CONSENT CALENDAR Minutes ON MOTION BY BOYLE AND SECOND BY HIGGINS MINUTES OF MARCH 12, 1974 WERE APPROVED BY THE FOLLOWING VOTE: AYES: Bazil, NOES: None ABSENT: Geiger SCHEDULED ITEMS: Higgins, Kerins, Wallin, Boyle, Porter CONDITIONAL EXCEPTION NO. 72-5 Applicant: Frank L. Arterberry This is the annual review of the application for allowing the continued operation of an oil salvage business originally approved by the City under Use Variance No. 792. The property is located 300 f t. north of Clay Avenue and west of Crystal Street in an RA-0 Residential Agriculture District combined with oil production. Mr. John Cope, Planning staff, addressed the Commission and outlined the conditions of approval recommended by staff. He stated that additional landscaping of fast growing variety should be implemented. Commission discussed the conditions of approval. Slides of the property were shown. Mr. Ketching, representing Frank L. Arterberry, addressed the Commission. -He stated that Mr. Arterberry was willing to cooperate with the conditions imposed by the Planning Commission in every way possible. He further stated that the business was really not a salvage yard but rather a storage place for material prior to removal. 4 Minutes: H.B. Planning Commission Tuesday, April 2, 1974 Page 2 ON MOTION BY WALLIN AND SECOND BY BOYLE CONDITIONAL EXCEPTION NO. 72-5 WAS ALLOWED TO CONTINUE SUBJECT TO THE FOLLOWING CONDITIONS AND BY THE FOLLOWING VOTE: 1. Conditional Exception No. 72-5 shall be reviewed annually by the Planning Commission. 2. Said use may be terminated by the Planning Commission with a 30 day notice to the owner. 3. Landscape screening, consisting of a fast growing, dense coverage type vine or bush, shall be placed against the chain link fence on Crystal Avenue, and the north property line. The placement, quantity, and type of screening plants shall be subject to Planning Department approval. AYES: Bazil, Higgins, Kerins, Wallin, Boyle, Porter NOES: None ABSENT: Geiger WORK PROGRAM FOR 1974 Mr. Ed Selich addressed the Commission and stated that his present- ation would be an update of the Work Program which was presented in February to the Commission. Three charts were on display for the Commission, representing the work progress of the three teams, the Housing Policy Team, Physical Planning Team, and Environmental Planning Team. There was a discussion on the preparation of technical report on �. the Noise Element, in-house versus outside consultant. ON MOTION BY KERINS AND SECOND BY HIGGINS STAFF WAS DIRECTED TO TRANSMIT TO CITY COUNCIL A REQUEST FOR FUNDING TO HAVE A TECHNICAL REPORT FOR NOISE ELEMENT PREPARED BY AN OUTSIDE CONSULTANT BY THE FOLLOWING VOTE: AYES: Bazil, Higgins, Kerins, Wallin, Boyle, Porter NOES: None ABSENT: Geiger REVISED APPLICATION FORM FOR CONDITIONAL USE PERMITS Mr. Dave Eadie addressed the Commission and noted that a copy of proposed revised Conditional Use Permit had been included in their packets. Mr. John O'Connor, Deputy City Attorney, requested that action on accepting this form be deferred until he could respond to it. Mr. Eadie noted that the fee study is still underway and the fee will be determined upon termination of the study. ON MOTION BY PORTER AND SECOND BY WALLIN DISCUSSION WAS CONTINUED TO APRIL 16, 1974 BY THE FOLLOWING VOTE: AYES: Bazil, Higgins, Kerins, Wallin, Boyle, Porter NOES: None .' Planning Commission Tuesdy, April 2, 1974 Page ARBORICULTURAL AND LANDSCAPE STANDARDS AND SPECIFICATIONS FROM DEPARTMENT OF PUBLIC WORKS Mr. Daryl Smith, Public Works Department, addressed the Commission. He indicated that the Arboricultural and Landscape Standards and Specifications which they had been furnished for review in their packet was a combination of three documents. Planning Commission requested alternate solutions from the Design Review Board regarding meandering sidewalk treatment and median strip within three months. Commission discussed adopting the specification and reviewing in three mont;is to see if an improvement could be made. A MOTION WAS MADE BY PORTER AND SECONDED BY HIGGINS TO ADOPT ARBORICULTURAL AND LANDSCAPE STANDARDS AND SPECIFICATIONS DATED Jj,PUARY 1974. Mr. O'Connor stated that there was no need to adopt the speci- fications, but that they could be referenced as part of the conditions of approval. VOTE: AYES: Bazil, Higgins, Kerins, Wallin, Boyle, Porter NOES: None ABSENT: Geiger THE MOTION CARRIED. TENTATIVE TRACT 8025 Mr. John Cope addressed the Commission and stated that the applicant had requested an extension of time for a period of one month. The City Council has adopted the final map and the Tentative map must be recorded prior to final tract. ON MOTION BY BAZIL AND SECOND BY HIGGINS A REQUEST FOR EXTENSION OF ONE MONTH WAS GRANTED ON TENTATIVE TRACT 8025 BY THE FOLLOWING VOTE: AYES: Bazil, Higgins, Kerins, Wallin, Boyle, Porter NOES: None ABSENT: Geiger PROPOSED CODE AMENDMENT NO. 74-5 AND 74-2 Mr. John Cope addressed the Commission and stated that Proposed Code Amendment No. 74-5 is referred to as "PRD Parking Standards Revision" and Proposed Code Amendment No. 74-2 is referred to as "Definition Revision" which is definition of open or public land. He asked Commission if they preferred for staff to pursue separate Code Amendments on these two items or should staff incorporate into the PRD rewrite. Commission discussed the proposed Code Amendments. Mr. Cope stated that the PRD Ordinance is due the first part of June 1974. -3- 4/2/74 - PC Minutes: H.B. Planning Commission Tuesday, April 2, 1974 Page 4 ON MOTION BY BOYLE AND SECOND BY WALLIN STAFF WAS DIRECTED TO INCORPORATE PROPOSED CODE AMENDMENT NO. 74-5 AND 74-2 INTO THE PRD REVISION BY THE FOLLOWING VOTE: AYES: Bazil, Higgins, Kerins, Wallin, Boyle, Porter NOES: None ABSENT: Geiger REWRITE OF DIVISION 9 Mr. John O'Connor, City Attorney's office, discussed the rewr'te of Division 9. He stated that it might be well to discuss oL twin- ing an appropriation to handle this. ON MOTION BY KERINS AND SECOND BY BAZIL PLANNING STAFF AND ATTORNEY'S OFFICE WERE DIRECTED TO PREPARE TRANSMITTAL TO CITY COUNCIL WHICH WILL INCLUDE JUSTIFICATION FOR REWRITE OF DIVISION 9 BY THE FOLLOW- ING VOTE: AYES: Bazil, Higgins, Kerins, Wallin, Boyle, Porter NOES: None ABSENT: Geiger WRITTEN COMMUNICATIONS TRACT 7805 A letter from H. E. Hartge was noted by Commission. This letter indicated that the necessary right-of-way to provide access along Prairie Drive to Tract 7805 has been obtained. MEMO FROM JOHN O'CONNOR RE DEDICATION OF WATER RIGHTS TO THE CITY AS A CONDITION OF APPROVAL OF A TENTATIVE TRACT Commission discussed Opinion from City Attorney's office which indicated condition for requirement that subsurface water rights be dedicated to the City was invalid. ON MOTION BY BAZIL AND SECOND BY PORTER PROVISION FOR DEDICATING SUBSURFACE WATER RIGHTS TO THE CITY AS A CONDITION OF APPROVAL OF A TENTATIVE TRACT WAS REMOVED FROM CONDITIONS OF APPROVAL, INCLUDING MAPS WHICH HAVE BEEN APPROVED BUT NOT ACTUALLY RECORDED BY THE FOLLOWING VOTE: AYES: Bazil, Higgins, Kerins, Wallin, Boyle, Porter NOES: None ABSENT: Geiger ORAL COMMUNICATIONS Colonel Hayes addressed the Commission and explained the difficulty he had experienced in obtaining a permit to tear down the family residence, presently situated on three lots located at 601 California Avenue, and rebuild a home on the three lots. The difficulty was brought about by the zoning in the area being R2 and R3. He further J 1 -4- 4/2/74 - PC Minutes: H.B. Planning Commission Tuesday, April 2, 1974 Page 5 stated that at the direction of the Planning Director he was appearing before the Commission seeking their reconsideration. ON MOTION BY WALLIN AND SECOND BY HIGGINS STAFF WAS DIRECTED TO PRESENT SLIDES OF THE PROPERTY AS IT EXISTS AT APRIL 16 MEETING TOGETHER WITH RECOMMENDATIONS CONCERNING DOWNGRADING THE PROPERTY FROM R3 TO R2 BY THE FOLLOWING VOTE: AYES: Bazil, Higgins, Kerins, Wallin, Boyle, Porter NOES: None ABSENT: Geiger Mrs. Margaret Carlberg addressed the Commission and rEaJ a letter of commendation from the Sea and Sage Chapter of the Audubon Society which was addressed to the La Solana Corporation commending them for their efforts in protecting the least tern which is an endangered species. Mr. Dave Diamond, President of the Home Council, addressed the Commission and discussed landscaping on medians of freeways, and indicated that oleanders were a poisonous species and should only be used in areas where there is no danger to small children. STAFF COMMENTS: Secretary Harlow discussed the City Council meeting of April 1, 1974. COMMISSIONERS' COMMENTS: Chairman Kerins requested that a Master Plan be displayed on wall behind Commission, and that spot lights should be added to reflect on plans. He further stated that a microphone should be available in display area. Commissioner Boyle referred to Court Decision 72 which deals with zoning. He stated that he felt the Commission should be furnished a copy of this as soon as possible as it would be of particular interest to the City. Commissioner Porter requested that a Master Plan be on display at meetings. There was a discussion on "findings" being incorporated in staff } reports. Chairman Kerins asked staff to report at next study session recommendations on how Planning Commission and City Council should proceed on these matters. Commission discussed the processing of Exemption Declarations.
