COMMISSIONERS ABSENT: Higgins NOTE: A TAPE RECORDING OF THIS MEETING IS ON FILE IN THE PLANNING DEPARTMENT OFFICE. CONSENT CALENDAR ON MOTION BY GEIGER AND SECOND BY BOYLE THE MINUTES OF JANUARY 15, 1974 WERE APPROVED AS AMENDED BY THE FOLLOWING VOTE: AYES: Geiger, Bazil, Kerins, Wallin, Boyle NOES: None ABSENT: Porter, Higgins REGULAR AGENDA ITEMS DISCUSSION - EXPANSION OF USE PERMIT APPLICATIONS Secretary Harlow stated that the purpose of this discussion was to cover the expansion of Use Permit applications to include duplexes and up. It was included on the Agenda at the request of Commissioner Wallin which was made at the December 18, 1973 Planning Commission meeting. The Commission at that time also expressed an interest in discussing inclusion of Environmental Review Board recommendations on Tentative Tracts through such techniques as Code Amendments. Mr. Dave Eadie, Secretary of the Board of Zoning Adjustments, addressed the Commission and stated that there had not been any occasions when an applicant had not been willing to accept the Environmental Review Board recommendations. Deputy City Attorney O'Connor stated that the Environmental Review Board has authority only to examine a proposed project and to prepare an Environmental Impact Report or grant a Negative Declaration. The authority to impose the recommendations still lies with the body approving the project. There was a discussion on insulation. Secretary Harlow stated that it would be preferable to discuss this item when it came up later in the Agenda under the 1974 Work Program (Item 7. of the Subdivision Section). Commissioner Porter stated that Mr. John Behrens, Director of Building and Community Development, Minutes: H.B. Planning Commission Tuesday, January 29, 1974 Page 2 had spoken before the Mayor's Energy Committee and stated that he was reluctant to impose any conditions on insulation until the State presents their standards. DISCUSSION - PRIORITIES WITHIN SPECIAL PLANNING UNITS IN LAND USE PHASE I Secretary Harlow addressed the Commission and stated that at the January 8, 1974 Planning Commission meeting, staff was directed to evaluate each special planning unit area in order to determine what areas should have the highest priority. Mr. Ed Selich addressed the Commission and discussed the priorities of the different areas, stating that large land holdings have the least priority. Chairman Kerins inquired when Phase II of the Land Use Element would be completed, and Mr. Selich indicated that it should be completed in four months. PRESENTATION - PARKING STUDY Secretary Harlow addressed the Commission and stated that staff had requested a rescheduling of this item because further direction was needed from the Commission at this point. Mr. Ed Selich addressed the Commission and stated that the staff could proceed with a Code Amendment or expand the study. Mr. Selich said that the two points covered at this time were (1) analysis of the design criteria and (2) analysis of parking ratio within industrial, commercial, and residential areas. Commission directed staff to continue with original objective and to schedule the study for the February 13th adjourned meeting. DISCUSSION - CODE AMENDMENT NO. 73-24 (-AR SUFFIX) (Continued from 12/18/73) The standards for the Alternative Residential Suffix District reflect a combination of existing standards found in the Rl, R2, R3, and R4 Districts. Proposed sections include: Purpose; designation of a new district suffix, -AR; Property Development Standards; yard requirements and setbacks; exceptions; and the location of fences, walls, and hedges. Mr. Fred Ritter addressed the staff and noted that this was the seventh draft. Mr. Ritter pointed out the changes that had been made from the previous draft. Commission then reviewed the draft, page by page, amending as required. Staff was directed to amend the proposed Code Amendment and set for study on the February 13th adjourned meeting with remaining problems worked out. -2- 1/29/74 - PC Minutes: H.B. Planning Commission Tuesday, January 29, 1974 Page 3 ATTORNEY'S MEMO - OPINION REGARDING S. 9014 AND S. 9700 Secretary Harlow addressed the Commission and stated that Councilman Duke had requested that this item be placed on this Agenda, and that it be included as part of the Planned Development Ordinance. It was the consensus of the Commission that it should be continued and included in the PD Ordinance to be heard at a later date. DISCUSSION - PRELIMINARY RESULTS OF THE CIRCULATION AND TRANSPORTATION STUDY AS PREPARED BY HERMAN KIMMEL AND ASSOCIATES Ed Selich addressed the Commission and gave a progress report on the study. Three major occurrences have taken place since the last traffic study was held: 1. Deletion of the Route 1 Freeway 2. Restudy of Route 39 Freeway alignment 3. Possibility of ocean cut going into Bolsa Bay which necessitates rerouting of Pacific Coast Highway Vugraphs depicting the eight alternatives to be used in the study were presented. Ralph Leyva, Public Works Department, discussed the technical background and indicated the four steps involved in the study. 1. Data collection 2. Analysis with different problem areas 3. Proposed alternatives 4. Plan implementation Staff was directed to transmit to Kimmel and Associates the Commissioners' comments. Commissioner Geiger requested vugraph copies which were shown by Mr. Leyva and not included in Commissioners' packets. Staff was directed to study Lake Street and the need for additional right-of-way. MISCELLANEOUS The letter from Mr. B. G. Williams was noted by the Commission. Staff was directed to reply by letter to Mr. Williams acknowledging his letter and advising him of the existing situation insofar as Planning Commission and staff are concerned. -3- 1/29/74 - PC Minutes: H.B. Subdivision, subcategory c. be added which would include a Code Amendment concerning con- servation of energy. The Environmental Resources Division of the Planning Department will be coordinating this Code Amendment. BENDER BE PRESENTED A CERTIFICATE OF APPRECIATION BY THE FOLLOWING VOTE: AYES: Geiger, Bazil, Kerins, Wallin, Boyle, Porter NOES: None ABSENT: Higgins STAFF'S COMMENTS Secretary Harlow addressed the Commission and explained why the transmittal to the City Council had been delayed on the Growth Policy. He outlined the action which could be taken by the City Council. Mr. Pat Spencer, Building and Community Development Department, stated that the sign at Will Wright's had been investigated by his department and as a result they have 10 days within which to remove the sign. Mr. Spencer stated that the real estate signs in landscaped area on Springdale had been removed. RESOLUTION NO. 1135 ON MOTION BY GEIGER AND SECOND BY WALLIN RESOLUTION NO. 1135 COMMENDING KENNETH A. REYNOLDS WAS ADOPTED BY THE FOLLOWING ROLL CALL VOTE: AYES: Geiger, Bazil, Kerins, Wallin, Boyle, Porter NOES: None ABSENT: Higgins COMMISSIONERS' COMMENTS Chairman Kerins requested staff to arrange a tour of the new Civic Center prior to moving in. -4- 1/29/74 - PC Minutes: H.B. Planning Commission Tuesday, January 29, 1974 Page 5 Commissioner Porter discussed the meeting of the Mayor's Commission on Energy Conservation which he attended on January 28th. Topics for discussion included the San Onofre expansion, oil well reactivation, and donation of time by Channel 50 for energy conservation messages. Commissioner Porter requested staff to investigate and report on the labor camp. It was noted that the camp's variance had expired and it is now an illegal operation. Secretary Harlow was requested to examine the possibility of classifying the labor camp as an unclassified use, subject to a Conditional Use Permit. Under the Conditional Use Permit procedure the camp could continue operation. Commissioner Geiger requested a report on the appropriate width of the Pacific Electric Right -of -Way for mass transit. Ed Selich indicated that this is currently under study. Mr. Selich also indicated that he would be meeting with OCTD on January 31st to discuss this matter. He will report to the Commission on February 5th the results of the OCTD meeting. Commissioner Boyle stated that there is documentation available from Arthur Little Co. concerning the legality of cutting off sunlight as a result of high rise development. NOTICE OF PUBLIC HEARING - DOUGLAS OIL CO. UV-2-74 For structural alterations to a nonconforming service station in the C-1 zone... ON MOTION BY BOYLE AND SECOND BY PORTER COMMISSIONERS DIRECTED THAT A TRANSMITTAL BE PREPARED AND MAILED TO PLANNING COMMISSION OF THE CITY OF SEAL BEACH RECOMMENDING DENIAL AND STATING REASONS THEREFOR OF ABOVE APPLICATION BY THE FOLLOWING VOTE: AYES: Geiger, Bazil, Kerins, Wallin, Boyle, Porter NOES: None ABSENT: Higgins Chairman Kerins "reported on his meeting with DRB Chairwoman Ms. Carole Ann Wall. DRB will consider all Civic District applications. All appeals arising from discretionary action of DRB as well as Code Amendments originating from DRB will be referred to the Planning Commission.
