CONSENT CALENDAR
ON MOTION BY WALLIN AND SECOND BY PORTER THE FOLLOWING ITEMS

TENTATIVE TRACT NO. 7899 (Continued from 8/21/73)
Applicant: Godfrey and Associates, Inc.
Staff requested withdrawal as the tract has been recorded since
staff report was written.
LAND USE ELEMENT AND OPEN SPACE ELEMENTS TO THE GENERAL PLAN
Mr. Ed Selich presented an introduction to the General Plan,
stating that it sets forth basic concepts in Planning which
should be of general interest to the citizens of Huntington
Beach.
Mr. Selich presented the work programs for 1973 and 1974. In
addition he introduced and distributed the Phase I Land Use Element
and Phase I Open Space and Conservation Element to the General
Plan. He presented a Work Program Chart and outlined the
programs in progress. Chairman Kerins requested that the
Commission be provided with a copy of this chart.
Mr. Selich and the staff were complimented on the Introduction
to the General Plan report.
There was a discussion on those areas where zoning must be
brought into compliance with the Master Plan.

It was the consensus of the Commission that it would be appropriate
to invite the City Council to an afternoon Study Session on December
11, 1973. A Public Hearing will be held December 18, 1973 on these
two elements.
CODE AMENDMENT NO. 73-24 - Alternative Residential Suffix District( -AR)
Mr. Fred Ritter addressed the Commission and stated that he had been
in contact with the City of Carlsbad which has similar development
requirements within their planned community district.
Commission requested that a new draft be prepared to include City
Attorney's comments and that said draft be typed on numbered pages.
Discussion followed regarding zero setback for rear yards and the
question of access from alleys. Commissioner Porter requested that
Section 9155.2 should indicate a minimum of not less than 5 ft. for
interior sideyard. Chairman Kerins stated that he felt Code Amend-
ments should be reviewed at Study Sessions rather than regular meetings.
Commission requested a majority of Section 9157.4 be deleted as well
as the appeal section.
At 9:20 Chairman Kerins declared an adjournment for a ten minute
recess.
ZONE CASE 73-19* (Continued from October 2, 1973)
Applicant: Initiated by Planning Commission
Zone Case No. 73-19 is a request to change existing R1 zone to ROS
(Recreation Open Space). Property is located on the northeast corner
of Graham Street and Warner,Avenue.
There was a discussion on the three or four other areas that should
be included in the Recreation Open Space areas. There was also
discussion on preparation of an E.I.R. to cover all these areas.
Staff was directed to pursue zone changes including this parcel and
others in conjunction with an E.I.R.

CONDITIONAL USE PERMIT NO. 73-052
Applicant: Harbour Pacific Ltd.
Tentative Tract No. 5483 is a request for 120 lots on 23.4 acres
located on the southwest corner of Edinger Ave. and Trinidad Lane.
,"Conditional Use Permit No. 73-052 is a request to permit the
construction of a 120 unit planned unit development.

Commissioner Wallin discussed the SL•bdivis�ion Committee
meeting of October 26, 1973 in connection with traffic and
parking problems for this proposed development, and noted that
Conditional Exception No. 73-64 had been filed to be heard
by the Board of Zoning Adjustments.
Mr. Dunn, representing the applicant, addressed the Commission
and explained that the need for the filing of a Conditional
Exception resulted from a recommendation of the Environmental
Review Board. The ERB recommended that there be a reduction
of parking requirements from 4.5 to 3.3 spaces per unit.
Commissioner Wallin thought that it would be appropriate to
ask the Board of Zoning Adjustments to refer this application
to the Planning Commission to be heard concurrently with
Tentative Tract No. 5483 and Conditional Use Permit No. 73-052.
ON MOTION BY PORTER AND SECOND BY BOYLE TENTATIVE TRACT NO. 5483
AND CONDITIONAL USE PERMIT NO. 73-052 WERE CONTINUED TO DECEMBER 4,
1973 TO BE HEARD IN CONJUNCTION WITH CONDITIONAL EXCEPTION NO. 73-64
BY THE FOLLOWING VOTE:

NOES: None

Staff was directed to request the Board of Zoning Adjustments to
refer Conditional Exception No. 73-64 to Planning Commission to
be heard on December 4, 1973.
ZONE CASE NO. 73-22
Applicant: Joseph N. Shaffer
Zone Case No. 73-22 is a request to change the zone from R5 to
R2 to be in compliance with Master Plan. It is located on the
southeast corner of Huntington St. and Garfield Avenue.
Secretary Reynolds addressed the Commission and stated that the
applicant, Joseph N. Shaffer, was not yet the owner of the
property and that the property was in fact in escrow. The legal
owner was present and requested that the Zone Case be heard
rather than continued to January 15, 1974 as staff had recommended
prior to learning that property is in escrow.
Commissioner Bazil stated that he felt the property should be
zoned the same as the other three corners which are R2.
Chairman Kerins opened the public hearing on Zone Case No. 73-22.
Mr. Gordon Andrews, property owner, addressed the Commission.and.
stated that the property had been in escrow since August and
that he has no assurance that the applicant will buy the property.
He requested that the Commission take action so that he would
be in a better position to sell the property.

ZONE CASE NO. 73-24
Applicant: Lincoln Property Company
Zone Case No. 73-24 is a request to change zone from R3 to R4-33.75-PD
to permit the conversion of an existing 342 unit apartment complex
to condominium units located on the northeast corner of Boardwalk
Drive and Saybrook Lane.
The Chairman opened the hearing to the public.
Mr. Bob Nichols, representative of Lincoln Property Company, addressed
the Commission and spoke in favor of the project.
Mr. Bud Morrison, representing the Property Owners Association,
spoke against the conversion.
The Chairman closed the public hearing.
Commission discussed recreational facilities, parking, and open space,
and density.
Secretary Reynolds stated that it was his understanding that if the
Commission was not in favor of the application that the applicant
would be willing to withdraw the application. Chairman Kerins asked
Mr. Nichols if he wished to drop the Zone Case and he stated that
he did not wish to withdraw.
ON MOTION BY PORTER AND SECOND BY BOYLE ZONE CASE NO. 73-24 WAS
DENIED FOR THE FOLLOWING REASONS AND BY THE FOLLOWING VOTE:
It does not meet either old or new PD criteria including (1) required
parking, (2) building setbacks, and (3) diversification of dwelling
unit type.

Conditional Exception No. 73-56 is a request for approval of
five ft. rear yard setback in lieu of required ten ft. located
at 15522 Sunburst Lane. This Conditional Exception was approved
by the Board of Zoning Adjustments on October 17, 1973.
Vugraphs of the project were presented.
Commissioner Porter stated that he had met with staff and
contacted developer and the Building Department, and after
conferring with them the Appellants agreed to withdraw the
appeal.

EXCEPTION NO. 73-56 WAS WITHDRAWN BY THE FOLLOWING VOTE:

This is a change of zone initiated by the Planning Commission
on a 7.17 acre parcel located on Ellis Ave. between Gothard
and Huntington Streets from M2 and M2-0 to Ml-A (27,000).
Vugraphs were shown and staff recommendations were discussed.

WRITTEN COMMUNICATIONS:
Dyer -Johnson & Associates' request for presentation of Preliminary
Land Use plans to be located at Hamilton Ave. and Magnolia St.
Discussion between Commissioners and Dyer -Johnson indicated a
request for zone change would be necessary before any decision
could be reached as to approval of concept.
FINAL TRACT 7896 - WROUGHT IRON FENCE
A letter from Homeowners on Henton Drive requesting reconsideration
was received and filed. Staff was directed to send a letter to
representative of the Homeowners Association indicating -that the
Commission was firm in their decision but they do have the opportunity
to appear under Oral Communications at any Planning Commission meeting
to discuss the subject once again.
ALPINE CIVIL ENGINEERS - TT 7772
A request for paving of Newland Street. Commission discussion
followed.

ARE TO REVIEW ALIGNMENT AT NEXT STUDY SESSION AND REVIEW EIR.

COMMISSIONERS COMMENTS
Chairman Kerins read excerpts from Metropolitan Water District letter,
which indicated that they intend to pursue negotiation with
Signal and obtain property as planned. Staff was directed to keep
in touch with Mr. Stringer and to be advised of MWD's actions. -
Commission directed request that a member of the Environmental
Review Board be in attendance at Planning Commission meetings.
STAFF'S COMMENTS
Secretary Reynolds suggested and Commission concurred that the
first regular meeting in January should be arranged for January 8,
1974.
