Scholer To permit the construction of a 66 unit apartment complex pursuant to S. 9202.3.1.3 of the Huntington Beach Ordinance Code located on the east side of Algonquin Street approxi- mately 210 ft. north of Warner Avenue in the R3 Medium High Density Residential District. The Acting Secretary stated that applicant has had difficulty in getting revised plans back from the architect and concurs with Board on continuing the hearing to June 13, 1973. Revised plans were discussed. The Board discussed zoning, exemption declaration requirements and Administrative Review requirements. The applicant intends to construct a service station. Mr. Mazelow stated that Mobil has been informed of Exemption Declaration and zoning as necessary. Proposed conditions of approval were discussed. Minutes: H.B. Beach Blvd. and Talbert Avenue shall be dedicated to City and State standards at the time each parcel is developed. 3. Division of Land shall not be effective until a covenant and agreement is signed agreeing to the conditions of approval. B. TO BE COMPLETED PRIOR TO FRAMING INSPECTION: 1. To permit zero side rear yard setback for carports of a pro- posed 296 unit apartment complex in lieu of S. 9320.13(c) of the Huntington Beach Ordinance Code. In Conjunction With USE PERMIT NO. 73-32 Applicant: Shelter Industries, Inc. To permit the construction of a 296 unit apartment complex pursuant to S. 9202.3.1.3 of the Huntington Beach Ordinance Code located approximately 190 ft. southwest of the intersection of Newland St. and Edinger Ave. in an R3 medium high density residential district. The Acting Secretary stated that Use Permit No. 73-32 and Conditional Exception No. 73-23 would be continued but the hearing was opened for comments from the audience. He stated the reason for continuance was that the application cannot be processed because the Environmental Impact Report had not been finalized by the Environmental Review Board. -2- 5/23/73 - BZA Minutes: H.B. Board of Zoning Adjustments Wednesday, May 23, 1973 Page 3 The Planning Director from Westminster, Mr. Frank Schuma, presented a letter to the Board of Zoning Adjustments which expressed opposition to the application. The Acting Secretary stated that the applications should be heard on June 6, 1973, and if there is a change in date of hearing the Planning Director of Westminster will be notified of the change in hearing date. The public hearing was closed. ON MOTION BY EADIE AND SECOND BY LIPPS CONDITIONAL EXCEPTION NO. 73-23 AND USE PERMIT NO. 73-32 WERE CONTINUED TO JUNE 6, 1973 BY THE FOLLOWING ROLL CALL VOTE: AYES: Spencer, Lipps, Eadie NOES: None ABSENT: None ADMINISTRATIVE REVIEW NO. 73-75 Applicant: Ken Cooper To permit the construction of a 9 unit apartment complex' pursuant to S. 9231.6 of the Huntington Beach Ordinance Code located on the west side of loth St. approximately 50 f t. south of Olive Ave. in an R3 District. Mr. Ken Cooper, applicant, was present. The Acting Secretary stated that in checking the plans several problems were noted, such as circulation problems, location of trash area, and need for 25' turning radius in two stalls. The Acting Secretary suggested that applicant and his architect meet with staff to go over plans prior to regular Board_of Zoning Adjustments meeting on May 30, 1973. Soil and compaction reports as required by the Build- ing Department and the Department of Public Works shall be submitted to the City. B. TO BE COMPLETED PRIOR TO FRAMING INSPECTION: 1. A landscaping plan shall be submitted to the Planning Department for review and approval action. 2. All signs for the Proposed Development shall be sub- mitted to the Board of Zoning Adjustments for approval. Signs shall reflect a common theme with respect to design materials and colors which are compatible with the architectural theme of the proposed project. 3. Fire alarm system conduit and appurtenances shall be installed by the developer at locations and to speci- fications provided by the Fire Department. 4. Parking compounds shall be screened with a combination of fencing and landscaping. Said plan shall be submitted to the Planning Department for review and approval action. Fencing and landscape plans shall include the following information: a. A list including quantities and sizes for each species of plants and all ground cover material. b. Irrigation layout to include meter location, pipe sizes, sprinkler head types, etc. c. Fencing materials and detail drawing. S. The structural street section of all private drives shall be approved by the Department of Public Works. C. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. Stark Street shall be fully improved including street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 2. All utilities shall be installed underground. 3. Off-street parking facilities shall conform to Article 979. 4. A masonry wall shall be constructed along west and east property lines. The height of said wall shall be such that top will be six (6) feet above the highest ground surface within twenty (20) feet of the common property line. Except within the front yard setback in which case the height of said wall shall be reduced to 42 inches. The required chain link fence located from existing building to east property line shall be included with slats to screen adjacent properties. S. To permit construction of a 4500 sq. ft. addition to an existing catering service building pursuant to S. 9530 of the Huntington Beach Ordinance Code, located on the west side of Morgan Lane approximately 240 ft. south of Slater Ave. in an M1 industrial district. Mr. G. Boekstein and Mr. Jay Mastroani, applicants, were present. The plans were discussed and Conditions of Approval were discussed. Applicants stated that no additional signs were planned. ON MOTION BY EADIE AND SECOND BY LIPPS ADMINISTRATIVE REVIEW NO. 73-80 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING ROLL CALL VOTE: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The plot plan received May 3, 1973 shall be the approved layout. 2. Morgan Lane shall be dedicated to City standards at the time each parcel is developed. 3. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 4. Soil and compaction reports as required by the Building Department and the Department of Public Works shall be submitted to the City. S. Questad To permit the construction of an industrial building pursuant to S. 9530 of the Huntington Beach Ordinance Code located on the east side of Commerce St. approximately 600 ft. south of McFadden Ave. in an 100-M-A-20,000 District. Lynn J. Questad, applicant, was present. Plans were discussed and applicant stated that he planned eventually to have 20,000 sq. ft. building, with additional 10,000 sq. ft. being added to present plans. The trash area was discussed and Acting Secretary stated that plans indicated it was not in a good area, that it should be nearer to the front. Suggested Conditions of Approval were discussed. Applicant stated that signing would be up to tenants. ON MOTION BY LIPPS AND SECOND BY SPENCER ADMINISTRATIVE REVIEW NO. 73-81 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING ROLL CALL VOTE: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The plot plan received May 3, 1973 shall be the approved layout as amended. 2. Mrs. Lain, applicant, was present. The Board discussed the plans with Mrs. Lain and stated that signing would have to be reviewed with future tenants when building is ready for occupancy. Baber To permit the construction of a one bedroom apartment pursuant to S. 9161.2 of the Huntington Beach Ordinance Code located on the east side of 12th St. approximately 140 ft. north of Acacia Ave. in an R2 residential district. Jerry Baber, applicant, was present. The Acting Secretary and applicant discussed the error in application whereby it appeared that application was for a one bedroom apartment to be constructed over an existing garage. Applicant stated that this was an error and that in fact there is no existing garage on the premises to add a one bedroom apartment. Open space and turning radius were discussed. The Conditions of Approval were discussed with applicant. ON MOTION BY LIPPS AND SECOND BY SPENCER ADMINISTRATIVE REVIEW NO. 73-86 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING ROLL CALL VOTE: A. Father Ronald Colloty, O.F.M., the applicant, was present. The Acting Secretary stated that a letter from Charles Gerarden, Chief Land Use Technician for the City of Huntington Beach, had addressed a letter to the Board of Zoning Adjust- ments stating that application for Administrative Review No. 73-89 should be withdrawn and that it was recommended the filing fee be refunded to applicant. The letter stated that subject property had not been abandoned for a period of six months and therefore the filing of an Administrative Review application is not required for this property and new business operation. -11- 5/23/73 - BZA Minutes: H.B.
