SPENCER CHAIRMAN PRO-TEM AT THIS HEARING. AGENDA ITEMS CONTINUED OR WITHDRAWN: USE PERMIT NO. 73-88 Applicant: Guy W. Gardner To permit the construction of a 12 unit apartment building pursuant to S.9162.3.1 of the Huntington Beach Ordinance Code located on the southeast corner of Huntington Avenue and 17th Street in an R-2, medium density residential district. In Conjunction With: CONDITIONAL EXCEPTION NO. 73-66 Applicant: Guy W. Gardner To permit a zero rear yard setback for carports in the construction of a'proposed 12 unit apartment complex in lieu of S.9163.3 of the Huntington Beach Ordinance'Code located on the southeast corner of Huntington Avenue and 17th'Street in an R-2, medium density residential district. The Acting Secretary informed the Board that these applications are pending finalization of Exemption Declaration No. 73-231. He further recommended a continuance of three weeks. Board of Zoning Adjustments Wednesday, January 2, 1974 Page 2 ON MOTION BY EADIE AND SECOND BY FORD CONDITIONAL EXCEPTION NO. 73-66 WAS CONTINUED TO JANUARY 23, 1974 BY THE FOLLOWING VOTE: AYES: Spencer, Eadie, Ford NOES: None ABSENT: None ADMINISTRATIVE REVIEW NO. 73-204 (Cont. from 12/19/73) Applicant: John St. Amour To permit the construction of a 12,000 sq. ft. commercial building pursuant to S.9430 of the Huntington Beach Ordinance Code located on the north side of Bolsa Avenue approximately 150 ft. east of Springdale Street in the C-2, community business district. Mr. St. Amour, the applicant, was present. The Acting Secretary informed the Board that this application had been previously continued for finalization of the Environmental requirements. He further stated that the Environmental Review Board granted Exemption Declaration No. 73-216 January 2, 1974 with the following additional information: Architectural design and materials have been proposed which are compatible with the existing development, buffers have been provided over and across the existing property to the subject project, satisfactory signing has been planned, and the applicant has pursued the relocation of the building to eliminate the periphery drive which was adjacent to the rear yards of the abutting single-family residences. Treatment of the trash areas has also been satisfactorily resolved. The Acting Secretary outlined the proposal to the Board. Board discussed plans with applicant. The moving of a wall and replacing it with berming and the relocation of driveways were also discussed. Mr. St. Amour discussed the sign theme to be used as signs containing a white background with blue lettering. Board discussion followed. Conditions of approval were discussed. ON MOTION BY SPENCER AND SECOND BY EADIE ADMINISTRATIVE REVIEW NO. 73-204 WAS APPROVED WITH THE FOLLOWING CONDITIONS AS OUTLINED AND AMENDED BY THE FOLLOWING VOTE: A. TO BE COMPLETED PRIOR TO ISSUANCE OF -BUILDING PERMITS: 1. The revised plot plan received 11/12/73 shall be the approved layout as amended. Minutes: H.B. Board of Zoning Adjustments Wednesdays January 2, 1974 Page 3 2. A revised Plot Plan shall be submitted to the Board of Zoning Adjustments for Approval Action. Said plan shall reflect the relocation of the easterly driveway and rearrangement of the parking spaces displaced by the rearrangement. 3. Bolsa Avenue shall be dedicated to City standards at the time each parcel is developed. 4. Elevations of the proposed plan shall be submitted to the Board of Zoning Adjustments for review and approval action. 5. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 6. All buildings on lots abutting a City easement shall be set back five (5) feet from the edge of such easement. 7. Soil and compaction reports as required by the Building Department and the Department of Public Works shall be submitted to the City. B. TO BE COMPLETED PRIOR TO FRAMING INSPECTION: 1. A landscaping plan shall be submitted to the -Board of Zoning Adjustments for review and approval action. 2. Rooftop mechanical equipment shall be screened from view. Said screening plan shall be approved by the Board of Zoning Adjustments. 3. All signs for the Proposed Development shall be submitted to the BZA for approval. The BZA encourages signs which reflect a common theme with respect to design materials and colors which are compatible with the architectural theme of the proposed project. 4. Fire alarm system conduit and appurtenances shall be installed by the developer at locations and to specifi- cations provided by the Fire Department. 5. Parking compounds shall be screened with a combination of fencing and landscaping. Said plan shall be submitted to the Planning Department for review and approval. Fencing and landscape.plans shall include the following information: a. A list including quantities and sizes for each species of plants and all ground cover material. b. Irrigation layout to include meter location, pipe sizes, sprinkler head types, etc. c. Fencing materials and detail drawing. Minutes: H.B. Bolsa Avenue shall be fully improved including street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 2. All utilities shall be installed underground. 3. Off-street parking facilities shall conform to Article 979. 4. A masonry wall shall be constructed along the north and east property line. The height of said wall shall be such that the top will be six (6) feet above the highest ground surface within twenty (20) feet of the common property line. Except within the 42 inch in which case the height of said wall shall be reduced to 42 inches. 5. There shall be no fence, structure or landscaping constructed or maintained over 3 1/2 feet high within a 10 ft. by 10 ft. triangular area at the intersection of driveways and streets or within a 25 ft. by 25 ft. triangular area at the intersection of streets. 6. A lighting system shall be installed within the project equal in illumination to lighting on public streets. Lighting system shall be shielded to reflect away from adjoining properties and streets. D. TO BE COMPLETED PRIOR TO ISSUANCE OF CERTIFICATE OF OCCUPANCY: 1. Water supply shall be through the City of Huntington Beach's water supply system. 2. Sewage disposal shall be through the City of Huntington Beach's sewage system. 3. Easements for utilities or walkways shall be provided to Department of Public Works standards. 4. The property shall participate in the local drainage assessment district. 5. No structures, other than those shown on the approved plot plan, shall be constructed within the project. 6. Kniss To permit 414" encroachment into the required 5 ft. side yard in lieu of S.9103.2.1 of the Huntington Beach Ordinance Code located on the northeast corner of White Oak Lane and Vesper Circle in an R-1, low density residential district. Mr. Kniss, the applicant, was present. The Acting Secretary informed the Board that this application is a categorical exemption - class 5., California Environmental Quality Act, 1970. The Chairman opened the public hearing. Mr. Kniss presented his hardship to the Board as being in the nature of a drainage problem. He stated that he corrected his drainage problem with the construction of a side roof which currently exists on the site, and further stated that drainage had been diverted to the front of the house. He further informed the Board that due to the improper drainage situation, a block wall had been sinking. The Acting Secretary noted that no building permit had been obtained for the existing structure. As there were no parties present to speak in favor or opposition to Conditional Exception No. 73-69, the Chairman closed the public hearing. Board discussion followed. It was the concensus of the Board to continue this application for one week to allow time for an on -site inspection by the Department of Public Works. ON MOTION BY FORD AND SECOND BY EADIE CONDITIONAL EXCEPTION NO. 73-69 WAS CONTINUED TO JANUARY 9, 1974 BY THE FOLLOWING VOTE: AYES: Spencer, Eadie, Ford NOES: None r BSENT : None USE PERMIT NO. 72-84 (Continued from 2/14/73) Applicant: Eugh Shibasaki To permit the construction of a lawnmower shop, pursuant to S.9472 of the Huntington Beach Ordinance Code located on the southwest corner of Warner Avenue and B Street in the C-4, highway commercial district. Mr. Bob Mandic, representing the applicant, was present. Minutes: A.B. Board of Zoning Adjustments Wednesdays January 2, 1974 Page 6 The Acting Secretary informed the Board that this application had been continued indefinitely 2/14/73. At that time the Use Permit was exempt from Environmental Review Board requirements. The Acting Secretary further advised the applicant's representative to inquire at the Environmental office whether this application is still exempt from Environmental Review Board requirements. The Chairman opened the public hearing. As there were no parties present to speak in favor or opposition to Use Permit No. 72-84, the Chairman closed the public hearing. It was the concensus of the Board to continue this item for one week to allow staff to make further studies on this application. { ON MOTION BY EADIE AND SECOND BY SPENCER USE PERMIT NO. 72-84 WAS CONTINUED TO JANUARY 9, 1974 BY THE FOLLOWING VOTE: AYES: Eadie, Spencer, Ford NOES: None ABSENT: None CONDITIONAL EXCEPTION NO. 73-70 Applicant: The Presley Companies To permit an encroachment of 4 feet of building into air space required between buildings in a 69 unit apartment development in lieu of S.9310.26 of the Huntington Beach Ordinance Code located on the southwest corner of 17th Street and Garfield Avenue in an R-2, medium density residential district. Mr. Gary Gits of The Presley Companies, and Mr. Pat Kapp of Toups Engineering, representing the applicant were present. The Acting Secretary stated that this proposal is exempted from further Environmental Review as Exemption Declaration No. 73-107 was approved concerning the entire tract. The Chairman opened the public hearing. Board reviewed the proposed exception to the Ordinance Code with the applicant. The Acting Secretary pointed out to the Board that no construction has taken place at the subject site to date. Mr. Gits outlined the concept of his plan to the Board. Minutes: H.B. A motion was made by Ford to Approve Conditional Exception No. 73-70. Motion died for lack of second. ON MOTION BY SPENCER AND SECOND BY EADIE CONDITIONAL EXCEPTION NO. 73-70 WAS REFERRED TO THE PLANNING,COMMISSION FOR THE FOLLOWING REASONS BY THE FOLLOWING VOTE: 1. The existing tentative map previously approved, indicated the'existing code violation. As this application has previously been approved as a precise plan, the Planning Commission should investigate the proposed encroachment. 2. The Chairman felt that a hardship had not been demonstrated. AYES: Spencer, Eadie, Ford NOES: None ABSENT: None. ADMINISTRATIVE REVIEW NO. 73-224 Applicant,:. W—Sterling Buck & Assoc. To.permit the construction of a 3 bedroom house pursuant to S.9161.2 of the Huntington Beach Ordinance Code located on the northwest corner of 18th Street and Acacia in an R-2, medium density residential district. Mr. DeLeonardis, representing the applicant, was present. The Acting Secretary informed the Board that this application is a categorical exemption - class 3, California Environmental Quality Act, 1970. The Acting Secretary further stated that this application met ordinance code requirements. Board discussed plans with applicant. Board discussion followed. Conditions of approval were discussed. ON MOTION BY FORD AND SECOND BY SPENCER ADMINISTRATIVE REVIEW NO. 73-224 NAS APPROVED WITH THE FOLLOWING CONDITIONS AS OUTLINED AND AMENDED BY THE FOLLOWING VOTE: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. Mr. DeLeonardis, representing the applicant, was present. ,The Acting Secretary informed the Board that this application -is a categorical exemption - class 3, California Environmental Quality Act, 1970. The Board discussed plans with the applicant's representative. Method of screening parking area, was discussed. The Acting Secretary informed the Board that plan was in conformance to ordinance code requirements. Board discussion followed. Conditions of approval were discussed. Conditions of approval were discussed. ON MOTION BY FORD AND SECOND BY EADIE PLOT PLAN AMENDMENT NO. 73-06 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: 1. All former administrative actions shall be complied with. 2. All applicable ordianances shall be complied with. 3. The plot plan received 10/13/73 shall be the approved layout. AYES: Spencer, Ford, Eadie NOES: None ABSENT: None ADMINISTRATIVE REVIEW NO. 73-223 Applicant: Huntington Beach Industrial Park To permit the construction of an industrial building pursuant to 5.9511 of the Huntington Beach Ordinance Code located on the southeast corner of McFadden Avenue and Container Street in an MI -A Restricted Manufacturing District. Mr. George Lusk, owner of the industrial park, and Mr. Harding, Architect, representing the applicant were present. The Acting Secretary informed the Board that the Environmental Review Board granted Exemption Declaration No. 73-126 July 31, 1973. Board discussed plans with applicant's representative. Berming along the proposed building was discussed, as well as parking and driveway locations. It was the concensus of the Board to continue this application for one week to allow applicant time to submit revised plans showing sign program as well as architectural revisions.
