ON MOTION BY SPENCER AND SECOND BY FORD DAVE EADIE WAS ELECTED CHAIRMAN OF THE BOARD OF ZONING ADJUSTMENTS BY THE FOLLOWING VOTE: AYES: Spencer, Ford NOES: None ABSENT: None ABSTAIN: Eadie MINUTES: ON MOTION BY FORD AND SECOND BY SPENCER MINUTES OF JANUARY 9, 1974 AND JANUARY 16, 1974 WERE ACCEPTED BY THE FOLLOWING VOTE: AYES: Spencer, Eadie, Ford NOES: None ABSENT: None AGENDA ITEMS CONTINUED OR WITHDRAWN: To permit the construction of an industrial building pursuant to S.9511 of the Huntington Beach Ordinance Code located on the west side of Producer Lane, approximately 235 ft. north of Research Drive in a 100-M1A-20,000 restricted industrial district. The Chairman informed the Board that the Environmental Review Board granted Exemption Declaration No. 74-3 January 29, 1974. The Chairman further informed the Board that the applicant submitted a letter requesting a continuance of one month to allow him time to revise his site plan. Board concurred with continuance. Board of Zoning Adjustments Wednesday, Jan. 30, 1974 Page 2 ON MOTION BY EADIE AND SECOND BY SPENCER ADMINISTRATIVE REVIEW NO. 74-1 WAS CONTINUED TO FEBRUARY 27, 1974 BY THE FOLLOWING VOTE: AYES: Eadie, Spencer, Ford NOES: None ABSENT: None REGULAR AGENDA ITEMS ADMINISTRATIVE REVIEW NO. 73-210 (Cont. from 1-23-74) Applicant: Sid Lance To permit the construction of an industrial building pursuant to S.9511 of the Huntington Beach Ordinance Code located on the south side of Research Drive, approximately 250 ft. east of Product Lane in an M1-A, industrial district. The Applicant was not present. The Chairman informed the Board that the Environmental Review Board granted Exemption Declaration No. 73-244 January 8, 1974. This item had been continued several times as the applicant has not endeavored to resolve the problems on his plot plan. However, in working with the applicant's architect, the Chairman felt that a resolution to all aspects of the applicants plans could be completed by next week. The Chairman further proposed a continuance of this application to allow the applicant to be present at his hearing and for him to revise his plans. ON MOTION BY FORD AND SECOND BY SPENCER ADMINISTRATIVE REVIEW NO. 73-210 WAS CONTINUED TO FEBRUARY 6, 1974 BY THE FOLLOWING VOTE: AYES: Eadie, Spencer, Ford NOES: None ABSENT: None DIVISION OF LAND NO. 74-2 Applicant: Huntington Beach Industrial Park To permit the consolidation of four (4) legal parcels into two (2) parcels pursuant to S.9811.3 of the Huntington Beach Ordinance Code located on the southwest corner of Industry Lane and McFadden in a 100-M1A-2000 light industrial district. Mr. Doug Foster, representing the applicant, was present. 1 Minutes: H.B. Board of Zoning Adjustments Wednesday, Jan. 30, 1974 Page 3 The Chairman informed the Board that the Environmental Review Board granted Exemption Declaration No. 74-4 January 29, 1974 with the following additional information: Findings are based upon the information contained in the Exemption Declaration request and the fact that the project does not constitute any type of underlying activity. The Chairman outlined the proposal to the Board. Former applications pertaining to this proposal were discussed. It was the consensus of the Board that the proposed division of land meets ordinance code requirements. Board discussion followed. Conditions of approval were discussed. ON MOTION BY FORD AND SECOND BY SPENCER DIVISION OF LAND NO. 74-2 WAS APPROVED WITH THE FOLLOWING CONDITIONS AS OUTLINED AND AMENDED BY THE FOLLOWING VOTE: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The parcel map received January 8, 1974 shall be the approved layout. 2. McFadden, Industry Lane and Container Avenue shall be dedicated to City standards at the time each parcel is developed. 3. Division of Land shall not be effective until a covenant and agreement is signed agreeing to the conditions of approval. B. TO BE COMPLETED PRIOR TO OCCUPANCY OR ISSUANCE OF A CERTIFICATE OF OCCUPANCY: 1. A copy of the recorded parcel map shall be'submitted to the Planning Department. 2. Water supply shall be through the City of Huntington Beach's water supply system at the time each parcel is developed. 3. Sewage disposal shall be through the City of Huntington Beach's sewage system at the time each parcel is developed. 4. A Parcel Map and the Covenant and Agreement shall be filed with the City and recorded prior to framing inspection of any structures on any parcel. Minutes: H.B. AYES: Eadie, Spencer, Ford NOES: None ABSENT: None USE PERMIT NO. 74-1 Applicant: Franklin Buccella To permit the construction of a 21 unit apartment building pursuant to S.9202.3.1.3 of the Huntington Beach Ordinance Code located on the east side of Sims Street, approximately 132 ft. south of Milo Street in an R-3, medium high density residential district. Mr. Franklin Buccella, the applicant, was present. The Chairman informed the Board that the Environmental Review Board granted Exemption Declaration No. 74-5 January 29, 1974 with the following additional information: The Board feels that the project would be enhanced by the following: 1. The construction with full insulation of all exterior walls and ceilings to reduce the burden on heating and cooling systems. 2. The disposal of building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material at an off - site facility equipped to handle them. 3. The stubbing in of natural gas at the locations of clothes dryers, cooking facilities, water heaters, and central heat- ing units to alleviate the possible drain on any one energy source. The Chairman outlined the proposal to the Board. The applicant stated that he has had previous conversation with the Fire Department as to placement of fire hydrants. The possibility of widening the driveways was discussed. The Chairman further informed the Board that a plan check revealed that the proposed plan meets ordinance code re- ■ quirements. Board of Zoning Adjustments Wednesday, Jan. 30, 1974 Page 5 ON MOTION BY FORD AND SECOND BY SPENCER USE PERMIT NO. 74-1 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS AS OUTLINED AND AMENDED BY THE FOLLOWING VOTE: FINDINGS: The establsihment, maintenance and operation'of the use will not be detrimental to: 1. The general welfare of persons residing or working in the vicinity. 2. Injurious to property and improvements to the vicinity of such use or building. 3. That the granting of a Use Permit will not adversely affect the Master Plan of the City of Huntington Beach. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The revised plot plan received January 22, 1974 shall be the approved layout. 2. Sims Street shall be dedicated to City standards at the time each parcel is developed. 3. Elevations of the proposed plan received January 9, 1974 shall be the approved elevations. 4. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and.Fire Department. 5. All buildings on lots abutting a City easement shall be set back five (5) feet from the edge of such easement. 6. Soil and compaction reports as required by the Building Department and the Department of Public Works shall be submitted to the City. B. TO BE COMPLETED PRIOR TO FRAMING INSPECTION: 1. Fire alarm system conduit and appurtenances shall be installed by the developer at locations and to specifi- cations provided by the Fire Department. 2. Parking compounds shall be screened with a combination of fencing and landscaping. Said plan shall be sub- mitted to the Planning Department for review and approval. A list including quantities and sizes for each species of plants and all ground cover material. b. Irrigation ]payout to include meter location, pipe sizes, sprinkler head types, etc. c. Fencing materials and detail drawing. C. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. Sims Street shall be fully improved including street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 2. All utilities shall be installed underground. 3. Off-street parking facilities shall conform to Article 979. D. TO BE COMPLETED PRIOR TO ISSUANCE OF CERTIFICATE OF OCCUPANCY: 1. Water supply shall be through the City of Huntington Beach's water supply system. 2. Sewage disposal shall be through the City of Huntington Beach's sewage system. 3. Easements for utilities or walkways shall be provided to Department of Public Works standards. 4. The property shall participate in the local drainage assessment district. 5. No structures, other than those shown on the approved plot plan, shall be constructed within the project. 6. All applicable City Ordinances shall be complied with. GENERAL: 1. To permit a patio cover to encroach 6" into the minimum 5 ft. sideyard setback in lieu of S.9103.2.1 of the Huntington Beach Ordinance Code located on the south side of Antrim Circle, approximately 400 ft. east of Toway Lane in an R-1, low density residential district. Mr. David Downie, Office Manager of Ace Awning Inc., representing the applicant, was present. The Chairman informed the Board that this application is a categorical exemption, class 5, California Environmental Quality Act, 1970. The applicant's representative outlined the proposal to the Board. He stated that the patio cover was already built, and that a mistake had been made by the contractor at time of construction. He further stated that if the 6 additional inches are not allowed, his camper would not clear the patio cover. Upon a field check by Dave Eadie and Pat Spencer, it was believed that there is nothing structurally that would prevent the applicant from moving the poles and being within ordinance code requirements. The applicant's representative felt that there might be a possible problem in moving the poles, and further asked for a continuance to allow him time to acquire more information on the structural aspects of the patio. Board concurred with continuance. ON MOTION BY EADIE AND SECOND BY SPENCER CONDITIONAL EXCEPTION NO. 74-3 WAS CONTINUED TO FEBRUARY 6, 1974 BY THE FOLLOWING VOTE: AYES: Eadie, Spencer, Ford NOES: None ABSENT: None ADMINISTRATIVE REVIEW NO. 74-4 Applicant: L. D. Zehnder To permit the construction of a 4 unit apartment building pursuant to S.9231.6 of the Huntington Beach Ordinance Code located on the north side of 22nd Street, approximately 100 ft. south of Olive in the R-4, high density residential district. The Chairman stated that this application is a categorical exemption, class 3, California Environmental Quality Act, 1970. The Chairman outlined the proposal to the Board and further informed the Board that this application meets ordinance code requirements. Board discussed plans with applicant. Parking was discussed. Conditions of approval were discussed. ON MOTION BY EADIE AND SECOND BY SPENCER ADMINISTRATIVE REVIEW NO. 74-4 WAS APPROVED WITH THE FOLLOWING CONDITIONS AS OUTLINED AND AMENDED BY THE FOLLOWING VOTE: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. Mr. Bob Stellrecht, the applicant, was present. The Chairman informed the Board that this application is a categorical exemption, class 5, California Environmental Quality Act, 1970. Plans and Elevations were discussed. Mr. Stellrecht stated that he had a very limited choice of elevations. Board discussion followed. Conditions of approval were discussed. ON MOTION BY EADIE AND SECOND BY FORD ADMINISTRATIVE REVIEW NO. 74-5 WAS APPROVED WITH THE FOLLOWING CONDITIONS AS OUTLINED BY THE FOLLOWING VOTE: Minutes: H.B. All conditions as contained in S.9106.2.1.1 of the Huntington Beach Ordinance Code shall be complied with. AYES: Eadie, NOES: None ABSENT: None MISCELLANEOUS: Spencer, Ford ADMINISTRATIVE REVIEW NO. 74-10 Applicant: Center for Special Surgery, Inc. (Neil A. Friedman) To permit the expansion of a previously approved use pursuant to S.9401 of the Huntington Beach Ordinance Code located on the south- east corner of Newman Avenue and Beach Blvd. in an R-5, office professional district. Dr. Neil Friedman, the applicant, was present. The Chairman informed the Board that this application is a categorical exemption, class 1, California Environmental Quality Act, 1970. Dr. Friedman explained the proposed project as being a small food commissary to accommodate the personnel only. He further informed the Board that he does not wish to erect any signs connected with the proposal. A former administrative filing pertaining to this application was discussed as well as parking and landscaping. It was the consensus of the Board that the proposed project meets ordinance code requirements. Conditions of approval were discussed. ON MOTION BY FORD AND SECOND BY SPENCER ADMINISTRATIVE REVIEW NO. 74-10 WAS APPROVED WITH THE FOLLOWING CONDITIONS AS OUTLINED BY THE FOLLOWING VOTE: 1. The plot plan received January 28, 1974 shall be the approved layout. 2. All conditions of Administrative Review No. 72-157 shall be complied with.
