Brown To permit the construction of a ten (10) unit apartment complex pursuant to Section 9202.3.1.3 of the Huntington Beach Ordinance Code located on the north side of Stark Ave. approximately 80 ft. east of Park Side Lane in an R3 medium high density residential district. The Acting Secretary stated that due to extenuating circumstances concerning the applicant's Environmental Review Board status the application for Use Permit No. 73-37 would have to be continued. The Acting Secretary stated that by previous Board policy 20 foot setbacks have been allowed if the subdivision was originally built in this manner and for this reason applicant's file was in error. Mr. Gerarden stated that policy was established March 28, 1973. ON MOTION BY EADIE AND SECOND BY GERARDEN CONDITIONAL EXCEPTION N0, 73-21 WAS WITHDRAWN AND FILING FEE TO BE REFUNDED APPLICANT BY THE FOLLOWING ROLL CALL VOTE: AYES: Spencer, Gerarden, Eadie NOES: None ABSENT: None REGULAR AGENDA ITEMS: ADMINISTRATIVE REVIEW NO. 73-94 Applicant: Huntington Estates, Inc. To permit the construction of model homes for Tract 6874 pursuant to S. 9730.18 of the Huntington Beach Ordinance Code located on the north side of Intrepid Road approximately 600 ft. west of Broadway in an R1 low density residential district. No one was present to represent the applicant. The Board discussed the plans. There was a discussion of the outside directional sign and Mr. Gerarden stated that the sign abutting the channel does not conform to Code. ON MOTION BY GERARDEN AND SECOND BY SPENCER ADMINISTRATIVE REVIEW NO. 73-94 WAS APPROVED WITH THE FOLLOWING CONDITIONS AND BY THE FOLLOWING ROLL.CALL VOTE: 1. Plan received May 24, 1973 shall be approved layout. AYES: Spencer, Gerarden, Eadie NOES: None ABSENT: None ADMINISTRATIVE REVIEW NO. 73-93 Applicant: Mr. and Mrs. Robert Pestolesi To permit the construction of a masonry wall in the front yard pursuant to S. 9104.5.1 of the Huntington Beach Ordinance Code located on the south side of Gatehill Circle approximately 200 f t. south of Evening Hill Dr. in an R1 low density residential district. Mr. Pestolesi, applicant, was present and addressed the Board. He explained the plans. The Acting Secretary stated that a field check had been made and Questioned footage on plan. Mr. Gerarden stated that he did not feel the masonry wall would have a detrimental effect on the neighborhood. The Acting Secretary stated that based on the wall creating better continuity with adjacent property he would be in favor of it. ON MOTION BY GERARDEN AND SECOND BY SPENCER ADMINISTRATIVE REVIEW NO. 73-93 WAS APPROVED FOR THE FOLLOWING REASONS AND BY THE FOLLOWING ROLL CALL VOTE: 1. Will not have detrimental effect on neighborhood. 2. Better utilization of property by creating private,patio area which cannot be achieved in rear due to property abutting golf course where no walls are allowed, S. 9104.5.1. 3. Plot Plan received June 8 shall be approved layout. AYES: Spencer, Gerarden, Eadie NOES: None ABSENT: None CONDITIONAL EXCEPTION NO. 73-24 - Continued from 6/6/73 Applicant: Robert Bailor To permit an encroachment into the required sight angle setback in lieu of S. 9432.3 of the Huntington Beach Ordinance Code located on the northwest corner of Holt Ave. and Beach Blvd. in a C4 highway commercial district. Mr. Robert Bailor, applicant, was present. The hearing was opened to the public. Mr. Bailor addressed the Board and stated that existing arrange- ment on parking lot is the best utilization of the property that he has been able to achieve. The Acting Secretary outlined the reasons for request which applicant had submitted to him. The safety factor was discussed concerning the entries to parking lot being closed by chain link. It was the consensus of the Board that a meeting should be arranged at which time applicant would be able to present an alternate method of utilization of parking lot which would decrease number of vehicles and still display to greatest ad- vantage. Public hearing was closed. ON MOTION BY SPENCER AND SECOND BY GERARDEN CONDITIONAL EXCEPTION NO. 73-24 WAS CONTINUED TO JUNE 272 1973 BY THE FOLLOWING ROLL CALL VOTE: AYES: Spencer, Gerarden, Eadie NOES: None ABSENT: None PLOT PLAN AMENDMENT NO. 73-3 Applicant: Philip B. Houghton, Pastor To permit the addition of proposed class rooms and foyer pursuant to S. 9811.4 of the Huntington Beach Ordinance Code located on the west side of Newland St. approximately 340 f t. south of Slater Ave. in a R2 low density residential district. There was no one present to represent the applicant. The Board discussed the plans. The Acting Secretary stated that applicant was -exempt from Exemption Declaration Status. ON MOTION BY EADIE AND SECOND BY SPENCER PLOT PLAN AMENDMENT NO. 73-3 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING ROLL CALL VOTE: 1. The additional building will be architecturally compatible with existing building. 2. Plot Plan received May 21, 1973 shall be approved layout. Open space was discussed. ON MOTION BY SPENCER AND SECOND BY GERARDEN ADMINISTRATIVE REVIEW NO. 73-54 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOW- ING ROLL CALL VOTE: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The plot plan received May 21, 1973 shall be the approved layout. 2. A revised plot plan and elevation shall be submitted to the Board of Zoning Adjustments for approval action. Said plan shall reflect 7 1/2 ft. setback after dedication. 3. 12th St. and alley shall be dedicated to City standards at the time each parcel is developed. 4. The water, sewer, and fire hydrant system shall be ap- proved by the Department of Public Works and Fire Depart- ment. S. Soil and compaction reports as required by the Building Department and the Department of Public Works shall be submitted to the City. B. TO BE COMPLETED PRIOR TO FRAMING INSPECTION: Fire alarm system conduit and appurtenances shall be installed by the developer at locations and to specifications provided by the Fire Department. C. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. 12th St. and alley shall be fully improved including street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 2. All utilities shall be installed underground. 3. Off-street parking facilities shall conform to Article 979. D. TO BE COMPLETED PRIOR TO ISSUANCE OF CERTIFICATE OF OCCUPANCY: 1. The property shall participate in the local drainage assessment district. 5. No structures, other than those shown on the approved plot plan, shall be constructed within the project. 6. All applicable City Ordinances shall be complied with. The Board dis- cussed the plans and it was the consensus of opinion that plans of that magnitude should be reviewed by Daryl Smith of Public Works Department and the Board at an informal meeting. Mr. Gerarden stated that he would be in favor of the Appearance Review Board submitting a written comment on the landscaping project.
