Gerarden, Leyva, Eadie None DIVISION OF LAND NO. 73-26 Applicant: 'King of Glory Lutheran Church To permit the division of one parcel of land into two parcels pursuant to S.9811.3 of the Huntington Beach Ordinance Code located on the west side of Newland Street approximately 960 feet north of Talbert Avenue in an R-2, medium density residential district. Pastor Anderson, the applicant, and Mr. Charles Ferguson, Realtor, representing the applicant, were present. The Acting Secretary reported that the applicant's Exemption Declaration No. 73-167 was approved by the Environmental Review Board on September 4, 1973 with the following recom- mendations to mitigate environmental impact. 1. That the Board of Zoning Adjustments pay specific attention to the number of curb cuts on Newland Avenue within that quarter section and analyze thoroughly the access to the property as proposed. 2. Under no case should the Division of Land be approved until a development plan has been filed to make deter- mination where the primary access will occur. A MOTION BY GERARDEN TO DENY DIVISION OF LAND NO. 73-26 FAILED TO PASS The Acting Secretary stated that a continuance would be in order to allow the applicant time to submit a revised plan to show 60 ft. frontage to Newland and submit a proposed development plan. The Acting Secretary stated that a continuance is in order due to the Environmental Review Board's denial of Exemption Declaration No. 73-168 and that the Environmental Review Board further requires an Environmental Impact Report due to insufficient information having been provided on tree removal. The applicant concurred with the requested con- tinuance. ON MOTION BY GERARDEN AND SECOND BY EADIE, ADMINISTRATIVE REVIEW NO. 73-137 WAS CONTINUED TO OCTOBER 3, 1973 BY THE FOLLOWING VOTE: AYES: Gerarden, Leyva, Eadie NOES: None ABSENT:' None USE PERMIT NO. 73-66 Applicant: Richard L. Lindgren To permit an addition of a room to an existing residence with a non -conforming side yard pursuant to S.9719 of the Huntington Beach Ordinance Code located on the east side of England Street approximately 80 feet south of Lincoln Avenue in an R-2 medium density residential district. The Chairman opened the hearing to the public. Mr. Richard Lindgren, and Mr. Morris Lindgren, representing the applicant, were present. The Acting Secretary outlined the proposal and stated that applicant was exempt from Environmental Review Board require- ments. Board discussion followed. It was the concensus of the Board that a one week continuance was in order to allow the staff to gather more information regarding this application.- The applicant concurred with the continuance. Mr. Tupman, representing the applicant, was present. The Acting Secretary outlined the proposal and stated that the application was exempt from Environmental Review Board requirements. The Chairman opened the hearing before the Board. The proposal was discussed with the applicant. The Chairman stated that he felt the proposal was not in keeping with the intent of S.9106.2.1.1 of the Huntington Beach Ordinance Code. Further discussion•followed. It was the Board's consensus that a continuance was in order to allow time for Staff to meet with the applicant for further discussion. The applicant concurred with continuance. Research Drive shall be dedicated to City standards at the time each parcel is developed. 3. Division of Land shall not be effective until a covenant and agreement is signed agreeing to the conditions of approval. B. TO BE COMPLETED PRIOR TO FRAMING INSPECTION: 1. The Acting Secretary outlined the proposal and stated that applicant was exempt from Environmental Review Board requirements. Board discussion followed: The public hearing was closed. It was the consensus of the Board to advise the applicant to withdraw his application as he has not demonstrated specific ' hardship to warrant a Conditional Exception. I Mr. Paul R. Hickey, the applicant, requested that his Conditional 1 Exception be withdrawn. CONDITIONAL EXCEPTION NO. 73-46 Applicant: Robert Brown To permit a 3 ft. encroachment into the required 10 ft. rear yard setback in lieu of S.9103.3 of the Huntington Beach Ordinance Code located on the southeast end of DeLong Circle approximately 390 ft. south of Price Drive. Mrs. Brown, wife of the applicant, was present. The Acting Secretary outlined the proposal and stated that applicant was exempt from Environmental Review Board requirements. ON MOTION BY EADIE AND SECOND BY GERARDEN CONDITIONAL EXCEPTION NO. 73-46 WAS DENIED FOR THE FOLLOWING REASONS AND BY THE FOLLOWING VOTE: 1. Applicant failed to justify hardship. 2. The existing floor plan lends itself to a logical layout for a living unit and the proposed addition would not require an encroachment. 3. The granting of this Conditional Exception would constitute a special privilege inconsistent with those properties in the immediate vicinity. The applicant was not present. The Chairman opened the hearing to the public. The Acting Secretary outlined the proposal and stated that applicant was exempt from Environmental Review Board re- quirements. Board discussion followed. The Chairman closed the public hearing. ON MOTION BY GERARDEN AND SECOND BY LEYVA, USE PERMIT NO. 73-64 WAS APPROVED WITH THE FOLLOWING CONDITIONS AND BY THE FOLLOWING VOTE: 1. Alley Right -Of -Way shall be dedicated to the City of "Huntington Beach prior to issuance of Building Permits. 2'. The Plot Plan received August 8, 1973 shall be the approved layout. And for the, following reasons: 1. The Use Permit would not be detrimental to the general welfare'of persons residing or working in the vicinity. 2. The proposal would not be injurous to properties and improvements to the vicinity of such use. Downs To permit the construction of a 4,000 sq. ft. professional office building pursuant to S.9401 of the Huntington Beach Ordinance Code located on the south side of Warner Avenue approximately 500 ft. east of Bolsa Chica in an R5, office - professional district. Board discussion followed. ON MOTION BY GERARDEN AND SECOND BY EADIE, ADMINISTRATIVE REVIEW NO. 73-148 WAS APPROVED WITH THE FOLLOWING CONDITIONS AND BY THE FOLLOWING VOTE: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The plot plan received 8-13-73 shall be the approved layout. 2. A revised Plot Plan shall be submitted to the Board of Zoning Adjustments for Approval Action. Said plan shall add parking bumpers, screening walls, trash area, 6" concrete curbing, and said plan shall contain an irrigation system. 3. Warner Avenue shall be dedicated to City standards at the time each parcel is developed. 4. Elevations of the proposed plan submitted to the Planning Department for review and approval action. 5. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 6. All buildings on lots abutting a City easement shall be set back five (5) feet from the edge of such easement. 7. Soil and compaction reports as required by the Building Department and the Department of Public Works shall be submitted to the City. B. TO BE COMPLETED PRIOR TO FRAMING INSPECTION: 1. A landscaping plan shall be submitted to the Planning Department for review and approval action. 2. Rooftop mechanical equipment shall be screened from view. Said screening plan shall be approved by the. Board of Zoning Adjustments. 3. All signs for the Proposed Development shall be sub- mitted to the BZA for approval. Signs shall reflect a common theme with.respect to desigq materials and colors which are compatible with the architectural theme of the proposed project. 4. Fire alarm system conduit and appurtenances shall be installed by the developer at locations and to speci- fications provided by the Fire Department. Minutes: H.B. Said plan shall be sub- mitted to the Planning Department for review and approval. Fencing and landscape plans shall include the following information: a. A list including quantities and sizes for each species of plants and all ground cover material.. b. Irrigation layout to include meter location, pipe sizes, sprinkler head types, etc. C. Fencing materials and detail drawing. 6. The structural street section of all private drives shall be approved by the Department of Public Works. C. TO BE -COMPLETED PRIOR TO FINAL INSPECTION: 1. Warner Avenue shall be fully improved including street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 2. All utilities shall be installed underground. 3. Off-street parking facilities shall conform to Article 979. 4. There shall be no fence, structure or landscaping con- structed or maintained over 3 1/2 feet high within a 10 ft. by 10 ft. triangular area at the intersection of driveways and streets or within a 25 ft. by 25 ft. triangular, area at the intersection of streets. ON MOTION BY EADIE AND SECOND BY GERARDEN, ADMINISTRATIVE REVIEW NO. 73-165-A WAS APPROVED WITH THE FOLLOWING CONDITIONS AND BY THE FOLLOWING VOTE: 1. Applicant shall comply with 5.9730.17 of the Huntington Beach Ordinance Code. 2. The Plot Plan received August 20, 1973 shall be the approved layout., 3. All applicable City Ordinances shall be complied with. 4. The temporary sales office shall be located as per the approved plot plan subject to on -site inspection by the Building Department. 5. The Administrative Review is approved for a period of three (3) months at which time the temporary sales office shall be relocated to the recreation building on Gumtree Lane. The revised plot plan received 8-28-73 shall be the approved layout. 2. A revised Plot Plan shall be submitted to the Board of Zoning Adjustments for Approval Action. Said plan shall indicate an 18 ft. wide drive access, 28 ft. turning radius and relocation of trash area. 3. Florida Street shall be dedicated to City standards at the time each parcel is developed. 4. Soap Box Derby - YMCA to be held Saturday, September 8, 1973 from 9:00 A.M. to 12:00 Noon on Ellis between Goldenwest and Edwards. The Board reviewed and approved said event with the following suggested conditions of approval. 1. On -site supervision by YMCA personnel. 2. Traffic barriers and site layout shall be subject to on -site inspection by the Huntington Beach Police Department. Minutes: H.B. Board of Zoning Adjustments Wednesday, September 5, 1973 Page 14 Applicant: FOUNTAIN VALLEY YMCA INDIAN GUIDES The Acting Secretary presented a request for a special hermit through the City Administrator's Office which has been submitted to the Board of Zoning Adjustments for comment and review. Turkey Shoot - F.V. YMCA to be held Sunday, November 18, 1973 at the Robinwood Little League Field. The Board reviewed and approved said event with the following suggested conditions of approval. 1. There shall be on -site supervision by YMCA personnel and by a member of the Huntington Beach Police Department. SIGNS: Applicant: Kaufman & Broad The Acting Secretary presented a proposal to erect a sub- division directional sign to be located within the sub- division located at approximately 300 ft. north of Talbert on the west side of Newland. Sign is 15' in height Total of 60 Sq. Ft. The Board noted that location and copy conform to Article 976 of the Huntington Beach Ordinance Code, and that sub- division directional sign is to be located within the subdivision.
