Jones To permit the construction of a 2,900 sq. ft. industrial building pursuant to S.9530 of the Huntington Beach Ordinance Code located on the south side of Slater Avenue, approximately 430 ft. east of Gothard in an Ml-CD, light industrial - civic district. Mr. Gerald A. Jones, the applicant, was present. The Chairman informed the Board that the Environmental Review Board granted Exemption Declaration No. 73-229 December 18, 1973. The Chairman informed the Board that this application had been continued previously at the request of the applicant to allow him time to revise his plans. The applicant presented revised plans to Board. The Board questioned the location of the building and the access to the proposed development off a private street. Dedication of right of way was also discussed. Minutes; H.B. Open space, parking and landscaping were discussed. It was the consensus of the Board to continue this application one week to allow revised plan, submitted February 13, 1974, to be plan checked. Applicant concurred with continuance. ON MOTION BY EADIE AND SECOND BY FORD ADMINISTRATIVE REVIEW NO. 73-219 WAS CONTINUED TO FEBRUARY 20, 1974 BY THE FOLLOWING VOTE: AYES: Eadie, Spencer, Ford NOES: None ABSENT: None USE PERMIT NO. 74-2 (Cont. from 2/6/74) Applicant: Howard Subnick To permit the construction of a 6 unit apartment building pursuant to S.9162.3.1 of the Huntington Beach Ordinance Code located on the north side of Heil, approximately 455 f t. west of Beach Blvd. . in an R-2, medium density residential district. Mr. Subnick, the applicant, was present. The Chairman informed the Board that the Environmental Review Board granted Exemption Declaration No. 74-6 February 13, 1974 with the following additional information: The project would be enhanced by the following; 1. The construction of the project with full insulation of all exterior walls and ceilings to reduce the burden on heating and cooling systems. 2. The disposal of building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material at an offsite facility equipped to handle them. 3. The stubbing in of natural gas at the locations of clothes dryers, cooking facilities, water heaters, and central heating units to alleviate the possible drain on any one energy source. The Chairman presented a petition dated January 30, 1974 to the Board. The petition states opposition to the proposed project and is signed by 10 property owners living on Alhambra Street. The Chairman opened the public hearing. Minutes: H.B. Board of Zoning Adjustments Wednesday, Feb. 13, 1974 Page 3 Mr. Ronald Hall, a neighbor living on Alhambra Street, was present and questioned the removal of a house which he thought was located partially on the lot of the house next to it. He further stated his opposition to the proposed project. The Chairman informed Mr. Hall that the petitioners had been concerned about previous apartment developments in that area and had been advised at that time that existing zoning would have to be changed if multiple family dwelling units were not to be permitted. The Chairman informed the Board that the proposed plan meets ordinance code requirements. Dedication of Heil Avenue for future widening of that street was discussed. As there were no further parties present to speak in favor or opposition to Use Permit No. 74-2, the Chairman closed the public hearing. Conditions of approval and elevations were discussed. It was the consensus of the Board to request the applicant to submit a revised set of elevations containing more detail. ON MOTION BY EADIE AND SECOND BY FORD USE PERMIT NO. 74-2 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS AS OUTLINED AND AMENDED BY THE FOLLOWING VOTE: FINDINGS: The establishment, maintenance and operation of the use will not be detrimental to: 1. The general welfare of persons residing or working in the vicinity. 2. Injurious to property and improvements to the vicinity of such use or building. 3. That the granting of a Use Permit will not adversely affect the Master Plan of the City of Huntington Beach. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The revised plot plan received February 5, 1974 shall be the approved layout. 2. Heil Avenue and Alhambra shall be dedicated to City stand- ards at the time each parcel is developed. 3. Elevations of the proposed plan shall be submitted to the Board of Zoning Adjustments for approval action. Said plan shall call out in detail the materials used. Minutes: H.B. All buildings on lots abutting a City easement shall be set back five (5) feet from the edge of such easement. 6. Soil and compaction reports as required by the Building Department and the Department of Public Works shall be submitted to the City. B. TO BE COMPLETED PRIOR TO FRAMING INSPECTION: 1. All signs for the Proposed Development shall be submitted to the BZA for approval. Signs shall reflect a common theme with respect to design materials and colors which are compatible with the architectural theme of the proposed project. 2. Fire alarm system conduit and appurtenances shall be installed by the developer at locations and to specifi- cations provided by the Fire Department. 3. Parking compounds shall be screened with a combination of fencing and landscaping. Said plan shall be submitted to the Planning Department for review and approval. Fencing and landscape plans shall include the following information: a. A list including quantities and sizes for each species of plants and all ground cover material. b. Irrigation layout to include meter location, pipe sizes, sprinkler head types, etc. c. Fencing materials and detail drawing. C. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. Heil Avenue and Alhambra shall be fully improved including street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 2. All utilities shall be installed underground. 3. Off --street parking facilities shall conform to Article 979. 4. A decorative masonry wall shall be constructed along Heil Avenue. The height of said wall shall be such that the top will be six (6) feet above the highest ground surface within twenty (20) feet of the common property line. Minutes: H.B. Water supply shall be through the City of Huntington Beach's water supply system. 2. Sewage disposal shall be through the City of Huntington Beach's sewage system. 3. Easements for utilities or walkways shall be provided to Department of Public Works standards. 4. The property shall participate in the local drainage assessment district. 5. No structures, other than those shown on the approved plot plan, shall be constructed within the project. 6. All applicable City Ordinances shall be complied with. GENERAL: 1. AYES: Eadie, Spencer, Ford NOES: None ABSENT: None ADMINISTRATIVE REVIEW N0. 74-6 (Cont. from 2/6/74) Applicant: Saul Sher To permit the demolition and removal of an existing gasoline station and to construct a retail store pursuant to S.9430 of the Huntington Eeach Ordinance Code located on the southwest corner of Sher Lane and Edinger Avenue in a C-2, community business district. Mr. Donald Sher, the applicant, and Mr. Roger Porter, representing the applicant, was present. Minutes: H.B. Board of Zoning Adjustments Wednesday, Feb. 13, 1974 Page 6 The Chairman informed the Board that the Environmental Review Board granted Exemption Declaration No. 74-6 February 13, 1974 with the following additional information: No environmental impact report has been prepared for this project. The Negative Declaration issued for the project was properly posted in the office of the City Clerk. Findings are based upon the information contained in the exemption declaration request. Board discussed plans with applicant and his representative. A plan check revealed a lack of parking spaces, however a field check indicated that parking problem could be resolved due to the adjoining property being owned by the applicant. The Board pointed out that a 32" high masonry wall to screen parking is required within a landscaped planter. Mr. Sher addressed the Board and stated that the proposed commercial building would be of a retail sale of electronics use. Traffic flow, trash location was discussed. The applicant was notified that a Fire Department permit for removal of tanks must be secured. Board discussed signs with applicant. The applicant reiterated that no signs are proposed other than those shown on the building elevations that were submitted. Board discussion followed. Conditions of approval were discussed. ON MOTION BY FORD AND SECOND BY EADIE ADMINISTRATIVE REVIEW NO. 74-6 WAS APPROVED WITH THE FOLLOWING CONDITIONS AS OUTLINED AND AMENDED BY THE FOLLOWING VOTE: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The revised plot plan received February 13, 1974 shall be the approved layout. 2. A revised Plot Plan shall be submitted to the Board of Zoning Adjustments for Approval Action. Said plan shall indicate: a. A method of screening of the parking area on Edinger Avenue and Sher Lane detailing the materials to be used and the height of such screening. The above information shall be detailed on a cross section view. b. A 6" concrete retaining cur-_ shall be shown wherever landscaping occurs. 1 Minutes: H. B. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 6. All buildings on lots abutting a City easement shall be set back five (5) feet from the edge of such easement. 7. The driveway locations shall be subject to the approval of the Traffic Engineer. B. TO BE COMPLETED PRIOR TO FRAMING INSPECTION: 1. A landscaping plan shall be submitted to the Planning Department for review and approval action. 2. Rooftop mechanical equipment shall be screened from view. Said screening shall be approved by the Board of Zoning Adjustments. 3. All signs for the Proposed Development shall be submitted to the BZA for approval. D. TO BE COMPLETED PRIOR TO ISSUANCE OF CERTIFICATE OF OCCUPANCY: 1. Water supply shall be through the City of Huntington Beach's water supply system. 2. Sewage disposal shall be through the City of Huntington Beach's sewage system. 3. Easements for utilities or walkways shall be provided to Department of Public Works standards. 4. All applicable City Ordinances shall be complied with. 7. Reciprocal parking agreement between the subject parcel and the adjacent parcel shall be recorded and presented to the Planning Department. Weir To permit an encroachment of a six foot high fence into the front yard setback in lieu of S. 9204 of the Huntington Beach Ordinance Code located on the southwest corner of Holly and Main in an R-3 high density residential district. Mr. Donald Weir, the applicant, was present. The Chairman opened the public hearing. The Chairman outlined the proposal to the Board. He stated that a letter of authorization on leased property is required. The applicant informed the Board that the chain link fence will not hinder safety vision and that the fence is required for security purposes. As there were no parties present to speak in favor or opposition to Conditional Exception No. 74-5, the Chairman closed the public hearing. Board discussion followed. ON MOTION BY EADIE AND SECOND BY FORD CONDITIONAL EXCEPTION NO. 74-5 WAS APPROVED FOR THE FOLLOWING REASONS AND WITH THE FOLLOWING CONDITIONS AS OUTLINED: REASONS FOR APPROVAL: 1. Protection of the oil well from vandalism and from a safety standpoint by precluding any entrance to the site by non personnel. 2. The proposed encroachment would not physically affect the surrounding property or be detrimental to traffic circula- tion as it is a chain link fence designed for security reasons. 3. A hardship exists on this particular site as there is not adequate room available for the customary front yard setback. Minutes: H. B. The applicant shall submit proof, in writing, that he has authorization to structurally alter the subject parcel, or this application shall become null and void. 2. No slats or any other material which would potentially cause a safety hazard shall be installed. 3. The plot plan received January 22, 1974 shall be the approved layout. Chalabian To permit the construction of an industrial building pursuant to S. 9511 of the Huntington Beach Ordinance Code located on the east side of Commerce, approximately 600 feet south of McFadden in an Ml-A restricted industrial district. Mr. Chalabian, the applicant, was present. The Chairman informed the Board that the Environmental Review Board granted Exemption Declaration No. 74-13 February 13, 1974 with the following additional information: "No environmental impact report has been prepared for this project. The Negative Declaration issued for the project was properly posted in the office of the City Clerk. The findings of the Board are based upon the information contained in the exemption declaration form, as well as information gained by contact with Orange County Sanitation District No. 11, the Regional Water Quality Control Board, and the APCD. The Board feels that the project would be enhanced by the recommendations set forth by the Orange County Sanitation District." Minutes: H. B. It was pointed out to the applicant that his plan shows 19 ft. setback and that a 20 ft. setback is required. The addition of one parking stall was discussed, as well as traffic circulation of the proposed develop- ment. The Board received chemical breakdown from Chemical Product Company as to the solutions Mr. Chalabian will be using. Signing was discussed with the applicant. Applicant indicated that he would build wall signs only as typified on the elevations. Board discussion followed. Conditions of approval were discussed. ON MOTION BY SPENCER AND SECOND BY EADIE ADMINISTRATIVE REVIEW NO. 74-9 WAS APPROVED WITH THE FOLLOWING CONDITIONS AS OUTLINED AND AMENDED BY THE FOLLOWING VOTE: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The revised plot plan received January 23, 1974 shall be the approved layout. 2. A revised Plot Plan shall be submitted to the Planning Department for Approval Action. Said plan shall reflect: a. Front yard setback shall be complied with. b. 6" concrete curbing -)tot contain the landscaping. 3. Commerce Lane shall be dedicated to City standards at the time each parcel is developed. 4. Elevations of the proposed plan received January 24, 1974 shall be the approved elevations. 5. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 6. Sampson To permit a model complex pursuant to S.9730.18 of the Huntington Beach Ordinance Code located on the southwest corner of Pearce and Bolsa Chica in an R-31 medium high density residential district. Mr. Sampson, the applicant, was present. The Chairman informed the Board that this project is a lesser part of a previous Environmental Impact Report No. 73-12 approved by the Environmental Review Board June 14, 1973. Minutes: H.B. He stated that all parking would be on the street and that all signs shall be on site. Board discussion followed. Conditions of approval were discussed. ON MOTION BY FORD AND SECOND BY EADIE ADMINISTRATIVE REVIEW NO. 74-16 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: 1. All provisions of S.9730.18 shall be complied with. 2. All signs shall comply with Article 976 of the Huntington Beach Ordinance Code. 3. The plot plan received February 5, 1974 shall be the approved layout. AYES: Eadie, NOES: None ABSENT: None MISCELLANEOUS: Spencer, Ford A letter was submitted from the Southern California Edison Company regarding installation of underground cablings for Jose Brown (7 unit apartment complex, 7881 Holt Street). The Board took no action and directed Secretary to receive and file. APPLICANT: FAIR TIME SHOWS The Chairman presented a request for a special permit through the City Administrator's office which had been submitted to the Board of Zoning Adjustments for comment and review. Carnival - Fair Time Shows to be held February 15, 1974 through February 25, 1974 at Two Guys Department Store, 9882 Adams Boulevard, Huntington Beach, Calif. The Board reviewed and approved said event with the following suggested conditions of approval. 1. There shall be on -site inspection by the Huntington Beach Fire and Police Departments. 2. APPLICANT: Joe Abandonato RECOMMENDATION OF SIGN APPEAL - HUNTINGTON BEACH TRAILER SUPPLY On February 5, 1974 the Planning Commission continued the hearing on an appeal filed by Mr. Joe Abandonato in reference to action by the Board of Zoning Adjustments to deny a proposed roof sign. The Commission requested the Board to render a recommendation as to what alternatives could be sought by Mr. Abandonato to meet the intent of the criteria for approval of identification signs. The Board discussed the sign program for the subject site with the appellant and offers the following comments and recommendations. 1. The Board discussed allowing the roof signs and bringing the pole sign down to a monument type. However, Mr. Abandonato indicated that there would be no possible place within Ordinance Code limitations that a monument sign could be safely placed on his frontage. 2. As previously discussed with the Planning Commission, Mr. Abandonato reiterated his need for the roof sign as the view of his pole sign is hindered by overhead utilities along the right-of-way of Beach Boulevard. 3. Mr. Abandonato indicated that he had to keep the square footage of his pole sign down to a bare minimum as the pole had to be high enough to clear the recreational vehicles yet low enough to miss the overhead utility lines. Thus, he indicated that the smaller square footage just didn't do the job he anticipated it would. RECOMMENDATIONS: Upon receipt of additional justification from the appellant, it was the consensus of the Board to recommend to the Planning Commission that the proposed roof sign be approved. It was the majority opinion of the Board not to recommend the pole sign be removed completely in exchange for the roof sign. However, it was suggested that Mr. Abandonato discuss the onsite problems he'felt inherent with the property regarding this particular sign and that the Planning Commission use discretion after considering this information. The Planning Commission further requested information regarding the zoning of the property to the south of the subject site contained within the City of Westminster and how they would apply sign criteria within that particular zone. In conversation with Mr. Frank Schuma, Planning Director of the City of Westminster, he indicated that the property to the south of the subject site is zoned C2-PD (General Commercial - Planned Development). This zoning classification is similar to our C2 General Business District. The City of Westminster would allow either one pole sign or one roof sign if given a similar situation Minutes: H.B. The square footage allotment is calculated basically the same as the City of Huntington Beach's i.e., one square foot per Each lineal foot of frontage (Max. 200 square feet).
