Cowles To permit the construction of a 6' high fence within the front yard setback in lieu of S.9164 of the Huntington Beach Ordinance Code located on the northeast corner of Blanton Street and Pearce Road in an R-2, medium density residential district. The Acting Secretary advised the Board that the application be continued at the request of the applicant in order for the applicant to further investigate code requirements. Staff recommends withdrawal due to improper application. The Acting Secretary further stated that this application be continued pending the receipt of a letter of withdrawal from the applicant. The Acting Secretary advised the Board that the Environmental Review Board's posting period has not expired, therefore, he recommended a continuance. Applicant concurred with continuance. The Acting Secretary advised the Board that the Environmental Review Board's posting period has not expired. Therefore, he recommended a continuance. Applicant concurred with continuance. The Acting Secretary advised the -Board that the applicant concurred with a continuance at staff's request for a meeting between applicant and staff for discussion of this application. ON MOTION BY EADIE AND SECOND BY CROSBY ADMINISTRATIVE REVIEW NO. 73-186 WAS CONTINUED TO OCTOBER 24, 1973 BY THE FOLLOWING VOTE: AYES: Gerarden, Crosby, Eadie NOES: None ABSENT: None REGULAR AGENDA ITEMS USE PERMIT NO. 73-76 Applicant: Lenny Lindborg To permit the construction of two 5 unit apartment buildings pursuant to S.9202.3.1.4 of the Huntington Beach Ordinance Code located on the north side of Holt Street, approximately 250 ft. west of"Beach Blvd. in an R-3, medium -high density residential district. The applicant was not present. The Acting Secretary informed the Board that Exemption Declaration No. 73-201 was approved October 16, 1973 by the Environmental Review Board with no stipulations. The Chairman opened the public hearing. As there was no one present in the audience to speak in favor or in opposition to Use Permit No. 73-76, the Chairman closed the public hearing. Board discussion followed. Simmons & J. L. La Parne To permit the construction of a 6 unit apartment building pursuant to S.9162.3.1 of the Huntington Beach Ordinance Code located on the southwest corner of Sycamore Street and Ash Street in an R-2, medium density residential district. The applicant was not present. The Acting Secretary advised the Board that the Environmental Review Board approved Exemption Declaration No. 73-198 on October 16, 1973 with the following stipulation to the Board of Zoning Adjustments: The BZA shall look into the areas of trash enclosures, parking and setbacks. The Chairman opened the public hearing. Mr. and Mrs. Willie Hamm of 17132 Ash Street, Huntington Beach, the property owners, spoke in favor of the application. They felt that since the lot was zoned for apartment buildings, that apartments should be built there. Mrs. Goldie Crawford of 7771 Sycamore, Huntington Beach also spoke in favor of the application, however, she was concerned about the location of the driveway and was opposed to the parking situation. Mrs, Catherine Snyder of 7822 Sycamore, Huntington Beach, Mrs. Betty Standridge of 17182 Ash St., Huntington Beach, and Mrs. Patricia Clifton of 17171 Ash St., Huntington Beach were opposed to the development. Mrs. Snyder stated that she was opposed due to too much density in that area and she felt that the streets are too narrow. Mrs. Standridge pointed out that she has been having nothing but problems in that neighborhood since apartments were first being built, and felt that there is no need for more people on that street. This development does not directly affect Mrs. Clifton, but she felt that her support might help defeat this development. She feels there is a nice atmosphere presently, and would like to keep as many one story dwellings as possible. She felt that it is more of a family atmosphere when there are only one story dwellings in a neighbor hood. The Chairman closed tAe public hearing. Minutes: H.B. It was the concensus of ithe Board that a continuance would be in order to allow applicant time to be present and to allow Board to discuss mitigating measures with applicant. ON MOTION BY GERARDEN AND SECOND BY EADIE USE PERMIT NO. 73-75 WAS CONTINUED TO OCTOBER 31, 1973 BY THE FOLLOWING VOTE: AYES: Gerarden, Eadie, Crosby NOES: None ABSENT: None CONDITIONAL EXCEPTION NO. 73-56 Applicant: S $ S Construction Company To permit a 5 ft. encroachment into the required 10 ft. rear yard setback in lieu of S.9103.3 of the Huntington Beach Ordinance Code located on the east side of Sunburst Lane, approximatley 600 ft. north of Blue Bonnet Dr. in an R-1, low density residential district.. Mr. Lawler, representing the applicant, was present. The Acting Secretary advised the Board that this application was exempt from Environmental Review Board requirements. The Chairman opened the public hearing. The applicant presented his case to the Board as being an oversight on their Engineering staff and Building staff. He pointed out the extreme expense to bring application to code requirements. He further stated that the future home owner would enjoy as•much living area as his neighbors. The decrease would not hamper any rights a future home buyer might possess. As there was no one present in the audience to speak in•favor or opposition to Conditional Exception No. 73-56, the Chairman closed the public hearing. Board discussion followed. Reasons for approval were outlined to the applicant's representative. ON MOTION BY GERARDEN AND SECOND BY CROSBY CONDITIONAL EXCEPTION NO. 73-56 WAS APPROVED FOR THE FOLLOWING REASONS AND BY THE FOLLOWING VOTE: REASONS FOR APPROVAL OF CONDITIONAL EXCEPTION NO. 73-56 1. The granting,of this •Conditional Exception will not constitute a_special p,riviledge inconsistant upon other properties in the vicinity under identical zone classifications. 1 Minutes: H.B. That due to the irregular pie -shape geometry of this lot and the fact that 5' of additional zity right-of- way was taken from the rear of this lot, the strict application of the zoning ordinance is found to deprive this property of normal priviledges. 3. The granting of this Conditional Exception will not adversely affect the master plan of the City of Huntington Beach. 4. This request is to allow but one corner of a one story single family dwelling to encroach within the setback area a distance of (5) five feet. 5. The square footage of this corner encroachment amounts to a mere (21) twenty-one square feet of building area. 6. The property and specifically this corner of the building will be separated from the traffic noise of Goldenwest Street by a 10' high masonry wall; thereby, mitigating any noise discomfort which may be incurred by the future resident due to this (21) twenty-one square foot encroachment. 7. That locating the building on,the lot, as proposed, provides for more desirable distribution of open space,.accessibility thereto and use thereof to and for the benefit of the future resident. Mr. Lockyer,'the applicant was present. The Acting Secretary informed the Board that this application was exempt from Environmental Review Board requirements. The Applicant stated his reasons for the continued use of overhead utility installation as being: All utility lines are presently overhead.
