AGENDA ITEMS CONTINUED OR WITHDRAWN: DIVISION OF LAND NO. 73-28 (Continued from 10/31/73) Applicant: Cornelius Zeilenga To permit the division of one parcel of land into two parcels pursuant to S.9811.3 of the Huntington Beach Ordinance Code located on the southeast corner of Elm Street and Cypress Street in an R-2, medium density residential district. The Acting,Secretary informed the Board that the Environmental Review Board took no action on Exemption Declaration No. 73-182, and further stated that this application requires a Conditional Exception before the Planning Commission. It was the concensus of the Board to accept the letter of withdrawal the applicant had submitted in view of his application status. Board of Zoning Adjustments Wednesday, Nov. 7, 1973 Page 2 The Acting Secretary informed the Board that Exemption Declaration No. 73-206 was approved November 6, 1973 by the Environmental Review Board with the following recommendations: The project would be enhanced by the following: 1. Gravel surfacing for the storage areas. 2. AC paving for the parking areas and vehicular circulation areas within the storage yard. 3. The discouragement of the use of oil because of the impact the oil would create on the water quality through both the runoff and percolation. The Acting Secretary reviewed plan check status and informed the applicant that 6 percont of the property must be landscaped. Parking requirements were discussed (A minimum of 7 parking spaces required). Access to property, type of storage area to be used and method of screening were also discussed. It was the concensus of the'$oard that the present plot plan does not show adequate information, therefore, it was suggested that the applicant submit a new plot plan for Board review reflecting changes and additions as outlined. To permit the phasing of improvements for an existing non -conforming use to comply with requirements of the Huntington Beach Ordinance Code located on the east side of Gothard Street, approximately 270 feet south of Talbert Avenue in an M1-CD industrial district. The applicant was:not present. The Acting Secretary informed the Board that Exemption Declaration No. 73-101 was approved by the Environmental Review Board November 6, 1973. He further recommended that this proposal be referred to the Planning Commission at their regular meeting of December 4, 1973 due to several necessary continuances of this application due to Environmental Review Board concerns, lack of complete information on the application and plot plans, and in view of the Planning Commission's primary input regarding this site as to resolution #1106. AYES: Gerarden, Ford, Eadie NOES: 'None ABSENT: None USE PERMIT NO. 73-74 (Continued from 10/31/73) Applicant: Bryant's Landscaping To permit the establishment of a retail nursery pursuant to S.9472.1 of the,Huntington Beach Ordinance Code located on the south side of Utica Street, approximately 120 ft. east of Florida Street in a'C-4, highway commercial district. The Acting Secretary informed the Board that Exemption Declaration No. 73-199 was approved by the Environmental Review Board on October 23, 1973. He further advised the Board that this application had been continued previously for receipt of revised plans. Mr. Bryant, the applicant, was present. The Board reviewed the applicant's revised plans submitted today. The Chairman opened the public hearing. It was the concensus of the Board that the revised plans reflect better circulation for access to the proposed nursery and landscaping has been brought into conformance to ordinance code. Location of trash area was discussed as well as location of signing. The Board recommended a monument sign if the applicant wished to pursue a free standing sign. Applicant felt wall sign was more economical. A provision was made on the plot plan that sign shall be placed on the slump stone wall.for business identification, copy to be.the business name only. Conditions of approval were discussed. As there were no parties present to speak in favor or opposition to Use Permit No. 73-74, the Chairman closed the public hearing. ON MOTION BY GERARDEN AND SECOND BY EADIE USE PERMIT NO. 73-74 WAS APPROVED WITH THE FOLLOWING FINDINGS AND WITH THE FOLLOWING CONDITIONS AS OUTLINED AND AMENDED,BY THE FOLLOWING VOTE: FINDINGS: The establishment, maintenance and operation of the use will not be detrimental to: Minutes: H.B. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS OR CONDUCTING ANY BUSINESS ON PROPERTY. 1. The revised plot plan received 11/6/73 shall be the approved layout as amended thereon. 2. Utica Street shall be dedicated to City standards at the time each parcel is developed. 3. Building elevations of the proposed plan shall be sub- mitted to the Planning Department for review and approval action. 4. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. S. All buildings on lots abutting a City easement -shall be set back five (S) feet from the edge of such easement. 6. Soil and compaction reports as required by the Building Department and the Department of Public Works shall be submitted to -the City. 7. A landscaping plan shall be submitted to the Planning Department for review and approval action. 8. Rooftop mechanical equipment shall be screened from view. Said screening plan shall be approved by the Board of Zoning'Adjustments. 9. All signs for the Proposed Development.shall be submitted to the BZA for approval. The BZA encourages signs which reflect a common theme with respect to design material and colors which are compatible with the architectural theme of the proposed project. 10. Fire Alarm system conduit_ and appurtenances shall be installed by the developer at locations and to specifications provided by the Fire Department. 1 Minutes: H.B. Said plan shall be submitted to the Planning Department for review and approval. Fencing and landscape plans shall include the following information: a. A list including quantities and sizes for each species of plants and all ground cover material. b. Irrigation layout to include meter location, pipe sizes, sprinkler head types, etc. c. Fencing materials and detail drawing. 12. Utica Street shall be fully improved including street trees, street signs, streetlights, fire hydrants, sewer and water main extensions. 13. All utilities shall be installed underground. 14. Off-street parking facilities shall conform to Article 979. 15. A- masonry wall shall be constructed along the south property line. The height of said wall shall be such that the top will be six (6) feet. 16. Water supply shall be through the City of Huntington Beach's water supply system. 17. Sewage disposal shall be through the City of Huntington Beach's sewage system. 18. Easements for utilities or walkways shall be provided to Department of Public Works standards. 19. The Acting Secretary informed the Board that Exemption Declaration No. 73-207 was rejected by the Environmental Review Board on Oct. 30, 1973 due to the need of an Environmental Impact Report. The applicant was not present. The applicant had indicated verbally,that he intends to withdraw his application until such time that Environmental status is finalized. It,was the concensus of the Board that a continuance is in order to allow applicant time to submit letter of withdrawal. Board of Zoning -Adjustments Wednesday, Nov. 7, 1973 Page 10 y ADMINISTRATIVE REVIEW NO. 73-187 Applicant: William Bray To permit the construction of a 6 unit apartment building pursuant to S.9201.2 of the Huntington Beach Ordinance Code located on the northwest corner of 19th Street & Olive Avenue in an R-3, medium - high density residential district. Mr. Bill Bray, the applicant representing Fox Development Company, was present. The Acting Secretary informed the Board that Exemption Declaration No. 73-187 was approved October 30, 1973 by the Environmental Review Board, The Acting Secretary stated that there were inadequacies on the plot plan, however, the applicant was not previously available to discuss a continuance of his application. The Board discussed a shortage in the open space requirement with the applicant and ,noted that it was 40 sq. ft. short. Pedestrian circulation to parking areas, parking, refuge disposal, and fencing were also discussed. Several points where the Plot Plan could be amended were discussed. Conditions of approval were discussed. ON MOTION BY FORD AND SECOND BY EADIE ADMINISTRATIVE REVIEW NO. 73-187 WAS APPROVED WITH THE FOLLOWING CONDITIONS AS OUTLINED AND AMENDED BY THE FOLLOWING VOTE: A. AYES: Gerarden, Ford, Eadie NOES: None ABSENT: None CONDITIONAL EXCEPTION NO. 73-57 Applicant: The Pasadena Neon Sign Company To permit a wall sign on a building surface not facing a street, public way or.parking lot in -lieu of S.9760.2.17 and S.9764.3.4 of the Huntington Beach Ordinance Code located on the west side of Beach Boulevard, approximately 750 ft. south of Atlanta Avenue in a C-4, highway commercial district. Mr. John Lonagan, Mr. S. Bianco, of the Pasadena Neon Sign Company, representing the applicant, and Mr'. G. Turl, Vice President of Marina Federal, the applicant, were present. The Acting!Secretary reviewed the requirements of the ordinance code with the applicant and his representative. The Chairman opened the public hearing. The applicant outlined his justifications as to why he should be granted a conditional exception. He stated that he is charged premium rent for thislocation, he does not feel that this sign would affect public welfare, he stated that a sign is allowed in a similar location within the City of Huntington Beach, he felt that a wall sign of this type is aesthetically more pleasing on a wall instead of a roof, and that the sign does not face a residential area being -located along a private driveway. As there were no parties present to speak in favor or opposition to Conditional Exception No. 73-57, the Chairman closed the public hearing. ON MOTION BY FORD AND SECOND BY GERARDEN CONDITIONAL EXCEPTION NO. 73-57 WAS DENIED FOR THE FOLLOWING REASONS AND BY THE FOLLOWING VOTE: 1. Applicant failed to demonstrate justifiable hardship, 2. Absence of the proposed sign would not be detrimental to business operation. 3. Application would constitute a special privilege inconsistent with surrounding buildings in the vicinity. AYES: Gerarden, Ford, Eddie NOES:, None ABSENT: None USE PERMIT NO. 73-67 Applicant: Nicholas M. $ Linda M. Ekovich To permit an addition to an existing family dwelling with a non- conforming side yard setback, pursuant to S.9719 of the -Huntington Beach Ordinance Code Located on the southeast side of Geneva Street approximately 350 feet east of Delaware Street in an R-2, medium density residential district. Mr. Ekovich, the applicant, was present. The Acting Secretary outlined the proposal to the Board, and further stated that the application was not in conformance to ordinance code. The Chairman opened the public hearing. It was the concensus of the Board that a meeting with the applicant was in order to discuss his proposal. The applicant concurred to this type of a meeting. As there were'no parties present to speak in favor or opposition to Use Permit No. 73-67, the Chairman closed the public hearing. ON MOTION BY FORD AND SECOND BY EADIE USE PERMIT NO. 73-67 WAS CONTINUED,TO NOVEMBER 14, 1973 BY THE FOLLOWING VOTE: AYES: Ford, Gerarden, Eadie NOES: None ABSENT: None Minutes: H.B. Board of Zoning Adjustments Wednesday, Nov. 7, 1973 Page 14 CONDITIONAL EXCEPTION NO. 73-60 Applicant: G.M. Signs To permit the construction of an additional pole sign to a site containing an existing pole sign in lieu of 5.9764.3.1.2 (b,l) of the Huntington Beach Ordinance Code located on the east side of Beach Boulevard, approximatley 150 ft. north of Terry Drive in a C-4, highway commercial district. Mr.. Frank Mercado, representing the applicant, and Mr. Rosen, the applicant, were present. The Acting Secretary advised the Board that this application was exempt from Environmental Review Board requirements. . The Acting Secretary outlined that a letter of authorization from the property owner of record was required. The Chairman opened the public hearing. Mr. Mercado outlined,his justifications to the Board as follows: He stated that the.building.itself is 350 ft. back of the property line, and that is.why a pole sign is necessary, he stated that all three businesses will compliment each other, the proposed sign is clean and not elaborate, it is an ideal location for Lee's Bar Stools,and Dinettes, the proposed sign shall be surrounded by an existing planter and that the wording of the sign is minimal. As there were no parties present to speak in favor or opposition to Conditional Exception No. 73-60, the Chairman closed the public hearing. A MOTION WAS MADE BY GERARDEN AND SECONDED BY FORD TO DENY CONDITIONAL EXCEPTION NO. 73-60 FOR THE FOLLOWING REASONS AND BY THE FOLLOWING VOTE: 1. There is no reasonable justification for allowing additional sign coverage to the property in lieu of existing sign. 2. Conditional Exception does not present justifiable hardship. 1 3. Granting of the Conditional Exception would constitute'a special privilege and is totally inconsistent with other properties. AYES: Gerarden, Ford NOES: None ABSTAIN: Eadie 1 Minutes: H.B.
