The Acting Secretary informed the Board that the Environmental
Review Board granted Exemption Declaration No. 73-244 January
8, 1974 with the following additional information:
The project is only a shell building with no specific
use proposed; therefore, it is impossible to determine
at this time the total environmental impact of the
ultimate use.
The Acting Secretary further informed the Board that he was
unsuccessful in contacting the applicant to discuss his plans;
and recommended a continuance of two weeks to allow applicant
time to submit revised plans.

Applicant: Arthur Lehtola
To permit the reduction in the minimum setback for a front
entry garage from 22 ft. to 14 ft. in lieu of S.9103.3
and S.9106.2 of the Huntington Beach Ordinance Code located
on the northwest corner of Hollywood Lane and Caliente Drive
in an R-1, low density residential district.
Mr. Lehtola, the applicant, was present.
The Acting Secretary outlined the proposal to the Board.
A field check by Jay Ford indicated that a drainage problem
does not exist. Mr. Ford stated that he failed to notice
anything that would represent any large amount of drainage
flow, and added that the field check was made during an extensive
rainfall. Mr. Ford further felt that the garage is adequate
and that the construction of a new garage was not necessary.
The Chairman opened the public hearing.
The applicant questioned the Board as to how he could modify
his plan to meet ordinance code requirements. Open space
was discussed. The applicant further stated that he was
able to take the roof off of his patio to meet open space
requirements.
As there were no parties present to speak in favor or opposition
to Conditional Exception No. 73-67, the Chairman closed the public
hearing.

Board discussed various ways of revising the plan to meet ordinance
code requirements with the applicant. The applicant felt that
withdrawal of his application would allow him more time to make
further decisions on his proposed project.

The Acting Secretary informed the Board that the Environmental
Review Board granted Exemption Declaration No. 73-126 July 31, 1973.
The Acting Secretary outlined the proposal to the Board. Plans were
discussed. It was the concensus of'the Board that the revised plan
met ordinance.code requirements. Elevations were discussed.
Board discussion followed.
Conditions of approval were discussed.

73-223 WAS APPROVED WITH THE FOLLOWING CONDITIONS AS OUTLINED AND,

A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The revised plot plan received 1/3/74 shall be the approved
layout.
2. McFadden Avenue and Container Street, and Industry Lane shall be
dedicated to City standards at the time each parcel is developed.
3. Elevations of the proposed plan received 1/9/74 shall be;the
approved elevations.
4. The water, sewer, and fire hydrant system shall be approved
by the Department of Public Works and Fire Department.

parcels into two (2) shall be submitted to the City.
B. TO BE COMPLETED PRIOR TO FRAMING INSPECTION:
1. A landscape plan shall be submitted to the Board of Zoning
Adjustments for review and approval actions. Said plan shall
contain indications of berming along McFadden Avenue and
shall contain a graphic cross section indicating the
height of said berm.
2.
Rooftop mechanical equipment shall be screened from view.
Said screening plan shall be approved by the Board of
Zoning Adjustments.
3.
All signs for the Proposed Development shall be submitted to
the BZA for approval and shall be limited to building or
wall signs only. The BZA encourages signs which reflect
a common theme with respect to design materials and colors
which are compatible with the architectural theme of the
proposed project.
4.
Fire Alarm system conduit and appurtenances shall be installed
by the developer at locations and to specifications provided
by the Fire Department.
5.
Parking compounds shall be screened with a combination of
fencing and landscaping. Said plan shall be submitted to
the Planning Department for review and approval. Fencing
and landscape plans shall include the following information:
a. A list including quantities and sizes for each species
of plants and all ground cover material.
b. Irrigation layout to include meter location, pipe
sizes, sprinkler head types, etc.
c. Fencing materials and detail drawing.
C. TO BE COMPLETED PRIOR TO FINAL INSPECTION:
1. McFadden and Container and Industry Street shall be fully
improved including street trees, street signs, street lights,
fire hydrants, sewer and water main extensions.
2. All utilities shall be installed underground.
3. Off-street parking facilities shall conform to Article 979.

4. There shall be no fence, structure or landscaping constructed
or maintained over 3 1/2 feet high within a 10 ft. by 10 ft.
triangular area at the intersection of driveways and streets
or within a 25 ft. by 25 ft. triangular area at the intersection
of streets.
D. TO BE COMPLETED PRIOR TO ISSUANCE OF CERTIFICATE OF OCCUPANCY:
I. Water supply shall be through the City of Huntington Beach's
water supply system.
2. Sewage disposal shall be through the City of Huntington Beach's
sewage system.
3. Easements for Utilities or Walkways shall be provided to
Department of Public Works standards.
4. The property shall participate in the local drainage assessment
district.
5. No structures, other than those shown on the approved plot plan,
shall be constructed within the project.
6. All applicable City Ordinances shall be complied with.
7. All applicable conditions of approval of Tentative Tract
#6948 shall be complied with.
8. The required Division of Land once approved by the City
shall be recorded.
9. A Parcel Map shall be filed with the City and recorded
prior to the issuance of Certificate of Occupancy of
any structures on any parcel.
10. Reciprocal agreements for ingress and egress and parking
shall be submitted to the City naming the City -as a part
thereof. Said document shall be approved in concept by
the City Attorney.

To permit a 414" encroachment into the required 5' side yard in
lieu of S.9103.2.1 of the Huntington Beach Ordinance Code located
on the northeast corner of White Oak Lane and Vesper Circle in an-
R-1, low density residential district.

Mr. Kniss, the applicant, was present.
The Acting Secretary advised the Board that this application
is a categorical exemption - Class 5, California Environmental
Quality Act, 1970.
The Acting Secretary outlined the proposal to the Board.
The Chairman opened the public hearing.
The applicant presented his hardship as being in the nature
of a severe drainage problem. He stated that he solved his
drainage problem with the construction of the present side
yard roof.
Mr. Jay Ford performed a site inspection during heavy rainfall
and strong winds and reported that most of the rain water was
splashing back into the yard. The Board felt that perhaps
the installation of rain gutters may solve the drainage problem.
Mr. Kniss stated that he has tried several other ways to devert
the water flow but to no avail. Mr. Ford stated that during
his inspection he found no water flowing onto the neighbors
property, and further felt that no damage had been done to
the neighbors property due to the drainage problem.
Mr. Kniss stated that he would be able to contact his carpenter
and reconstruct his side structure to meet ordinance code
requirements.
As there were no other parties present to speak in favor or
opposition to Conditional Exception No. 73-69, the Chairman
closed the public hearing.
Board discussion followed. It was the concensus of the Board that
the applicant was able to meet ordinance code requirements.
ON MOTION BY EADIE AND SECOND BY GERARDEN CONDITIONAL EXCEPTION
NO. 73-69 WAS DENIED FOR THE FOLLOWING REASONS BY THE FOLLOWING
VOTE:
1. The proposal creates a substantial increase into a side
. yard having a width in excess of the minimum required.
2. Comments relative to the drainage problem due to location
and engineering on site can be rectified by means other
than an encroachment and does not demonstrate a justifiable
hardship.

Applicant: Eugh Shibasaki
To permit the construction of a lawnmower shop pursuant to S.9472
of the Huntington Beach Ordinance Code located on the southwest
corner of Warner Avenue and B Street in the C-4, highway commercial
district.
The Applicant was not present.
The Board reviewed the plans. The Acting Secretary proposed a
one month continuance to allow time to request a report from the
City Administrator's office as to the disposition for acquisition
of Warner Avenue and further instruct the Department of Public
Works to meet with the applicant and indicate to him what alternatives
are available to him. Board concurred with continuance.

To permit the construction of a 19 unit apartment complex pursuant
to S.9162.3.1 of the Huntington Beach Ordinance Code located on
the northwest corner of Florida Street and Clay Avenue in an R-2,
medium density residential district.
Mrs. Doris Martinez, representing the applicant, was present.
The Acting Secretary informed the Board that the Environmental Review
Board granted Exemption Declaration No. 73-92 July 10, 1973.
The Acting Secretary outlined the proposal to the Board, and further
stated that a plan check revealed no ordinance code violations.
Board discussed plans with applicant.
The Chairman opened the public hearing.
Mrs. Wood, mother of the applicant, was present to speak in favor
of the proposal.
As there were no other parties present to speak in favor or opposition
to Use Permit No. 73-92, the Chairman closed the public hearing.

APPROVED WITH THE FOLLOWING FINDINGS AND WITH THE FOLLOWING CONDITIONS
AS OUTLINED AND AMENDED BY THE FOLLOWING VOTE:
FINDINGS:
The establishment, maintenance and operation of the use will not
be detrimental to:
1. The general welfare of persons residing or working in the
vicinity.
2. Injurious to property and improvements to the vicinity of such
use or building.
3. That the granting of a Use Permit will not adversely affect the
Master Plan of the City of Huntington Beach.
CONDITIONS OF APPROVAL:
GENERAL:
1. All exterior walls and ceilings shall receive full insulation.
2. All construction debris shall be removed from the construction
site and shall be dumped at an off -site solid waste disposal
site, especially allocated for such use.
3. Both natural gas and electricity shall be provided for clothes
dryers to alleviate the possible drain on any one energy source.

1. The plot plan received 12/27/73 shall be the approved
layout as amended thereon.

USE PERMIT NO. 73-90
Applicant: Harry L. Scholer
To permit the construction of a 66 unit apartment complex
pursuant to S.9202.3.1.3 of the Huntington Beach Ordinance
Code located on the east side of Algonquin Street, approximately
210 ft. north of Warner Avenue in an R-3, medium -high density
residential district.
Mr. Griffin, architect for the project, representing the applicant,
was present.
The Acting Secretary informed the Board that the Environmental
Review Board granted Exemption Declaration No. 73-49 December 26,
1973 with the following information:
In light of extensive changes to the plan which had previously
been approved, it was the determination of the Environmental
Review Board that these changes did not materially affect
the environmental impact of the project and that no further
action is necessary under the environmental review process.
Board reviewed plans with the applicant. Landscaping and parking
bumpers were discussed. Fire Captain Vanderlaan expressed his
concerns regarding access ways to the project. After reviewing
the plans, he felt that additional access ways are needed. Board
discussed parking layout and elevations with the applicant.
The Chairman opened the Public Hearing.
As there were no parties present to speak in favor or opposition
to Use Permit No. 73-90, the Chairman closed the public hearing.
Board discussion followed.

1. A landscaping plan shall be submitted to the Planning

2. The identification sign shown on the elevations dated
December 21, 1973 shall be the approved copy and design.
No other signs shall be permitted.

installed by the developer at locations and to specifications
provided by the Fire Department.

Mr. Jack Wallace, representing the applicant, was present.
The Acting Secretary informed the Board that the Environmental
Review Board granted Exemption Declaration No. 73-238 January 2, 1974
with the following additional information:
The supplementary information as presented indicates that there
have been sufficient precautions taken to avoid negative environmental
impact.
Based upon a commitment from the applicant, the Board recommends that

no oiling be applied to any portion of said access road and/or
to any portion of the site for weed control.
Mr. Wallace explained the proposal to the Board. He stated that this
was an old well which last produced in 1964. He further stated that
the well existed and that they planned on testing before -any extensive
drilling would commence. Mr. Wallace further stated that the access
road was to be graveled and that excess water will go into City
sewage system.
Mr. Herb Day, of the Oilfield Department, was present and stated that
this application met oil code requirements. He further stated that
the application should be conditioned that after a reasonable testing
period, well should be permanently abandoned.
