HomeMy WebLinkAbout1973-11-12Page #2 - Council Minutes - 11/12/73 TERRY, ET AL VS CITY - STIPULATION APPROVED The City Attorney presented a "Stipulation Under Code of Civil Procedures 583 Extending Time For Bringing Action To Trial Within Five Years, which his office had prepared utilizing input from the Attorney representing the parties of the class action lawsuit. He spoke regarding the legal ramifications of the document and recommended Council approval of same. On motion by Bartlett, Council approved the "Stipulation Under Code.of Civil Procedures 583 Extending Time For Bringing Action To Trial Within Five Years," and authorized the City Attorney to execute the agreement on behalf of the City. The motion was passed by the following roll call vote: AYES: Councilmen: Shipley, Bartlett, Gibbs, Green, Coen, Duke, Matney NOES: Councilmen: None ABSENT: Councilmen: None INFORMAL MEETING CALLED Mayor Matney called an informal meeting of the Council as a Committee -of -the -Whole to meet with the Planning Commission. RECESS The Mayor called a recess of the Council at 6:00 P.M. for a study session.with the Planning Commission. RECONVENE The meeting was .reconvened at 8:00 P.M. by the Mayor, at which time Councilwoman Gibbs and Councilman Duke were recorded as absent from the meeting. APPOINTMENT HENRY H KAUFMAN - HiGH RISE COMIMITTEE - APPROVED On motion by Shipley, Council appointed Dr. Henry H. Kaufman to serve on the City High Rise Committee, by the following roll call vote: AYES: Councilmen: Shipley, Bartlett, Green, Coen; Matney NOES: Councilmen: None ABSENT: Councilmen: Gibbs, Duke RETREATS BY COUNCILS & COMMISSIONS Discussion was held between the Council and City Attorney regarding the possibility of the Council and Planning Commission participating in retreats and the City Attorney advised them of the procedure which must be followed relative to such retreats, which would include attendance by the press, and that less than a quorum of Council or Commission members could attend orthey would be in violation of the Brown Act. CITY REPRESENTATIVE TO ORANGE COUNTY HEALTH PLANNING COUNCIL - DEFERRED Discussion was held by Council regarding the necessity of appointing a representative to the Orange County Health Planning Council, as the City's present representative was ineligible to serve due to a conflict of interest. Mayor Matney asked that Council give consideration to possible appointees for sub- mission at the November 19, 1973 meeting. 171
