CONDITIONAL USE PERMIT NO. 73-07 Conditional Use Permit No. 73-07 was continued to October 2, 1973 at the request of the applicant. CONDITIONAL USE PERMIT NO. 73-05 Conditional Use Permit No. 73-05 was continued to October 16, 1973 at the request of the applicant. SPECIFIC PLAN NO. 73-1 $ ZONE CHANGE NO. 73-21 Specific Plan No. 73-1 and Zone Change No. 73-21 were continued to October 2, 1973, at request.of staff. Use.Permit No. 72-82 is a request to permit 13 unit planned residential development located west of Marina View Drive north of Los Patos and southeast of Warner. Minutes: H. B. Commission discussion followed. ON MOTION BY WALLIN SECOND BY BAZIL TENTATIVE TRACT NO. 7743 AND USE - PERMIT NO. 72-82 WERE CONTINUED TO OCTOBER 16, 1973, WITH A RECOMMENDATION THAT A SUBDIVISION COMMITTEE REVIEW TAKE PLACE ON ANY REVISED PLANS BY THE FOLLOWING VOTE: AYES: Geiger, Bazil, Higgins, Kerins, Wallin, Boyle, Porter NOES: None ABSENT: None ZONE CASE NO. 73-18 (Cont. 9/5/73) Applicant: -Linda L. Thomas Zone Case No. 73-18 is a request to change from RAO Residential Agricultural District combined with oil production to MI -A Restricted Manufacturing located on the east side of Goldenwest Street from north of Garfield Avenue to Ernest Avenue. The Acting Secretary reviewed the plot plan and vugraphs with the Commission. The Chairman opened the public hearing. Linda and John A. Thomas addressed the Commission. Mr. Thomas stated that he planned to improve the property for an equipment yard and put a block wall on Goldenwest. There being no one further to speak for or against the applications, the Chairman closed the public hearing. Commission discussion followed concerning adding the CD suffix to this zone change. As the previous zone change was not effective at this time it was Mr. O'Conner's opinion that the CD'suffix should be included. Chairman Kerins turned the Chair over to Vice Chairman Higgins and stated that he would be abstaining from discussion and action on Conditional Use Permit No. 73-06. CONDITIONAL USE PERMIT NO. 73-06 Applicant: Douglas Realty Co., Inc. Conditional Use Permit No. 73-06 is a request to permit an agricultural use in the MI -A zone located on the northwest corner of Bolsa Avenue and Springdale Street. Vice Chairman Biggins opened the public hearing. There being no one present to speak for or against the Conditional Use Permit No. 73-06, the public hearing was closed. Commission discussion followed. ON MOTION BY GEIGER SECOND BY BAZIL CONDITIONAL USE PERMIT NO. 73-06 WAS APPROVED TO INCLUDE RECOMMENDATIONS OF THE ENVIRONMENTAL REVIEW BOARD WITH THE FOLLOWING CONDITION AND BY THE FOLLOWING VOTE: 1. That the applicant be required to conduct watering -down operations on the property sometime before initiation of plowing, to reduce dust. 2. That no plowing operations be done on windy days. (Definition on "windy"'to be wind velocities in excess of 15 knots.) 3. That planting take place immediately after plowing (within a period of two weeks). FOR THE FOLLOWING REASONS: 1. The use will not be injurious or detrimental to the health, welfare, and general safety of the neighboring property. 2. Idle uncultivated land will be put into food production. 3. Open space will be preserved. AYES: Geiger, Bazil, Higgins, Wallin, Boyle, Porter NOES: None ABSTAIN: Kerins ABSENT: None CODE AMENDMENT NO. 73-20 DRAFT #2 as amended by Planning Conutlssion- at a previous meeting. This Code Amendment No. 73-20 is for retail food services in M17A ' zone. The Chairman opened .the hearing to the public. Minutes: H. B. Planning Commission Tuesday, September 18, 1973 Page 4 Mr. Charles Puccio addressed the Commission stating that he had sent two letters to Commission and that a rendering was on display for their viewing. There being no further comments and no one else present to speak on the Code Amendment, the hearing was closed to the public. Commission discussion followed. Signing was discussed. Mr. John O'Conner, representing the Attorney's office, added item (4) to the second draft to read as follows: "On -site signs shall be approved by the Planning Commission at the time of issuance of the Conditional Use Permit, shall comply with provisions of Article 976, and such additional conditions upon on -site signs as necessary to render such signs compatible with existing architecture." ON MOTION BY BAZIL SECOND -BY BOYLE CODE AMENDMENT NO. 73-20 WAS APPROVED AS AMENDED BY THE FOLLOWING ROLL CALL VOTE: AYES: Geiger, Bazil, Higgins, Kerins, Wallin, Boyle, Porter :NOES: None ABSENT: None STATUS REPORT OF LAND USE EDP SYSTEM Mr. Ken Reynolds, Planning Director, stated there -would be a full report in two.weeks. - DISCUSSION - Status Report on short forms EIR on Code Amendment No. 73-9 and Code,Amendment No. 73-13 (Apartment standards and density). The Acting Secretary stated that the Planning Department is in receipt of the proposed new state guidelines which may allow a much shorter form EIR to be prepared on these code amendments when there is no construction involved in the project. MISCELLANEOUS Review revised plans - Standard Plan 709 Tentative Tract No. 7692 Commission and staff reviewed the rendering of proposed fencing for the Cul-de-sac. Commission discussion followed. Planning Commission Tuesday, September 18, 1973 Page 5 0'J MOTION 13Y PORTER SECOND BY HIGGINS REVISED PLANS WERE APPROVED AS AMENDED FOR TENTATIVE TRACT NO. 7692 BY TILL FOLLOWING VOTE: AYES: Geiger, Bazil, Higgins, Kerins, Wallin, Boyle, Porter NOES: None ABSENT: None WRITTEN COMMUNICATIONS Letter from Cameo Homes regarding planning of property•located, between Goldenwest Street and Edwards Street and Garfield to the south and Schleicher to thernrth was discussed. A letter from County of Orange concerning Zone Change 73-25 was discussed. It stated that a petition had been filed with County of Orange Planning Commission office requesting that the property located on the southerly side of Pacific Coast Highway between 4th and Sth Streets in the Sunset Beach area is identified by a map which was attached. Mr. Ken Reynolds, Planning Director, stated that a copy of the general plan and zoning would be obtained from the County for the October 2 meeting. Orange County Planning Department indicated that all recommendations regarding the zone change should be received by October 6, 1973. COMMISSIONERS' COMMENTS Commission discussed the property presently undeveloped adjacent to Westminster which is the site of the proposed freeway. It was the consensus that a study should be made toward rezoning and land usage in order that a developer would be aware of such information before embarking upon a project. Commission discussed the Westminster Mall and the staff was. directed to send a letter to the Planning Commission of Westminster with a carbon copy to Environmental Survey,I nc., outlining the inadequacies of the report, such as landscaping, buffers, traffic, building locations, etc. Commissioner Wallin requested staff to prepare a list of other agencies required to review an EIR. The Acting Secretary stated that we will be amending the Ordinance Code and existing resolutions to. establish procedures by resolution. The wording on pages 12 and 5 of the revised State Guidelines of Environmental Resource Agency were directed to staff's attention. Staff was directed to establish sequence of permit applications for an applicant. Minutes: H. B. Planning Commission Tuesday, September 18, 1973 Page 6 Commissioner Kerins brought to the Commission's and staff's attention Senate Bill 268 which is pending before Congress and concerns land use with certain funds to be provided to City local jurisdiction the expenditure of these funds. He requested staff and Commission to keep abreast of this bill. Commissioner Porter noted that there would be a study on Conservation of Energy at Riverside on October 1 and 2 and that he planned to attend.
