Mr. Lichten, 15571 Placid Lane, Huntington beach, spoke in favor of the proposal. The Board discussed the existing wall with the applicant and his representative. ON MOTION BY GERARDEN AND SECOND BY EADIE CONDITIONAL EXCEPTION NO. 73-42 WAS DENIED FOR THE FOLLOWING REASONS AND BY THE FOLLOWING VOTE: 1. The applicant failed to demonstrate a justifiable hardship. 2. The granting of this Conditional Exception would constitute a special privilege inconsistant with other properties in the area. 3. The Conditional Exception would not meet criteria outlined in S.9811.1.1 (b) of the Huntington Beach Ordinance Code. Michelle To permit the construction of an eleven (11) unit apartment building pursuant to S.9162.3.1 of the Huntington Beach Ordinance Code located on the southwest corner of 19th Street and Acacia Avenue in an R-2, Medium Density Residential District. The Chairman opened the hearing to the public. Mr. George R. Michelle, the applicant, was present. The Board reviewed the recommendations of the Environmental Review Board with the applicant. The Board discussed the plans with the applicant and stated that prior to final approval, the developer shall be required to install full insulation of the northern walls of the northern units with 4 inch mineral batt insulation or 2 inch fiberglass batts with foil backing, as a mitigating measure for noise reduction as recommended by the Environmental Review Board. The hearing was closed to the public. The conditions of approval were discussed. ON MOTION BY GERARDEN AND SECOND BY EADIE, USE PERMIT NO. 73-60 WAS APPROVED WITH THE FOLLOWING CONDITIONS, AND BY THE FOLLOWING VOTE: Minutes: H.B. Board of Zoning Adjustments Wednesday, August 29, 1973 Page 4 GENERAL: The development shall conform with the mitigating recommendations of the Environmental Review Board as modified and adopted by the Board as follows: Exemption Declaration No. 73-158 1. The developer shall be required to insulate the northern walls of the northerly units with 4 inch thick mineral batt or 2 inch thick fiberglass batts with foil backing. A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The revised plot plan received August 22, 1973 shall be the approved layout. 2. 19th Street, Acacia Avenue, and alley shall be dedicated to City standards at the time each parcel is developed. 3. Elevations of the proposed plan submitted to the Board of Zoning Adjustments for review and approval action August 29, 1973 shall be the approved layout. 4. The water, sewer and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 5. All buildings on lots abutting a City easement shall be set back five (5) feet from the edge of such easement. 6. Soil and compaction reports as required by the Building Department and the Department of Public Works shall be submitted to the City.- B. TO BE COMPLETED PRIOR TO FRAMING INSPECTION:. 1. All signs for the Proposed Development shall be submitted to the BZA for approval. Signs shall reflect a common theme with respect to design materials and colors which are compatible with the architectural theme of the proposed project. 2. Fire alarm system conduit and appurtenances shall be installed by the developer at locations and to specifi- cations provided by the Fire Department. C. D. TO BE COMPLETED PRIOR TO ISSUANCE OF CERTIFICATE OF OCCUPANCY: 1. Water supply shall be through the City of Huntington Beach's water supply system. 2. Sewage disposal shall be through the City of Huntington Beach's sewage system. 3. Easements for utilities or walkways shall be provided to Department of Public Works standards. 4. The property shall participate in the local drainage assessment district. S. No structures, other than those shown on the approved plot plan, shall be constructed within the project. 6. Wiede To permit the addition of a garage on a lot with non -conforming side yard pursuant to S.9719 of the Huntington Beach Ordinance Code located on the west side of Florida Street approximately 55 feet north -of Joliet Avenue in an R-2, Medium Density Residential District. The Chairman opened the hearing to the public. Mr. Jack D. Wiede, the applicant, was present. The conditions of approval were discussed by the Board members and the applicant. In addition to conditions outlined below, prior to -issuance of a Building Permit, a Division of Land shall be filed with and approved by the City of Huntington Beach to consolidate the lots. The plot plan received August 7, 1973 shall be the approved layout as amended. 2. Florida Street and alley shall be dedicated to City standards at the time each parcel is developed. 3. Elevations of the proposed plan shall be submitted to the Board of Zoning Adjustments for review and approval action. 4. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. S. Mr. Donner, and Mr. Russel representing E1 Don Development, Inc. were present. The Board discussed the revised plan with applicant and conditions of approval were discussed. ON MOTION BY GERARDEN AND SECOND BY EADIE ADMINISTRATIVE REVIEW NO. 73-150 WAS APPROVED WITH THE FOLLOWING CONDITIONS AND BY THE FOLLOWING VOTE: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The plot plan received August 17, 1973 shall be the approved layout as amended. 2. A revised Plot Plan shall be submitted to the Planning Department for Approval Action showing the following: Relocation of trash to parking space 4 which shall be omitted, 25 ft. turning radius from alley shall be shown.
