HomeMy WebLinkAbout1973-06-12MINUTES HUN1'INGTON BEACH PLANNING COMMISSION Council Chambers, Civic Center Huntington Beach, California TUESDAY, JUNE 12, 1973 - 7 P.M. - STUDY SESSION COMMISSIONERS PRESENT: Geiger, Bazil, Porter, Wallin, Boyle, Higgins Commissioner Kerins arrived at 9 P.M. NOTE: A TAPE RECORDING OF THIS MEETING IS ON FILE IN THE PLANNING DEPARTMENT OFFICE TENTATIVE TRACT NO. 7771 The Acting Secretary Jim Palin stated that a report has been prepared by the City Engineer concerning removal of trees and requirements for wall construction. Pursuant to the report, the Staff recommends the matter be continued for additional information from a consultant who has been engaged and for results of an infrared survey to determine the health of the trees. Further, a request has been received from the subdivider requesting to remove a clump of trees near the midden area. Slides and photographs of the the tree location in relation trees were shown to the property and a map indicating line was reviewed. Mr. Robert Croft, a resident on Hartlund Lane, addressed the Commission requesting removal of the trees and requesting block wall fencing on the property line and correction of grading and drainage problems existing on the property of adjacent residents. ON MOTION BY GEIGER SECOND BY WALLIN, THE MATTER WAS REFERRED TO -STAFF FOR STUDY AND RECOMMENDATION AS TO THE REQUIREMENTS FOR TREE REMOVAL BASED ON FENCING MATERIAL USED, WHICH TREES SHOULD BE TOPPED, WHICH TREES SHOULD BE REMOVED OR RETAINED AND A DETERMINATION AS TO RESPONSI- BILITY FOR CORRECTION OF GRADING AND DRAINAGE PROBLEMS; REQUESTED RECOMMENDATIONS TO BE SUBMITTED FOR CONSIDERATION ON JUNE 19, 1973, BY THE FOLLOWING VOTE: AYES: Geiger, Bazil, Porter, Wallin, Boyle, Higgins NOES: None ABSENT: Kerins Dr. S. Lampert TRANSPORTATION STUDY Dr. S. Lampert addressed the Commission at the,invitation of the Planning Commission Committee on Transportation. Dr. Lampert discussed the city's needs for a transportation system, compatibility with Orange County Transit District's system, demand and destination areas. PC 6/12/73 Minutes: H. B. Planning Commission Tuesday, June 12, 1973 Page 2 Planning Director K. A. Reynolds reviewed work thus far accomplished by the Planning Department and city with regard to transportation systems. Following discussion, it was determined that information already developed should be provided to the Commission and a meeting with the staff should be arranged to review the information and the progress of discussions with Orange County Transit District. COMMISSIONER ARRIVES Commissioner Kerins arrived at 9 P.M. and assumed his duties. RECESS At 9:05 P.M. the Chairman called a recess. The meeting reconvened at 9:15 P.M. CARE OF NON -RELATED ADMINISTRATIVE. REVIEW FILING FEE Carl Duncan, Fire Department, addressed;the Planning Commission in behalf of the County of Orange requesting that the $10 filing fee for Administrative Review applications for care of non -related be discontinued. He stated that if,pending legislation is approved, it will preclude the city making the charge, but in any case, it constitutes a hardship on applicants who are providing a community service. Miss Sara Smith, Supervising Probation Officer, County of Orange was present and further discussed the request. ON MOTION BY BOYLE SECOND BY BAZIL, STAFF WAS DIRECTED TO PREPARE A CODE AMENDMENT RESCINDING THE $10 FILING FEE FOR CARE OF NON - RELATED FOR THE REASON THAT A NON-PROFIT COMMUNITY SERVICE IS BEING PROVIDED, BY THE FOLLOWING VOTE: AYES: Geiger, Bazil,,Kerins, Porter, Wallin, Boyle, Higgins NOES: None ABSENT: None MULTI -STORY STUDY SPECIFIC PLAN, CONSTRUCTION COST AND RENT STRUCTURES Mr.Steve Kellogg, Planning Department, reviewed a,sample specific plan for multi -story development. Mr. Dave Eadie, Planning Depart- ment, reviewed statistical data on construction cost and rent structures. PC 6/12/73 Minutes: H. B. Planning Commission Tuesday, June 12, 1973 Page 3 Mr. Art Knox, Chairman of the Citizens' Committee on High Rise addressed the Commission. Mr. Knox stated that.the Committee feels that residential high rise is at its peak overlooking the ocean and the Townlot Area does not lend itself to the specific plan approach. The Committee feels the general philosophy of the seventh draft of Code Amendment No. 72-21 as applied to the Townlot area is the proper approach. The Bolsa .ca or other undeveloped area could be handled under a specific aln-but only sees merit in the specific plan when applied to developed land. Planning Director K. A. Reynolds recommended proceeding with the specific plan approach, revising the code amendment in conjunction therewith, and selecting an area,on which to develop the first specific plan application. Mr. Leonard Wright, a member of the Citizens,High Rise Committee, stated that he thinks it would be'a good idea to have a specific plan. The Commission discussed which area should be selected as the first area in which to develop a specific plan. ON MOTION BY KERLNS SECOND BY HIGGINS, STAFF WAS DIRECTED TO PROCEED WITH DEVELOPMENT OF A SPECIFIC PLAN CONCEPT AND TO AMEND THE MULTI- STORY CODE AMENDMENT IN CONCERT THEREWITH, BY THE FOLLOWING VOTE: AYES: Geiger, Bazil, Kerins, Porter, Wallin, Boyle, Higgins NOES: None ABSENT: None A MOTION WAS MADE BY KERINS SECOND BY BOYLE TO DESIGNATE THE HUNTINGTON CENTER AREA AS THE FIRST AREA_IN WHICH TO DEVELOP A SPECIFIC PLAN. The meeting reconvened CIVIC CENTER IMPACT STUDY ACTIVITY LEVEL Mrs. Maureen Wild, Planning Department, showed vugraphs indicating the following: High activity civic center level with freeway High activity level without freeway Medium activity level with freeway Medium activity level without freeway Planning Director K. A. Reynolds stated that two policy questions should be answered:prior to making a decision concerning the activity level of the civic center: 1. Whether or not the city should —acquire a triangular parcel of property bounded,by.Utica, Lake and 17th Streets. 2. Whether or not a'freeway is desirable. The Commission discussed.these factors. The consensus was that commercial and office professional activity should be pursued as well relocation of the municipal courts. ON MOTION BY GEIGER SECOND BY KERINS, THE HIGH ACTIVITY -LEVEL CIVIC CENTER PLAN WITH A FREEWAY WAS SELECTED AS MOST DESIRABLE AND STAFF WAS DIRECTED TO PREPARE A PREFERED'ALIGNMENT FOR THE ROUTE 39 FREEWAY, BY THE FOLLOWING VOTE: AYES: Kerins, Boyle, Wallin, Porter, Geiger NOES: Higgins, Bazil ABSENT: None USE PERMITS NOS. 73-3,.73-5, 73-6 Applicant: James Montgomery In response to a request by Commissioner Wallin, Planning Director Reynolds stated that an area study would be prepared for the Commission's information on June 19, 1973. COMMENTS Request for Information Commissioner Wallin requested information be provided the Planning Commission concerning matters which relate to land use, including status of negotiations, legal opinions and correspondence. Meadowlark Golf Course Deputy City Attorney John O'Conner reporte ,that an opinion will be forthcoming concerning application of k6dreational Open Space District zoning. Open Space Element Deputy City Attorney John O'Conner reported that'S.B. 594 which would extend the deadline for adoption of the Open Space Element of the General Plan to December 31, 1973 is expected to be voted upon June 18, 1973. Pacific Electric Right of Wa Commissioner Bazil inquired as to the'status of incorporating the Pacific Electric Right of Way into a transportation corridor. Acting Secretary stated that this report will be forthcoming to the Commission, however, a high priority has not been assigned since it takes approximately seven years to vacate the right of way. Growth Policy In response to a question by Commissioner ining Department, reported that a draft of be submitted to the Planning Commission by Boyle, Ed Selich, Plan the Growth Policy will June 30, 1973. Planning Commission Tuesday, June 12, 1973 Page 7 Street Improvements - Brookhurst Street In response to a question by Commissioner Higgins, City Engineer Bill Hartge reported that street improvements will be made on Brookhurst Street near the Edison facility as soon as the work can be incorporated into another job. Requests to be Excused from Planning Commission Meetings Commissioner Boyle requested to be excused from evening meetings of the Planning Commission during the course of summer school, commencing June 19, 1973. Commissioner Higgins requested to be excused from attendance at the June 19, 1973 meeting. Commissioner Geiger requested to be excused for the June 19 and 26 meetings. The Chairman granted all three requests. TENTATIVE TRACT NO. 7771 The Deputy City Attorney was requested to report on punitive action which may be taken against the developer of Tentative Tract No. 7771 as a result of his illegal removal of trees on the property.
