HomeMy WebLinkAbout1973-11-12MINUTES Administrative Annex, Civic Center Huntington Beach, California Monday, November 12, 1973 Mayor Matney called the adjourned regular meeting of the City Council of the City of Huntington Beach to order at 5:30, ROLL CALL Councilmen Present: Shipley, Bartlett, Gibbs, Green, Coen, Duke, Matney Councilmen Absent: None ARCHITECTURAL CONSTRUCTION COORDINATOR AGREEMENT - ERNEST H ELWOOD - APPROVED The City Administrator presented the Architectural Construction Coordinator Agreement between the City and Ernest H. Elwood for Council's consideration.. The City Attorney read the final sentence of Paragraph #2 on Page #2 of said Agreement in which changes had been initialed by the parties involved. On motion by Green, Council approved the Architectural Construction Coordinator Agreement between the City and Ernest H. Elwood and authorized the Mayor and City Clerk to execute same on behalf of the City. The motion was passed by the following roll call vote: AYES: Councilmen: Shipley,.Bartlett, Gibbs, Green, Coen, Duke, Matney NOES: Councilmen: None ABSENT: Councilmen: None CENTRAL CITY LIBRARY FACILITY - ADDENDUM TO AGREEMENT - NEUTRA & ASSOCIATES - APPROVED The City Administrator.presented an Addendum to an Agreement dated May 6, 1970 between the City and Neutra and Associates, with respect to the Central City Library Facility. The City Attorney explained the intent of the Addendum. On motion by Duke, Council approved the Addendum to the Agreement between Neutra and Associates, with respect to the Central City Library Facility, and authorized the Mayor and City Clerk to execute same on behalf of the City. The motion was passed by the following roll call vote: AYES: Councilmen: Shipley, Bartlett, Gibbs, Green,..Coen, Duke, Matney NOES: Councilmen: None ABSENT: Councilmen: None RELEASE AND HOLD HARMLESS AGREEMENT - CITY & PUBLIC FACILITIES CORP. - DEFERRED The City Attorney addressed Council regarding the intent of the proposed "Release and Hold Harmless Agreement".between the City and the Public Facilities Corporation. He recommended that no action be taken by the Council at this time and that his office be directed to study the matter for report back to Council. The Mayor directed that the proposed "Release and Hold Harmless Agreement" between the City and Public Facilities Corporation,be referred to the City Attorney's office to review said agreement. 1W40 Page #2 - Council Minutes - 11/12/73 TERRY, ET AL VS CITY - STIPULATION APPROVED The City Attorney presented a "Stipulation Under Code of Civil Procedures 583 Extending Time For Bringing Action To Trial Within Five Years," which his office had prepared utilizing input from the Attorney representing the parties of the class action lawsuit. He spoke regarding the legal ramifications of the document and recommended Council approval of same. On motion by Bartlett, Council approved the "Stipulation Under Code of Civil Procedures 583 Extending Time For Bringing Action To Trial Within Five Years," and authorized the City Attorney to execute the agreement on behalf of the City. The motion was passed by the following roll call vote: AYES: Councilmen: Shipley, Bartlett, Gibbs, Green, Coen, Duke, Matney NOES: Councilmen: None ASSENT: Councilmen: None INFORMAL MEETING CALLED Mayor Matney called an informal meeting of the Council as a Committee -of -the -Whole to meet with the Planning Commission. RECESS The Mayor tailed a recess of the Council at 6:00 P.M. for a study session with the Planning Commission. RECONVENE The meeting was reconvened at 8:00 P.M. by the Mayor, at which time Councilwoman Gibbs and Councilman Duke were recorded as absent from the meeting. APPOINTMENT -HENRY H KAUFMAN - HIGH RISE COMMITTEE - APPROVED On motion by Shipley, Council appointed Dr. Henry H. Kaufman to serve on the City High Rise Committee, by the following roll call vote: AYES: Councilmen: Shipley, Bartlett, Green, Coen, Matney NOES: Councilmen: None ABSENT: Councilmen: Gibbs, Duke RETREATS BY COUNCILS & COMMISSIONS Discussion was held between the Council and City Attorney regarding the possibility of the Council and Planning Commission participating in retreats and the City Attorney advised them of the procedure which must be followed relative to such retreats, which would include attendance by the press, and that less than a quorum of Council or Commission members could attend or they would be in violation of the Brown Act. CITY REPRESENTATIVE TO ORANGE COUNTY HEALTH PLANNING COUNCIL - DEFERRED Discussion was held by Council regarding the necessity of appointing a representative to the Orange County Health Planning Council, as the City's present representative was ineligible to serve due to a conflict of interest. Mayor Matney asked that Council give consideration to possible appointees for sub- mission at the November 19, 1973 meeting. 171 Page #3 - Council Minutes - 11/12/73 1 LOCATION OF ORANGE COUNTY CULTURAL ARTS CENTER Councilman Coen spoke regarding the efforts being made by the Allied Arts Commission in connection with the possible location of the Orange County Cultural Arts Center in the.City. He recommended that Council consideration be given to various aspects of the matter such as site location. The Council requested that the City Administrator prepare a report on the matter for presentation to Council. GOTHARD STREET/MAIN STREET INTERSECTION The City Administrator reported on the reasons for the delay involved in the signali zation of Gothard and Main Streets and Garfield Avenue due to the railroad crossing at that location. ENVIRONMENTAL PROTECTION AGENCY TRANSPORTATION CONTROLS - FREEWAYS Councilman Green read the amendments to the Environmental Protection Agency's rules which will serve to prevent the construction of new freeways in the Southeastern. Basin, and discussion was held by Council -on the matter. ADJOURNMENT On motion by Shipley, the adjourned regular meeting of the City Council of the City of Huntington Beach adjourned to Monday, November 19, 1973 at 5:30 P.M. in the Administrative Annex.
