COMMISSIONERS ABSENT: Porter NOTE: A TAPE RECORDING OF THIS MEETING IS ON FILE IN THE, PLANNING DEPARTMENT OFFICE. ITEMS TO BE CONTINUED OR WITHDRAWN: Code Amendment No. 73-11 - Issuance of Permits The Acting Secretary requested that Code Amendment No. 73-11 be continued to a future meeting to allow further revision prior to Commission discussion. The Chairman so directed. REGULAR AGENDA ITEMS LAND USE IN THE TAYLOR AND BEACH BOULEVARD AREA Mr. Ed Selich, Planning Department, stated that with the recent decision of the Ocean View School District to declare the Taylor Drive school site (#10) surplus and the Planning Commission's instruction to initiate rezoning of the school and park site to Ml, further review is necessary since a portion of the area is not designated on the Master Plan of Land Use. Commissioner Bazil arrived and assumed his duties at 3:05 P.M. After reviewing two alternate land use proposals and configurations, the proposed plan recommended by the Recreation and Parks Commission, discussing access to industrial parcels and circulation and methods of minimizing adverse effects of industrial development adjacent to the park site and single family residential development, staff was directed to prepare in final form the necessary resolutions, code amendments and zone changes to implement a specific plan encompassing provisions of Alternate No. 2, including the cul-de- sacing of Taylor Avenue, Ml-A zoning with a setback to provide a landscaped buffer area, wall construction on the industrial property along Taylor with fencing on the property line between industrial parcels, and blank wall construction of industrial buildings abutting Taylor. 1 . Planning Commission Tuesday, July 10, 1973 Page 2 ON MOTION BY BOYLE SECOND BY HIGGINS, STAFF WAS DIRECTED TO SET THE MATTER FOR PUBLIC HEARING ON AUGUST 7, 1973, BY THE FOLLOWING VOTE: A ' YES: Kerins, Wallin, Boyle, Higgins, Bazil NOES: None ABSENT: Geiger, Porter Staff was directed to discuss the proposed cul-de-sacing of Taylor Avenue with residents in the area to explain the proposal prior to the public hearing and to inform the Recreation and Parks Commis- sion of the proposed specific plan of the area. RECREATIONAL TRAILS - PHASE I Mr. Ed Selich, Planning Department, stated that subsequent to the preliminary plan of the Trails Element being adopted by the Plan- ning Commission and City Council last year, the city applied for and received a Land and Water Conservation grant in the amount of $69,000 to be matched by city funds for development of the trails system. The Planning Department has been working with the Citizens' Recreational Trails Committee, Public Works Department, City Administrator's office and Recreation and Parks Department to develop the plan for Phase I implementation. Commissioner Geiger arrived at 3:30 P.M. and assumed his duties. The concepts of the primary and secondary bicycle trails were reviewed. Mrs. Margaret Carlberg, Mrs. McGreggor and another member of the Citizens Trails Committee discussed the plan. Vugraphs were shown and Commission discussion followed. Commissioner Bazil suggested adding a trail designation along the proposed transportation corridor on the Southern Pacific Right of Way. The Planning Commission concurred with the Phase I bicycle routes with the routes being set off from traffic lanes by Pox Dots preferably, or double yellow striping. It was,,the consensus of the Commission that maximum safety provisions for the first phase of the bicycle trails should take precedence over development of the second phase. The staff was directed to prepare cost esti- mates and drawings of Phase I development for Commission review prior to submission to the City Council. Relative to Phase II of the bicycle trails, the safety element of the first phase should take precedence over the development of the second phas - e. Commissioner Wallin suggested that a trail along I Heil Avenue be reflected by a broken line designation. Commissioner -2- PC 7/10/73 Minutes: H. B. Planning Commission Tuesday, July 10, 1973- Page 3 Bazil suggested dev elopment of the trail along Coast Highway between Lake Street and Warner Avenue be given highest priority in the second phase development. Chairman Kerins suggested allocation of funds for marking the major primary and secondary arterials throughout the whole city as first priority and suggested moving the trail designation from Edwards to Goldenwest Street and from Bushard Street to Brookhurst Street. There was discussion of the probability that development of a bicycle trail along Bolsa Chica Beach will be accomplished by the State as a part of the Bolsa Chica Beach improvement plan. The Commission reviewed the jogging trails and determined that they were satisfactory as proposed. With reference to the equestrian trail system, Mr. Selich stated that a policy should be established by the city with regard to horses. Until such a policy is established, effective planning for a trail system is not feasible. Commission discussion followed. Commissioner Boyle left the meeting. ON MOTION BY WALLIN SECOND BY BAZIL, STAFF WAS DIRECTED TO PREPARE A FEASIBILITY STUDY OF THE NEED FOR A CITY POLICY CONCERNING HORSES, THE NEED FOR HORSE TRAILS AND EQUESTRIAN TRAIL ROUTES, BY THE FOLLOWING VOTE: AYES: Bazil, Kerins, Wallin, Higgins, Geiger NOES: None ABSENT: Porter, Boyle ON MOTION BY HIGGINS SECOND BY WALLIN, STAFF WAS DIRECTED TO EVALUATE THE EXISTING EQUESTRIAL CROSSING AT GOLDENWEST STREET AND GARFIELD AVENUE TO EITHER REAFFIRM ITS BEING A PROPER LOCATION OR TO RECOMMEND AN ALTERNATE LOCATION, BY THE FOLLOWING VOTE: AYES: Bazil, Kerins, Wallin, Higgins, Geiger NOES: None ABSENT: Porter, Boyle SCIENTIFIC RESOURCES INVENTORY A written report was submitted to the Commission concerning comments and recommendations relative to the Scientific Resources Inventory. Planning Commission Tuesday, July 10, 1973 Page 4 Development Proposal Warner/Simms/Green Street Area The Acting Secretary, Jim Palin, stated that a number of requests have been received by the Planning Department and Environmental Review Board for residential development on the south side of Warneil Avenue between Simms and Green Streets. Many of these proposals would be located some distance away from an approved access and would be served only by private 20 foot easements. Because of the many problems in this area, guidance was requested by the staff concerning establishment of firm policies and possible formation of an assessment district in the area. Commission discussion followed and vugraphs were shown. Commission requested an interpretation from the City Attorney of "approved access" and an opinion as to the legality of a specific plan for the area to be submitted at the July 17, 1973 Planning Commission meeting. Code Amendment No. 73-9 Consolidated Apartment Standards Code Amendment No. 73-13 Apartment Density Reduction The Acting Secretary informed the Commission that the City Council referred Code Amendments 73-9 and 73-13 back to the Planning Commission pending review by -the Environmental Review Board. Because of such factors as the.tax base, reduction of open space, traffic and impact on schools, the Environmental Review Board has denied exemption -declarations on these two amendments and will require environmental reports (short form). Civic District Suffix on Arterials between'Civic Facilities The Acting Secretary, Jim Palin, reviewed previous Commission discussion relative to establishing a civic district suffix on arterials between civic facilities. Commission discussion.followed. Staff was directed to set the Civic District Suffix for public hearing before the Planning Commission on August 7, 1973.; COMMISSIONERS' COMMENTS Appeal Procedures The Planning Commission reviewed a memorandum from1ichard Harlow to the City Attorney's office outlining proposed amendments to the -4- PC 7/10/73 I Minutes: H. B.-Planning Commission Tuesday, July 10, 1973 Page 5 appeal provisions of the ordinance code and restatement of the purpose of the Administrative Review application. Commission comments on each item enumerated by Mr. Harlow were as follows: 1. All appeals shall be in writing and shall state the reasons for such appeal. Comment: Alright as proposed. 2. The amendment should also provide that the hearing on the appeal shall only apply to the points raised in such appeal. Comment: It was the consensus of the Commission that this was too restrictive; that cogent points may arise which should be considered during the appeal hearing. 3. The City Attorney's office shall review all appeals as to their legality. Comment: The Planning Commissi'&fi�_does not consider this an appropriate or feasible judgement by the City Attorney. The Planning Commission does agree that the City Attorney should review the appeal procedure as set forth in the ordinance code. 4. The Board of Zoning Adjustments decision on administrative appeal applications shall only be appealable by the applicant. Such appeal shall be made within three working days after such decision. 5. The purpose of the Administrative Review application is to provide a means whereby an applicant may ascertain the require- ments which may be imposed on a project by the city ordinances and/or specifications. The ordinance should be specific that uses considered under the Administrative Review application are permitted uses. Comments, Items 4 and S: The present procedure now in existence should be retained. The staff was directed to forward these comments to Mr. Harlow. South Coast Regional Commission Staff Meeting In response to a question by Commissioner Wallin, the Acting Secretary stated that a meeting has been scheduled and will include staff members from the other coastal cities and the County of Orange. Planning Commission Tuesday, July 10, 1973 Page 6 Top of Pier VTN Study Commissioner Wallin requested the Planning Director to update the Commission at the July 17, 1973 meeting on the recent agreement for a development plan by VTN. Tentative Tract No. 7771 Commissioner Wallin requested that all city departments be made aware of conditions of approval of Tentative Tract No. 7771 and that conditions of approval be strictly enforced. Farm Labor Camp In response to a question by Commissioner Wallin, the Acting Secretary stated,that the staff is awaiting a report from the State of California relative to the farm labor camps located within the city. When this report is received, the matter will be brought to the attention of the Planning Commission. State Beach Design Commission Commissioner Higgins reported on the formation of the State Beach Design Commission which has been formed for the purpose of cri- tiquing the State's development plans on Bolsa Chica Beach. The Commission was formed at the suggestion of the City Administrator with the cooperation of State Director of Beaches and Parks, Mr. William Penn Mott. Planning Commission Goals and Objectives Mid -Year Status Report In response to a question by Chairman Kerins, the Acting Secretary stated that the report will be submitted to the Commission on July 17, 1973.
