To permit the phasing of improvements for an existing non- conforming use to comply with requirements of the Huntington Beach Ordinance Code located on the east side of Gothard Street approximately 270 feet south of Talbert Avenue in an M1-CD Industrial District. The Acting Secretary stated that this proposal shall be continued pending further clarification to the Environmental Review Board regarding open space calculation and the specific assignments on the surplus tandem parking spaces. Holden To permit a 9 ft. encroachment into the required 10 ft. exterior side yard setback in lieu of S. 9103.2.2 of the Huntington Beach Ordinance Code located on the southeast corner of Rainier Circle and Interior Lane in an R-1, low density residential district. The Chairman opened the hearing to the public. Mrs. Holden, wife of the applicant, was present. Richard Peters of 2857 W. The Chairman reviewed the criteria necessary for the granting of this request with the applicant and her representatives. The size of pool in the yard requires that the gazebo be closer to the fence than normally. Placing it elsewhere would obstruct view and eliminate sunshine. Applicant does not feel that granting of Conditional Exception would constitute a grant of special privilege inconsistent with normal limitations. The granting of this conditional exception would constitute enjoyment of existing property rights and improve the beauty of the yard. The Chairman closed the public hearing. Board discussion followed. ON MOTION BY GERARDEN AND SECOND BY EADIE CONDITIONAL EXCEPTION NO. 73-43 WAS DENIED FOR THE FOLLOWING REASONS.AND BY THE FOLLOWING VOTE: 1. Applicant had failed to demonstrate justifiable hardship. 2. Granting of the Conditional Exception would constitute a special privilege to the property. 3. The location of this structure is not necessary to preserve or enjoy a substantial property right. ON MOTION BY GERARDEN AND SECOND BY EADIE, ADMINISTRATIVE REVIEW NO. 73-139 WAS APPROVED WITH THE FOLLOWING CONDITIONS AND BY THE FOLLOWING VOTE: TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The plot plan received August 8, 1973, shall be the approved layout as amended to show a 25' turning radius required from the alley. 2. Twenty-first Street and the alley shall be dedicated'to City standards at the time each parcel is developed. 3. Elevations of the proposed plan shall be submitted to the Board of Zoning Adjustments for review and approval action. 4. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 5. All buildings on lots abutting a City easement shall be set back five (5) feet from the edge of such easement. 6.
