AYES: Bazil, Kerins, Porter, Wallin, Higgins NOES: None ABSENT: Geiger, Boyle REGULAR AGENDA ITEMS TENTATIVE TRACT NO. 7771 (Tree Removal) Subdivider: Meadow Homes No. 2 The Acting Secretary, Jim Palin, stated that a map was posted showing the trees in relation to the property line and that correspondence has been received by the Planning Commission from the developer, Daryl Smith, Wes Humphrey, University of California Extension, Richard Bigler, and the Planning Department staff. Daryl Smith, Street Tree Supervisor, showed infra -red films taken of the trees indicating their state of health. Mr. Tom Shelton, engineer for the project, was present and stated that he accepts the staff's recommendations and that a decision on the tree removal is imperative at this time since escrow on the property closes July 1, 1973. In response to a question by the Commission concerning construction of a block wall fence on the property line to the south of Kiner Avenue, Mr. Shelton stated that he has previously offered to share the cost of such a fence with the abutting property owners. He further stated that he will be glad to submit a landscape plan and will resolve the wall question at a later time. PC 6/19/73 Minutes: H. B. Mr. Robert Cronk, 18312 Hartlund Lane, requested a fence be installed prior to start of construction. Commission discussion followed concerning the tree removal and a landscape plan. ON MOTION BY BAZIL, TREE REMOVAL WAS AUTHORIZED BASED ON ANALYSIS BY THE STAFF OF REPORTS FROM THE TWO CONSULTANTS ENGAGED BY THE CITY. TREE REMOVAL AS DEEMED NECESSARY BY THE STAFF IS AUTHORIZED BECAUSE OF POSSIBLE LIABILITY OF THE CITY. STAFF IS TO CONSIDER THE NUMBER OF TREES REMOVED WHEN REVIEWING THE LANDSCAPE PLAN. The Chairman opened the public hearing on the Objectives and Principles of the Society and Culture Section of the Policy Plan. There being no one present to speak either for or against, the Chairman closed the public hearing. B. Planning Commission Tuesday, June 19, 1973 Page 4 TENTATIVE TRACT NO. 7950 in conjunction with USE PERMIT NO. 73-036 Applicant: Daniel Webb Construction Inc. Tentative Tract No. 7950 is a request for 24 single family homes in the R1-PD District, located on the south side of Holland Drive, 265.5 ft. east of Beach Blvd. Use Permit No. 73-036 is a request to permit construction of a 24 unit planned residential development on 3.86 acres of land. Rendered elevations of the plan were posted and a plot plan has been submitted. The Chairman opened the public hearing on Use Permit No. 73-036. Mr. Jack Millet, Millet and King, representing the applicant addressed the Commission speaking in favor of the proposed project. Mr. Vincent Guarcello, a property owner in the area and President of the Dutch Haven Homeowners Association, discussed proposals submitted to the City Council at the time the zone case on the area was considered. There being no one further present to speak, the Chairman closed the public hearing. Commission discussion followed. Planning Commission Tuesday, June 19, 1973 Page 5 TENTATIVE TRACT NO. 8289 (Cont. 5/l/73) in conjunction with USE PERMIT NO. 73-21 (Cont. 5/l/73) Applicant: F. A. Jones Tentative Tract No. 8289 is a proposal for 101 lots on 8.3 acres in the R3 District. The property is master planned medium high density residential. Use Permit No. 73-21 is a request to permit construction of a 101 unit condominium located on the southwest corner of Pearce Avenue and Bolsa Chica Street. The Acting Secretary stated that the Planning Commission should accept, reject or modify the Environmental Review Board's findings on the Environmental Impact Report on this project. A revised plot plan was posted. The Chairman opened the public hearing on Use Permit No. 73-21. Mr. J. Jamison Moore, 9015 Ocean Blvd., Long Beach, Atlantis Scientific Co., was present in behalf of the applicant to answer any questions. There being no one further present to speak, the Chairman closed the public hearing. Commission discussion followed. Commissioner Bazil was excused from 9:25 P.M. to 9:40 P.M. In reviewing the plan, it was determined that the plan is deficient in the following areas: 1. No landscaping is provided within the setback along Bolsa Chica Street. 2. Recreational vehicle storage must be prohibited by the CCFR's. 3. Certain street widths are less than minimum allowed. 4. A 25 ft. separation at the north end of the tract is required rather than the existing 17 ft. S. There is a shortage of open space and patio requirements on the six units along Pearce Street. 6. Clarification is required in the area designated on the tentative tract adjacent to Bolsa Chica and Green Street and north of the tennis courts, designated as Lot G, to indicate whether this is garages or assigned open parking spaces. 8. Treatment of garage doors. Mr. Moore requested permission to substitute a more desirable species of tree rather than retaining the existing eucalyptus trees on the property. As a result of the discussion, Mr. Moore plans to submit a revised map for Commission consideration. ON MOTION BY KERINS SECOND BY HIGGINS, THE ENVIRONMENTAL IMPACT REPORT AND THOSE RECOMMENDATIONS OF THE ENVIRONMENTAL REVIEW BOARD WERE ACCEPTED, INCORPORATING THOSE MITIGATING POINTS CONTAINED IN THE ENVIRONMENTAL REVIEW BOARD'S TRANSMITTAL TO THE PLANNING COMMISSION, BY THE FOLLOWING VOTE: AYES: Bazil, Kerins, Porter, Wallin, Higgins NOES: None ABSENT: Geiger, Boyle ON MOTION BY KERINS SECOND BY BAZIL, TENTATIVE TRACT NO. 8289 AND USE PERMIT NO. 73-21 WERE CONTINUED TO JULY 3, 1973 TO ALLOW THE APPLICANT TIME TO REVISE THE PLOT PLAN WITH THE CONSENT OF THE APPLICANT, BY THE FOLLOWING VOTE: AYES: Bazil, Kerins, Porter, Wallin, Higgins NOES: None ABSENT: Geiger, Boyle Mr. Moore was requested to confirm his consent for continuance by letter to the Planning Department. ZONE CASE NO. 73-6 (Cont. 5/15/73) Applicant: B. G. Williams Zone Case No. 73-6 is a request for a change of zone on 1.36 acres of property located at the northwest corner of Huntington Avenue and Utica Street, from M2-0-CD to R2-CD. The property is master planned Medium Density Residential. The Acting Secretary stated that Exemption Declaration No. 73-28 was granted by the Environmental Review Board on May 1, 1973. Williams, applicant, addressed the Commission, speaking in favor of the request. There being no one further present to speak, the Chairman closed the public hearing. Mr. Ed Selich, Planning Department, stated that prior to a decision on a change of zone, staff needs to complete the Cost/Revenue Study on Industrial and Commercial Land and to have the results of the Growth Policy Study. A MOTION WAS MADE BY PORTER TO APPROVE ZONE CASE NO. 73-6 FOR THE REASON THAT IT IS CONSISTENT WITH THE MASTER PLAN FOR THE AREA. THE MOTION FAILED FOR LACK OF A SECOND. ON MOTION BY HIGGINS SECOND BY BAZIL, ZONE CASE NO. 73-6 WAS DENIED BY THE FOLLOWING VOTE FOR THE FOLLOWING REASONS: 1. The partial rezoning of the block is inappropriate. 2. Such rezoning would leave a key corner (an existing lot across the street) zoned for manufacturing. 3. The entire area should be rezoned since the two uses, manu- facturing and residential, are incompatible. AYES: Bazil, Kerins, Wallin, Higgins NOES: Porter ABSENT: Geiger, Boyle Commissioner Kerins noted that the staff expects to be able to act on the entire area within 30 days. ON MOTION BY BAZIL SECOND BY HIGGINS, STAFF WAS DIRECTED TO INITIATE A CHANGE OF ZONE ON ALL INDUSTRIAL PROPERTY IN THE AREA OF HUNTINGTON AND UTICA STREET, SOUTH TO YORKTOWN, FROM MANUFACTURING TO MEDIUM DENSITY RESIDENTIAL, IN COMPLIANCE WITH THE MASTER PLAN OF THE AREA, BY THE FOLLOWING VOTE: AYES: Bazil, Porter, Higgins NOES: Kerins, Wallin ABSENT: Geiger, Boyle Commissioner Kerins stated that he would like to see the results of the studies before initiating zone changes in the area. Planning Commission Tuesday, June 19, 1973 Page 8 USE PERMIT NO. 73-3 Appeal USE PERMIT NO. 73-5 (Cont. 5/l/73) USE PERMIT NO. 73-6 Applicant: James Montgomery Use Permits No. 73-3, 73-5 and 73-6 are requests to allow the construction of three, 20 unit (Total of 60 units) apartment complexes in the R3 District. The area is master planned High Density Residential and Industrial uses and is located on the west side of Holly Street, 185 ft. south of Garfield Avenue. The appeal is by Planning Commissioner Katherine Wallin, to approval by the Board of Zoning Adjustments of Use Permits No. 73-3, 73-5 and 73-6. Mr. Ed Selich, Planning Department, stated that zoning, land use and master plan maps of the area were posted for the Commission's information. Mr. Selich discussed conflicts within the area and possible street realignments. The Chairman reopened the public hearing on the appeal to approval of Use Permits No. 73-3, 73-5 and 73-6. Mr. James Montgomery, applicant, addressed the Commission request- ing a decision at this time. There being no one further present to speak, the Chairman closed the public hearing. Commission discussion followed. A MOTION WAS MADE BY WALLIN SECOND BY KERINS TO OVERRULE THE BOARD OF ZONING ADJUSTMENTS AND DENY USE PERMITS NO. 73-3, 73-5 MAD 73-6 FOR THE FOLLOWING REASONS: 1. Granting of the use permits would adversely affect the Master Plan. 2. The abutting area is developing as industrial and residential development would be incompatible. 3. Denial of the use permits will protect the investment of the community in the preservation of the integrity of the civic center and the proposed freeway right of way. THE MOTION FAILED BY THE FOLLOWING VOTE: AYES: Kerins, Wallin _ NOES: Bazil, Porter, Higgins ABSENT: Geiger, Boyle PC 6/19/73 Minutes: H. B. Planning Commission Tuesday, June 19, 1973 Page 9 ON MOTION BY HIGGINS SECOND BY BAZIL, THE APPEAL WAS OVERRULED AND APPROVAL OF USE PERMITS NO. 73-3, 73-5 AND 73-6 BY THE BOARD OF ZONING ADJUSTMENTS WAS SUSTAINED, SUBJECT TO THE FOLLOWING CONDI- TIONS, FOR THE FOLLOWING REASONS, BY THE FOLLOWING VOTE: Reasons _ 1. The request complies with the existing zoning and existing .ordinance requirements. 2. The amended plan is a better project than the original plan. Conditions of Approval: 1. The revised plan dated April 10, 1973 shall be the approved plan. 2. All applicable conditions previously imposed by the Board of Zoning Adjustments shall be complied with. AYES: Bazil, Kerins, Porter, Higgins NOES: Wallin ABSENT: Geiger, Boyle COMMISSIONER �HIGGINS EXCUSED Commissioner Higgins was excused by the Chairman and left the meeting at 11:20 P.M. ZONE CASE NO. 73-16 Applicant: Mobile Oil Corp. Zone Case No. 73-16 is a request for a change of zone from C4 Highway Commercial District to C4-SS Highway Commercial District Service Station Suffix on property located at the southwest corner of Beach Blvd. and Talbert Avenue. The property is master planned Commercial Retail. The Acting Secretary noted that the plot plan submitted does not conform to the intent of the Service Station Suffix, however a zone change cannot be conditioned if approved. The Chairman opened the public hearing on Zone Case No. 73-16. Mr. Don Robbins, Senior Real Estate Representative for Mobile Oil Company, addressed the Commission speaking in favor of the request. Mr. Robbins stated that Mobile Oil has been interested in the site for seven years but until now, the owner has been unable to deliver clear title. Mr. Robbins stated that marketing studies conducted by his company have established that the site is a good service station location. PC 6/19/73 Minutes: H. B. A MOTION WAS MADE BY KERINS SECOND BY WALLIN TO DENY ZONE CASE NO. 73-16 FOR THE FOLLOWING REASONS: 1. The change of zone would be detrimental to the public wlefare. by contributing to the energy crisis. 2. The change of zone would be detrimental to the public welfare by possibly creating another abandoned service station in the community. THE MOTION FAILED BY THE FOLLOWING VOTE: AYES: Kerins, Wallin, Porter NOES: Bazil ABSENT: Higgins, Boyle, Geiger Zone Case No. 73-16 will be placed on the agenda for the next regular Planning Commission meeting for action. CODE AMENDMENT NO. 73-16 Code Amendment No. 73-16 repeals Section 9203.4.1 and makes minor corrections to eliminate duplications and ambiguities to the R3 District and Service Station Standards. The Chairman opened the public hearing on Code Amendment No. 73-16. There being no one present to speak either for or against the proposed amendment, the Chairman closed the public hearing. The Acting Secretary stated that the City Attorney has advised that an Exemption Declaration is not required because of the minor nature of the changes. ON MOTION BY WALLIN SECOND BY KERINS, CODE AMENDMENT NO. 73-16 WAS APPROVED AS AMENDED BY THE FOLLOWING VOTE: AYES: Bazil, Kerins, Porter, Wallin NOES: None ABSENT: Geiger, Boyle, Higgins TENTATIVE TRACT NO. 7899 Subdivider: Godfrey and Associates, Inc. The Acting Secretary stated that the applicant has requested a modification of Condition of Approval No. 16 dated Sept. 6, 1972. PC 6/19/73 Minutes: H. B. Planning Commission Tuesday, June 19, 1973 Page 11 The condition was imposed initially because the staff was concerned that there was not sufficient control of the location of sewer and water systems. The City Engineer concurs with the proposed modi- fication of Condition No. 16. ON MOTION BY KERINS SECOND BY BAZIL, THE MODIFICATION OF CONDITION OF APPROVAL NO. 16 OF TENTATIVE TRACT NO. 7899 WAS APPROVED AS FOLLOWS, SUBJECT TO THE FOLLOWING CONDITION, BY THE FOLLOWING VOTE: 16. The sewer, water and fire hydrant systems shall be designed to city standards. Such system shall be constructed in the common area as shown on the sewer and water plan dated June 8, 1973, subject to the following conditions: a. Access to the manholes within the sewer line shall be provided upon the proposed sidewalks at a location between the private dirveways and the proposed location of manholes. The sidewalk section shall have a minimum width of eight feet. AYES: Kerins, Porter, Bazil, Wallin NOES: None ABSENT: Geiger, Boyle, Higgins CONDITIONAL EXCEPTION NO. 71-30 Applicant: William F. Perkes The Church of Jesus Christ of the Latter Day Saints The Acting Secretary stated that a two year review by the Planning Commission is required, pursuant to Conditions of Approval. Conditional Exception No. 71-30 permits the placement of a mobile classroom unit at 15761 Goldenwest Street, with a three year time limit. The Acting Secretary stated that the Church of Jesus Christ of the Latter Day Saints desires at this time, to use an existing residen- tial structure on the property for religious education purposes. The structure would be brought up to code. An interpretation is requested of the Planning Commission as to whether the proposed use comes under Unclassified Uses, and if so, the applicant should file application for a Conditional Use Permit. Mr. Carl Farnsworth, coordinator for LDS Church schools in the area, addressed the Commission explaining the request. Following discussion, it was the consensus of the Commission that the applicant should file application for a Conditional Use Permit, PC 6/19/73 Minutes: H. B. Planning Commission Tuesday, June 19, 1973 Page 12 COMMISSIONERS' COMMENTS Huntington Beach Trailer Supply 16242 Beach Blvd. Commissioner Wallin, referring to a June 16, 1973 Los Angeles Times article, stated that is appeared that major repair would be taking place, contrary to conditions of approval for minor repair only. Commissioner Wallin requested that a Certificate of Occupancy be withheld until written agreement is received guaranteeing compliance with conditions of approval. Board of Zoning Adjustments Members Commissioner Wallin requested members of the Board of Zoning Adjust- ments be present at the June 26, 1973 Planning Commission Study Session to discuss policies and possible proposed revisions to the ordinance code to facilitate processing of applications. Ocean View School District School Site No. 10, near Beach and Taylor ON MOTION BY WALLIN SECOND BY KERINS, STAFF WAS DIRECTED TO INITIATE A CHANGE OF ZONE TO M1 ON OCEAN VIEW SCHOOL SITE NO. 10, NEAR BEACH AND TAYLOR, AND TO SO INFORM THE OCEAN VIEW SCHOOL DISTRICT BOARD OF TRUSTEES AND SUPERINTENDENT, BY THE FOLLOWING VOTE: AYES: Bazil, Kerins, Porter, Wallin NOES: None ABSENT: Geiger, Boyle, Higgins Southern Pacific Railroad Right of Way Commissioner Bazil stated that it seemed appropriate to increase the width of the right of way when setting up a transportation corridor on the property, by possibly 15 ft. on each side. Commissioner Bazil requested this recommendation be forwarded to the Environmental Council and requested an opinion from the City Attorney on the legality of establishing a setback on the property and requiring dedication of 15 ft. of property on each side of the corridor as the property develops. Shopping Center - Northwest Corner Magnolia and Adams Commissioner Kerins noted that there is a strip of trashy land up the middle of the shopping center and requested staff to endeavor to have the area cleaned up as a condition of approval of any applications which have been or may be filed on the property.
