Moore & Wilford-S. Lalk To permit the construction of a 7-Eleven Food Store pursuant to 5.9451 of the Huntington Beach Ordinance Code located on the southwest corner of 5th Street and Lake Street in a C-3, general business district. Mr. Max G. Moore, applicant, was present. Also, Mr. Wallace of the Huntington Beach Company, land owner, was present. The Acting Secretary outlined that The Environmental Review Board approved Exemption Declaration No. 73-168 Sept. 25, 1973 with the following stipulation; the landscaping shall be increased and rearrangement of parking layout to provide better circulation, etc. Mr. Wallace and Mr. Moore concurred with the ERB's recommendation of increasing landscaping along 5th Street. Mr. Jack Wallace, representing the applicant, was present. The Acting Secretary outlined that the Environmental Review Board's action of approval of Exemption Declaration No. 73-160 on August 21, 1973 with the following stipulation; The Environmental Review Board recommended that the Board 'of Zoning Adjustments pursue complete compliance with all aspects of the code regarding temporary parking facilities. The Board discussed the revised plan and temporary commercial parking lot regulations with the applicant. Other conditions of approval were discussed. ON MOTION BY GERARDEN AND SECOND BY SPENCER ADMINISTRATIVE REVIEW NO. 73-123 WAS APPROVED WITH THE FOLLOWING CONDITIONS AND BY THE FOLLOWING VOTE: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The revised plot plan received 10/2/73 shall be the approved layout. 2. Lake Street shall be dedicated to City standards at the time each parcel is developed. 3. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. B. TO BE COMPLETED PRIOR TO FRAMING INSPECTION: 1. The Board discussed plans with applicant. Trash bin location, and landscaping were discussed. The Fire Department Representative expressed concern about what type of building material to be used in the spray paint area and the fire prevention precautions to be taken within the storage area. ,Conditions of approval were discussed. ON MOTION BY GERARDEN AND SECOND BY EADIE ADMINISTRATIVE REVIEW NO. 73-168 WAS APPROVED WITH THE FOLLOWING CONDITIONS AND BY THE FOLLOWING VOTE: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The revised plot plan received 10/1/73 shall be the approved layout as amended. 2. A revised Plot Plan shall be submitted to the Board of Zoning Adjustments for Approval Action. Said plan shall delineate: a. A 16' setback for the building in order to meet minimum 6 percent landscaping. b. Overhead door on Southeast corner of building shall be eliminated in order to provide for accessible parking. c. Wheel bumpers shall be shown. 3. Commerce Lane shall be dedicated to City standards at the time each parcel is developed. 4. Elevations of the proposed plan received 8/29/73 shall be the approved layout. 5. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 6. Soil and compaction reports as required by the Building Department and the Department of Public Works shall be submitted to the City. B. TO BE COMPLETED PRIOR TO FRAMING INSPECTION: 1. A landscaping plan shall be submitted to the Planning Department for review and approval action. 2. Rooftop mechanical equipment shall be screened from view. Irrigation layout to include meter location, pipe sizes, sprinkler head types, etc. c. Fencing materials and detail drawing. C. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. Manley To permit the establishment of an auto storage yard pursuant to S.9534 of the Huntington Beach Ordinance Code located on the west side of Crabb Lane at the west end of Liberty Avenue in an M-1, industrial district. Mr. Manley, the applicant, Mrs. Mildred Lehy, Manager of the Industrial Center, and Mr. Victor Di Stephano, representing the applicant, were present. The Acting Secretary stated that this application was exempt from Environmental Review Board requirements. The Chairman opened the public hearing. The Acting Secretary outlined the proposal to the applicant and his representatives and explained that one of the conditions of approval as outlined in the Huntington Beach Ordinance Code is that a 6 ft. high 6 inch thick masonry wall is required around the perimeter of the proposed storage area. Further conditions of approval were discussed. As there were -no other parties present to speak in favor of or in opposition to Use Permit No. 73-71 the Chairman closed the public hearing. Board discussion followed. ON MOTION BY GERARDEN AND SECOND BY EADIE USE PERMIT NO. 73-71 WAS APPROVED WITH THE FOLLOWING CONDITIONS AND BY THE FOLLOWING VOTE: GENERAL: The applicant shall be required to cease use of the lot within 60 days from approval of Use Permit No. 73-71 if the wall and planting have not been installed. A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The plot plan received 9/13/73 shall be the approved layout as amended thereon. 2. Crabb Lane shall be dedicated to City standards at the time each parcel is developed. 3. To permit the -construction of two (2) industrial buildings, pursuant.to S.9511 of the Huntington Beach Ordinance Code located on the west side of Producer Lane, approximately 240 ft. south of McFadden in a 100-M1-A-20,000, industrial district. Mr: Wayne Stewart, applicant,•and Mr. Burke and Mr. Langer, representing the applicant, were present. The Acting Secretary outlined that the Environmental Review Board's approval of Exemption Declaration No. 73-191 on October 2, 1973 with the following stipulation; The Environmental Review Board requested that the Board of Zoning Adjustments check the size of the parking stalls. The Board reviewed the plans with the applicant and found the parking stalls'to be in conformance to ordinance code. Conditions of approval were discussed. ON MOTION BY EADIE AND SECOND BY SPENCER ADMINISTRATIVE REVIEW NO. 73-175 WAS APPROVED WITH THE FOLLOWING CONDITIONS AS OUTLINED AND AMENDED BY THE FOLLOWINGVOTE: " A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The revised plot plan received 9/17/73 shall be the approved layout as amended. 2. A revised Plot Plan shall'be submitted to the-Board.of Zoning Adjustments for approval action.' Said plan shall delineate a. 6" concrete curbing to contain all landscaping. b. Singular bumpers shall be required for each parking.stall. c. The landscaping provided on Producer and Product Sts. 'shall be mounded to screen the parking area. d. To permit a reduction in the required 900 sq. ft. open space in lieu of S.9103.3.1.1.2 of the Huntington Beach Ordinance Code located on the north end of Callieburn Circle, approximately 230 ft. north of Colbreggan Drive in an R-1, low density residential district. Mr. Dennis D'Ambra, applicant, and Mrs. Cucolo, owner of the property, were present. The Acting Secretary outlined that the proposed application was exempt from Environmental Review Board requirements. The Acting Secretary outlined the application to the Board. The Chairman opened the public hearing. The applicant, and the property owner, outlined their hardship to the Board. They felt that due to the odd shape of the lot, a conditional exception is warranted. Mrs. Cucolo outlined that there are nine (9) people living in her house and that the addition was mandatory. She further felt that it would add to the beauty of the house and of that of the neighborhood. As there were no other parties present to speak in favor of or in opposition of Conditional Exception No. 73-55, the Chairman closed the public hearing. Board discussion followed. Minutes: H.B. AND SECOND BY SPENCER CONIIITIONAL EXCEPTION NO. 73-55 WAS APPROVED FOR THE FOLLOWING REASONS AND BY THE FOLLOWING VOTE: 1. The Addition would not decrease the required open space area. 2. The addition would not be detrimental to the surrounding property as the addition abuts an arterial highway. 3. The shape of the lot precludes placement of any normal addition without decreasing the minimum open space dimension. 4. The plan is not adverse to the master plan. The applicant was not present. The Acting Secretary stated that this application was exempt from Environmental Review Board requirements. The Board reviewed the plans. Conditions of approval were discussed. ON MOTION BY GERARDEN AND SECOND BY SPENCER ADMINISTRATIVE REVIEW NO. 73-176 WAS APPROVED WITH THE FOLLOWING CONDITIONS AND BY THE FOLLOWING VOTE: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The plot plan received 9/12/73 shall be the approved layout. 2. A revised plot plan shall be submitted to the Board of Zoning Adjustments for Approval Action. 3. 17th Street and Alley shall be dedicated to City standards at the time each parcel is developed. 4. Elevations of the proposed plan received 9/12/73 shall be the approved elevations. 5.
