In Conjunction With USE PERMIT NO. 73-32 - Continued from 5/23/73 Applicant: Shelter Industries, Inc. To permit the construction, of a 296 unit apartment complex pursuant to S. 9202.3.1.3 of the Huntington Beach Ordinance Code, located approximately 190 ft. southwest of the inter- section of Newland St. and Edinger Ave. in an R3 medium -high density residential district. Minutes: H.B. Board of Zoning Adjustments Wednesday, June 6, 1973 Page 2 The Chairman indicated that this item was opened at the previous meeting. John Wells, Architect, and Don Biggs, representing the applicant, were present. Mr. Wells addressed the Board and outlined the proposed project. The Acting Secretary explained the reason for need of a Con- ditional Exception. The Chairman asked Mr. Wells if flood control requirements were being met. Mr. Wells stated that they were working with Orange County Flood Control District and were meeting all their requirements. The Acting Secretary stated that Environmental Impact Report No. 73-7 was adopted by the Environmental Review Board on May 29, 1973. Mr. Gerarden requested an explanation of hardship. Mr. Wells explained that the triangular shape of the property bounded on all three sides by arterials created the hardship. Mr. Bob Wilson, President of Maybrook Homeowners Association, addressed the Board in opposition to the project. He stated that his reasons for opposition were increase in traffic on Edinger and Newland, parking problems, additional noise created by increased traffic, air pollution, and density not compatible with the area. He further stated that both proposed and alternate freeway routes would go through the project between five and ten years, and that the project would be an expense to taxpayers to condemn and buy for freeway use. He stated that he had a petition containing in excess of 300 signatures protesting the development. This was received by the Board. The Acting Secretary stated that the Highway Division is aware of the project and if they were interested in acquiring the property for protection, they would do so. Doris Hays addressed the Board and inquired about parking the cars. The Acting Secretary stated that plans met parking require- ments except that one additional enclosed parking space would be required. Mrs. Moser spoke in opposition to the development with regard to the proposed freeway. She quoted an article which appeared in the Santa Ana Register June 3rd edition wherein the City Attorney of Huntington Beach was quoted in regard to overgrowth of the City of Huntington Beach. Mr. Gerarden stated that the EIR should be relied upon and this report had determined there would be insignificant environmental damage overall. -2- 6/6/73 - BZA Minutes: H.B. Mr. Don Biggs discussed the plans and landscaping. Discussion was held on Conditions of Approval. Hearing was closed to the audience. There was a discussion of Environmental Impact Report. ON MOTION BY EADIE AND SECOND BY GERARDEN RECOMMENDATIONS OF ENVIRONMENTAL REVIEW BOARD AND RECOMMENDATIONS FOR MITIGATING MEASURES AS OUTLINED IN TRANSMITTAL DATED MAY 31, 1973 WERE ACCEPTED BY THE FOLLOWING ROLL CALL VOTE: AYES: Spencer, Gerarden, Eadie NOES: None ABSENT: None ON MOTION BY EADIE AND SECOND BY SPENCER USE PERMIT NO. 73-32 WAS APPROVED WITH THE FOLLOWING CONDITIONS AND BY THE FOLLOWING ROLL CALL VOTE: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The revised plot plan received May 29, 1973 shall be the approved layout. 2. A revised plot plan shall be submitted to the Board of Zoning Adjustments for approval action. Revised plan shall indicate (1) a modified walkway system minimizing amount of concrete coverage and maximum use of open space, (2) additional trash areas to be located closer than 200 feet from any dwelling unit, and (3) revised plan shall reflect closure of street access from secondary entrance on Edinger Ave. and shall reflect a 20' setback to be landscaped, (4) right of way dedication shall be required per Orange County Flood Control District standards, (5) one additional parking space shall be incorporated. -3- 6/6/73 - BZA Minutes.; H.B. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 6. All buildings on lots abutting a City easement shall be set back (S) feet from the edge of such easement. 7. Soil and compaction reports as required by the Building Department and the Department of Public Works shall be submitted to the City. 8. All private streets shall meet the minimum standards for planned residential developments as adopted by the City Council. 9. Approval -of Use Permit No. 73-32 shall be contingent upon approval of Conditional Exception No. 73-23. B. TO BE COMPLETED PRIOR TO FRAMING INSPECTION: 1. A landscaping plan shall be submitted to the Board of Zoning Adjustments for review and approval action. 2. Rooftop mechanical equipment shall be screened from view. Said screening plan shall be approved by the Board of Zoning Adjustments. 3. All signs for the proposed development shall be submitted to the BZA for approval. Signs shall reflect a common theme with respect to design materials and colors which are compatible with the architectural theme of the pro- posed project. 4. Fire alarm system conduit and appurtenances shall be installed by the developer at locations and to.speci- fications provided by the Fire Department. S. Parking compounds shall be screened with a combination of fencing and landscaping. Said plan shall be submitted to the Planning Department for review and approval. On -site drainage shall be in accordance with the requirements of the City Engineer, and treatment of the area adjacent to the flood control channel shall be in accordance with the requirements of the Orange County Flood Control District, as outlined in its letter of May 17, 1973. 8. A building identification system shall be provided subject to approval of the Fire Department. 9. All requirements stipulated by the Orange County Flood Control District shall be complied with. 10. A Covenant and Agreement stipulation that the apart- ments will be "Adult Only" shall be filed with the City and recorded prior to framing inspection. C. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. Edinger and Newland Ave. shall be fully improved including street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 2. All utilities shall be installed underground. 3. Off-street parking facilities shall conform to Article 979. 4. There shall be no fence, structure or landscaping constructed or maintained over 3 1/2 feet high within a 10 ft. by 10 ft. triangular area at the intersection of driveways and streets or within a 25 ft. by 25 ft. triangular area at the intersection of streets. S. A lighting system shall be installed within the project equal in illumination to lighting on public streets. Lighting system shall be shielded to reflect away from adjoining properties and streets. ' 6. The project is to be constructed with balanced power to reduce possible overloading on any one energy source. 9. Carports constructed on 0' property line shall be of maintenance -free masonry material. A plan demonstrating compatible architectural treatment of all carports and periphery walls shall be submitted to the Board of Zoning Adjustments for approval action. Said plan shall indicate design, materials and color. D. TO BE COMPLETED PRIOR TO ISSUANCE OF CERTIFICATE OF OCCUPANCY: 1. Water supply shall be through the City of Huntington Beach's water supply system. 2. Sewage disposal shall be through the City of Huntington Beach's sewage system. 3. Easements for utilities or walkways shall be provided to Department of Public Works standards. 4. The property shall participate in the local drainage assessment district. S. No structures, other than those shown on the approved plot plan, shall be constructed within the project. 6. All applicable City Ordinances shall be complied with. GENERAL CONDITIONS 1. Disposal of building spoils: Unusable lumber, tar paper, wire, pipe and other excess or unusable waste shall be dumped at an off -site facility equipped to handle them. 2. The location of the roof vents shall be as stipulated on page 141 of the final EIR report; i.e., the walls of the buildings will be higher than the exhaust vents, and the hooded vents will be located away from the freeway sides of the buildings closest to the freeway. Board of Zoning Adjustments Wednesday, June 6, 1973 Page 7 To permit the construction of a commercial building pursuant to S. 9472 of the Huntington Beach Ordinance Code located on the west side of Springdale St. approximately 210 ft. south of Warner Ave. in a C4 Highway Commercial District. The hearing was opened to the audience. Mr. John St. Amour, applicant, and Mr. Sprik, representing applicant, were present. Parking spaces and driveway areas were discussed. The applicant stated that driveway would be temporary until property is permanently developed. The Acting Secretary stated that the landscaping complies with Code. Conditions of approval and signing were discussed. Mr. Sprik stated that a rendering of sign would be submitted and that no pole signs were to be built. The public hearing was closed. ON MOTION BY SPENCER AND SECOND BY GERARDEN USE PERMIT NO. 73-31 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING ROLL CALL VOTE: ' A. The height of said wall shall be such that the top will be six (6) feet above the highest ground surface within twenty (20) feet of the common property line. Mr. L. Lindborg and Mr. Wallenfang, representing the applicant, were present. The Acting Secretary stated that ED 73-63 had been approved on this development. AYES: Spencer, Gerarden, Eadie NOES: None ABSENT: None CONDITIONAL EXCEPTION NO. 73-ZS Applicant: Drug -A -Rama To.permit the addition of an identification sign to an existing super market pole sign pursuant to S. 9763.4.4 and in lieu of S. 9764.3.2 of the Huntington Beach Ordinance Code located on the north side of Warner Ave. approximately 400 ft. west of Goldenwest St. in a C2 community business district. The applicant, Gordon Hatch, and the owner of the building, , Mr. Elis Nourafchan, were present. Mr. Bill Murray, representing the sign company, was present. The hearing was opened to the public. The applicant addressed the Board. He stated that since his business was second largest in the shopping area and that the building he occupies sets back from the others his business requires a larger sign. He stated that Alpha Beta had consented to his adding on to their sign and that they recognized his problem. The owner stated .that while he had 16 tenants only 10 of them had signs. Mr. Nourafchan indicated that some tenants did not want signs on the frontage. Mr. Murray stated that it would be quite costly to erect another monument type structure to hold additional signs. Applicant stated that none of the 10 tenants presently using the signs would be willing to give them up. There was a discussion about redesigning the present sign. Mr. Murry stated that lie had designed signs in Phoenix and presented Board with renderings of sign similar to what might be acceptable to Board. 1 -14- 6/6/73 - BZA 1 1 Minutes; H.B.
