contained therein.
The Board reviewed the plans with applicant and discussed the
Conditions of Approval.
The public hearing was closed.
Further discussion ensued.
A MOTION WAS MADE BY GERARDEN TO DENY CONDITIONAL EXCEPTION 73-32
FOR THE FOLLOWING REASON:
1. Justifiable hardship not demonstrated.
2. Alignment of industrial buildings with that industrial park
area is in conflict with previously established policy of
City to provide 30 ft. separation between buildings.
THE MOTION FAILED FOR LACK OF A SECOND.
The Board discussed the plans with applicant and his representative
further.

1. The revised plot plan received July 30, 1973 shall be the
approved layout as amended.
2. A revised plot plan shall be submitted to the Board of
Zoning Adjustments for approval action. Said plan shall
indicate Lot 40 screening wall and 6" landscape curbing.
3. Research Drive shall be dedicated to City standards at
the time each parcel is developed.
4. Elevations of the proposed plan submitted July 30, 1973
to the Board of Zoning Adjustments for review and approval
action shall be the approved layout.
S. The water, sewer, and fire hydrant system shall be approved
by the Department of Public Works and Fire Department.

Department for review and approval action.
2. Rooftop mechanical equipment shall be screened from view.
Said screening plan shall be approved by the Board of
Zoning Adjustments.
3. All signs for the proposed development shall be submitted
to the BZA for approval. Signs shall reflect a common
theme with respect. to design materials and colors which
are compatible with the architectural theme of the
proposed project.
4. Fire alarm system conduit and appurtenances shall be
installed by the developer at locations and to specifica-
tions provided by the Fire Department.
5. Parking compounds shall be screened with a combination of
fencing and landscaping. Said plan shall be submitted to
the Planning Department for review and approval. Fencing
and landscape plans shall include the following information:

C. TO BE COMPLETED PRIOR TO FINAL INSPECTION:
1. Research Drive shall be fully improved including street
trees, street signs, street lights, fire hydrants,

2. All utilities shall be installed underground.
3. Off-street parking facilities shall conform to Article
979.
4. There shall be no fence, structure or landscaping
constructed or maintained over 3-1/2 ft. high within a
10 ft, by 10 ft. triangular area at the intersection of
driveways and streets or within a 25 ft. by 25 ft.

USE PERMIT NO. 73-29 - Continued from 7/25/73
Applicant: Harry L. Scholer
To permit the construction of a 66 unit apartment complex pursuant
to S. 9202.3.1.3 of the Huntington Beach Ordinance Code located
on the east side of Algonquin Street approximately 210 ft. north
of Warner Avenue in the R3 medium high density residential
district.
The Chairman opened the hearing to the public.
Mr. Scholer, applicant, and Mr. Bergh, his architect, were
present and addressed the Board.
The Acting Secretary stated that Exemption Declaration No. 73-49
had been approved July 10, 1973 with a stipulation that attention
should be directed to southerly driveway of project. The
Acting Secretary outlined the plan check. Parking was discussed
as well as the southerly driveway. Mr. Scholer in conjunction
with Mr. Bergh briefly described three alternate plans for the
project and outlined their reasons for preference of one under
consideration.
The Chairman closed the public hearing.
ON MOTION BY GERARDEN AND SECOND BY SPENCER USE PERMIT NO. 73-29
WAS APPROVED WITH THE FOLLOWING CONDITIONS AND BY THE FOLLOWING
VOTE:

Applicant: James A. Wilson
To permit the establishment of a furniture stripping business
and retail sales in an existing building pursuant to S. 9451
of the Huntington Beach Ordinance Code located on the east
side of Main St. approximately 125 ft. south of Orange Ave.
in a C3 general business district.
Mr. Bob Baker, partner of the applicant, and Ms. Doris Hicks,
owner of the building, were present.
Mr. Jim Gerspach, representative from the Huntington Beach
Fire Department, was present and addressed the Board, stating
that the chemicals to be used in furniture stripping process
were non-flammable and met with the approval of the Fire
Department. The Board noted that an Exemption Declaration
had been filed and withdrawn by the Environmental Review
Board because it was not necessary. Further Board discussion
followed.

The Acting Secretary stated that Exemption Declaration No. 73-126
had been approved July 31, 1973, with no stipulations. The Board
reviewed the plans with the applicant's representatives.

NO. 73-24 WAS APPROVED WITH THE FOLLOWING CONDITIONS AND BY THE

modifications to existing striping, - and to treatment

4. A masonry wall shall be constructed along south and east
property lines. The height of said wall shall be such
that the top will be six (6) feet above the highest
ground surface within twenty (20) feet of the common
property line. Except within the front and exterior
side yard setbacks, in which case the height of said
wall shall be reduced to 42 inches.
S. There shall be no fence, structure or landscaping
constructed or maintained over 311 feet high within a 10 ft.
by 10 ft. triangular area at the intersection of driveways
and streets or within a 25 ft. by 25 ft. triangular area
at the intersection of streets.
6. A lighting system shall be installed within the project
equal in illumination to lighting on public streets.
Lighting system shall be shielded to reflect away from
adjoining properties and streets.
D. TO BE COMPLETED PRIOR TO ISSUANCE OF CERTIFICATE OF OCCUPANCY:
1. Water supply shall be through the City of Huntington
Beach's water supply system.
2. Sewage disposal shall be through the City of Huntington

a CZ community business district.
The Chairman opened the hearing to the public.
Mr. Ball, the applicant, was present.
The Board discussed the plans with the applicant. Applicant
outlined the need for sight angle setback being waived.
There being no further discussion, the Chairman closed the
public hearing.
ON MOTION BY GERARDEN AND SECOND BY SPENCER CONDITIONAL
EXCEPTION NO. 73-38 WAS APPROVED WITH THE FOLLOWING CONDITIONS
AND BY THE FOLLOWING VOTE:
Plan received July 31, 1973 under Administrative Reveiw No. 73-113
shall be the approved layout for Walker and Lee Building with this
modification: No portion of building or column shall encroach
within 25 ft. of the Adams Ave, property line for the reason that
sight angle is not necessarily that appropriate to the shopping
center in this location.

The Board discussed the plans with applicant and inquired if
any speakers were to be used on the premises. Mr. Flaro
stated that he had no plans to use any speakers. Conditions of

3. Fire alarm system conduit and appurtenances shall be
installed by the developer at locations and to specifi-
cations provided by the Fire Department.
4. Beach Blvd. and Blaylock Ave. shall be fully improved
including street trees, street signs, street lights,
fire hydrants, sewer and water main extensions.

6. Off-street parking facilities shall conform to Article

Beach's water supply system.
9. Sewage disposal shall be through the City of Huntington
Beach's Sewage system.
10. Easements for utilities or walkways shall be provided
to Department of Public Works standards.
11. The property shall participate in the local drainage
assessment district.
12. No structures, other than those shown on the approved
plot plan, shall be,constructed within the project.
