The Applicant was not present. The Board discussed the Environmental Review Board's additional information transmitted to the BZA on 11/6/73. ON MOTION BY EADIE AND SECOND BY GERARDEN FINDINGS BY THE ENVIORNMENTAL REVIEW BOARD WERE ADOPTED BY THE FOLLOWING VOTE: AYES: Gerarden, Ford, Eadie NOES: None ABSENT: None Conditions of approval were discussed and amended. ON MOTION BY EADIE AND SECOND BY GERARDEN ADMINISTRATIVE REVIEW NO. 73-191 WAS APPROVED WITH THE FOLLOWING CONDITIONS AS OUTLINED AND AMENDED BY THE FOLLOWING VOTE: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The revised plot plan received 11/9/73 shall be the approved layout as amended thereon. a. Planter area shall have a minimum depth of 15 ft. b. The driveway entrance is to be relocated as shown on the plot plan. 2. Stewart Street shall be dedicated to City standards at the time each parcel is developed. 3. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 4. All buildings on lots abutting a City easement shall be set back five (5) feet from the edge of such easement. B. TO BE COMPLETED PRIOR TO FRAMING INSPECTION: 1. A landscaping plan shall be submitted to the Planning Department for review and approval action. 2. All signs for the Proposed Development shall be submitted to the BZA for approval-. The BZA encourages signs which reflect a common theme with respect to design materials and colors which are compatible with the architecutral theme of the proposed project. Minutes: H.B. Fire alarm system conduit and appurtenances shall be installed by the developer at locations and to specifi- cations provided by the Fire Department. C. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. Stewart Street shall be fully improved including street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 2. All utilities shall be installed underground. 3. Off-street parking facilities shall conform to Article 979. 4. A 6 ft. high chain link fence with redwood slats shall be constructed around the perimeter of the storage yard as shown on the plot plan received November 9, 1973. D. TO BE COMPLETED PRIOR TO ISSUANCE OF CERTIFICATE OF OCCUPANCY: 1. Water supply shall be through the City of Huntington Beach's water supply system. 2. Sewage disposal shall be through the City of Huntington Beach's sewage system. 3. Easements for utilities or walkways shall be provided to Department of Public Works standards. 4. The property shall participate in th-e local drainage assessment district. S. No structures,'other than those shown on the approved plot plan, shall be constructed within the project, excepting signs. 6. All applicable City Ordinances shall be complied with. 7. The storage yard area is to be surfaced with gravel material. 8. Required parking and vehicular circulation within the storage yard shall receive AC paving. Board of Zoning Adjustments Wednesday, November 14, 1973 Page 5 ADMINISTRATIVE REVIEW NO. 73-198 Applicant: Theodore Gohr To permit the outside storage and display of automobiles and the use of temporary building for sales office pursuant to 5.9432.3 and S.9730.17 of the Huntington Beach Ordinance Code located on the east side of Beach Blvd., approximately 300 ft. north of Yorktown Avenue in the C-4, highway commercial district. In Conjunction With: USE PERMIT NO. 73-80 Applicant: Theodore Gohr To permit the construction of a new and used auto sales and service facility pursuant to S.9472 of the Huntington Beach Ordinance Code located on the East side of Beach Blvd., approximately 300 ft. north of Yorktown Avenue in the C-4, highway commercial district. The Applicant was not present. The Acting Secretary advised the Board that a continuance of this application is in order due to the necessity of a Negative Declaration to be submitted to the City's Environmental Review Board in order to determine the environmental impacts, if any, that exist on the site. This Negative Declaration request is required as the ultimate development of all of the property would warrant Environmental Review Board consideration. The Board questioned the information received as it related to a field check: 1. The property to be developed displays extreme differences in grades and would require an excess of 300 cu. yds, of fill to develop the rear half. 2. The Board feels that a specific Plot Plan for the entire property should be developed and 3. Without Environmental Review Board Review, the Board feels that the project may have a detrimental effect on the health and general welfare of the vicinity. Board of Zoning Adjustments Wednesday, November 14, 1973 Page 6 ON MOTION BY EADIE AND SECOND BY GERARDEN USE PERMIT NO. 73-80 WAS CONTINUED TO NOVEMBER 21, 1973 BY THE FOLLOWING VOTE: AYES: Gerarden, Eadie, Ford NOES: None ABSENT: None ADMINISTRATIVE REVIEW NO. 73-196 Applicant: Colwell & Ray Architects To permit the construction of a drive-in restaurant pursuant to S.9430 of the Huntington Beach Ordinance Code located on the west side of Brookhurst Street approximately 500 ft. south of Garfield in a C-2, community business disttict. Mr. Duaine Duff and Mr. Gary Bosz, representing the applicant, were present. The Acting Secretary informed the Board that Exemption Declaration No. 73-211 was approved by the Environmental Review Board on November 13, 1973. The Board discussed the Environmental Review Board's additional information transmitted to the BZA on 11/14/73 and felt that the findings of Exemption Declaration No. 73-211 require further study by the Environmental Review Board. It was the concensus of the Board that the applicant had not shown his entire property and the Board also felt as the Environmental Review Board had not been informed that the total property in question was not delineated on the plot plan. ON MOTION BY GERARDEN AND SECOND BY FORD THE BOARD OF ZONING ADJUSTMENTS REJECTED THE FINDINGS OF THE ENVIRONMENTAL REVIEW BOARD AND REFERRED EXEMPTION DECLARATION NO. 73-211 BACK TO THE ENVIRONMENTAL REVIEW BOARD FOR FURTHER CONSIDERATION. AYES: Gerarden, Ford, Eadie NOES: None ABSENT: None It was the concensus of the Board to continue this proposal to allow the Environmental Review Board time to consider Exemption Declaration No. 73-211. Board of Zoning Adjustments Wednesday, November.14, 1973 Page 7 ADMINISTRATIVE REVIEW NO. 73-199 Applicant: Alva Wilson Company To permit the establishment of a model home and sales office site pursuant to S.9730.18 of the Huntington Beach Ordinance Code located on the south side of Springhurst Avenue, approximately 250 feet west of Newland Street in an R-1, low density residential district. Mr. Shelton, Engineer and representing the applicant, informed the Staff that he was unable to be present at the meeting. The Acting Secretary informed the Board that this application was exempt from Environmental Review Board requirements. The Board reviewed the plans and conditions of approval were discussed. ON MOTION BY EADIE AND SECOND BY GERARDEN ADMINISTRATIVE REVIEW NO. 73-199 WAS APPROVED WITH THE FOLLOWING CONDITIONS AS OUTLINED BY THE FOLLOWING VOTE: 1. Criteria contained in 5.9730.18 shall be complied with. 2. Administrative Review No. 73-74 and Administrative Review No. 73-165-A shall become null and void. 3. Plot Plan received 10/30/73 shall be the approved layout as amended thereon. 4. Street improvements on Gumtree Lane, Springhurst Avenue, and Newland Street within the area of the model homes and sales office shall be made prior to opening the area for use. 5. All signs proposed for the model homes and sales office complex shall conform with the sign ordinance and shall be approved by the Planning Department prior to issuance of building permits. ON MOTION BY FORD AND SECOND BY EADIE ADMINISTRATIVE REVIEW NO. 73-201 WAS CONTINUED TO NOVEMBER 28, 1973 BY THE FOLLOWING VOTE: AYES: Gerarden, Ford, Eadie NOES: None ABSENT: None ADMINISTRATIVE REVIEW NO. 73-200 Applicant: Frank Darling To permit the display and sales of Christmas Trees pursuant to S.9730.16 of the Huntington Beach Ordinance Code located on the southeast corner of Beach Boulevard and Talbert Avenue except for the southwest corner of approximately 160 ft. by 160 ft. Mr. Blayock, partner, was present. The Acting Secretary informed the Board that this application was exempt from Environmental Review Board requirements. The Board reviewed the plan and conditions of approval were discussed. ON MOTION BY GERARDEN AND SECOND BY FORD ADMINISTRATIVE REVIEW NO. 73-200 WAS APPROVED WITH THE FOLLOWING CONDITIONS AS OUTLINED AND AMENDED BY THE FOLLOWING VOTE: 1. Plot Plan received 10/30/73 shall be the approved layout. 2. Applicant shall comply with S.9730.16 of the Huntington Beach Ordinance Code. 3. Applicant shall obtain all necessary electrical permits. 4. On site inspection shall be required by the Fire Department prior to opening. 5. Signing shall comply with the provisions of Article 276. 6. No ingress or egress shall be allowed on Beach Boulevard. 7. ON MOTION BY GERARDEN AND SECOND BY FORD ADMINISTRATIVE REVIEW N0. 73-202 WAS APPROVED WITH THE FOLLOWING CONDITIONS AS OUTLINED AND AMENDED BY THE FOLLOWING VOTE: 1. Plot Plan received November 6, 1973 shall be the approved layout. 2. Applicant shall comply with 5.9730.16 of the Huntington Beach Ordinance Code. 3. Applicant shall obtain all necessary electrical permits. 4. On site inspection shall be required by the Fire Department prior to opening. 5. Traffic control and on site circulation shall be approved by the Department of Public Works prior to opening. The Board informed the applicant's representative that a bond must be posted for the six models. Parking spaces and egress and ingress were discussed. It was the concensus of the Board that a continuance is in order to allow applicant time to submit revised plans which also show precise sign copy.
