CONSENT CALENDAR
ON MOTION BY HIGGINS AND SECOND BY WALLIN THE MINUTES OF DECEMBER
11, 1973 AND DECEMBER 18, 1973 WERE APPROVED AS AMENDED BY THE
FOLLOWING VOTE:

REGULAR AGENDA ITEMS
LEGAL OPINION: Planning Commission Authority on Tentative Tracts
Assistant City Attorney John O'Connor distributed a Memorandum
Opinion on Regulation of Subdivisions.
The Commission briefly discussed the memorandum and Commissioner
Wallin recommended that at the January 22nd meeting consideration
should be given to possible ordinance changes.
DISCUSSION: Policy Decision re Tentative Tracts and Zone Cases
in Phase I. Land Use Special Planning Unit Areas
The Commission discussed the six alternatives suggested by the
staff in the staff report, and noted that goals and objectives
and priorities will be discussed at January__22nd meeting.
Planning reserve areas were discussed.
ON MOTION BY BOYLE AND SECOND BY PORTER AMENDED ALTERNATIVE NO. 1,
AS INDICATED BELOW, TO BE DISCUSSED AT JANUARY 29, 1974 MEETING,
BY THE FOLLOWING VOTE:
Alternative No. 1 (Amended): Allow applications to proceed in
accordance with existing zoning. Staff to advise all applicants
that areas are under study.

CONDITIONAL EXCEPTION NO. T3-64 REQUEST:
To permit a reduction of the parking requirement from 4.5 to 3.3
spaces per unit in lieu of Section 9310.23 of the Huntington Beach
Ordinance Code, and a zero ft. setback from the public street in
lieu of the required fifteen (15) feet minimum as stated in Section
9310.14 of the Huntington Beach Ordinance Code.
CONDITIONAL USE PERMIT NO. 73-052 REQUEST:
To permit the construction of 120 unit planned residential develop-
ment.

To subdivide 23.4 acres into 120 lots.
Subdivider: Harbour Pacific Ltd.
This property is located at the southwest corner of Edinger and
Trinidad Lane.
Commission discussed proposed Code Amendment No. 74-2 generally
referred to as "Definition Revision". Staff recommendations were
also reviewed by the Commission, which suggested a continuance to
March 5, 1974.
Mr. Dale Dunn, Development Manager of Huntington Harbour, addressed
the Commission and stated that he had read the staff report and
recommendations, and that the recommended action only dealt with
one facet of the applications. He passed out copies of suggested
procedural steps for processing Tentative Tract 5483 and Conditional
Use Permit 73-052.
Chairman Kerins opened the public hearing.
Mr. Art Knox addressed the Commission and spoke in opposition to
the project. He stated that he had been elected President of the
Huntington Harbour Homeowners Association and as a result of their
meeting he had filed with the local newspaper a Notice of Intent
to Circulate a,Petition within the City of Huntington Beach for
the purpose of negating approval of these applications should they
be passed by the Commission.
The public hearing was closed.

There was a discussion on a grading permit, which according to
rlr. Palin, was issued for the construction of the least tern
nesting site and at the time the emergency permit was authorized
it was assumed that material would come out of the general area
of the new channel. Instead, the Commission was informed that the
material came out of the general area of the proposed lagoon.
Commission discussed continuance of all three items to a later
date. There was also a discussion on the Environmental Impact
Report.
A IMOTION WAS MADE BY WALLIN AND SECONDED BY BOYLE TO CONTINUE
CONDITIONAL EXCEPTION NO. 73-64, TENTATIVE TRACT NO. 5483 AND
CONDITIONAL USE PERMIT NO. 73-052 TO MARCH 5, 1974.
Staff discussion followed concerning amending the motion to
continue to a Study Session.
Mr. William Duncan, Vice President of Huntington Harbour, spoke
in favor of the project and the procedural steps suggested by
Huntington Harbour Corp.
Mr. Art Knox spoke again and stated that he did not feel a
continuance was justified at this time.
COMMISSIONER BOYLE WITHDREW HIS SECOND FROM THE MOTION.
He stated that he felt the public hearing should be reopened.
COIR4ISSIONER BAZIL SECONDED THE MOTION.
He stated that he felt that his reason for seconding the motion
was that the Commission could not look at the project as it was
presented with any way other than denial until it complies with
the Ordinance, and that the project does have merit.
Mr. Dale Dunn agreed to a continuance to March 5, 1974.

There was a discussion on time limit within which an application
must be acted on and the problems of documentation of the Environ-
mental Impact Reports within the time limits. Staff was requested
to come back with recommendations as to how this problem can be
solved at the next study session.
SIGN APPEAL
APPLICANT: Heath & Company
APPELLANT: Commissioners Kerins and Porter
The sign is located at Public Storage, 5892 McFadden, Huntington
Beach, California, and was approved by the Board of Zoning Adjust-
ments on November 28, 1973.
The Acting Secretary stated that the applicant had requested a
continuance to February 5, 1974.

TO FEBRUARY 5, 1974 BY THE FOLLOWING VOTE:

Chairman Kerins directed staff to contact Lusk Developers and
request that they have a representative present at the meeting
of February 5, 1974 to discuss signing program for the Lusk
Industrial Tract.
PRECISE PLAN OF1 STREET ALIGNMENT NO. 69-1
Applicant: Planning Commission
Request is to amend the alignment of Elm Street located approximately
660 ft. north of Slater Avenue, 330 ft. west of Beach Boulevard.
Vugraphs were presented and staff recommendations were discussed.
Andy Vanderlaan, representative from the Fire Department, discussed
circulation in�the area. There was a discussion on the water well
and it was noted that it is in use at the present time with no
immediate plans for abandonment.
The Commission did not find staff's recommendation for alignment
acceptable.
Commissioner Bazil suggested that staff work on a loop around the
well with an island situation and all Commissioners concurred.
DISCUSSION: Planning Commission Position Statement on Metropolitan
Water District

Staff was directed to prepare a cover letter to the City Council
from the Planning Commission enclosing the position statement with
amendments as•requested by the Commission.

TENTATIVE TRACT NO. 8192
Applicant: Covington Bros.
Mr. Bob Fitzpatrick presented a letter and maps requesting an
amendment to the Tentative Tract. Said amendment would permit
the applicant to complete the tract in two phases, with construc-
tion on the second phase to begin no later than six months after
the first phase.
Commissioners discussed the request with Mr. Fitzpatrick.

shall be complied with.
2. The revised Tentative Tract Map received January 4, 1974 shall
be the approved layout.

COMMISSIONERS' COMMENTS
Chairman Kerins stated that Mr. Richard Harlow had been appointed
Planning Director of the City of Huntington Beach but would be
attending classes on Tuesday evenings until January 29th with
Mr. Ed Selich conducting the meetings during the interim period.

UP A RESOLUTION OF COMMENDATION FOR MR. REYNOLDS FOR SERVICE TO THE

Commissioner Geiger addressed the Commission and passed out maps
indicating bus routes. He discussed the January 7th meeting
between representatives of the Orange County Transit District and
City Council on proposed methods of transit. He stated that OCTD
was interested in learning if the City of Huntington Beach was
willing to support high density rapid transit. It was the consensus
of the Commission that this item should be put on the agenda for
January 15th. Bus routes were discussed and Commissioner Geiger
stated that the OCTD had requested recommendations on bus routes.
Commissioner Wallin asked Assistant City Attorney John O'Connor
if he had reviewed the Multi -Story draft prior to its being sent
to members of the High Rise Committee. Mr. O'Connor stated that
he had reviewed it.
Commissioner Wallin discussed a three hour meeting on the Bolsa
Chica with members of Fish and Game, Signal Oil, Park and Recrea-
tion, and Coastal Commission in attendance, or a total of some 130
in attendance. She stated that $100,000 has been budgeted for
this area.
Commissioner Bazil requested that an ordinance be prepared to
cover a zero yard setback.

Chairman Kerins requested that the Board of Zoning Adjustments
Action Agenda have the date of the meeting typed in lower right
corner of each page.
STAFF'S COMMENTS
Jim Palin discussed plans of the Kendall Development Co. stating
that they had requested the Commission's opinion on the concept
so that it'could be incorporated into the Environmental Impact
Report. It was the concensus of the Commission that the same
plan had been previously presented and the Commission did not
feel it met the intent of a PRD, particularly in the periphery
area. Commission directed Mr. Palin to listen to the tape of the
previous meeting to get the correct information.
Ed Selich advised the Commission of a meeting of the Planning
Commission Institute to be held February 6, 7, and 8 at the Riviera
Hotel in Palm Springs. Commissioners were furnished brochures.
