PROPOSED CODE AMENDMENT NO. 73-15 (Third Draft)
AMENDMENTS TO THE PLANNED RESIDENTIAL ORDINANCE ARTICLE 931
The Acting Secretary reviewed the staff's recommendations on
Code Amendment No. 73-15 and a possible density reduction within
Planned Developments with the Commission.
Commissioner Porter stated that a developer of a planned develop-
ment can get sixteen units on a 2.5 (gross) acre parcel which
allows an increase of 221 over net acres of the parcel. He
further stated that the "intent" of Article 931 should be reworded
such that a developer is put on notice that in all planned. develop=
ments less than 10 acres, the maximum density may not be allowed
per gross area. ,
The Acting Secretary stated that when Article 931 was being
adopted by the City there was discussion of limiting the size
of planned development to not less than 10 acres but that this
provision was not written into the ordinance because it was felt
that the Commission had sufficient controls and the developer
would have to thoroughly justify a planned development of less
than 10 acres.
Commissioner Bazil discussed gross acreageand net acreage,
indicating the added expense to a developer of a corner lot insofar
as expense of both streets are concerned.
The Planning Director stated that when the Ordinance was prepared
there had been discussion on minimum acreage size, but after
studying some of the smaller units (28 units on 4 acres, for
instance) there didn't seem to be any problems. He stated that
the idea of minimum size restrictions had been discarded if the
facility was well designed. He pointed out that the Planning
Commission does have control over problem parcels, and that it
was his opinion that the City would be better off with Planned
Developments than standard subdivisions.

The Commissioners at this time entered into discussion and
revisions of Proposed Code Amendment No. 73-15 (Third Draft)
which may be generally referred to as "UPDATE P.R.D. ORDINANCE."
There was a discussion on page 1, S..'9310.7, and it was the
consensus of the Commission that it should be eliminated from
the ordinance entirely.
On page 2, line 13 there was a discussion on the use of the
words "open space" and the City Attorney's office representative,
John O'Connor, suggested the word "Area" be substituted for
open space. The Commission concurred with this suggestion.
Commissioner Kerins asked for a definition of "common open
space" and the Acting Secretary indicated that open space
indicates property owned under joint tenancy.
There was a discussion on page 3, lines 8 and 16. It was the
consensus of the Commission that the word "dwelling" should
be deleted from both lines and "other than carports and garages"
substituted.
There was a discussion of ALTERNATE A and ALTERNATE B on page
4. The Acting Secretary stated that that staff would recommend
endorsement of ALTERNATE B over ALTERNATE A, and that the
City Attorney's office had worked with staff in writing
ALTERNATE B. The Planning Director stated that over 90% of
projects would be'much better with flexibility offered in
ALTERNATE B.
Commissioners Kerins and Geiger preferred Alternate A while
Commissioners Higgins, Bazil and Porter preferred Alternate B.
Staff was directed by Chairman Kerins to rewrite Alternate B,
page 4 of 9, and stated that it was not ready for public
hearing. There was a discussion on S. 9310.15.1 (a), (b), (c)-
and (d), page 2 and page 3, and staff was directed to work on
rewording.
Commissioner Porter requested that Commissioners be furnished
with reasons for approval of Conditional Exception No. 73-31
by the Board of Zoning Adjustments in their August 21, 1973
packet.
Carl Duncai, Fire Marshal, introduced Mr. Andy Vanderloaan who
will.be replacing Marshal Duncan in representing the"Fire
Department at the Planning Commission meetins.
The Chairman stated that due to lack of time the Arterial
Highway Landscape Designs presentation would be continued
to August 21, 1973 regular meeting.
