Stagliano The Acting Secretary stated that the applicant had requested a continuance for the purpose of pursuing revised plans or withdrawing the Administrative Review and Conditional Exception applications. Staff concurred with continuance. ON MOTION BY EADIE AND SECOND BY SPENCER ADMINISTRATIVE REVIEW NO. 73-92 AND CONDITIONAL EXCEPTION NO. 73-32 WERE CONTINUED TO JULY 11, 1973 BY THE FOLLOWING ROLL CALL VOTE: AYES: Spencer, Gerarden, Eadie NOES: None ABSENT: None REGULAR AGENDA ITEMS: ADMINISTRATIVE REVIEW NO. 73-59 Applicant: Mrs. Anna M. Andrade To permit the 24 hour care of six (6) non -related persons pursuant to S. 9730.27 of the Huntington Beach Ordinance Code located on the south side of Paddock Circle approximately 240 ft. east of Johnson,Lane in the R1 low density residential district. The hearing was opened to the public. Mrs.'Andrade, the applicant, was present. The Acting Secretary stated that the fire clearance had been completed and approved. It was found that a total of 9 persons occupied the dwelling, an excess of code allowances. It was noted that Mrs. Andrade's County License was in proper order. Mrs. Andrade requested time to discuss with her social worker the problem of giving up one non -related charge. Minutes: H.B. ON MOTION BY GERARDEN AND SECOND BY SPENCER ADMINISTRATIVE REVIEW NO. 73-59 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING ROLL CALL VOTE: 1. To permit the care of not to exceed five (5) non -related persons and at no time shall there be an aggregate total of more than eight (8) people residing on the premises. 2. -Subject to compliance with S. 9730.27 et seq of the Huntington Beach Ordinance Code. Zehnder To permit the, construction of a 7 unit apartment building pursuant to S. 9201.2 of the Huntington Beach Ordinance Code located on the east side of 21st St. approximately 75 ft. south of Pecan Ave. in an R3 medium high density residential district. Mr. Zehnder, the applicant, was present, and presented the Board with a revised plan. The Acting Secretary stated that the plan should have been submitted several days prior to meeting in order that a proper check could be made. The applicant con- curred with this comment. Mr. Robert Bailor, the applicant, was present, and presented a revised plan for consideration by the Board. There was discussion on the proposed display of recreational vehicles, the physical limitations of the property, and proper traffic site angles. ON MOTION BY EADIE AND SECOND BY GERARDEN CONDITIONAL EXCEPTION NO. 73-24 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING ROLL CALL VOTE: 1. Plot Plan as submitted June 27, 1973 shall be the precise plot plan, identifying the location of all vans over 6' in height. 2. Conditional Exception No. 73-24 is granted for the duration of this use only, and any variation shall deem this application null and void. And for the following reasons: 1. Encroachment does not interfere with safety vision. 2. Size of lot precludes placement of recreational vehicles to facilitate adequate circulation throughout project. 3. Not injurious to property in vicinity. AYES: Spencer, Gerarden, Eadie NOES: None ABSENT: None ADMINISTRATIVE REVIEW NO. 73-49 - Continued from 5/2/73 Applicant: Mrs. William M. Slevin To permit the construction of a five (5) unit apartment building pursuant to S. 9201.2 of the Huntington Beach Ordinance Code in the R3 medium high density residential district located on the northwest corner of 16th St. and Orange Avenue. Mr. Evola, project architect,representing the applicant, was present. There was a discussion of the plans and Mr. Gerarden stated that by definition of the Huntington Beach Ordinance Code the unit over the garage could not be considered an accessory building. It was suggested that Mr. Evola and the city staff meet to go over the plans and review the ordinance requirements of the R-3 district. AYES: Spencer, Eadie, Gerarden NOES: None ABSENT: None ADMINISTRATIVE REVIEW NO.,73-100 - Continued from 6/20/73 Applicant: Edward Chetakian To permit the construction of two (2) industrial buildings pursuant to S. 9511 of the Huntington Beach Ordinance Code located on the northwest corner of Research Dr. and Product Lane in a 100-M1-A-20,000 industrial district. Mr. Chetakian, applicant, was present as well as his rep- resentatives, Mr. Beaver and Mr. Kaplan. - The Acting Secretary stated -that there were some minor problems indicated in the plans, such as vehicle wheel bumpers not being 1 1 1 -4- 6/27/73 - BZA Minutes; H.B. There was a discussion on parking, at which time it was noted that approximately 40% of the overall floor areas were projected for storage use. It was noted that the applicant had submitted a Use Permit on a future agenda. Suggested conditions of approval were discussed. Mr. Gerarden stated that at no time could less than 40% of the building's total floor areas be used for purposes other than warehousing or storage as exemplified on the plot plan. The Acting Secretary stated that the Board's policy of allowing a maximum of 30% of an industrial building to be allocated as warehousing was not being complied with and that parking problems in the future may ensue. ON MOTION BY SPENCER AND SECOND BY GERARDEN ADMINISTRATIVE REVIEW NO. 73-100 WAS APPROVED WITH THE FOLLOWING CONDITIONS AND BY THE FOLLOWING ROLL CALL VOTE: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The revised plot plan received June 27, 1973 shall be the approved layout as amended. 2. A revised plot plan illustrating the amendments shall be submitted to the Board of Zoning Adjustments for approval action. Said plan shall indicate parking bumpers, trash areas, mounding of landscaping, 6 inch curbing around landscaping and shall show deletion of property line splitting property. 3. Research Drive and Product Lane shall be dedicated to City standards at the time each parcel is developed. 4. Elevations of the proposed plan shall be submitted to the Board of Zoning Adjustments for review and approval action. S. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 6. All buildings on lots abutting a City easement shall be set back (S) feet from the edge of such easement. 7. Soil and compaction reports as required by the Building Department and the Department of Public Works shall be submitted to the City. 8. Warehouse doors facing public right of way shall be subject to approval of a Use Permit application. B. TO BE COMPLETED PRIOR TO FRAMING INSPECTION: -5- 6/27/73 - BZA Minutes: H.B. A landscaping plan indicating berming treatment of setbacks shall be 'submitted to the Board of Zoning Adjustments for review and approval action. 2. Rooftop mechanical equipment shall be screened from view. Said screening plan shall be approved by the Board of Zoning Adjustments. 3. All signs for the proposed development shall be sub- mitted to the BZA for approval. Signs shall reflect a common theme with respect to design materials and colors which are compatible with the architectural theme of the proposed project. 4. Fire alarm system conduit and appurtenances shall be installed by the developer at locations and to speci- fications provided by the Fire Department. S. Parking compounds shall be screened with a combination of fencing and landscaping. Said plan shall be submitted to the Planning Department for review and approval. Fencing and landscape plans shall include the following information: a. A list including quantities and sizes for each species of plants and all ground cover material. b. Irrigation layout to include meter location, pipe sizes, sprinkler head types, etc. c. Fencing materials and detail drawing. 6. The structural street section of all private drives shall be approved by the Department of Public Works. C. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. Research Dr. $ Product Lane shall be fully improved including street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 2. All utilities shall be installed underground. 3. Off-street parking facilities shall conform to Article 979. 4. There shall be no fence, structure or landscaping constructed or maintained over 3 1/2 feet high within a 10 ft. by 10 ft. triangular area at the intersection .of driveways and streets or within a 25 ft. by 25 ft. triangular area at the intersection of streets. TO BE COMPLETED PRIOR TO ISSUANCE OF CERTIFICATE OF OCCUPANCY: 1. Water supply shall be through the City of Huntington Beach's water supply system. 2. Sewage disposal shall be through the City of Huntington Beach's sewage system. 3. Easements for utilities or walkways shall be provided to Department of Public Works standards. 4. The property shall participate in the local drainage assessment district. S. No structures other than those shown on the approved plot plan shall be constructed within the project. 6. All applicable City Ordinances shall be complied with. At no time shall less than 40% of the floor area be used for the purpose of warehousing. AYES: Spencer, Gerarden, Eadie NOES: None ABSENT: None EADIE: Consideration of allocation for warehousing in an industrial building over 301 may be valid thinking and that parking requirements for City may be too restrictive. Further study should be done. ADMINISTRATIVE REVIEW NO. 73-101 Applicant: Irving J. Snyder To permit the construction of an additional commercial building in an existing commercial center pursuant to S. 9430 of the ,Huntington Beach Ordinance Code and located on the northwest corner of Adams Ave. and Magnolia St. in a C2 community business district. Mr. Snyder, applicant, and Mr. Tidmus, representing applicant, were present. There was a discussion on property line discrepancies of the parcel map. It was noted that the revised plan indicated a continuation of planting along the Adams Street frontage to upgrade the site. The Board reviewed the suggested conditions of approval with the applicant. Signing was discussed and the applicant agreed to replace the existing Pacific Plaza pole sign with two monument I.D. signs to be located as specified -7- 6/27/73 - BZA Minutes: H.B. It was noted that due to discrepancies in the parcel map property lines that reciprocal parking, ingress and egress agreements be amended to include legal description of each parcel. It was stated that reciprocal easements for the entire shopping center would have,to be submitted to Planning Department prior to issuance of building permits. ON MOTION BY GERARDEN AND SECOND BY EADIE ADMINISTRATIVE REVIEW NO. 73-101 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING ROLL CALL VOTE: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The revised plot plan received June 25, 1973 shall be the approved layout. 2. Adams Ave. shall be dedicated to City standards at the time each parcel is developed. 3. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 4. Osmer To permit a 5 ft. encroachment into the required 15 ft. front yard setback in lieu of S. 9103.1 of the Huntington Beach Ordinance Code located on the southwest corner of Figoro Circle and Edgewater -Lane in an R1 low density residential district. Mr. and Mrs. Osmer, the applicants, were present. The hearing was opened to the public. There was a discussion on the plans. The applicants stated that they wished to add a pool to their yard and without approval for encroachment there would not be enough room to have a pool of adequate size. They stated that they felt it would upgrade the area. Mr. W. E. Harrison requested an explanation of plans. He ex- pressed doubt about the fence blocking view, but expressed no opposition after viewing the plans. The hearing was closed to the public. ON MOTION BY SPENCER AND SECOND BY GERARDEN CONDITIONAL EXCEPTION NO. 73-30 WAS APPROVED BY THE FOLLOWING ROLL CALL VOTE AND FOR THE FOLLOWING REASONS: AYES: Spencer, Gerarden, Eadie NOES: None ABSENT: None 1. Affords applicant more recreational open space. 2. Majority of lots do front on cul de sac streets. 3. Would not be detrimental to street scene and would be consistent with existing fences in area. 4. 15 ft: area is far enough from corner to not create sight angle problem. USE PERMIT NO. 73-42 Applicant: Occidental Petroleum Land and Development Corp. -10- 6/27/73 - BZA Minutes: H.B. Board of Zoning Adjustments Wednesday, June 27, 1973 Page 11 To permit the construction of a 8805 sq. ft. bank building pursuant to S. 9472 of the Huntington Beach Ordinance Code located on the southeast corner of Atlanta Ave. and Beach Blvd. in a C4 highway commercial district. The hearing was opened to the public. Mr. Earl Stump and Mr. Jerry Merfeld, representing the applicant, were present. The Board members disEussed the plans with applicant's representatives. There being no further comment from the audience, the hearing was closed to the public. Board discussion followed. It was noted that this project was previously approved under Use Permit No. 72-17 which had expired. ON MOTION BY EADIE AND -SECOND BY SPENCER USE PERMIT NO. 73-42 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING ROLL CALL VOTE: 1. All conditions of approval of Use Permit No. 72-17 shall be complied with. 2. Plot Plan received June 5, 1973 shall be the approved layout. 3. Signing shall be brought back to Board and common theme will be typified for entire center. AYES: Spencer, Eadie, Gerarden NOES: None ABSENT: None CONDITIONAL EXCEPTION NO. 73-28 Applicant: Thomas and Jean Whaling To permit a five (5) ft. encroachment into the required 15 ft. front yard setback in lieu of S. 9103.1 of the Huntington Beach Ordinance Code located on the northeast corner of Niantic Circle and Mistral Dr. in an R1 low density residential district. Mrs. Whaling, applicant, was present and addressed the Board. She stated that the existing layout does not provide enough space for plants, and that the existing wall destroys the looks of the house. Board of -Zoning Adjustments Wednesday, June 27, 1973 Page 12 ON MOTION BY SPENCER AND SECOND BY GERARDEN CONDITIONAL EXCEPTION NO. 73-28 WAS APPROVED WITH THE FOLLOWING CONDITION, FOR THE FOLLOWING RESONS, AND BY THE FOLLOWING ROLL CALL VOTE: Condition: Not to exceed a maximum encroachment of four(4) feet. Reasons: S. 9811.1.1 (a) That the granting of a Conditional Exception will not constitute a grant of special privilege inconsistent upon other properties in the vicinity and under an identical zone classification. (d) That the granting of a Conditional Exception will not be materially detrimental to the public welfare or injurious to property in the same zone classi- fication. AYES: Spencer, Gerarden NOES: None ABSTAIN: Eadie* ABSENT: None *For the reasons that another field investigation should be arranged to view adjacent properties. USE PERMIT NO. 73-45 Applicant: Michael J. Major To permit the construction of a 2100 sq. ft. building to be used as a service department for an existing auto retailer pursuant to S. 9472 of the Huntington Beach Ordinance Code lo- cated on the west side of Beach Blvd. approximately 1080 ft. south of Ellis in a C4 highway commercial district. In Conjunction With CONDITIONAL EXCEPTION NO. 73-29 Applicant: Michael J. Major To permit a 6 ft. encroachment into the required 10 ft. rear yard setback in lieu of S. 9471.4.1 of the Huntington Beach Ordinance Code. Mr. Major, the applicant, and Mr. Bellinger, representing the applicant, were present. The hearing was opened to the public. The Acting Secretary outlined the proposal-, Landscaping was discussed and applicant stated that they were over in landscape requirements. There was a discussion,on the sign which is 35' high. Applicant stated that it was recently installed at a cost of some $4,000 and was per code at time of installation. It was noted by the Board that the adjacent property to the west was proposed for zone change in conformance with City Master Plan. When the change becomes effective the 10' rear yard setback would not apply. ON MOTION BY GERARDEN AND SECOND BY SPENCER CONDITIONAL EXCEPTION NO. 73-29 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING ROLL CALL VOTE: 1. Conditional Exception No. 73-29 will become null and void unless Use Permit No. 73-45 is approved. And for the following reason: 1. 10' setback will not be required when the property to the west is rezoned to R5 as per Zone Change 73-8. 2. 9811.1.1 (a) That the granting of a Conditional Exception will not constitute a grant of special privilege inconsistent upon other properties in the vicinity and under an identical zone classification. 3. 9811.1.1 b That because of special circumstances applicable to the subject property, including size, shape, topography, location or surroundings, the strict application of the zoning ordinance is found to deprive the subject property - of privileges enjoyed by other properties in the vicinity and under identical zone classifications. 4. 9811.1.1 (c) That the granting of a Conditional Exception is necessary to preserve the enjoyment of one or more substantial property rights. S. 9811.1.1 (d) That the granting of a Conditional Exception will not be materially detrimental to the public welfare or injurious to property in the same zone classification.
