Tentative Tract No. 7743 is a request for 16 lots, 15 units oft
2.616 acres. Use Permit No. 72-82 is a request to permit a planned
residential development.
The Acting Secretary stated that the City Council had adopted a
Resolution declaring the property surplus, and that the present
owner has the iirst right of refusal to purchase the surplus
property and that the most recent blue line elevations and plot
plan dated February 20, 1973 were on display for review by the
Commission.
Commissioner Porter contended that the 15 units were beyond the
intent of the planned development ordinance and would in fact
create R2 density on R1 property. He requested staff to attempt
to lay out a possible R1 subdivision on this property and inquired
how many units would be allowed. The Acting Secretary stated that
between 7 and 9 R1 lots could be layed out on the property.
Commissioner Porter stated that he did not feel more than 10 planned
developments should be allowed on the property.
Commissioner Wallin requestel that a plot plan be presented for
study and inquired what had transpired at subdivision meeting in
July. S
The Commission requested the Attorney's office to research the
need for deed restriction on the city surplus property.
It was the consensus of the Commissioners that revised maps be
presented for their review and that until further study of revised
maps could be made a continuance should be recommended.
Mr. Larry Redman, representative of the applicant, addressed the
Commission. He stated that he was not aware of staff's recommenda-
tions until today and that lie would be in favor of a continuance.
Commissioner Bazil concurred with applicant's request to a contin-
uance.

TENTATIVE TRACT NO. 5642
CONDITIONAL USE PERMIT NO. 73-02
Applicant: Toups Engineering Co.
Tentative Tract No. 5642.is a request to construct 69 units on 7
lots on 5.35 acres. Conditional Use Permit No. 73-02 is a request
to construct a 69 unit planned residential development on the
southwest t:orner of Garfield and 17th Street.
The Chairman opened the hearing to the public on Conditional Use
Permit No. 73-02.
The Acting Secretary outlined the study and recommendations of the
Subdivision Committee.
Commission discussion followed. Commissioner Geiger questioned
access to recreation area. Commissioner Wallin inquired if they
had tried other plans and would -they be willing to experiment
further, perhaps acquire adjoining property. Commissioner Bazil
discussed the garages. There was discussion on alley type design.
Mr. Gary Gibbs-, of the Presley Co., spoke in behalf 'of the project
indicating that the -odd shape of the lot had presented a problem
architecturally.
Mr. Gibbs stated that they would*be unable to acquire additional
adjoining property and that he would concur with Commission to a
continuance to allow additional time for revising plans to bring
them into conformance with Code requirements.
ON MOTION BY WALLIN AND SECOND BY BAZIL TENTATIVE TRACT NO. 5642
AND CONDITIONAL USE PERMIT NO. 73-02 WERE CONTINUED TO SEPTEMBER
5, 1973 BY THE FOLLOWING; ROLL CALL VOTE:

Commissioner Porter referred'to S. 9310.2 of the Ordinance Code
and stated that under conditions set forth therein the Planning

Tentative Tract No. 8367 is a request for a 7 lot subdivision on
7.17 acres of land located on the southwest corner of Ellis Avenue
and Huntington Street located in the M2 zone.
The Acting Secretary addressed the Commission and stated that he
had been unable to contact the developer concerning a continuance
to August 21, 1973 meeting.
Commissioner Kerins addressed Mr. Jim Chapman, representative from
Classic Development, and stated that the developer's request
for 30 day extension would expire August 20 and asked if representa-
tive would be agreeable to a continuance to August 21 meeting, and
the representative concurred with this continuance date.
ON MOTION BY WALLIN SECOND BY PORTER TENTATIVE TRACT NO. 8367 WAS
CONTINUED TO AUGUST 21, 1973 BY THE FOLLOWING ROLL CALL VOTE:

CONDITIONAL USE PERMIT NO. 73-01
Applicant: Rodney B. Lauter N
Conditional Use Permit No. 73-01 is a request to permit a 1/2 day
nursery school (pre-school) located -on the east side of Florida,
300 ft. south of Utica in a R2 medium density residential district.
The Chairman opened the hearing to the public.
Mr. Rodney B. Lauter, representative from the Evangelical Free
Church, spoke in behalf of the request. Mr. Granville, occupant
of surrounding property addressed the Commission, speaking in
favor of the project.
The Chairman closed the public hearing.
The Commission discussed the request and the recommended conditions
of approval.
ON MOTION BY BAZIL SECOND BY PORTER CONDITIONAL USE PERMIT NO.
73-01 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING
ROLL CALL VOTE:
1. The southerly driveway of the existing church facility shall
be increased to a width of 20 ft. to facilitate two way traffic.

2. The Plot Plan received June 20, 1973 shall be the approved
layout.
3:-' The number of children permitted shall not exceed the number
of children permitted by state regulations.
4. If at a future date it is determined that the combined
facilities exceed the parking allocation, additional parking
shall be required to be provided on site. The number and
location shall be determined by the Board of Zoning Adjust-
ments.
S. If a mutual driveway easement can be arranged over property
to the south of adequate width to servq parking facilities,
the northerly driveway shall be reverted back into landscaped
area.
AND FOR THE FOLLOWING REASONS:
1. The -proposed use will not be detrimental to the value of
property or improvements within the vicinity.
2. The proposed use` -shall not have an adverse effect on the
general health, welfare, -safety and convenience of the
neighborhood or the City as a whole.

Goldenwest Street in an R1 low density residential district.
The Acting Secretary presented Vugraphs of the proposed project.
The Chairman opened the hearing to the public.
Mr. Karl Farnsworth addressed the Commission as did Mr. Robert
Little, his architect.

Commissioner Porter opened the discussion concerning installation
of underground utilities, indicating the initial saving if instal-
lation were made prior to laying the sidewalks. There was a
discussion on using the City of Huntington Beach water supply and
sewers.
The Chairman closed the public hearing.
Commission discussion followed. Landscaping was discussed.
ON MOTION BY WALLIN SECOND BY PORTER CONDITIONAL USE PERMIT NO.
73-03 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING
ROLL CALL VOTE:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The plot plan received June 28, 1973 shall be the
approved layout.
2. Goldenwest Street shall be dedicated to City standards
at the time each parcel is developed.
3. The water, sewer, and fire hydrant'systen shall be
approved by the Department `of Public Works and Fire
Department.
4. All buildings on lots abutting a City easement shall be
set back five (S) feet from the edge of such easement.
S. Soil and compaction reports as required by the Building
Department and the Department of Public Works shall be
submitted to the City.
6. A Division of Land application, separating this parcel
from the remaining property held under the same owner-
ship, shall be approved by the City.

1. A landscaping plan shall be submitted to the Board of

Zone Case No. 73-18,is a request for a change of zone from RAO
Residential Agricultural District combined with oil production' to

Street, 445 ft. north of Garfield.
The Chairman opened the hearing to the public.
Mr. John Thomas, applicant, was present and addressed the '.
Commission.
When questioned about ownership indicated on plot plan as.being
in conflict'with;appl,ication, Mr. Thomas submitted to the Commis-
sion proof of ownership indicated on the Deed, in lieu of Letter
of Authorization.
Commissioner Bazil stated that he ;felt the entire block should be
rezoned and not just the small portion proposed by this request.
Commissioner, Wallin stated thai the -industrial study on-thisarea
had been tabled until -an analysis of revenue versgs,.expenditures
had been completed. The ,Planning Director stated that the Master
Plan study is in process and will not have 'results until around
October.

WRITTEN COMMUNICATIONS:
Commissioner Porter directed staff to draw up standard conditions
with regard to environmental Review Board recommendations on
tentative tract maps. He further directed staff to"revise PRD
density calculations of 10 acres or less. The City Attorney's
office was requested to determine if Commission -could condition
CC&R's. He also recommended the City adopt provisions requiring
permits for replacement of trees of certain diameter within the
City.
Commissioner Wallin recommended that Commission and staff attempt
to attend October 13 Seminar, ENERGY CRUNCH AND PUBLIC POLICY, at
the University of California Extension: Staff was requested to
present to Commission an R1 layout and copies of ED on Tentative
Tract 7743. She stated that she -would like better system of
finalizing conditions of approval such as these headings: PHYSICAL,
Trees..., BUILDING... Applicant should sign conditions of approval
with stipulation that if in violation there will be an immediate
STOP WORK ORDER prepared on project until such time as a public
hearing can be held. Commissioner Wallin requested a report on
Coastal Commission meeting held on July 27 concerning letters of
approval in concept and procedures.

CONDITIONS OF APPROVAL IN LOGICAL SEQUENCE WITIf ATTENTION TO PHYSICAL

Commissioner Geiger wants staff to provide information on Environ-
mental Review Board. He stated that Maureen Wild is working on
Transportation Plan and expects to have a complete plan the last
meeting in August which will include a detailed set of objectives
and recommended courses of action.

Commissioner Bazil stated that staff should prepare a new set of
conditions for adoption on September 11 meeting with backup infor-
mation'provided Planning Commission at that time.
Chairman Kerins requested that copy of agreement between the City
of Huntington Beach and VTN be furnished Commissioners. He noted
that there had been undue absenteeism on part of the Commissioners
at recent Subdivision Committee Meetings.
STAFF COMMENTS:
The Acting Secretary reviewed action of City Council meeting held
July 6, 1973, and set Subdivision Committee meeting for Friday
August 17 at 9:00 A.M.
