owner, were present.
The Chairman informed the Board that Conditional Exception No.
74-25 is a categorical exemption, class 5, California Environmental
Quality Act, and Use Permit No. 74-11 is a categorical exemption,
class 3, California Environmental Quality Act, 1970.
The Chairman opened the public hearing on Conditional Exception
No. 74-25 and Use Permit No. 74-11.
The Chairman informed the Board that the Use Permit application
had been previously continued for the submittal of a Conditional
Exception for the proposed 5 ft. side yard encroachment.
The applicant outlined his justification as being in the nature
of an inflexibility in the ordinance code. It was also the feeling
of the applicant that all intent of complying to all ordinance
code requirements has be_en.made. The applicant further outlined
that the maximum height of a two story building would not be
violated.
As there were no parties present to speak in favor or opposition
to Conditional Exception No. 74-25 or Use Permit No. 74-11, the
Chairman closed the public hearing.
Board discussion followed.

Mr. Spencer, maker of the motion to approve subject applications,
proposed the following amendments to the Board of Zoning
Adjustments Minutes of April 17, 1974:

Mr. Spencer, maker of the motion to approve the subject
applications wished to clarify his reasons and findings
for approval. He instructed the Secretary to add into
minute action the issues which were not outlined in the
motion for approval. Mr. Spencer stated regarding the
Conditional Exception that his reasons for approval
were as previously noted and in addition he noted that

NO. 74-39 WAS APPROVED WITH THE FOLLOWING CONDITIONS AS OUTLINED
BY THE FOLLOWING VOTE:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The plot plan received April 1, 1974 shall be the
approved layout containing the following amendments:
a. Reflection of a 24 ft. driveway approach.
b. Mounding of the landscaping adjacent to the parking
complex in lieu of a 32" wall. Said mounding shall
be at least 32" in height at its highest point.
2. Research Lane right-of-way shall be dedicated to City
standards at the time each parcel is developed.
3. Elevations of the proposed plan received April 1, 1974
shall be the approved elevations.
4. All buildings on lots abutting a City easement shall be
set back five (5) feet from the edge of such easement.
5. Soil and compaction reports as required by the Building
Department and the Department of Public Works shall be

6. Plans depicting the fire protection systems including
automatic sprinkler systems, fire hydrants,,) fire alarms
and any required fire protection device shall be approved
by the Fire and Public Works Departments.

8. Easements for utilities or walkways shall be provided to
Department of Public Works standards.

GENERAL:
1. All signs for the proposed development shall be submitted
to the Board of Zoning Adjustments for approval. The Board
of Zoning Adjustments encourages signs which reflect a
common theme with respect to design materials and colors
which are compatible with the architectural theme of the
proposed project. Signs shall be limited to wall signs.
2. All required fire hydrants shall be installed, accessible
and operable prior to the construction of any permanent
structure using combustible material.
3. All conditions of Tentative Tract 6948 shall be complied with.

CONDITIONAL EXCEPTION NO. 74-21
Applicant: Martin T.. Rainey
To permit a reduction in the minimum amount of open -space in lieu
of S.9103.1.1.3 of the Huntington Beach Ordinance Code. Said
reduction is for the purpose of constructing a room addition to
an,existing single family dwelling unit located on the south side
of Netherway Drive near the southeast corner of Bushard and
Indianapolis in an R-1, low density residential district.
Mr. Rainey, the applicant, was present.
The Chairman informed the Board that this application is a
categorical exemption, class 5, California Environmental Quality
Act, 1970.

The Chairman presented two letters in opposition to the proposed
addition. Mr. Doyle Davison stated in his letter that an addition
would detract from the property value of'his home. Mr. Edwin Welcre
stated in his letter that the property would not lend itself to
any addition.
Mr. Rainey presented his justification as being in the nature of
the severity of his physical handicap and the difficulties involved
with using either of two methods of ambulation, a wheel chair or
a gurney. The location and accessibility of the facilities occupied
and utilized by Mr. Rainey, with particular emphasis directed to
the addition which consists of an open bedroom, an accessible closet,
and most important a special and specifically designed bath -shower -
dressing area which can accommodate either wheelchair or gurney, are
necessary for him to remain independent as a property owner.
He further felt that the granting of a conditional exception would
preserve his rights to freely utilize and enjoy his property as
well as his right to remain independent.
Mr. Rainey further stated that the design and planning of the
proposed project has been performed by an architect to enhance
the beauty and value of his property while performing a necessary
function and it will blend in with the surroundings of his property.
As there were no further parties present to speak in favor or
opposition to Conditional Exception No. 74-21, the Chairman closed
the public hearing.
Board discussion followed.
Captain Vanderlaan stated that the Fire Department concurred with
the proposed project due to the fact that a proposed modification
to the driveway will provide better means of vehicular egress for
this person due to his physical handicap. The proposed project
will help to insure the applicant's safety and well being.
Findings were discussed.

The Chairman opened the public hearing on Use Permit No. 74-14.
The Chairman outlined the proposals to the Board. He stated
that the Use Permit application was for the construction of a
truck well, the Division of Land application was filed to
consolidate two lots into one, and the Administrative Review
application was filed for the construction of an industrial
building.

Board discussed plans with applicant. Traffic circulation and trash
receptacle locations were discussed. The Board discussed the location
of the truck well and the amount of landscaping required with the
applicant's representatives.
The Chairman outlined the code requirement for the construction of
a truck well to the applicant's representatives.
Relocation of parking spaces was discussed to meet ordinance code
requirements.
Mr. Harding addressed the Board and stated that the Division of Land
application was filed to consolidate two smaller lots into one.
As there were no parties present to speak in favor or opposition to
Use Permit No. 74-14, the Chairman closed the public hearing.
Conditions of approval and findings were discussed.
ON MOTION BY SPENCER AND SECOND BY FORD ADMINISTRATIVE REVIEW
NO. 74-42 WAS APPROVED WITH THE FOLLOWING CONDITIONS AS OUTLINED
BY THE FOLLOWING VOTE:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The plot plan received April 5, 1974 shall be the approved
layout as amended.
2. A revised plot plan shall be submitted to the Planning
Department for approval action. Said plan shall
incorporate the following amendments:
a. Reflection of a 20 ft. wide entrance to the truck
wells.
b. Reflection of a 24 ft. minimum driveway approach.
C. Revised landscaping allocations as indicated on
the approved plot plan.
d. Relocation of the proposed trash areas.
e. Reflection of revised parking layout as shown on
approved plot plan.
3. Container Avenue right-of-way shall be dedicated to
City standards at the time each parcel is developed.
4. Elevations of the proposed plan shall be submitted to
the Board of Zoning Adjustments for review and approval
action.

5. All buildings on lots abutting a City easement shall be
set back five (5) feet from the edge of such easement.
6. Soil and compaction reports as required by the Building
Department and the Department of Public Works shall be
submitted and approved by the City.
7. A Division of Land application, separating this parcel
from the remaining property held under the same ownership,
shall be approved by the City.
8. Plans depicting the fire protection systems including
automatic sprinkler systems, fire hydrants; fire alarms
and any required fire protection device shall be approved
by the Fire and Public Works Departments.
9. The following plans shall be submitted to the Planning
Department for review and approval.
a. Landscaping and irrigation plan
b. Rooftop mechanical equipment screening plan
10. Easements for utilities or walkways shall be provided to
Department of Public Works standards.
B. TO BE COMPLETED PRIOR TO FINAL INSPECTION:
1. A parcel map shall be filed with and approved by the
Department of Public Works and recorded with the Orange
County Recorder.
2. Container Avenue shall be fully improved including street
trees, street signs, street lights, fire hydrants, sewer
and water main extensions.
3. All utilities shall be installed underground.
4. Off-street parking facilities shall conform to Article 979.
5. Water supply shall be through the City of Huntington Beach's
water supply system.
6. Sewage disposal shall be through the City of Huntington
Beach's sewage system.
7. The property shall participate in the local drainage
assessment district. (Contact Dept. of Public Works)
8. No structures, other than those shown on the approved plot
plan, shall be constructed within the project.
9. The sewer system shall be approved by the Department of
Public Works and Fire Department.
10. All applicable City Ordinances shall be complied with.

GENERAL:
1. All signs for the proposed development shall be submitted
to the Board of Zoning Adjustments for approval. The
Board of Zoning Adjustments encourages signs which reflect
a common theme with respect to design materials and colors
which are compatible with the architectural theme of the
proposed project.
2. All required fire hydrants shall be installed, accessible
and operable prior to the construction of any permanent
structure using combustible material.
3. All applicable conditions of Tentative Tract 6948 shall
be complied with.

To permit the encroachment of three (3) feet into the required
ten (10) ft. rear yard setback in lieu of S.9103.3 of the Huntington
Beach Ordinance Code located on the west side of Dalehurst Circle
which intersects Mandeville Drive in an R-1, low density residential
district.
Mrs. Thomas, the applicant, was present.
The Chairman informed the Board that this application is a categorical
exemption, class 5, California Environmental Quality Act, 1970.
The Chairman opened the pudic hearing.

Mrs. Thomas explained her proposal to the Board. She stated that
her kitchen is very small and that there is not enough space for
an eating area. She further explained that the only way to expand
her kitchen is to build outwards.
The Chairman pointed out to the Board that the proposed property
had been previously granted a variance for a room addition.
As there were no parties present to speak in favor or opposition
to Conditional Exception No. 74-22, the Chairman closed the public
hearing.
Board discussion followed.
It was`the consensus of the Board to make a field check of the
proposed project to further determine whether or not a hardship
existed.
