ON MOTION BY EADIE AND SECOND BY FORD ADMINISTRATIVE REVIEW NO. 73-208 WAS CONTINUED TO DECEMBER 26, 1973 BY THE FOLLOWING VOTE: AYES: Gerarden, Eadie, Ford NOES: None ABSENT: None REGULAR AGENDA ITEMS CONDITIONAL EXCEPTION NO. 73-62 (Cont. from 11/21/73) Applicant: Richard D. Stoddard To permit a reduction of the ground clearance for a pole sign from 10 ft. required minimum to 6 ft. 4 in. in lieu of S.9736.3 (b)'of the Huntington Beach Ordinance Code. The applicant was not present. The Acting Secretary informed the Board that the applicant requested a continuance to allow him time to be present at the hearing. ON MOTION,BY EADIE AND SECOND BY FORD CONDITIONAL EXCEPTION NO. 73-62 WAS CONTINUED TO DECEMBER 12, 1973 BY THE FOLLOWING VOTE: AYES: Gerarden, Eadie, Ford NOES: None ABSENT: None USE"PERMIT NO. 73-84 Applicant: Heath & Company, Inc. To permit the amendment of a previous approved plot plan for Use Permit, No. 72-33 by adding another pole sign on Goldenwest Avenue pursuant to S.9472 of the Huntington Beach Ordinance Code located on the southwest corner of Goldenwest Street and Warner Avenue in a C-41.commercial district. Mr. Briesemeister, representing the applicant, was present., The Acting Secretary outlined background information pertaining to the initial construction of the shopping center. He further reiterated that the subject sign had"been proposed at an earlier date and approved by the Board of Zoning"Adjustments under the application for a building permit.' The Board of Zoning Adjustments action was subsequently appealed grid denied by the Planning Commission. The subject Use,Permit was presently before the Board to amend Use Permit No. 73-33 by adding the sign in question. Minutes: H.B. The applicant's representative,,Mr. Briesemeister, addressed the Board•and­stated his"following justifications for the granting of this Use..Permit. 1. The sign is necessary due to heavy traffic. 2. The structures across the shopping center block off visibility -from north.and south bound'traffic. 3. This sign will not be detrimental to people in the vicinity. 4. He feels that it is'a good looking sign with=nothing flashing or animated. As there were no parties present to speak in favor or opposition to Use Permit.Na.-73-84,•the-Chairman closed the'public hearing. The Chairman outlined the criteria the Board must follow in granting approval of a pole and identification sign. Board discussion followed. ON MOTION BY GERARDEN AND,SECOND BY EADIE USE PERMIT NO. 73-84 WAS APPROVED WITH THE FOLLOWING FINDINGS AND THE FOLLOWING CONDITIONS"-0P'APPROVAL BY'THE FOLLOWING VOTE: FINDINGS: The establishment, maintenance and operation of the sign will not be detrimental to: 1. The general welfare of persons residing or working in the vicinity. 2. Injurious to property and improvements to the vicinity of such use or building. ' 3. That the granting of a Use Permit will not adversely affect] the -Master Plan- of the 'City of Huntington.- Beach. CONDITION -OF- 1FPROVAL : , " 1. No accessory sign shall'be added to the subject pole sign., AYES: Gerarden, Eadie, Ford NOES: None -ABSENT: None ADMINISTRATIVE REVIEW .;NO.:'. 73-*209 Applicant: Heath 4 : Company,.' -Inc To permit the expansion of an existing automobile dealer and the addition of six (6) new signs pursuant to S.9430 of the Huntington Beach Ordiance Code located on the northwest corner of Beach Blvd. and Taylor Street in a C-2, commercial aistrict. ' Minutes: H.B. Board of Zoning Adjustments Wednesday, December 5, 1973 - Page 4 Mr. Briesemeister and Mr -Fred Schwartz of Heath & Company, representing the applicant, and Mr. Groth of Groth-Chevrolet- were present. The Acting Secretary informed the Board that the Environmental Review Board found Exemption Declaration No. 73-225 to be categorically exempt and filing fees were refunded. The Acting Secretary informed the Board that a plan review showed the application to be -in conformance -with ordinance code requirements. The applicant's representatives addressed the Board and stated that the large painted signs are to be removed. They further stated that the main free standing signs will not be removed. The planter area, parking and storage of automobiles and traffic circulation was discussed. Board discussion followed. It was the concensus of the Board to continue this application to allow applicant time to meet with staff and for staff to make a physical inspection of the proposed site. ON MOTION BY GERARDEN AND SECOND BY EADIE ADMINISTRATIVE REVIEW NO. 73-209 WAS CONTINUED TO DECEMBER 19, 1973 BY THE FOLLOWING VOTE: AYES: Gerarden, Eadie, Ford NOES: None ABSENT: None Miscellaneous: ADMINISTRATIVE REVIEW NO.-73-220 Applicant: Leo M. Ford ' - To permit the display, and sales of.Christmas Trees pursuant to S.9730.16 of the Huntington Beach Ordinance Code located on the southeast corner of McFadden Avenue and Gothard Street in an R-1, low density residential district. Mr. Ford, the applicant, was present. The Board reviewed the plan with the applicant. Conditions of approval were discussed. ON MOTION BY EADIE AND SECOND BY FORD ADMINISTRATIVE REVIEW NO. 73-220 WAS APPROVED WITH THE FOLLOWING.CONDITIONS AS OUTLINED BY THE FOLLOWING VOTE: 1 Minutes: H.B. Board of Zoning -Adjustments Wednesdayr December 5, 1973 Page 5 1. Plot Plan received December 4, 1973 shall be the approved layout. 2. Applicant shall comply with S.9730.16 of the.Huntington Beach Ordinance Code excepting the posting of the bond shall be waived due to the nature of this use. 3. Applicant shall obtain all necessary electrical permits. 4. On site inspection shall be required by the Fire Department prior to opening. AYES: Gerarden, Eadie, Ford NOES: None ABSENT: None ADMINISTRATIVE REVIEW NO. 73-221 Applicant: Liberty Christian Schools To permit the display and sales of Christmas Trees pursuant to S.9730.16 of the Huntington Beach Ordinance Code located on the northeast corner of Nichols Street and Warner Avenue in an R-3, residential district. Mr Else, the applicant, was present. The Board reviewed the plan with the applicant. Conditions of approval were discussed. ON MOTION BY FORD AND SECOND BY GERARDEN ADMINISTRATIVE REVIEW NO. 73-221 WAS APPROVED WITH THE FOLLOWING CONDITIONS AS OUTLINED BY'THE FOLLOWING VOTE: 1. Plot Plan received December 5, 1973 shall be the approved layout as amended thereon. 2. Applicant shall comply with S.9730.16 of the Huntington Beach Ordinance Code. 3. Applicant shall obtain all necessary electrical permits. 4. On site inspection shall be required by the Fire ; Department pr-ibf'to opening. Board of Zoning Adjustments Wednesday, December 5, 1973 Page 6 REQUEST FOR MINUTE ACTION REGARDING CONDITIONAL EXCEPTION NO. 3-6 - Applicant: Huntington Pacific Communication was received from the planning staff notifying the Board that the Planning Commission will review Conditional Exception No. 73 -64 (previously referred by the Board of Zoning Adjustments to that Body) as it relates to the subject request and matters concerning setbacks. Staff has indicated that all necessary advertising of, the modified request has been accomplished. The Staff has requested the Board to concur with such procedure.
