Mr. James E. Logan and Mr. Richard A. Kent, the applicants were present. The Acting Secretary informed the Board that the Environmental Review Board granted Exemption Declaration No. 73-219 December 26, 1973. Exemption Declaration No. 73-219 refers to both conditional Exception No. 73-68 and Administrative Review No. 73-208. Tiie (-hairman opened the public hearing on Conditional Exception No. 73-68. Tile Acting Secretary outlined the applications to the Board. Mr. rent pointed out that he wished to maintain trees and to allow sufficient parking, which would necessitate the present wall to remain. Mr. Logan added that the treatment of the wall has been changed from the original plan and that the wall will act as a barrier between residents and commercial property. Mr. Jim Stead and Mr. Lyman McCray, neighbors expressed their concern of a proposed driveway and of the added amount of traffic that would be generated. They both felt that any additional commercial traffic would be unfair to their+residential area. Tile neighbors further felt that additional road traffic should not enter the proposed driveway. T:ie 4ice-Chairman explained the Department of Public Works' position on ingress and egress off of Goldenwest onto the proposed development site to the concerned neighbors. Minutes: H. B. Board of Zoning Adjustments Wednesday, December 26, 1973 Page 3 .4r..Logan explained that the building would be converted into a real estate office and assured the neighbors of little traffic that would be generated off this type of business. Tae Chairman stated that the driveway in question met code require- ments and further explained the proposal before the Board. The neighbors were in agreement that the block wall should remain. tis there were no further parties present to speak in favor or opposition to Conditional Exception No. 73-68, the Chairman closed clie public hearing. Board discussion follow�d. Administrative Review No. 73-208 was discussed. A low level sign depicting the name of the Real Estate office only was discussed. Board discussion followed. ON MOTION BY EADIE AND SECOND BY SPENCER CONDITIONAL EXCEPTION NO. 73-68 WAS APPROVED FOR THE FOLLOWING REASONS AND WITH THE FOLLOWING LONDI`t'ION BY THE FOLLOWING VOTE: RLASONS FOR APPROVAL 1. The granting of the Conditional Exception meets the intent of the ordinance code provision to provide separation between commercial and residential land uses. 2. A 6 ft. wall is required on a commercial site when abutting a residential district. The existing 6 ft. wall on the north property line abuts a street and not specifically the resi- dential use, however, in this instance it would be advantageous to leave the existing wall on the "0" property line as the residential character of the neighborhood, and the entrance to the tract would be preserved in lieu of the normal commercial setbacks. 3. The granting of the Conditional Exception is necessary to maintain and preserve the enjoyment of one or more substantial property rights in the immediate vicinity. i✓iinutes: H. B. The basis for hardship in this case is contained in the previous reasons and that a special circumstance applies to the location and surroundings of the subject site. J. The treatment and maintenance of the parkway landscaping along Breeland Street shall be incumbent upon the applicant. Goldenwest Street and Breeland Street shall be dedicated to City standards at the time each parcel is developed. 3. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 4. All buildings on lots abutting a City easement shall be set back five (5) feet from the edge of such easement. 3. Parking compounds shall be screened with a combination of fencing and landscaping. Said plan shall be submitted to the Planning Department for review and approval. Fencing and landscape plans shall include the following information: a. A list including quantities and sizes for each species of plants and all ground cover material. b. Irrigation layout to include meter location, pipe sizes, sprinkler head types, etc. C. Fencing materials and detail drawing. C. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. Goldenwest Street and Breeland Street shall be fully improved including street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 2. All utilities shall be installed underground. 3. Off-street parking facilities shall conform to Article 979. 4. A masonry wall shall be constructed along the west property line. The height of said wall shall be such that the top will be six (6) feet above the highest ground surface within twenty (20) feet of the common property line. Except within the exterior side yard setback in which case the height of said wall shall be reduced to 42 inches. 5. There shall be no fence, structure or landscaping constructed or maintained over 3 1/2 feet high within a 10 ft. by 10 ft. triangular area at the intersection on driveways and streets or within a 25 ft. by 25 ft. triangular area at the intersection of streets. Las Miller, the applicant, was present. Tiie Acting Secretary informed the Board that the Environmental Review Board granted Exemption Declaration No. 73-230 December 26, 1973. The acting Secretary outlined the proposal to the Board. He further informed the applicant that his plan was deficient in landscaping and pointed out the ordinance code requirements pertaining to landscaping. Parking spaces were discussed as well as the location of an enclosed trash area. Hoard discussion followed. Conditions of approval were discussed. Minutes: If. B. Board of Zoning Adjustments Wednesday, December 26, 1973 Page 9 Mr. Arthur Lehtola, the applicant, was present. The acting Secretary informed the Board that this application is a categorical exemption, Class 5, California Environmental Quality Act, 1970. The Chairman opened the public hearing. :sir. Lehtola addressed the Board and presented his justifications for the granting of a Conditional Exception. He stated that he would convert the present garage into a family room and build a new garage. He stated that his present garage is inadequate to accomodate two automobiles and miscellaneous items. He further stated that a fire hazard exists due to inadequate exits from the house, whereas it is impossible to pass quickly through the garage when two automobiles are parked. He felt he has restrictive driveway parking and restrictive street parking. T.Lie Chairman felt that the plan could be modified to meet ordinance code requirements. As there were no parties present to speak in favor or in opposition to Conditional Exception No. 73-67, the Chairman closed the public nearing. Board discussion followed. The Board asked if the applicant would be willing to revise the plan to meet ordinance code requirements. The applicant was agreeable to a continuance to revise his plan. The Acting Secretary advised the applicant*- _epresentatives that a 6 foot planter is required along Beach Boulevard and the plan only reflects a 5 foot planter. It was pointed out that parking bumpers were required. Further development of the adjacent property, traffic circulation, and driveway location were discussed.
