Johnson To permit the construction of an office building pursuant to S. 9471.4 of the Huntington Beach Ordinance Code located on the east side of Beach Blvd. approximately 275 ft. south of Slater in a C-4, highway commercial district. Mr. John Swint, representing the applicant, was present. The Chairman informed the Board that the Environmental Review Board granted Exemption Declaration No. 74-25 April 2, 1974 with the following additional information: No environmental impact report has been prepared for this project, and the Negative Declaration issued for the project has been properly posted in the office of the City Clerk. B. Board of Zoning Adjustments Wednesday, April 3, 1974 Page 4 The Chairman informed the Board that the proposal is for an exten- sion of a recently approved project. He further stated that the plan does not meet the landscaping requirement along Beach Blvd. The construction of a 6 foot inside diameter dimension landscaping planter is to be constructed along Beach Boulevard. The Chairman further informed the Board that all other aspects cf the ordinance code are being complied with. Conditions of approval were discussed. ON MOTION BY SPENCER AND SECOND BY FORD ADMINISTRATIVE REVIEW NO. 74-24 WAS APPROVED WITH THE FOLLOWING CONDITIONS AS OUTLINED AND AMENDED BY THE FOLLOWING VOTE: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The plot plan received February 13, 1974 shall be the approved layout. 2. A revised Plot Plan shall be submitted to the Planning Department for approval action. Said plan shall incor- porate the following amendments: a. Revision of landscaping planter along Beach Boulevard shall reflect a 6 ft. inside diameter dimension. b. A 32" decorative masonry screening wall shall be located within the landscaped planters along Cameron Avenue and Beach Boulevard. 3. Beach Boulevard and Cameron Avenue right of way shall be dedicated to City and State standards at the time each parcel is developed. 4. Elevations of the proposed plan received February 13, 1974 shall be the approved elevations. 5. All buildings on lots abutting a City easement shall be z set back five (5) feet from the edge of such easement. 6. Wall or fencing plan (send plans to Planning Department with Appearance Review Application). 9. Easements for utilities or walkways shall be provided to Department of Public Works standards. B. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. Beach Boulevard and Cameron Avenue shall be fully improved including street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 2. All utilities shall be installed underground. 3. Off-street parking facilities shall conform to Article 979. 4. There shall be no fence, structure or landscaping con- structed or maintained over 3 1/2 feet high within a 10 ft. by 10 ft. triangular area at the intersection of driveways and streets or within a 25 ft. by 25 ft. triangular area at the intersection of streets. 5. A lighting system shall be installed within the project equal in illumination to lighting on public streets. Lighting system shall be shielded to reflect away from adjoining properties and streets. 6. Water supply shall be through the City of Huntington Beach's water supply system. 7. No structures, other than those shown on the approved plot plan, shall be constructed within the project. 10. The sewer system shall be approved by the Department of Public Works and Fire Department. 11. All applicable City Ordinances shall be complied with. GENERAL: 1. All signs for the Proposed Development:shall be submitted to the Board of Zoning Adjustments for approval. The Board of Zoning Adjustments encourages signs which reflect a common theme with respect to design materials and colors which are compatible with the architectural theme of the proposed project. To permit the construction of a three story dwelling unit pursuant to S. 9102.6.1.2 of the Huntington Beach Ordinance Code located on the west side of Bolero Lane, approximately 790 ft. from Finisterre Drive in an R-1, low density residential district. Mr. Lorenzini, the applicant, and Mr. Ken Doyle, representing the owner, were present. The Chairman informed the Board that this application is a cate- gorical exemption, Class 3, California Environmental Quality Act, 1970. The Chairman opened the public hearing. The Chairman outlined the proposal to the Board and presented the Planning Department's position on the proposed development as being a three story dwelling requiring a 10 ft. side yard setback on both sides. Board of Zoning Adjustments Wednesday, April 3, 1974 Page 7 Mr. Spencer presented the Building Department's position on the proposed development as also being a three story dwelling requiring a 10 ft. side yard setback on both sides and that the appication should be treated as such. The Board informed the applicant that the proposed 5 ft. side yard setback requires a Conditional Exception Application, and that this request can not be considered under a Use Permit Application. The applicant requested a continuance in order to submit a Condi- tional Exception Application requesting the encroachment into the required interior side yard setback. As there were no parties present to speak in favor or opposition to Use Permit No. 74-11, the Chairman closed the public hearing. Board discussion followed. ON MOTION BY EADIE AND SECOND BY SPENCER USE PERMIT NO. 74-11 WAS CONTINUED TO APRIL 17, 1974 BY THE FOLLOWING VOTE: AYES: Eadie, Spencer, Ford NOES: None ABSENT: None CONDITIONAL EXCEPTION NO. 74-15 Applicant: Denzil Wilson To permit a reduction in the required minimum open space dimension for the purpose of constructing a room addition in lieu of S. 9103.3.11.3 of the Huntington Beach Ordinance Code located on the north side of Woodcrest Drive, approximately 100 ft. west of Lancelot Lane in an R-1, low density residential district. Mr. Denzil Wilson, the applicant, and Mr. Bates, Contractor, were present. The Chairman informed the Board that this application is a Cate- gorical exemption, class 3, California Environmental Quality Act, 1970. The Chairman opened the public hearing. Mr. Wilson outlined his proposal to the Board as being a room addition to be utilized by his mother-in-law. L_J Minutes: H. B. Board of Zoning Adjustments Wednesday, April 3, 1974 Page 8 The Chairman informed the Board that the open space requirement for the proposal is 25 ft. and that only 23 ft. are shown on the proposed plan. Mr. Spencer felt that due to the large front yard, an excessive amount of open space is available, and can be utilized. He further felt that the application meets the intent of open space require- ments as defined in the Huntington Beach Ordinance Code. The construction of a 42 inch high fence at the front yard sett ack line to provide a physical separation between the area devoted to open space and the remainder of the lot was discussed and agreed upon. As there were no parties present to speak in favor or opposition to Conditional Exception No. 74-15, the Chairman closed the public hearing. Board discussion followed. ON MOTION BY SPENCER AND SECOND BY FORD CONDITIONAL EXCEPTION NO. 74-15 WAS APPROVED FOR THE FOLLOWING REASONS AND BY THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: REASONS FOR APPROVAL: 1. The property will have a total of 2,180 sq. ft. devoted to usable open space exceeding the minimum of 1,200 sq. ft. required. 2. Meets the intent of open space requirements in Section 9103.3.1.1.3 of the Huntington Beach Ordinance Code where open space may be distributed. CONDITION OF APPROVAL: 1. A minimum 42 inch high fence shall be placed at the front yard setback line to provide a physical separation between the area devoted to open space and the remainder of lot. Board of Zoning Adjustments Wednesday, April 3, 1974 Page 9 To permit the construction and operation of a coin operated car wash pursuant to S. 9430.7 of the Huntington Beach Ordinance Code located on the south side of Garfield Avenue, approximately 200 ft. west of Brookhurst Street in a C-2, community business district. The Chairman informed the Board that the Environmental Review Board granted Exemption Declaration No. 74-37 April 2, 1974 with the following additional information: No environmental impact report has been prepared for this project, and the Negative Declaration issued for the project has been properly posted in the office of the City Clerk. Findings are based upon information contained in the exemption declaration request as well as upon statements made by the applicant at the Environmental Review Board's meeting. The Chairman informed the Board that the applicant has made intensions to withdraw the subject application and further proposed an indefinite continuance of Use Permit No. 74-12 to be readvertised at a future date if such withdrawal is received. ON MOTION BY EADIE AND SECOND BY SPENCER USE PERMIT NO. 74-12 WAS CONTINUED INDEFINITELY BY THE FOLLOWING VOTE: AYES: Eadie, Spencer, Ford NOES: None ABSENT: None CONDITIONAL EXCEPTION NO. 74-16 Applicant: Harold F. Morr To permit a reduction in the required amount of off-street parking spaces for a 3 unit apartment building in lieu of S. 9206 of the Huntington Beach Ordinance Code located on the west side of Alabama Avenue, approximately 200 ft. south of Hartford Street in an R-3 medium high density residential district. Mr. Harold Moor, the applicant, and Mr. Rodney Lauter, Architect, were present. The Chairman informed the Board that this application is a cate- gorical exemption, Class 3, California Environmental Quality Act, 1970. Minutes: H. B. Board of Zoning Adjustments Wednesday, April 3, 1974 Page 10 The Chairman outlined the proposal to the Board whereby the appli- cant is requesting 4 parking spaces in lieu of the required 5 parking spaces. The Chairman opened the public hearing. Mr. Lauter informed the Board that this proposal is partially developed. Mr. Lauter further felt that an additional parking space would create a maneuverability problem for vehicles. Mrs. Eiline D. Mantell addressed the Board and stated her opposition to the proposal. She stated that a congestion in parking existed, and felt that the applicant was adding to an already bad situation. Mr. Morr addressed the Board and stated that he has tried to conform to ordinance code requirement and that plenty of parking existed across the street. Mrs. Mantell informed the Board and the applicant that the vacant lot across the street was not to be utilized for public parking being privately owned. As there were no further parties present to speak in favor or opposition to Conditional Exception No. 74-16, the Chairman closed the public hearing. A MOTION WAS MADE BY EADIE TO DENY CONDITIONAL EXCEPTION NO. 74-161 HOWEVER, THE CHAIRMAN WITHDREW HIS MOTION AS THE APPLICANT STATED HE WOULD WITHDRAW HIS APPLICATION AT THIS TIME. ON MOTION BY EADIE AND SECOND BY FORD CONDITIONAL EXCEPTION NO. 74-16 WAS WITHDRAWN BY THE FOLLOWING VOTE: AYES: Eadie, Spencer, Ford NOES: None ABSENT: None CONDITIONAL EXCEPTION NO. 74-14 Applicant: Q. R. S. Corporation To permit the construction of a pole sign exceeding the maximum allowable area permitted, maximum permissible height, and the locational criteria provided by code in lieu of Sections 9763.2(a), 9763.2(b), 9764.3.1.1, and 9764.3.2 of the Huntington Beach Ordinance Code located on the west side of Main Street, approximately 50 ft. north of Olive Avenue in a C-3, general business district. The Chairman opened the public hearing. The Chairman outlined the sign code to the applicant and his representative. Mr. Van Gerpen addressed the Board and presented his justi'ication. He stated that the U. S. National Bank was bought by Crocker Bank. Mr. Van Gerpen further explained that the adjoining buildings would prevent anyone from seeing the sign, if it cannot be placed in the approximate height and location as the existing sign. He further stated that the actual copy of the sign would be 112 square feet as opposed to the existing sign copy being 294 square feet. As there were no parties present to speak in favor or opposition to Conditional Exception No. 74-14, the Chairman closed the public hearing. The Chairman felt that no hardship was demonstrated, and that sign could be brought into ordinance that the Board could take code action on conformance. He further felt this application. Mr. Spencer and Mr. Ford felt that this application should be referred to the Planning Commission for consideration. ON MOTION BY FORD AND SECOND BY SPENCER CONDITIONAL EXCEPTION NO. 74-14 WAS REFERRED TO THE PLANNING COMMISSION AT THEIR MEETING OF MAY 7, 1974 BY THE FOLLOWING VOTE: AYES: Ford, Spencer NOES: Eadie ABSENT: None ADMINISTRATIVE REVIEW NO. 74-34 Applicant: Ronald L. Knudtson To permit the construction of a 2 unit apartment building pursuant to S. 9201.2 of the Huntington Beach Ordinance Code located on the east side of 12th Street, approximately 50 ft. north of Orange Ave. in an R-3, medium high density residential district. Mr. Knudtson, the applicant, was present. The Chairman informed the Board that this application is a cate- gorical exemption, Class 3, California Environmental Quality Act, 1970. Minutes: H. B. The Board pointed out that Mr. Knudtson would have to submit revised plans showing the balconies conforming to ordinance code. The Chairman further stated that applicant meets all other azpects of the Huntington Beach Ordinance Code. Conditions of approval were discussed. ON MOTION BY EADIE AND SECOND BY FORD ADMINISTRATIVE REVIEW NO. 74-34 WAS APPROVED WITH THE FOLLOWING CONDITIONS AS OUTLINED AND AMENDED BY THE FOLLOWING VOTE: A. AYES: Eadie, Spencer, Ford NOES: None ABSENT: None MISCELLANEOUS: OIL WELL ACTIVATION PERMIT NO. 74-4 Applicant: John Teberg To permit the reactivation of Jacat's Wells #3, 4, 6, and 7 pursuant to S. 2311.1 of the Huntington Beach Ordinance Code located on the east side of 22nd Street between Acacia and Pecan (lots 1, 2, 13, 15, 21, and 23) in an R2-0 medium density residential district combined with oil production. Mr. Teberg, the applicant, was present. The Chairman informed the Board that the Environmental Review Board granted Exemption Declaration No. 74-27 on March 26, 1974 with the following additional information: The Board feels that the project would be enhanced by the following: Minutes: H. B. Board of Zoning Adjustments Wednesday, April 3, 1974 Page 16 1. Well #4 shall comply with all requirements of the oil code, to include a 6 ft. block wall for sound attenuation. 2. Adequate landscaping shall be installed. 3. A chain link fence shall suffice around wells 3, 6, and 7. The Chairman informed the Board that he had not made a physical field check of the proposed site, and further asked for Mr. Herb Day, the Oilfield Superintendent, to outline the proposal to the Board. Mr. Day was opposed to Condition #1 stipulated by the Environmental Review Board. He felt that a six foot wall would hinder oilfield equipment from entering and exiting the well site. It was the consensus of the Board to condition the applicant to meet requirements of the oil code, and that vehicular maneuver- ability from the alley by oilfield vehicles shall be subject to the approval of the Oilfield Superintendent.
