Tom, A.I.A. To permit the alteration and addition to an existing bank pursuant to S.9430 of the Huntington Beach Ordinance Code lcoated on the east side of Springdale, approximately 130 ft. north of Edinger in a C-2, community business district. Mr. Truskier and Mr. Tom Kitchen, representing the applicant, were present. The Chairman informed the Board that this application is a categorical exemption, Class 1, California Environmental Quality Act, 1970. The Chairman outlined the revised plot plan to the Board. Additional landscaping along Springdale Avenue was discussed as well as the construction of a wall to preclude vision of parking from Springdale. The applicant's representatives indicated that no additional signs are to be erected, however, one wall sign will be moved from one location to another. Minutes: H.B. ON MOTION BY SPENCER AND SECOND BY EADIE ADMINISTRATIVE REVIEW NO. 74-8 WAS APPROVED WITH THE FOLLOWING CONDITIONS AS OUTLINED AND AMENDED BY THE FOLLOWING VOTE: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The revised plot plan received 2/9/74 shall be the approved layout as amended. 2. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 3. All buildings on lots abutting a City easement shall be set back five (5) feet from the edge of such easement. 4. Soil and compaction reports as required by the Building Department and the Department of Public Works shall be submitted to the City. 5. Rooftop mechanical equipment shall be screened from view. Said screening plan shall be approved by the Board of Zoning Adjustments. B. TO BE COMPLETED PRIOR TO FRAMING INSPECTION: 1. A landscaping plan shall be submitted to the Planning Department for review and approval action. 2.' Additional signs for the proposed development shall be limited to wall signs only. The BZA encourages signs which reflect a common theme with respect to design materials and colors which are compatible with the architectural theme of the proposed project. 3. Fire alarm system conduit and appurtenances shall be installed by the developer at locations and to specifi- cations provided by the Fire Department. 4. Jones To permit the construction of a 2,900 sq. ft. warehouse pursuant to S.9530 of the Huntington Beach Ordinance Code located on the south side of Slater Avenue, approximately 430 ft. east of Gothard in an M1-CD, light industrial - civic Aistrict. Mr. Jones, the applicant, was present. The Chairman informed the Board that the Environmental Review Board granted Exemption Declaration No. 73-229 December 18, 1973. The Chairman further informed the Board that a plan check revealed the plan to be within ordinance code requirements. The Board established the proposal as being a warehouse instead of an industrial building. Minutes; H,B. Conditions of approval were discussed. ON MOTION BY FORD AND SECOND BY SPENCER ADMINISTRATIVE REVIEW NO. 73-,219 WAS APPROVED WITH THE FOLLOWING CONDITIONS AS OUTLINED AND AMENDED BY THE FOLLOWING VOTE: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The revised plot plan received 2/13/74 shall be the approved layout. 2. Slater Avenue shall be dedicated to City standards at the time each parcel is developed. 3. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 4. All buildings on lots abutting a City easement shall be set back five (5) feet from the edge of such easement. 5. A Division of Land application, separating this parcel from the remaining property held under the same ownership shall be approved by the City. 7. D. TO BE COMPLETED PRIOR TO ISSUANCE OF CERTIFICATE OF OCCUPANCY: 1. Water supply shall be through the City of Huntington Beach's water supply system. 2. Sewage disposal shall be through the City of Huntington Beach's sewage system. 3. Easements for utilities or walkways shall be provided to Department of Public Works standards. 4. The property shall participate in the local drainage assessment district. 5. No structures, other than those shown on the approved plot plan, shall be constructed within the project. 6. Applicant must submit an application before the Design Review Board. AYES: Eadie, Spencer, Ford NOES: None ABSENT: None CONDITIONAL EXCEPTION NO. 74-7 Applicant: Huntington Executive Park To permit an offsite sign to advertise an entire development in lieu of S.9760.1.1 and S.9760.2.28 of the Huntington Beach Ordinance Code located on the southeast corner of Edinger and Beach Blvd. in a C'-2, community business district. Mr. Everett Dodge, representing the applicant, was present. The Chairman informed the Board that this application is a categorical exemption, class 11, California Environmental Quality Act, 1970. The Chairman opened the public hearing. The Chairman informed the Board that this conditional exception was filed to alleviate the code requirement, and further stated that a technicality existed in the code which would not allow a sign at this particular location. Mr. Dodge addressed the Board and -stated that this entire shopping center could be considered one parcel and that it was subdivided into separate parcels for leasing and tax purposes. Mr. Dodge further stated that a bank building, currently in escrow, was to be built in one corner and that the sign for this building would not be part of the executive park signing and they would have to obtain their own sign approval. The Chairman felt that the proposed sign could possibly be modified to make it more aesthetically pleasing. Mr. Dodge agreed and stated he would make modifications to the proposed sign. As there were no parties present to speak in favor or opposition to Conditional Exception No. 74-7, the Chairman closed the public hearing. ON MOTION BY FORD AND SECOND BY EADIE CONDITIONAL EXCEPTION NO. 74-7 WAS APPROVED FOR THE FOLLOWING REASONS AND WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: 1 Minutes: H.B. Board of Zoning Adjustments Wednesday, February 20, 1974 Page 7 REASONS FOR APPROVAL: 1. The Division of Land which was recently approved separating the executive park into several separate parcels is, like many shopping centers, done for leasing purposes only. The Board finds that placing of a sign in this area would be the most likely location to identify the executive park location and is prohibited by a technicality within the ordinance code. In essence, the parcel upon which the sign is to be located is a portion of the executive park and for this reason the Board believes that this sign is not specifically off -site advertisement. 2. The granting of a Conditional Exception will not constitute a grant of special privilege inconsistent upon other properties in the vicinity and under an identical zone classification and identical conditions. 3. The granting of a Conditional Exception is necessary as the location at the intersection of Beach and Edinger is the most logical area for placement of a sign of this type. 4. The granting of a Conditional Exception will not adversely affect the Master Plan of the City of Huntington Beach. CONDITIONS OF APPROVAL: 1. Revised elevations shall be submitted to the Planning Department. 2. All signs shall comply with Article 976. Dikeman To permit the waiver of the required rear 6 ft. wall separating R-5, office professional from R-3, high density residential in lieu of 5.9730.25 (b) of the Huntington Beach Ordinance Code located on the southeast corner of Edinger Avenue and Waikiki Lane in an R-5, office professional district. IN CONJUNCTION WITH: ADMINISTRATIVE REVIEW NO. 73-226 Applicant: Arthur M. Gutt To permit the construction of a two story office building in conjunction with Tract 6334 pursuant to 5.9401 of the Huntington Beach Ordinance Code located on the southeast corner of Edinger and Waikiki Lane in an R-5, office professional district. Board of Zoning Adjustments Wednesday, February 20, 1974 Page 8 Mr. Jack Koebig, representing the applicant, and Mr. Steve Dikeman, the applicant for Conditional Exception No. 74-8 were present. The Chairman informed the Board that Conditional Exception No. 74-8 is a categorical exemption, class 5, California Environmental Quality Act, 1970. He further stated that the Environmental Review Board granted Exemption Declaration No. 74-2 February 13, 1974 with the following additional information for Administrative Review No. 73-226. No environmental impact report has been prepared for this project. The Negative Declaration issued for the project was properly posted in the office of the City Clerk. Findings are based upon the initial study information submitted to the Board, as well as the applicant's intent to work with the BZA in resolving problems with the plot plan and the traffic engineer's concurrence on the location of the drive exiting onto Edinger Avenue from the project. The Chairman opened the public hearing on Conditional Exception No. 74-8. The Chairman informed the Board that a previous Conditional Exception No. 68-14 allowed for the waiver of the wall and that Conditional Exception No. 74-8 was not necessary, and further recommended withdrawal of this application. Mrs. Psaros, presented a petition from neighbors to the Board, and presented her case why a 6 ft. wall should exist to separate the office professional district from the residential district. She felt that due to the buildings directly south of the proposed development have children passing through an alley, going to school, would create a hazard for those children. She further felt that a wall would isolate the business activity and as such, driving and parking would be away from the residential section, thus also alleviating a lot of noise. She further stated that one of the patio's of her apartment building opens directly onto the alley which would also create a hazard. In summary, Mrs. Psaros felt that access to the professional building off of the alley would be dangerous. Mr. Koebig addressed the Board and stated that at the time the proposed office professional building's plans were made, the apartment house owners were aware of the type of use that would be built. Mr. Koebig presented a letter from Mr. B. G. Williams, Builder, to the Board stating that at the time of the original subdivision, he installed a 6 ft. wall along Lot 2 at the alley, at that time the apartment house occupants agreed that this would satisfy the requirement for a separating wall that Lot 1 would take access from the alley thus avoiding an additional curb cut adjacent to the school on Waikiki. Board of Zoning Adjustments Wednesday, February 20, 1974 Page 9 Trash bins, number of parking spaces, access from alley to parking spaces and fire access off of alley were also discussed. It was the consensus of the Board that due to additional information received from occupants in that immediate area, a meeting betweeen the applicant and staff is warranted to discuss alternatives and also allow time for the applicant to revise his plans. As there were no further parties present to speak in favor or opposition to Conditional Exception No. 74-8, the Chairman closed the public hearing. Board discussion followed. Lauter To permit an encroachment of one foot into the required side yard setback and to permit 24 parking spaces in lieu of the required 24-1/2 for a proposed apartment addition in lieu of 5.9163.2.1 and 5.9166 of the Huntington Beach Ordinance Code located on the east side of Delaware, approximately 190 ft. north of Yorktown in an R-2, medium density residential district. IN CONJUNCTION WITH: DIVISION OF LAND NO. 74-3 Applicant: Rodney B. Lauter To permit the consolidation of two parcels of land into one legal lot pursuant to S.9811.3 of the Huntington Beach Ordinance Code located on the east side of Delaware, approximately 190 ft. north of Yorktown in an R-2, medium density residential district. IN CONJUNCTION WITH: Minutes: H.B. Board of Zoning Adjustments Wednesday, February 20, 1974 Page 10 USE PERMIT NO. 74-3 Applicant: Rodney B. Lauter To permit the addition of an additional seven dwelling units to an existing four unit apartment complex pursuant to 5.9162.3.1 of the Huntington Beach Ordinance Code located on the east side of Delaware, approximately 190 ft. north:of Yorktown in an R-2, medium density residential district. Mr. Rodney Lauter, the applicant, was present. The Chairman informed the Board that the Environmental Review Board granted Exemption Declaration No. 74-14 covering Conditional Exception No. 74-6, Division of Land No. 74-3, and Use Permit No. 74-3 February 19, 1974 with the following ,.additional information: The Board recommends that the cumulative adverse effects of successive developments of this nature be mitigated by the following. 1. The insulation of all exterior walls and ceilings to reduce the burden on heating and cooling systems. 2. The disposal of building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material at an offsite facility equipped to handle them. 3. The stubbing in of natural gas at the locations of clothes dryers, cooking facilities, water heaters, and central heating units to alleviate the possible drain on any one energy source. The Chairman opened the public hearing on Conditional Exception No. 74-6 and Use Permit No. 74-3. The Chairman informed the Board that a previous Conditional Exception No. 71-5 allowed an encroachment of the portion of the existing dwelling into the required interior side yard setback. He further informed the Board that a plan check revealed the lack of 1/2 parking space and encroachment of one foot into side yard setback, and further stated that the encroachment is due to the turnaround radius required. The Board was unable to come up with proper calculations and asked the applicant to submit revised plans to show open space, trash bin location, turning radius and better ingress and egress for fire fighting purposes. As there were no parties present to speak in favor or opposition to Conditional Exception No. 74-6 and Use Permit No. 74-3, the Chairman closed the public hearing. It was the consensus of the Board to continue this application for one week to allow the applicant to be present. Board of Zoning Adjustments Wednesday, February 20, 1974 Page 12 ADMINISTRATIVE REVIEW NO. 74-17 Applicant: Covington Brothers To permit the construction of model complex for a condominium project (Tract 8192) pursuant to S.9730.18 of the Huntington Beach Ordinance Code located on the southeast corner of Ellis and Huntington in an R-2, medium density residential district. Mr. Bob Fitzpatrick of Covington -Bros., and Mr. Vick Edge, Architect, were present. The Chairman informed the Board that this application is a lesser part of Exemption Declaration No. 73-149 approved 9/11/73 by the Environmental Review Board. Mr. Fitzpatrick addressed the Board and stated that the proposal is for six (6) plain unfurnished models, and that the recreation building would be used as a sales office. Construction traffic circulation versus sales traffic was discussed. Board discussion followed. Conditions of approval were discussed. ON MOTION BY FORD AND SECOND BY SPENCER ADMINISTRATIVE REVIEW NO. 74-17 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: 1. The applicants stated that their lot was previously used for the sales office in that tract and that all other homes in that area had a fence. They further stated that a fence would have been erected if this house was not previously used as a sales office. As there were no parties present to speak in favor or opposition to Conditional Exception No. 74-11, the Chairman closed the public hearing. Board discussion followed. ON MOTION BY SPENCER AND SECOND BY FORD CONDITIONAL EXCEPTION NO. 74-11 WAS APPROVED FOR THE FOLLOWING REASONS BY THE FOLLOWING VOTE: REASONS FOR APPROVAL: 1. The granting of a Conditional Exception will not constitute a grant of special privilege inconsistent upon other properties in the vicinity and under an identical zone classification. 2. Because of special circumstances applicable to the subject property, including on site features, location, and surroundings, the strict application of the zoning ordinance is found to deprive the subject property of privileges enjoyed by other properties in the vicinity and under identical zone classifications. 3. The granting of a Conditional Exception is necessary to preserve the enjoyment of one or more substantial property rights. 4. The granting of a Conditional Exception will not adversely affect the Master Plan of the City of Huntington Beach. (1190) 5. The lot was a parking and landscaping area for the model home complex and had it been developed at the time the rest of the subdivision had been developed, that lot would have been included in the original plan to contain a wall as the other lots have.
