BOARD MEMBERS PRESENT: Eadie, Leyva, Gerarden BOARD MEMBERS ABSENT: None REGULAR AGENDA ITEMS: ADMINISTRATIVE REVIEW NO. 73-125 Applicant: Richard Spencer To permit the construction of a 2-story, 11,000 sq. ft. profes- sional building pursuant to S. 9401 of the Huntington Beach Ordinance Code, located on the south side of Warner Avenue approximately 750 ft. east of Bolsa Chica Road in an R5 Office - Professional District. Richard Spencer, applicant, was present. The Acting Secretary stated that Exemption Declaration No. 73-138 had been approved by the Environmental Review Board. The revised plans were reviewed, at which time parking revisions, driveway widths, and berm planting were discussed. The Board reviewed the conditions of approval with the applicant. ON MOTION BY GERARDWN AND SECOND BY EADIE ADMINISTRATIVE REVIEW NO. 73-125 WAS APPROVED WITH THE FOLLOWING CONDITIONS AND BY THE FOLLOWING ROLL CALL VOTE: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The revised plot plan received August 15, 1973, shall be the approved layout as amended. 2. Warner Avenue and Leslie Avenue shall be dedicated to City standards at the time each parcel is developed. 3. Elevations of the proposed plan shall be submitted to the Board of Zoning Adjustments for review and approval action. 4. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 5. A landscaping plan shall be submitted to the Planning Depart- ment for review and approval action. 2. Rooftop mechanical equipment shall be screened from view. Said screening plan shall be approved by the Board of Zoning Adjustments. 3. All signs for the Proposed Development shall be submitted to the BZA for approval. Signs shall reflect a common theme with respect to design materials and colors which are compatible with the architectural theme of the proposed project. 4. Fire alarm system conduit and appurtenances shall be installed by the developer at locations and to specifica- tions provided by the Fire Department. 5. Parking compounds .shall be screended with a combination of fencing and landscaping. Said plan shall be submitted to the Planning Department for review and approval. Fencing and landscape plans shall include the following information: a. A list including quantities and sizes for each species of plants and all ground cover material. b. Irrigation layout to include meter location, pipe sizes, sprinkler head types, etc. c. Fencing materials and detail drawing. C. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. Warner and Leslie Avenues shall be fully improved including street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 2. All utilities shall be installed underground. 3. Off-street parking facilities shall conform to Article 979. 4. There shall be no fence, structure or landscaping constructed or maintained over 3-1/2 feet high within a 10 ft. by 10 ft. triangular area at the intersection of driveways and streets or within a 25 ft. by 25 ft. triangular area at the inter- section of streets. Easements for utilities or walkways shall be provided to Department of Public Works standards. 4. The property shall participate in the local drainage assessment district. 5. AYES: Gerarden, Leyva, Eadie NOES: None ABSENT: None USE PERMIT NO. 73-58 Applicant: Mountjoy Construction Company To. -permit the construction of an 11,960 sq. ft. retail commercial building pursuant to S. 9472 of the Huntington Beach Ordinance Code, located at the southeast corner of Edinger and Gothard in a C4-Highway Commercial District. Mr. Mountjoy, applicant, was present. The Acting Secretary reported that Exemption Declaration No. 73-147 had been approved by the Environmetnal Review Board on August 7, 1973, with the stipulation to the BZA regarding onsite circulation between the front and rear parking lots. Chairman Gerarden opened the hearing to the public. Mr. Mountjoy indicated his desire to withdraw his revised plans and have the Board consider the original plans as submitted; he stated his company's intention to use the rear lot only for deliveries and employee parking. The parking, landscaping, and signing of the project were discussed. The Secretary was instructed to add to the Conditions of Approval the stipulation that the square footage of the sign existing on this property shall be subtracted from the allowable sign area permitted within the setbacks for this property. Other conditions of approval were discussed. As there were no further parties present to speak in favor of or in opposition to Use Permit No. 73-58, the hearing was closed to the public. 3. TO BE5COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The revised plot plan received July 17, 1973; shall be the approved layout as amended. 2. Gothard Avenue and Edinger Avenue shall be dedicated to City standards at the time each parcel is developed. 3. Leyva stated that his reason for voting no was the lack of satisfactory circulation between the front and rear parking lots in light of the possibility of future changes in use for the project. DIVISION OF LAND NO. 73-22 Applicant: Lander Engineering To permit the division of one (1) parcel of land into two (2) parcels pursuant to S. 9811.2 of the Huntington Beach Ordinance Code, located on the south side of Warner Avenue approximately 519 ft. west of Goldenwest Street in a C2 Community Business District. Robert Johnson, representing Santa Anita Development Corpora- tion, was present to represent the applicant. The Acting Secretary stated that the Environmental Review Board had approved this project on Exemption Declaration No. 73-90. Chairman Gerarden opened the hearing before the Board. The Board discussed with the applicant proposed restrictions on the signing of the parcels, and the conditions of approval. The hearing was closed. ON MOTION BY EADIE AND SECOND BY GERARDEN DIVISION OF LAND NO. 73-22 WAS APPROVED WITH THE FOLLOWING CONDITIONS AND BY THE FOLLOWING ROLL CALL VOTE: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The parcel map received August 1, 1973, shall be the approved layout. 2. Warner Avenue shall be dedicated to City standards at the time each parcel is developed. 3. Division of Land shall not be effective until a covenant and agreement is signed agreeing to the conditions of approval. 4. Reciprocal easements for ingress -egress and parking agreements shall be submitted to the City; form and content of these agreements shall be approved by the City Attorney. B. TO BE COMPLETED PRIOR TO FRAMING INSPECTION: 1. A Parcel Map and the Covenant and Agreement shall be filed with the City and recorded prior to framing inspection of any structures on any parcel. Ross, Jr. To permit the construction of a single family dwelling pursuant to S. 9161.•2 of the Huntingotn Beach Ordinance Code, located on the west side of 16th Street approximately 125 ft. north of Acacia Street in an R2 Medium -Density Residential District. Mr. Jim Van Der Hyden, representing the builders, was present. The Acting Secretary reported that this project was exempt from Environmental Review requirements. The applicant stated that the lot number as indicated on the plans should be Lot 11 instead of Lot 9. The Board discussed the conditions of approval with the applicant, and requested him to submit a copy of elevations for the project to the Planning Depart- ment files. ON MOTION BY GERARDEN AND SECOND BY LEYVA ADMINISTRATIVE REVIEW NO. 73-135 WAS APPROVED WITH THE FOLLOWING CONDITIONS AND BY THE FOLLOWING ROLL CALL VOTE: 7. BZA 8/15/73 Minutes: H.B. Liles To permit a 6 ft. high block wall to encroach 7 ft. 6 in. into the 15 ft. required front yard setback in lieu of S. 9103.1 and S. 9104 of the Huntington Beach Ordinance Code, located on the south side of Scenic Bay Lane approximately 60 ft. east of Island Bay in an Rl low density residential district. Mrs. Liles, the applicant, was present, together with "a neighbor, Mrs. Kathryn Allis, of 6811 Scenic Bay. Chairman Gerarden opened the hearing to the public. Mrs. Liles explained her reasons for requesting the Conditional Exception and presented letters from neighbors supporting her position. Mrs. Allis said that she felt the wall would enhance the neighborhood. The Board discussed the criteria for approval of a Conditional Exception and the application of those criteria to the present case. As there were no further parties to speak in favor of or in opposition to the request, the hearing was closed. Board discussion followed. ON MOTION BY LEYVA AND SECOND BY GERARDEN CONDITIONAL EXCEPTION NO. 73-41 WAS CONDITIONALLY APPROVED WITH FINDINGS BY THE FOLLOWING ROLL CALL VOTE: Approval carries the condition that an offset be provided in the wall adjacent to the adjoining driveway, as well as any accommoda- tions necessary to salvage the existing tree on the property. Further, that no construction on the wall shall be commenced until the location of the front yard tree is cleared by the super- visor of the Street Tree Section of the Department of Public Works. 1. This request will not grant a special privilege. 2. The granting will not be detrimental to neighborhood. 3. Approval grants parity with existing subdivision and will not be detrimental to the street scene. AYES: Leyva, Gerarden NOES: Eadie ABSENT: None 9. BZA 8/15/73 Minutes: H. B. John Grey, architect representing the O.K. Earl Corporation, was present. The Board discussed with the applicant the width and alignment of the stalls for the drive -up windows, access to the bank from the street, and on -site traffic circulation; also discussed were the conditions of approval. Larrance To permit the establishment of a display and office facilities pursuant to S. 9451 of the Huntington Beach Ordinance Code, located on the east side of Main Street approximately 125 ft. north of Pacific Coast Highway in a C3 general business district. The Acting Secretary stated that this application was exempt from Environmental Review requirements. The Board discussed the change of occupancy of the building and the conditions of approval. ON MOTION BY GERARDEN AND SECOND BY EADIE ADMINISTRATIVE REVIEW NO. 73-136 WAS APPROVED WITH THE FOLLOWING CONDITIONS AND BY THE FOLLOWING ROLL CALL VOTE: 1. No occupancy shall be permitted until a Certificate (or a Conditional Certificate) of Occupancy has been issued. 2. The inspection of this building relative to enforcement of the provisions of the Dangerous Building Code may be requested by the building owner at this time or waived with the understanding that any improvements made to the building or its premises may be nullified by the future inspection BZA' -8/15/73 12.
