In response to an inquiry by the Commission, Deputy City
Attorney John O'Conner stated that if the need for the
extension of time was created by circumstances beyond the
control of the applicant, the request for extension of time
should be granted.
A MOTION WAS MADE BY GEIGER SECOND BY WALLIN, TO DENY THE
REQUEST FOR AN EXTENSION OF TIME TO APRIL 3, 1974 FOR THE
REASONS THAT THE ENVIRONMENTAL IMPACT REPORT HAS BROUGHT OUT
SIGNIFICANT FINDINGS, INCLUDING THE GENERATION OF AUTOMOBILE

Chairman Porter noted that an opinion is anticipated from
the City Attorney concerning tools which may be used to
limit population growth within the City and this opinion
is anticipated this month.
ON MOTION BY PORTER SECOND BY KERINS, THE REQUEST FOR AN
EXTENSION OF TIME ON TENTATIVE TRACT NO. 7692 WAS CONTINUED
TO JUNE 5, 1973 IN ANTICIPATION OF RECEIPT OF THE CITY
ATTORNEY'S OPINION, BY THE FOLLOWING VOTE:

Deputy City Attorney John O'Conner stated that a written
report would be submitted to the Planning Commission,
probably next week, concerning changes in the Subdivison
and Map Act.
TENTATIVE TRACT NO. 5419 (Cont. 1/16/73)
Subdivider: Signal Landmark, Inc.
Tentative Tract No. 5411 is located at the northeast corner
of Atlanta Avenue and Newland Street and is a private adult
community and commercial development on 122 acres of land.
One commercial lot and nine residential lots. The property
is zoned R1 and C4 and the residential portions of the property
is master planned low density.
The Acting Secretary stated that a one year extension of time
is requested by the applicant. Maps of the project were
posted. The request for an extension of time is made because
of the additional time required to process an environmental
impact report. The Acting Secretary stated that additional
conditions of approval are recommended by the staff and
further added conditions are recommended by the Environmental
Review Board.
Mr. George Stringer, representing the subdivider was present
and stated that he concurred with the additional conditions
of approval.

1. The tentative map received April 27, 1973 which re-
establishes the phases within the development pursuant
to the Planning Commission's discussion at the February 6,
1973 meeting shall be the approved layout.
2. A use permit application incorporating that property
previously reserved for school site purposes shall be
submitted to the Planning Commission for approval action
prior to recordation of a final map on Phase IV of the
proposed development.
3. The access way for vehicular access to Indianapolis
Avenue shall be constructed concurrently with Phase III.
4. The applicant shall be subject to the required park
dedication in effect at the time the Planning Commission
grants the one year extension of time on'Tentative
Map 5419.
5. All standard conditions of approval for tentative maps
dated May 23, 1972 that are applicable shall be complied
with.
6. All applicable conditions of the previously approved
tentative map and use permit shall be complied with.
7. The minimum offset from all dwellings to the normal
travel lane of arterial streets shall be 35 feet.
8. All dwellings to be provided with forced air ventilation.
9. Full insulation of all exterior walls and ceilings of
dwellings is recommended to help minimize the burden on
heating and cooling systems.
10. Disposal of building spoil, unusable lumber, tarpaper,
wire, pipe and other excess or unusable waste shall be
done at off -site facilities equipped to handle them.
11. Development to be constructed with balanced power to
reduce possible overload on any one energy resource.
12. Building foundations for this project shall be designed
to withstand a maximum gravity acceleration of 7.5 ft./sec.
as outlined by the Environmental Impact Report.

DISCUSSION
Possible Park Site - Marine View Drive and Los Patos
The Planning Commission discussed the possible park site
located at the northwest corner of Marine View Drive and
Los Patos. A joint report from the Planning Dep<rtment'
and Recreation Department staffs was reviewed.
Mr. Norm Worthy, Recreation and Parks Director, reported
on a special meeting held by the Recreation and Parks
Commission held May 14, 1973.
FOLLOWING DISCUSSION, ON MOTION BY PORTER SECOND BY KERINS,
STAFF WAS DIRECTED TO TRANSMIT TO THE CITY COUNCIL THE
RECREATION AND PARKS COMMISSION ACTION OF MAY 9 AND MAY 14,
1973 WHICH INDICATES THAT THE RECREATION AND PARKS COMMISSION
DESIRE TO HAVE THE PROPERTY APPRAISED TO DETERMINE THE
FEASIBILITY OF ACQUIRING IT FOR A PARK SITE; ACTION IS
CONTINUED BY THE PLANNING COMMISSION ON THE PROPOSED DEVELOP-
MENT (TENTATIVE TRACT NO. 7743) AND THE DESIGNATION OF THE
PROPERTY AS OPEN SPACE ON THE MASTER PLAN IS CONTINUED UNTIL
SUCH TIME AS THE APPRAISAL TAKES PLACE AND THE RECREATION AND
PARKS COMMISSION AND CITY COUNCIL CAN DETERMINE WHETHER THEY
WANT TO ACQUIRE THE SITE AND WHAT MEANS WILL BE 'USED FOR

Applicant: W. Sterling Buck & Assoc.
Administrative Review No. 73-43 is a request to permit
construction of a hotel on property located on the north
side of Pacific Coast Highway between 9th and loth Streets.
The property is zoned C3 and master planned office -professional.
The Acting Secretary stated that this matter has been referred
to the Planning Commission by the Board of Zoning Adjustments.
Elevations and a plot plan were posted.

The Acting Secretary stated that a request for an exemption
declaration has been considered by the Environmental Review
Board and it was found that the project may hz.ve a substantial
impact upon the environment and that an invironmental impact
statement was required. The applicant was so informed,
however, the required statement has not been submitted.
Mr. Leonard Lindborg, representing the applicant, was
present and addressed the Commission speaking in favor
of the proposal and objecting to the delays encountered
in the processing of his application.
ON MOTION BY BOYLE SECOND BY KERINS, ADMINISTRATIVE REVIEW
NO. 73-43 WAS DENIED FOR THE REASON THAT THE REQUIRED

Applicant: Richard L. Tom
Conditional Exception No. 73-19 is a request to permit a
five foot side yard setback in the R1 Residential District.
Use Permit No. 73-28 is a request to permit construction of
a 3-story residence. The proposed project is located
at the northeast corner of Gilbert Drive and Somerset Lane.
The Acting Secretary stated that Use Permit No. 73-28 was
approved by the Board of Zoning Adjustments and that approval
has been appealed by Planning Commissioner Marcus Porter.
Conditional Exception No. 73-19 has been referred by the
Board of Zoning Adjustments to the Planning Commission at
the direction of the Planning Commission.
Elevations, a plot plan and a cross section of the proposed
unit were displayed.
The Chairman opened the public hearing on Conditional
Exception No. 73-19 and Use Permit No. 73-28,
Mr. Richard Tom, applicant and architect representing the
owner, addressed the Commission speaking in favor of the
proposed project.
Mr. John Wolf, 16662 Wellington Lane, a resident in the
area, addressed the Commission in opposition to the proposal.
Mr. Wolf read a letter stating his reasons for opposing the
project, a copy of which was provided each member of the
Commission.
Mr. Clint Morrison, a member of the zoning committee of the
Huntington Harbour Property Owners Association, spoke in
opposition to the plan.
Mr. Bob Williams, a resident in the area, addressed the
Commission, speaking in opposition to the proposal.
There being no one further present to speak, the Chairman
closed the public hearing.

We should not approve developments encompassing major features
such as number of stories, necessary structures or other
architectural features specifically precluded by deed
restrictions we have factual knowledge of. This is such a
case. The CC$R's for this island in Huntington�-Harbour
specifically restrict development to one and two story
homes. It is not proper to leave the resolution of these
restrictions to a civil court action when we control the
approval, by use permit, of an exception to normal standards.

Utica. The property is master planned low density.'

NO. 73-02 WAS APPROVED FOR THE FOLLOWING REASONS, SUBJECT
TO CONDITIONS LISTED BELOW:
1. Exceptional circumstances apply to this property that
deprive the subject property of privileges enjoyed
on other properties in the vicinity and under identical
zone classifications.
2. This conditional exception will not be materially
detrimental to the public welfare or injurious to
property in the same zone classification.
3. The proposal is consistent with the neighborhood and
does not grant special favor.

Code Amendment No. 73-9 proposes to.consolidate the apartment
standards to encourage better land planning techniques with
maximum use of landscaping, site layout and building design.
The Chairman opened the public hearing on Code Amendment
No. 73-9.
Mr. Mike Earmaker, 418 Potter Circle, Huntington Beach,
owner of property that would be affected by the proposed
amendment addressed the Commission. Following discussion
it was determined that his property would not be affected.

CODE AMENDMENT NO. 73-13
Code Amendment No. 73-13 proposes to reduce the density
on apartment developments, to encourage better land planning,
and to increase open space.
The Acting Secretary outlined the most recent revisions
to the proposed amendment and discussed the areas it would
effect.
The Chairman opened the public hearing on Code Amendment
No. 73-13.
Mr. Harold Bragg, 5840 E. 6th Street, Long.Beach, addressed
the Commission requesting the matter be continued to allow
him to have input prior to Planning Commission action.
Mr. Don Towle, 13701 Farmington Rd., Tustin, owner of
property that would be affected by the proposed code amendment
addressed the Commission in opposition to the proposal.
Mr. Larry Russell, 1538 N. Century Blvd., addressed the
Commission in opposition to the proposed code amendment.
There being no one further present to speak, the Chairman
closed the public hearing.

Zone Case No. 73-10
Signal Landmark, Inc.
The Acting Secretary stated that Zone Case No. 73-10 is
a request for a change of zone from R1-6,000 to R2 PD-10
on approximately ten acres of property located on the east
side of Newland Street approximately 1320 ft. north of
Atlanta Avenue. The property was formerly designated as
a shool site but it has been determined that the site is
no longer needed by the school district.
Deputy City Attorney John O'Conner stated that he expected
to have the written opinion requested by the Commission
concerning spot zoning prepared next week.
Mr. George Stringer representing the applicant and Mr. Don
McCone, Signal Landmark, Inc. were present. Mr. Stringer
stated that the property had been acquired at the request
of the city. Now that it is no longer required for a
school site, it is proposed to be incorporated within the
surrounding development.
Following discussion, the applicant stated that he would
probably withdraw the application for zone change.

The Chairman directed the staff to investigate a plot
plan amendment to allow for phasing of density with the
surrounding area.
Article 931
The Acting Secretary reported that the City Attorney has
determined that the exceptions clause of Article 931 is
unconstitutional and deletion of this section is proposed
by the City Council.
Master Plan Amendment Procedure
Following discussion it was determined that staff will
initiate a master plan amendment to be scheduled for
public hearing concurrently with zone cases which are
in conflict with the master plan.
Transportation Subcommittee
Commissioner Geiger reported that the Transportation Sub-
committee of the City Council had met and developed a proposed
course of action. Orange County Rapid Transit District will
be contacted to determine the relation of the city's study
with that agency. Commissioner Geiger will meet with
a supplier of natural gas powered equipment on May 18 to
determine availability of equipment. A consultant will be
contacted and possibly scheduled to address the Commission
at a future study session.
Huntington Beach High School District
Commissioner Kerins stated that a letter has been received
from Mr. Dennis Mangers, Huntington Beach High School District,
and he will discuss with the Planning Commission at the May 29
study session the district's overview concerning environmental
impact report actions, housing and district views. -
Requests for Continuances
Commissioner Kerins suggested that if an applicant requests
a second continuance on the processing of applications, the
applicant be required to pay for the cost of publication of
a second public_ hearing.

Public Notification on Hearings
Commissioner Wallin requested the staff to investigate the
possibility of notifying property owners within a radius of
400 to 500 feet rather than the present 300 feet.
Staff Reports
Commissioner Wallin requested that information be noted on
application forms stating that staff reports are available
on the Friday preceeding the hearing date of an application.
It was further suggested that applications for zone changes
not be scheduled for public hearing until environmental
impact statements or exemption declarations have been
processed.
