The Chairman stated that this application had been continued previously for the submittal of revised plans and the submittal of a Conditional Exception. He recommended a continuance on this item for the purpose of communicating with the applicant about matters of dedication and parking in addition to discussing the pending application informally. Gardner To permit the construction of a 12 unit apartment building pursuant to S.9162.3.1 of the Huntington Beach Ordinance Code located on the southeast corner of Huntington Avenue and 17th Street in an R-2, medium density residential district. IN CONJUNCTION WITH: CONDITIONAL EXCEPTION NO. 73-66 (Cont. from 2/6/74) Applicant: Guy W. Gardner To permit a zero rear yard setback for carports in the construction of a proposed 12 unit apartment complex in lieu of S.9163.3 of the Huntington Beach Ordinance .Code located on the southeast corner of Huntington Avenue and 17th Street in an R-2, medium density residential district. Mr. Guy Gardner, the applicant, was present. The Chairman informed the Board that the Environmental Review Board granted Exemption Declaration No. 73-231 pertaining to Use Permit No. 73-88 on February 26, 1974 with the following additional information. The Board offers the following recommendations to alleviate the cumulative adverse effects of successive projects of this nature: 1. If the developer proposes to provide air conditioning, the insulation in the ceilings shall be a minimum of R-19 and that in the exterior walls shall be a minimum of R-11; if no air conditioning is to be provided, the insulation in the ceilings shall be a minimum of R-13 and that in the exterior walls shall be a minimum of R-7. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 3. Natural gas outlets shall be stubbed in at the location of clothes dryers, cooking facilities, water heaters, and central heating units to alleviate the possible drain on any one energy source. 4. The Board recommends that the Board of Zoning Adjust- ments pursue eliminating the northerly drive, moving the northerly tier of units north on the plot plan, to add open space and to eliminate a driveway that could create traffic problems at the intersection of Huntington and 17th Streets. The Chairman opened the public hearing on Use Permit No. 73-88 and Conditional Exception No. 73-66. The Chairman outlined the proposal to the Board. The Board dis- cussed plans with applicant. The Chairman stated that the Environmental Review Board felt there was an excessive amount of asphalt proposed. The possibility of eliminating one drive for the project was discussed. The proposed plan indicates a shortage of driveway width. Mr. Ford did not feel that any traffic problems existed. As there were no parties present to speak in favor or opposition to Use Permit No. 73-88 or Conditional Exception No. 73-66, the Chairman closed the public hearing. Board discussion followed. It was the consensus of the Board to continue Use Permit No. 73-88 and Conditional Exception No. 73-66 to allow applicant time to meet with staff to discuss his plans and to revise his plans. Bragg To permit the construction of an 8 unit apartment building pursuant to 5.9162.3.1 of the Huntington Beach Ordinance Code located on the west side of Florida, approximately 150 ft. north of Garfield in an R-2, medium density resi- dential district. IN CONJUNCTION WITH: CONDITIONAL EXCEPTION NO. 74-10 Applicant: Harold V. Bragg To permit the construction of garages on the zero interior side yard property line and to permit a 15 ft. front yard setback for garages in lieu of S.9163.2 and S.9165.3 of the Huntington Beach Ordinance Code located on the west side of Florida, approximately 150 ft. north of Garfield in an R-2, medium -density residential district. Mrs. Doris Martinez, representing the applicant, was present. The Chairman informed the Board that the Environmental Review Board granted Exemption Declaration No. 74-20 pertaining -to Use Permit No. 74-6 and Conditional Exception No. 74-10, February 26, 1974 with the following additional information: The Board offers the following recommendations to alleviate the cumulative adverse effects of successive projects of this nature: 1. Construction of the project with full insulation of all exterior walls and ceilings to reduce the burden on heating and cooling systems. 2. Disposal of all building spoils, such.as unusable lumber, wire, pipe, and other surplus or unusable material at an offsite facility equipped to handle them. 3. The stubbing in of natural gas outlets at the locations of clothes dryers, cooking facilities, water heaters, and central heating units to alleviate the possible drain on any one energy source. The Chairman opened the public hearing on Use Permit No. 74-6 and Conditional Exception No. 74-10. The Chairman outlined that the plan meets ordinance code re- quirements excepting for those regulations for which the Conditional Exception has been filed. Parking and the construction of'a 32" screening wall was discussed. Minutes: H.B. Board of Zoning Adjustments Wednesday, February 27, 1974 Page 6 Mr. Spencer pointed out that the ordinance code was created for small lots in the town lot area and should technically not apply to this area, thereby pointing out the impossibility of complying with ordinance code requirements. Mr. Spencer also suggested that a code amendment be proposed to alleViate this problem. The Board concurred. Location of trash area, concrete curbing, parking bumpers and elevations were discussed. As there were no parties present to speak in favor or opposition to Use Permit No. 74-6 and Conditional Exception No. 74-10, the Chairman closed the public hearing. Board discussion followed. Findings and conditions of approval were discussed. ON MOTION BY SPENCER AND SECOND BY EADIE CONDITIONAL EXCEPTION NO. 74-10 WAS APPROVED FOR THE FOLLOWING REASONS BY THE FOLLOWING VOTE: 1. The granting of a Conditional Exception will not constitute a grant of special privilege inconsistent upon other properties in the vicinity and under an identical zone classification. 2. Because of special circumstances applicable to the -subject property, including size, shape, topography, location or surroundings, the strict application of the zoning ordinance is found to deprive the subject property of privileges en- joyed by other properties in the vicinity and under identical zone classifications. 3. The granting of a Conditional Exception is necessary to pre- serve the enjoyment of one or more substantial property rights. 4. The granting of a Conditional Exception will not adversely affect the Master Plan of the City of Huntington Beach. (1190) 5. The existing code section was primarily established to control existing dwellings in the old town R-2 Lots. Board of Zoning Adjustments Wednesday, February 27, 1974 Page 7 FINDINGS: The establishment, maintenance and operation of the use will not be detrimental to: 1. The general welfare of persons residing or working in the vicinity. 2. Injurious to property and improvements to the vicinity of such use or building. 3. That the granting of a Use Permit will not adversely affect the Master Plan of the City of Huntington Beach. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The plot plan received February 6, 1974 shall be the approved layout as amended showing: a. A 32" decorative masonry screening wall shall be located within the planting areas fronting the property in order to preclude sight of the open parking. b. 4 foot concrete bumpers shall be provided for parking stalls. c. Trash area shall be enclosed by a solid gate. d. 6" concrete curbing shall contain all landscaped areas. 2. Florida Street shall be dedicated to City standards at the time each parcel is developed. 3. Elevations of the proposed plot plan received February 6, 1974 shall be the approved elevations. 4. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 5. All buildings on lots abutting a City easement shall be set back five (5) feet from the edge of such easement. 6. Soil and compaction reports as required by the Building Department and the Department of Public Works shall be submitted to the City. Minutes: H.B. Fire alarm system conduit and appurtenances shall be installed by the developer at locations and to specifi- cations provided by the Fire Department. 2. Parking compounds shall be screened with a combination of fencing and landscaping. Said plan shall be submitted - to the Planning Department for review and approval. Fencing and landscape plans shall include the following information: a. A list including quantities and sizes for each species of plants and all ground cover material. b. Irrigation layout to include meter location, pipe sizes, sprinkler head types, etc. c. Fencing materials and detail drawing. C. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. Florida Street shall be fully improved including street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 2. All utilities shall be installed underground. 3. Off-street parking facilities shall conform to Article 979. D. TO BE COMPLETED PRIOR TO ISSUANCE OF CERTIFICATE OF OCCUPANCY: 1. Water supply shall be through the City of Huntington Beach's water supply system. 2. Sewage disposal shall be through the City of Huntington Beach's sewage system. 3. Easements for utilities or walkways shall be provided to Department of Public Works standards. 4. The property shall participate in the local drainage assessment district. 5. To permit the construction of an automotive lubrication center pursuant to S.9472 of the Huntington Beach Ordinance Code located on the southwest corner of A Street and Warner Avenue in a C-4, highway commercial district. Mr. Robert Overdewest, the applicant, was present. The Chairman informed the Board that the Environmental Review Board granted Exemption Declaration No. 74-17 on February 26, 1974 with the following additional information: No environmental impact report has been prepared for this project, and the Negative Declaration issued for the project has been properly posted in the office of the City Clerk. Findings are based upon the material contained in the exemption declaration request, as well as upon further data submitted by the applicant. The Chairman opened the public hearing. The Board discussed plans with the applicant. Landscaping was discussed. The applicant indicated that he would ;land- scape and maintain the strip of land along -Warner Avenue belonging to the City. It was the consensus of the Board to ask for revised plans detailing landscaping, open space, and sign proposal, and recommended a continuance for that reason. As there were no parties present to speak in favor or opposition to Use Permit No. 74-4, the Chairman closed the public hearing. ON MOTION BY EADIE AND SECOND BY SPENCER USE PERMIT NO. 74-4 WAS CONTINUED TO MARCH 6, 1974 BY THE FOLLOWING VOTE: AYES: Eadie, Spencer, Ford NOES: None ABSENT: None ADMINISTRATIVE REVIEW NO. 74-11 Applicant: Robert M. Tepper To permit the establishment of a 15,000 square foot shopping center addition to Zody and Stater Bros. complex pursuant to S.9430 of the Huntington Beach Ordinance Code located on the south side of Edinger, approximately 150 ft. from Goldenwest in a C-2, community business district. Mr. Tepper, the applicant, was present. The Chairman informed the Board that the Environmental Review Board granted Exemption Declaration No. 74-15 on February 26, 1974 with the following additional information: No environmental impact report has been prepared for this project, and the Negative Declaration issued for the project was properly posted in the office of the City Clerk. Findings are based upon the information contained in the exemption declaration request and upon supplementary plans submitted by the applicant. The Board discussed plans with applicant. The rearrangement of parking, the rearrangement of the building was discussed. Mr. Tepper informed the Board that the rear of the building would be used for trash area and that building would contain several back doors. Emergency -vehicle accessibility was discussed. A straight through access versus a turnaround access for emergency vehicles was discussed. Signs were discussed. The applicant indicated'a canopy sign and a free standing sign was proposed, but was 'not definite as to size or copy at this time. Conditions of approval were discussed. Minutes: H.B. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The revised plot plan received February 14, 1974 shall be the approved layout as amended. 2. Edinger Avenue shall be dedicated to City standards at the time each parcel is developed. 3. Elevations of the proposed plan shall be submitted to the Board of Zoning Adjustments for review and approval action. 4. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 5. All buildings on lots abutting a City easement shall be set back five (5) feet from the edge of such easement. 6. Signs shall reflect a common theme with respect to design materials and colors which are compatible with the architectural theme of the proposed project. 4. He stated that the original mistake had been made by the architect and is now unable to have a'20 ft. setback. Alternatives to the proposed plan were discussed. It was the consensus of the Board, that since the structure has not been erected yet, a hardship does not exist. Further- -,,.more,.it was the consensus of the Board that this lot would not accomodate the proposed structure and be within ordinance code; however, development could be accomodated.
