The Acting Secretary stated that Exemption Declaration No. 73-178 has not been approved by the Environmental Review Board for the following reasons: The Environmental Review Board requires that the applicant provide the ERB with a recordable document signed by the owner of the property concerning the use of the two parking spaces to be leased from the Laundromat. This document shall be binding on the property. The Chairman opened the public hearing. Mr. Wallenfang, representing the applicant, was present. The Acting Secretary informed the Board that the Environmental Review Board approved Exemption Declaration No. 73-161 on September 4, 1973 with no stipulations. The Board reviewed the proposed development with the applicant. The Chairman asked if any parties were present to speak in favor or in opposition to the application. As there were no parties present to speak in opposition to Use Permit No. 73-62 the Chairman closed the public hearing. Conditions of approval were discussed. ON MOTION BY GERARDEN AND SECOND BY SPENCER USE PERMIT NO. 73-62 WAS APPROVED WITH THE FOLLOWING CONDITIONS AND BY THE FOLLOWING VOTE: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The revised plot plan received August 31, 1973 shall be the approved layout. Minutes: H.B. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 5. All buildings on lots abutting a City easement shall be set back five (5) feet from the edge of such easement. 6. Soil and compaction reports as required by the Building Department and the Department of Public Works shall be _submitted to the City. B. TO BE COMPLETED PRIOR TO FRAMING INSPECTION: 1. Fire alarm system conduit and appurtenances shall be installed by the developer at locations and to specifications provided by the Fire Department. C. The property shall participate in the local drainage•'assessment district. 5. No structures, other than those shown on the approved plot plan,.shall be constructed within the project. 6. Zinngrabe To permit the construction of 158 Room, 200 Bed retirement resident care facilities, pursuant to S.9401 of the Huntington Beach Ordinance Code located on the east side of Florida Street approximately 725 ft. south of Main Street in an R-5, office professional district. In Conjunction With: CONDITIONAL EXCEPTION NO. 73-50 Applicant: Robert J. Zinngrabe To permit a reduction in the required parking spaces for a retirement resident care facility in lieu of S.9793.3 (c) of the Huntington,Beach Ordinance Code located on the east side of Florida Street approximately 640 ft. south of Main Street in an R-5, office professional district. Mr. Bob Zinngrabe, the applicant, and Mr. J. Wallace, representing .the applicant, were present. The Acting Secretary stated that Exemption Declaration No. 73-32 had been approved by the Environmental Review Board on Tuesday, May 1, 1973 with no stipulations. The Deputy Fire Marshall was present to state recommendations on the proposed -project. He felt that there was a lack of access to the property. He further stated that a minimum of 20 ft..access to the property should be provided. Further discussion followed. It was the consensus of,the Board to continue this application to allow the applicant time to meet with the Fire Department regarding access to the property. The applicant concurred with continuance. ON -MOTION BY GERARDEN AND SECOND BY SPENCER, ADMINISTRATIVE REVIEW NO. 73-130 WAS CONTINUED TO OCTOBER 10, 1973 BY THE FOLLOWING VOTE: AYES: Gerarden, Spencer, Eadie NOES:- None ABSENT: None Minutes: H.B. Board of Zoning Adjustments Wednesday, September 19, 1973 Page 6 The Chairmain opened the public hearing on Conditional Exception No. 73-50. The Board reviewed the proposed application with the applicant and his representative. Related parking lots in the vacinity were discussed. The number of staff working on the premises versus number of parking spaces were discussed. The Chairman asked if any further parties were present to speak in favor or in opposition of Conditional Exception No. 73-50. As there were no further parties present to address Conditional Exception No. 73-50, the Chairman closed the public hearing. ON MOTION BY EADIE-AND SECOND BY SPENCER, CONDITIONAL EXCEPTION NO. 73-50 WAS APPROVED FOR THE FOLLOWING REASONS AND, BY THE FOLLOWING VOTE: 1. Parking regulations contained in Article 979 do not relate to the nature of this use, thus posing a hardship. 2. Nature of use is a special circumstance where no applicable code provision exists. 3. Will not be detrimental to health and welfare of surrounding properties. 11 4. Granting of Conditional Exception is necessary as the use is not in need of a multitude of parking. 5. It is not adverse to master plan. AYES: Gerarden, Spencer, Eadie NOES: None ABSENT: None CONDITIONAL EXCEPTION NO. 73-48 Applicant: First Western Bank To permit an encroachment into the required setback for a proposed sign in lieu of S.9763.3 (a) of the Huntington Beach Ordinance Code located on the north side of Warner Avenue, approximately 200 yards west of Golden West Street. Mr. Briesemeister of Heath & Co., representing the applicant, Mr. James Freeman, of First Western Bank, and Mr. Heynes, Accounting Manager.of First Western Bank were present. The Acting Secretary informed the Board that this application was exempt from Environmental Review Board requirements. The Chairman opened the vublic hearing. Minutes: H.B. The Board suggested deleting one parking space adjacent to the sign, extending the landscaping and placing the sign further to the cast to meet code requirements. The applicant felt that if pole sign were to be located somewhere else, it would take away parking facilities, also it would not look good anywhere else. The Board noted that deletion of parking space would not make the parking requirement below code standards. The Chairman asked if any further parties were present to speak in favor or in opposition of Conditional Exception No. 73-48. Mr. Dave Kirschner of Paul Jones Realty spoke out in favor of the application and stated that he did not feel that there will be any congestion of signs in that area. He further stated that the nearest sign was 300 ft. to the west. As there were no further parties present to speak in favor or opposition to Conditional Exception No. 73-48. the Chairman closed the public hearing. Board discussion followed. ON MOTION BY GERARDEN AND SECOND BY SPENCER CONDITIONAL EXCEPTION NO. 73-48 WAS DENIED FOR THE FOLLOWING REASONS AND BY THE FOLLOWING VOTE: 1. Applicant failed to demonstrate justifiable hardship. 2. Granting of this Conditional Exception would constitute a special privilege. AYES: Gerarden, Spencer Eadie NOES: None ABSENT: None CONDITIONAL EXCEPTION NO. 73-49 Applicant: Lester L. Blanchard To permit an encroachment into the required interior side yard in lieu of S.9103.2.1 of the Huntington Beach Ordinance'Code located on the northwestern side of Niantic Circle, approximately 385 ft. west of Mistral Drive in an R-1, low density residential district. Mr. Lester L. Blanchard, the applicant, and Mr. McGloukin, Supt. Contractor, representing the applicant, was present. The Acting Secretary informed the Board that this application was exempt from Environmental Review Board requirements. The Chairman opened the public hearing. The Board reviewed the proposed application with the applicant and his representative. The applicant pointed out that they actually only need 12 inches of encroachment. The applicant poiiitvd out his justifications why he should be granted this conditional exception as follows: Minutes: H.B. If a Conditional Exception is not granted, there would be a 250 ft. walk to get to the handball court. In the case of rain, there is no shelter, and applicant must walk through the rain to get to handball court. He further stated that he would not be able to enjoy his property adequately. Mr. Blanchard pointed out that they had spent over $2,000.00 on the property to make it look nice to the community and to themselves. The Chairman asked if any parties were present to speak in favor or in opposition of Conditional Exception No. 73-49. The Acting Secretary stated that a letter from Mr. William Dalton, neighbor, speaking in favor of the application be entered in the record. As there were no further parties present to speak in favor or opposition to Conditional Exception No. 73-49, the Chairman closed the public hearing. Board discussion followed. ON MOTION BY SPENCER AND SECOND BY EADIE, CONDITIONAL EXCEPTION NO. 73-49 WAS APPROVED FOR THE FOLLOWING REASONS AND BY THE FOLLOWING VOTE. 1. The stairway is minimal and connects to existing balcony. 2. The Conditional Exception is not detrimental to the general welfare of the neighborhood. 3. The Conditional Exception is not contrary to the Master Plan. AYES: Gerarden, Spencer, Eadie NOES: None ABSENT: None USE PERMIT NO. 73-69 Applicant: Shing Ching Chan To permit the construction and operation of a Chinese Restaurant and Bar pursuant to S.9472.1 of the Huntington Beach Ordinance Code located on the west side of Beach Blvd., approximately 490 ft. north of Slater Avenue in a C-4, highway commercial district. Air. Dave Kirchner, agent for Mr. Chan, the applicant, was present. The Acting Secretary informed the Board that the applicant's Exemption Declaration No. 73-179 was approved on Tuesday, September, llth, 1973 by the Environmental Review Board with no stipulations. The Chairman pointed out that the sign to be erected on the property is not a part of the approval of this project. The Chairman asked if any parties were present to speak in*favor or in opposition of Use Permit No. 73-69. As there were no further parties present to speak in favor or opposition to Use Permit No. 73-69, the Chairman closed the public hearing. Board discussion followed. Conditions of Approval were discussed. ON MOTION BY GERARDEN AND SECOND BY SPENCER, USE PERMIT NO. 73-69 WAS APPROVED FOR THE FOLLOWING REASON AND WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: REASONS FOR APPROVAL: 1. As outlined in 5.9811.2 of the Huntington Beach Ordinance Code. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The revised plot plan received August 24, 1973 shall be the approved layout as amended. 2. Beach Boulevard shall be dedicated to City and State standards at the time each parcel is developed. 3. Elevations of the proposed plan shall be submitted to the Board of Zoning Adjustments for review and approval action. 4. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. S. Fire alarm system conduit and appurtenances shall be installed by the developer at locations and to specifications provided by the Fire Department. S.- Parking compounds shall be screened with a combination of fencing and landscaping. Said plan shall be submitted to the Planning Department for review and approval. Fencing and landscape plans shall include the following information: a. A list including quantities and sizes for each species of plants and all ground cover material. b. Irrigation layout to include meter location, pipe sizes, sprinkler head types, etc. C. Fencing materials and detail drawing. k C. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. Beach Boulevard shall be fully improved including street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 2. All utilities shall be installed underground. 3. Off-street parking facilities shall conform to Article 979. 4. A masonry wall shall be constructed along west property line. The height of said wall shall be such that the top will be six (6) feet above the highest ground surface within twenty (20) feet of the common property line. S. A lighting system shall be installed within the project equal in illumination to lighting on public streets. Lighting system shall be shielded to reflect away from adjoining properties and streets. D. TO BE COMPLETED PRIOR TO ISSUANCE OF CERTIFICATE OF OCCUPANCY: 1. Water supply shall be through the City of Huntington Beach's water supply system. 2. Sewage disposal shall be through the City of Huntington Beach's sewage system. 3. Easements for utilities or walkways shall be provided to Department of Public Works standards. Minutes: H.B. Heise To permit a 6 ft. high fence to encroach 616" into the required 15 ft. front yard setback in lieu of S. 9104 of the Huntington Beach Ordinance Code located on the north side of Lawn Haven Drive, approximately 300 ft. west of Beacon Hill Lane in an R-1, low density residential district. Mr. Heise, the applicant, was present. The Acting Secretary informed the Board.that-this application was exempt from Environmental Review Board requirements. The Chairman opened the public hearing. The Board reviewed the proposed application with the applicant. Mr. Heise outlined his justifications why a conditional exception should be granted; he wishes to establish parity with neighbors. Mr. Heise submitted several photographs which he took,showing the front walls on several houses in the neighborhood. He further stated that on certain houses in this development the developer provided front walls. The Chairman asked if any parties were present to speak in favor or in opposition of Conditional Exception No. 73-.51. As there were no further parties present to speak in favor or opposition to Conditional Exception No. 73-51, the Chairman closed the public hearing. Board discussion followed. Board of Zoning Adjustments Wednesday, September 19, 1973 Page 12 ON MOTION BY GERARDEN AND SECOND BY SPENCER, CONDITIONAL EXCEPTION NO. 73-51 WAS APPROVED WITH THE FOLLOWING CONDITIONS AND FOR THE FOLLOWING REASONS BY THE FOLLOWING VOTE: Conditions of Approval: 1. Materials and design on the plot plan received August 29, 1973 shall be the precise layout. 2. Area in front of the wall shall be landscaped with living plants. Reasons for Approval: 1. The granting of this Conditional Exception will grant parity of the majority of the homes on this street. 2. The granting of this Conditional Exception will not be detrimental to the neighborhood and the vicinity. 3. The granting of this Conditional Exception does not constitute special privilege to this property. AYES: Gerarden, Spencer, Eadie NOES: None ABSENT: None USE -PERMIT NO. 73-68 Applicant: Al Persico To permit the establishment of a Pizza Parlour pursuant to S. 9472.1 of the Huntington Beach Ordinance Code located on the northwest corner of Beach Blvd. and Joliet Avenue in a C-4 highway commercial district. Mr. -Al Perisco, applicant, and Mr. and Mrs. Wechsler,.owners of the property, representing the applicant, were present. The Acting Secretary informed the Board that this application was exempt°from Environmental Review Board requirements. The Chairman opened the public hearing. The Board reviewed the proposed application with the applicant and his representatives. Mr. Wechsler informed the Board that this was to be a take out pizza parlour only and that there shall be no further signs along Beach Blvd. The Chairman asked if any parties were present to speak in favor or in opposition of Use Permit No. 73-68. As there were no further parties present to speak in favor or opposition to Conditional Exception No. 73-51, the Chairman closed the public hearing. 11 1 Minutes: H.B. ON MOTION BY GERARDEN AND SECOND BY SPENCER, USE PERMIT NO. 73-68 WAS APPROVED FOR THE FOLLOWING REASON AND WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: Reason for Approval: 1. As outlined in S. 9811.2 of the Huntington Beach Ordinance Code. Conditions of Approval: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The revised plot plan received August 4, 1973 shall be the approved layout as amended thereon. 2. Beach Blvd. and Joliet Avenue shall be dedicated to City and State standards at the time each parcel is developed. B. TO BE COMPLETED PRIOR TO ISSUANCE OF CERTIFICATE OF OCCUPANCY: 1. A landscaping plan shall be submitted to the Planning Department for review and approval action. 2. Rooftop mechanical equipment shall be screened from view. Stoddard To permit a proposed pole sign to exceed the maximum permitted height in lieu of S. 9764.3.2 of the Huntington Beach Ordinance Code located on the east side of Beach Blvd., approximately 150 ft. north of Stark St., in a C2, community business district. Mr. Jim Gianni, Project Coordinator for Stoddard, the applicant, was present. The Acting Secretary informed the Board that this application was exempt from Environmental Review Board requirements. The Chairman opened the public hearing. Minutes: H.B. Board of Zoning Adjustments Wednesday, September 19, 1973 Page 14 The Board reviewed the proposed application with the applicant's representative. -Mr. Gianni was then asked to state his justifications as to why he felt a conditional exception should be granted. Mr. Gianni pointed out that the building itself is of a heavy wood renaissance nature. There are eight or nine restaurants in existance in California with an identical sign as the one proposed. He feels that people relate this establishment with the proposed sign. If sign must be made smaller, it would not be in proportion with building. The sign is designed to hang from something, therefore, the structure portion is the only thing above the size. The Chairman asked if any parties were present to speak in favor or in opposition to Conditional Exception No. 73-52. Mr. Briesemeister of Heath Sign Co. spoke out in favor of the proposed sign. As there were no further parties present to speak in favor or opposition to Conditional Exception No. 73-51, the Chairman closed the public hearing. Board discussion followed. ON MOTION BY GERARDEN AND SECOND BY EADIE, CONDITIONAL EXCEPTION NO. 73-52 WAS DENIED FOR THE FOLLOWING REASONS AND BY THE FOLLOWING VOTE: 1. Granting of this Conditional Exception would constitute a special privilege to the property. 2. Applicant is able to meet the ordinance code. 3. Applicant failed to meet justifiable hardship.
