact that the Ordinance did not permit advertisirg of retail sales on the property. Parking was dis- cussed. Mr. Langer expressed a desire to work with Mr. Eadie on signing. Public hearing was closed. ON MOTION BY EADIE AND SECOND BY GERARDEN USE PERMIT NO. 73-30 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING ROLL CALL VOTE: 1. S. 9530.2(B) shall be complied with. 2. All City Ordinances shall be complied with. 3. Plan received April 17, 1973 shall be the approved layout. 4. Signing shall be reviewed by Board of Zoning Adjustments In accordance with Master Plan of signing for the area. AND FOR THE FOLLOWING REASON: The Board felt that although the use does front on an arterial highway they felt it better in this case to permit side entrance to the retail activity. Mr. Baker Guthrie, applicant, was present. The plans were discussed. There was discussion about increasing setback from 7 1/2 ft. to 10 ft. ON MOTION BY EADIE AND SECOND BY SPENCER ADMINISTRATIVE REVIEW NO. 73-72 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING ROLL CALL VOTE: 1. Plot plan received April 19, 1973 shall be approved as amended to reflect 10 ft. setback. 2. All City Ordinances shall be complied with. Burke To permit the construction of three (3) industrial buildings pursuant to S. 9530 of the Huntington Beach Ordinance Code located on the northeast corner of Gothard St. and Heil Ave. in an Ml Industrial District. Mr. W. B. Burke, applicant, Mr. Wayne Stewart, Mr. G. Hayes, and Mr. Jim Edwards, representing the applicant, were present. The plans were discussed. It was the consensus of the Board - that plans had to be revised to show portion that would be used as warehousing as well as office and manufacturing in order that parking requirements could be determined. ON MOTION BY GERARDEN AND SECOND BY SPENCER ADMINISTRATIVE REVIEW NO. 73-73 WAS CONTINUED TO MAY 16, 1973 WITH REVISED PLANS OF FLOOR AREA TO BE SUBMITTED WITH DEFINITIONS OF AREAS OF USE. AYES: Spencer, Gerarden, Eadie NOES: None ABSENT: None CONDITIONAL EXCEPTION NO. 73-20 Applicant: Donald L. Bren Company To permit a reduction of the exterior side yards on 6 lots of 148 lot subdivision from the required 10 ft. setback td between 5 and 10 ft. in lieu of 9103.2.2 of the Huntington Beach Ordinance Code and to reduce the minimum dimension of 22 ft. required for a front entry garage on one lot of 20 ft. in lieu of S. 9106.2 of the Huntington Beach Ordinance Code, located in Tract 7991 at the southwest corner of Yorktown Ave. and Newland St. in an R1 low density residential district. The hearing was opened to the public. Mr. Richard Holz, representative of the applicant, was present. There was a discussion by the Board and Mr. Holz about the plans and it was pointed out by the Board that plans could be revised to adjust lot lines. Mr. Holz pointed out that this would involve tearing out curbs and gutters. There being no further questions the public hearing was closed. ON MOTION BY GERARDEN AND SECOND BY EADIE CONDITIONAL EXCEPTION NO. 73-20 WAS DENIED FOR THE FOLLOWING REASON BY THE FOLLOWING ROLL CALL VOTE: 1. Applicant failed to demonstrate any hardship. The hearing was opened to the public. Dr. Sam Hirt, owner, and Mr. Ken Beideman, applicant, were present. They presented to the Board a layout of suites indicating that there would be no way to have a functional layout of space if size had to be decreased by one foot. They indicated that attempts had been made to come up with alternate plans and present one seemed most feasible. Public hearing was closed.
