To permit the construction of a mobile home park pursuant to
5.9242.1 of the Huntington Beach Ordinance Code located on the
southwest corner of Newland Street and Ellis Avenue in an MH,
Mobile Home Park District.
The Acting Secretary informed the Board that the Environmental
Review Board rejected Exemption Declaration No. 73-204 January
15, 1974 and found the necessity of an Environmental Impact
Report. He further recommended a continuance to allow applicant
to meet Environmental Review Board requirements. Board concurred
with continuance.

DIVISION OF LAND NO. 73-25
Applicant: Michael Janes
To permit the realignment of two existing parcels of land pursuant
to S.9811.3 of the Huntington Beach Ordinance Code located on the
west side of Delaware Street, approximately 165 feet north of Clay
in an R-2, medium density residential district.
In Conjunction With:

Applicant: Michael Janes
To permit the construction of a 34 unit apartment building pursuant
to S.9162.3.1 of the Huntington Beach Ordinance Code located on
the west side of Delaware Street, approximately 165 feet north of
Clay in an R-2, medium density residential district.
Mr. George Alvarez, representing the applicant, was present.
The.Acting Secretary informed the Board that the Environmental Review
Board granted Exemption Declaration No. 73-246; pertaining to
Conditional Exception No. 73-71, Division of Land No. 73-35, Use
Permit No. 73-91 January 15, 1974 with the following additional
information:
The project would be enhanced by the following:
1. The construction with full insulation of all exterior walls
and ceilings to reduce the burden on heating and cooling
systems.
2. The disposal of all building spoils, such as unusable lumber,
wire, pipe, and other surplus or unusable material at an off -
site facility equipped to handle them.
3. The stubbing in of natural gas at the locations of clothes
dryers, cooking facilities, water heaters, and central
heating units to alleviate the possible drain on any one
energy source.
4. The staggering of the buildings to provide a variation in
setbacks to alleviate the visual impact of the project.
The Acting Secretary outlined the proposals to the Board: He further
felt that no major difficulties existed on the plans except for the
Conditional Exception, whereas the applicant requested carports instead
of garages.

The Chairman opened the public hearing on Conditional Exception
No. 73-71 and Use Permit No. 73-91.
The Acting Secretary stated that the building would look better
aesthetically if it were broken up instead of one continuous
long building. Type of building material was discussed.
Elevations were discussed.
The applicant's representative stated that the division of land
was necessary to create a larger parcel for this development.
It was the concensus of the Board that the project necessitated
garage doors due to the R-2 Zoning and where the proposed project
is to be located.
As there were no parties present to speak in favor or opposition
to Conditional Exception No. 73-71 and Use Permit No. 73-91,
the Chairman closed the public hearing.
Board discussion followed.
Conditions of approval were discussed.
ON MOTION BY GERARDEN AND SECOND BY EADIE CONDITIONAL EXCEPTION
NO. 73-71 WAS APPROVED WITH THE FOLLOWING FINDINGS AND THE FOLLOWING
CONDITIONS BY THE FOLLOWING VOTE:
FINDINGS:
1. The granting of the Conditional Exception will not be inconsistent
with prior actions of the Board of Zoning Adjustments for like
developments.
2.- The granting of the Conditional Exception will not adversely
affect the neighboring property and vicinity.
3. The granting of the Conditional Exception will create a more
functional parking area for the development.
CONDITIONS OF APPROVAL:
1. The plot plan received December 26, 1973 shall be the approved
layout.
2. The wall construction on the "0" property line shall be of a
decorative concrete or masonry material.
3. Approval of the Conditional Exception does not include waiver
of garage door requirements for R-2 Zone.

ON MOTION BY GERARDEN AND SECOND BY FORD DIVISION OF LAND NO.
73-35 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING
VOTE:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. Revised tentative parcel map shall be submitted to the
Planning Department reflecting accurate parcel dimensions.
2. The parcel map received 12/26/73 shall be the approved
layout.
3. Delaware Avenue and Huntington Avenue shall be dedicated
to City standards at the time each parcel is developed.
4. Division of Land shall not be effective until a covenant
and agreement is signed agreeing to the conditions of approval.
B. TO BE COMPLETED PRIOR TO OCCUPANCY OR ISSUANCE OF A CERTIFICATE
OF OCCUPANCY:
1. A Parcel Map and the Covenant and Agreement shall be filed
with the City and recorded prior to issuance of a Certificate
of Occupancy of any structures on any parcel.
2. A copy of the recorded parcel map shall be submitted to the
Planning Department.
3. Water supply shall be through the City of Huntington Beach's
water supply system at the time each parcel is developed.
4. Sewage disposal shall be through the City of Huntington Beach's
sewage system at the time each parcel is developed.
5. The property shall participate in the local drainage assessment
district at the time each parcel is developed.
6. All utilities shall'be installed underground at the time each
parcel is developed.
7. All applicable City Ordinances shall be complied with.
GENERAL:
1. The project shall be constructed with full insulation of all

WAS APPROVED WITH THE FOLLOWING FINDINGS AND THE FOLLOWING CONDITIONS
AS OUTLINED AND AMENDED BY THE FOLLOWING VOTE:
FINDINGS:
The establsihment, maintenance and operation of the use will
not be detrimental to:
1. The general welfare of persons residing or working in the
vicinity.
2. Injurious to property and improvements to the vicinity
of such use or building.
3. That the granting of a Use Permit will not adversely
affect the Master Plan of the City of Huntington Beach.
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The plot plan received 12/26/73 shall be the approved
layout.
2. A revised Plot Plan shall be submitted to the Planning
Department for approval action depicting a staggering
effect of the length of units on the north and west
property lines with a minimum building offset of 4 feet.
3. Delaware Avenue shall be dedicated to City standards at
the time each parcel is developed.
4. Elevations of the proposed plan received 12/26/73 shall
be the approved elevations.
5. The water, sewer, and fire hydrant system shall be approved
by the Department of Public Works and Fire Department.
6. All buildings on lots abutting a City easement shall be
set back five (5) feet from the edge of such easement.
7. Soil and compaction reports as required by the Building
Department and the Department of Public Works shall be
submitted to the City.
8. All applicable conditions of Division of Land No. 73=35
and Conditional Exception No. 73-71 shall be complied with.

9.- Rooftop mechanical equipment shall be screened from view.
Said screening plan shall be approved by the Building
Department.
B. TO BE COMPLETED PRIOR TO FINAL INSPECTION:
1. Fire alarm system conduit and appurtenances shall be installed
by the developer at locations and to specifications provided
by the Fire Department.
2. Delaware Avenue shall be fully improved including street
trees, street signs, street lights, fire hydrants, sewer
and water main extensions.
3. All utilities shall, be installed underground.
4. Off-street parking facilities shall conform to Article 979.
C. TO BE COMPLETED PRIOR TO ISSUANCE OF CERTIFICATE OF OCCUPANCY:
1. The Division of Land approved by the City shall be recorded.
2. A Parcel Map shall be filed with the City and recorded
prior to occupancy.
3. Water supply shall be through the City of Huntington Beach's

Applicant: Jacobson & Applebee
To permit the construction of an industrial building pursuant
to 5.9511 of the Huntington Beach Ordinance Code located on the
south side of Research, approximately 135 ft. east of Container
in a 100-M1-15,000 light industrial district.
Messrs. Reef, Jacobson and Applebee, the applicants, were present.
The Acting Secretary informed the Board that the Environmental
Review Board granted Exemption Declaration No. 73-126 July 31, 1973
for Tract 8327.
The Acting Secretary further stated that a plan check revealed
no major code violations.
Board discussed plans with applicants.
The possibility of flipping the plan over was discussed. The
applicants felt that this would add great expense to their proposed
project. Landscaping was discussed.
Board discussion followed.
Conditions of approval were discussed.
ON MOTION BY EADIE AND SECOND BY FORD ADMINISTRATIVE REVIEW NO.
74-2 WAS APPROVED WITH THE FOLLOWING CONDITIONS AS OUTLINED AND
AMENDED BY THE FOLLOWING VOTE:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The plot plan received 1/4/74 shall be the approved layout.
2. The letter of approval as outlined by conditions of Tentative
Tract 6948 is to be submitted to the Planning Department.
•3. A landscaping plan shall be submitted to the Planning
Department for review and approval action.
4. Rooftop mechanical equipment shall be screened from view.
Said screening plan shall be approved by the Building
Department.
5. Research Drive shall be dedicated to City standards at the
time each parcel is developed.

C. TO BE COMPLETED PRIOR TO ISSUANCE OF CERTIFICATE OF OCCUPANCY:
1. Water supply shall:be through the City of Huntington Beach's
water supply system.
2. Sewage disposal shall be through the City of Huntington Beach's
sewage system.
3. Easements for utilities or walkways shall be provided to
Department of Public Works standards.
4. The property shall participate in the local drainage assessment
district.

Applicant: Bruce L. Smith
To permit a 7 ft. encroachment into the minimum 22 ft. required
for a front entry garage in lieu of 5.9106.2.1.1 of the Huntington
Beach Ordinance Code located approximately 120 ft. north of
Colbreggan on the west side of Callieburn Circle in an R-1,
low -density residential district.
The applicant was not present.
The Acting Secretary informed the Board that this application
is a categorical exemption, class 5, California Environmental
Quality Act, 1970.
The Chairman opened the public hearing.
As there were no parties present to speak in favor or opposition
to Conditional Exception No. 74-1, the Chairman closed the public
hearing.
ON MOTION BY GERARDEN AND SECOND BY FORD CONDITIONAL EXCEPTION
NO. 74-1 WAS DENIED FOR THE FOLLOWING REASONS BY THE FOLLOWING
VOTE:
1. The shape and configuration of this property would not
prohibit conventional development at a 22 ft. setback.
2. If the building, as presented were reversed, it could,
with minor modification, meet the required setback.
3. The 7-1/2 ft. setback on this property would not be
consistent with the staggered setback previously
approved for this subdivision at the time of initial
development.
4. The applicant has failed to demonstrate a justifiable
hardship.

located approximately 351 feet west of Magnolia on the north side of
Adams in a C-2, commercial retail district.
Mr. Charles Lamb, representing the applicant, and Mr. Irving Snyder,
the applicant, were present.
The Acting Secretary informed the Board that this application is
a categorical exemption, class 5, California Environmental Quality
Act, 1970.
Board discussed plans with applicant and his representative.
The Chairman opened the public hearing.
It was the concensus of the Board that the sign must be brought
down to a 25 ft. height. Various ways of reorganizing the signs
were discussed. The Board suggested that some of the sign copy
be transferred onto another sign. Mr. Snyder, at this point,
stated that he was not ready to build another sign due to lack
of tenants. Color scheme was discussed.
It was the applicant's wish to withdraw his application and re-
build the sign to meet ordinance code requirements.

Education Department
The Acting Secretary presented a request for a special permit
through the City Administrator's Office which has been submitted
to the Board of Zoning Adjustments for comment and review.
Traffic Rodeo to be held on Shipley Street between 17th Street and
Adams Avenue January 17, 18, 21, 22, and 23. Classes for 400
students will be held from 8:00 A.M. until 2:30 P.M. each of these
days.
The Board reviewed and approved said event with the following
suggested condition of approval.
1. If the activity is authorized by the City, it shall be
supervised by a member of the Huntington Beach Police
Department or a member of the Traffic Division.
The Board discussed the revising of Standard Conditions of
Approval. The Division of Land Standard Conditions of Approval
are currently waiting legal opinion from the City Attorney's
office.
