The Chairman informed the Board that the Environmental Review Board
granted Exemption Declaration No. 74-2 February 13, 1974 with the
following additional information:
No environmental impact report has been prepared for this
project. The Negative Declaration issued for the project
was properly posted in the office of the City Clerk.
Findings are based upon the initial study information submitted
to the Environmental Review Board, as well as the applicant's
intent to work with the BZA in resolving problems with the
plot plan and the traffic engineer's concurrence on the
location of the drive exiting onto Edinger Avenue from the
project.
The Chairman presented a letter from Mrs. Psaros which included
a petition from neighbors to the Board why a 6 ft.'wall should
exist to separate the office professional district from the
residential district. She felt that due to the buildings
directly south of,the proposed development have children passing
through an alley, going to school, would create a hazard for those
children. She further felt that a wall would isolate the
business activity and as such, driving and parking would be away
from the residential section, thus also alleviating a lot of noise.
She further stated that one of the patios of her apartment building
opens directly onto the alley which would also create a hazard.
In summary, Mrs. Psaros felt that access to the professional
building off of the alley would be dangerous.
Mr. Koebig presented a revised plan to the Board showing an additional
10 ft. wide dedication area on the alley.
Board discussed plans with applicant. The Chairman informed the
Board that a plan check revealed the revised plans to be within
ordinance code requirements. Additional dedication was discussed.
A 4 ft. planter along the southerly portion of the property to preclude
vehicular ingress and egress from the main parking area and the alley
was discussed. It was noted that such a planter should have a 32"
decorative masonry wall within the planter.
Board discussion followed.
Conditions of approval were discussed.
ON MOTION BY FORD AND SECOND BY SPENCER ADMINISTRATIVE REVIEW NO.
73-226 WAS APPROVED WITH THE FOLLOWING CONDITIONS AND BY THE
FOLLOWING VOTE:

Zoning Adjustments.
10. All signs for the Proposed Development shall be submitted
to the BZA for approval. The BZA encourages signs which
reflect a common theme with respect to design materials
and colors which are compatible with the architectural
theme of the proposed project. Sign concept received
December 27, 1973 and approved shall comply to Article
976.
11. Fire alarm system conduit and appurtenances shall be
installed by the developer at locations and to specifi-
cations provided by the Fire Department.
12. Parking compounds shall be screened with a combination
of fencing and landscaping. Said plan shall be submitted
to the Planning Department for review and approval.
Fencing and landscape plans shall include the following
information:

a. A list including quantities and sizes for each
species of plants and all ground cover material.
b. Irrigation layout to include meter location, pipe
sizes, sprinkler head types, etc.

B. TO BE COMPLETED PRIOR TO FINAL INSPECTION:
1. Edinger and Waikiki shall be fully improved inluding
street trees, street signs, street lights, fire hydrants,
sewer and water main extensions.
2. All utilities shall be installed underground.
3. Off-street parking facilities shall conform to Article 979.
4. There shall be no fence, structure or landscaping
constructed or maintained over 3 1/2 feet high within
a 10 ft. by 10 ft. triangular area at the intersection
of driveways and streets or within a 25 ft. by 25 ft.
triangular area at the intersection of streets.
C. TO BE COMPLETED PRIOR TO ISSUANCE OF CERTIFICATE OF OCCUPANCY:
1. Water supply shall be through the City of Huntington Beach's
water supply system.

Applicant: Rodney B. Lauter
To permit 24 parking spaces in lieu of the required 24-1/2 for
a proposed apartment addition in lieu of S.9166 (d) (e) of the
Huntington Beach Ordinance Code located on the east side of
Delaware, approximately 190 ft. north of Yorktown in an R-2,
medium density residential district.

To permit the consolidation of two parcels of land into one

Applicant: Rodney B. Lauter
To permit the addition of an additional seven dwelling units
to an existing four unit apartment complex pursuant to
S.9162.3.1 of the Huntington Beach Ordinance Code located on
the east side of Delaware, approximately 190 ft. north of
Yorktown in an R-2, medium density residential district.
Mr. Rodney B. Lauter, the applicant, was present.
The Chairman informed the Board that the Environmental Review
Board granted Exemption Declaration No. 74-14 pertaining to
Conditional Exception 74-6, Division of Land 74-3 and Use
Permit 74-3 February 19, 1974 with the following additional
information:
1. The insulation of all exterior walls and ceilings to
reduce the burden on heating and cooling systems.
2. The disposal of building spoils, such as unusable lumber,
wire, pipe, and other surplus or unusable material at an
off -site facility equipped to handle them.
3. The stubbing in of natural gas at the locations of clothes
dryers, cooking facilities, water heaters, and central
heating units to alleviate the possible drain on any
one energy source.

The Chairman opened the public hearing on Conditional Exception
No. 74-6 and Use Permit No. 74-3.
The Chairman informed the Board that these applications had
been previously continued for submittal of revised plans.
He further stated that Conditional Exception No. 74-6 had
been readvertised to reflect the intent of the applicant.
Mr. Lauter presented his justifications for the granting of
a Conditional Exception as being in the nature of having
to remove existing trees due to this project being master planned
in 1964, whereby landscaping had been installed. He further
stated that he did not wish to remove those trees, having
a growth of 10 years. Mr. Lauter went on to explain that
one half of the project has been completed.
The Chairman pointed out that in regards to the driveway,
a 23 ft. drive is impossible to turn into. He further felt
that he would rather see having the trees removed than en-
dangering motorists entering and exiting a small driveway.
The Division of Land was discussed. It is the intent of the
applicant to combine two parcels back into one parcel.
Shortage of parking was discussed. On site parking was discussed,
and it was agreed upon by the Board that on -site parking could
possibly be accomodated, but would not be aesthetically pleasing.
The possibility of moving a fire hydrant, located in front of
the proposed project was discussed.
As there were no parties present to speak in favor or opposition
to Conditional Exception No. 74-6 and Use Permit No. 74-3, the
Chairman closed the public hearing.
Conditions of approval and reasons for approval were discussed.
ON MOTION BY SPENCER AND SECOND BY FORD CONDITIONAL EXCEPTION
NO. 74-6 WAS APPROVED FOR THE FOLLOWING REASONS BY THE FOLLOWING
VOTE:
1. Request for deletion of one half (1/2) parking space would
not constitute a grant of special privilege inconsistent
upon other developed properties in the vicinity and
under identical zone classifications.
2. An additional parking space could be provided within the
project but not without sacrificing much desired open
space devoted to landscaping.

A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. A tentative parcel map shall be submitted to the Planning
Department for approval.
2. Delaware shall be dedicated to City standards at the time
each parcel is developed.
3. Division of Land shall not be effective until a covenant
and agreement is signed agreeing to the conditions of
approval.
B. TO BE COMPLETED PRIOR TO FRAMING INSPECTION:
1. A Parcel Map and the Covenant and Agreement shall be
filed with the City and recorded prior to framing
inspection of any structures on any parcel.

FINDINGS:

3. That the granting of a Use Permit will not adversely
affect the Master Plan of the City of Huntington Beach.
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The revised plot plan received March 5, 1974 shall be
the approved layout as amended,
2. A revised Plot Plan shall be submitted to the Board of
Zoning Adjustments for Approval Action. Said plan shall

b. The implementation of additional paving to facilitate
a 25' turning radius.
C. In the event the existing fire hydrant on site cannot
be relocated an additional parking space shall be
shown on site on the revised plan.
3. Delaware Avenue shall be dedicated to City standards at
the time each parcel is developed.
4. Elevations of the proposed plan received March 5, 1974

GENERAL:
The project shall be constructed with full insulation of all
exterior walls and ceilings to reduce the burden on heating and
cooling systems (4" thick mineral batts or 2-3/41' thick fiberglass
batts with foil backing).
Building spoils, such as scraps of lumber, wire, pipe and other
surplus or unusable material shall be dumped at an off -site solid
waste disposal site, especially allocated for such use.
Both natural gas and electricity shall be stubbed in for clothes
dryers, cooking facilities, water heaters, and refrigeration units
to alleviate the possible drain on any one energy source with the
concurrence of the applicant.

To permit the construction of a medical professional building
pursuant to 5.9401 of the Huntington Beach Ordinance Code
located on the northwest corner of Delaware and Main in an R-5,
office professional district.
The applicant was not present.
The Chairman informed the Board that the Environmental Review
Board granted Exemption Declaration No. 74-26 March 5, 1974
with the following additional information:
The Environmental Review Board recommends that the project
would be enhanced by the following:
1. To mitigate any adverse effect from the possible removal
of the eucalyptus trees onsite, the Board recommends the
replacement of any trees found necessary to be removed on
a ratio of two for one, such replacement to be a minimum
size of 30" boxed trees.

2. That the driveways should be a minimum width of 24 ft.
affording both ingress and egress at both locations.
3. The plot plan shall be revised to reflect inner
circulation on site to facilitate access to both

It was the consensus of the Board to continue this item for
two weeks to allow applicant to be present at his hearing.
