The Chairman informed the Board that this application is pending finalization of Exemption Declaration No. 74-28 and further proposed a two week continuance. Lindborg To permit the construction of a 14 unit apartment building pursuant to S.9231.6 of the Huntington Beach Ordinance Code located on the northwest corner of llth Street and Walnut in an R-4, high density residential district. Mr. Lindborg, the applicant, was present. Minutes: H.B. Board of Zoning Adjustments Wednesday, May 1, 1974 Page 2 The Chairman informed the Board that the Environmental Review Board granted Exemption Declaration No. 74-48 with the following additional information: The Board offers the following recommendations to mitigate the cumulative effect of successive construction projects of this nature: 1. If the developer proposes to provide air conditioning, the insulation in the exterior ceilings shall be a minimum of R-19 and that in the exterior walls shall be a minimum of R-11; if no air conditioning is to be provided, the insulation in the exterior ceilings shall be a minimum of R-13 and that in the exterior walls shall be a minimum of R-7. 2. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 3. Natural gas and electricity shall be stubbed in at the location of clothes dryers, and natural gas only shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 4. A soils engineer shall be engaged to indicate the G-factor due to earth movement for this location. 5. A structural engineer shall be engaged to compile calculations for footings and structural members of the facilities to with- stand these G-factors. Board discussed plans with applicant. The applicant requested an indefinite continuance to further discuss plans with staff. It was noted that the applicant would be notified of hearing at a later date. ON MOTION BY FORD AND SECOND BY EADIE ADMINISTRATIVE REVIEW NO. 74-43 WAS CONTINUED INDEFINITELY BY THE FOLLOWING VOTE: AYES: Eadie, Spencer, Ford NOES: None ABSENT: None USE PERMIT NO. 74-13 (Cont. from 4/24/74) Applicant: Franklin J. Buccella To permit the construction of a 38 unit apartment building pursuant to S.9202.3.1.3 of the Huntington Beach Ordinance Code located on the west side of Lynn Street, approximately 450 ft. north of Warner Avenue in an R-3, medium high density residential district. The Chairman proposed a continuance of two weeks to allow the applicant to be present at the hearing and also to allow staff to meet with applicant requesting revised plans. ON MOTION BY EADIE AND SECOND BY SPENCER USE PERMIT NO. 74-13 WAS CONTINUED TO MAY 15, 1974 BY THE FOLLOWING VOTE: AYES: Eadie, Spencer, Ford NOES: None ABSENT: None ADMINISTRATIVE REVIEW NO. 74-51 Applicant: Richard D. Bowen To permit an amendment to the plot plan of a previously approved 153 unit motel pursuant to S.9471 of the Huntington Beach Ordinance Code located on the east side of Beach Blvd., approximately 300 ft. north of Yorktown Avenue in a C-4, highway commercial district. Mr. Bowen, of Statewide Motels, the applicant, was present. The Chairman informed the Board that this application is exempt due to the filing of a previous Exemption Declaration No. 74-36 granted by the Environmental Review Board April 9, 1974. Board discussed plans with applicant. The applicant outlined changes on the revised plan to the Board. Mr. Bowen stated that the project required an additional driveway to be able to utilize the existing sign. Mr. Bowen further felt the additional driveway was necessary to allow weekly tenants of the proposed motel to separately enter their units and not mix with the registration traffic. It was the consensus of the Board that by eliminating the proposed additional driveway a traffic problem would not be created, also, the additional proposed driveway could be in violation of local and State legislation. Relocation of parking stalls due to utilizing part of parking spaces for turning radius was discussed. The Chairman noted that the previous conceptual plan was short of the required landscaping and that the modified plan still was under the minimum requirement. Minutes: H.B. It was the consensus of the 'Board to continue this application to May 8, 1974 to obtain an opinion from the Traffic Engineer regarding the proposed additional driveway. ON MOTION BY FORD AND SECOND BY SPENCER ADMINISTRATIVE REVIEW NO. 74-51 WAS CONTINUED TO MAY 8, 1974 BY THE FOLLOWING VOTE: AYES: Eadie, Spencer, Ford NOES: None ABSENT: None CONDITIONAL EXCEPTION NO. 74-26 Applicant: Rayne Fairchild To permit the encroachment of an eave and a balcony into the rear yard setback in lieu of S.9103.4.2.2 and 5.9103.4.2.3 of the Huntington Beach Ordinance Code. The applicant was not present. The Chairman opened the public hearing. The Chairman informed the Board that this application is a categorical exemption, class 5, California Environmental Quality Act, 1970. The Chairman further stated that'this application has been filed improperly as the Channel of Huntington Harbour is considered permanent open space. Mr. Helfer of the Huntington Harbour Property Association, addressed the Board. Mr. Helfer was under the impression that the Building Department would not issue a building permit for the proposed balcony, and further stated that it was his understanding that the Channel of Huntington Harbour was not considered open space. As there were no further parties present to speak in favor or opposition to Conditional Exception 74-26, the Chairman closed the public hearing. It was the consensus of the Board to continue this application in order for the applicant to be present. ON MOTION BY SPENCER AND SECOND BY EADIE CONDITIONAL EXCEPTION NO. 74-26 WAS RECONSIDERED BY THE FOLLOWING VOTE: AYES: Eadie, Spencer, Ford NOES: None ABSENT: None Board discussed the proposal with the applicant. It was the consensus of the Board to withdraw the application, acting upon the clarification of code by the City Attorney's Office as described by Mr. Spencer. The Chairman closed the public hearing. ON MOTION BY SPENCER AND SECOND BY FORD CONDITIONAL EXCEPTION NO. 74-26 WAS WITHDRAWN BY THE FOLLOWING VOTE: AYES: Eadie, Spencer, Ford NOES: None ABSENT: None ADMINISTRATIVE REVIEW NO. 74-49 Applicant: Richard Doyle To permit the construction of a two car garage pursuant to S.9231.6 of the Huntington Beach Ordinance Code located on the east side of 9th Street, approximately 50 ft. north of Walnut in an R-4, high density residential district. Mr. Doyle, the applicant, was present. The Chairman informed the Board that this application is a categorical exemption, class 1, California Environmental Quality Act, 1970. Board discussed plans with applicant. The possibility of converting the garage into apartments at a future date was discussed. Dedication of right-of-way was also discussed. Board discussion followed. Conditions of approval were discussed. ON MOTION BY EADIE AND SECOND BY SPENCER ADMINISTRATIVE REVIEW NO. 74-49 WAS APPROVED WITH THE FOLLOWING CONDITION AS OUTLINED BY THE FOLLOWING VOTE: 1. If dedication of the opposite side of the Alley has not taken place, the subject garage shall set back an additional 2-1/2 feet to facilitate a 25 ft. turning radius. Minutes: H.B. Highsmith To permit a parking lot for existing shops pursuant to S.9456 and S.9456.2 of the Huntington Beach Ordinance Code located on the northwest corner of Pacific Coast Highway and 6th Street in a C-3, General Business District. Mr. Harry Monck, representing the applicant, was present. The Chairman informed the Board that this application is a categorical exemption, class 11, California Environmental Quality Act, 1970. Board discussed plans with applicant's representative. Board discussion followed. ON MOTION BY EADIE AND SECOND BY SPENCER ADMINISTRATIVE REVIEW NO. 74-53 WAS APPROVED WITH THE FOLLOWING CONDITION BY THE FOLLOWING VOTE: Approval is made with the assumption that, based on the applicant's verbal indication that nine (9) parking spaces are the maximum number required. CONDITION OF APPROVAL: 1. If the applicant is required to install additional parking stalls, the entire plan shall be submitted back to the Board of Zoning Adjustments subject to their approval. To permit the expansion of an office facility pursuant to S.9530.1 of the Huntington Beach Ordinance Code located on the south side of Garfield Avenue, 100 ft. east of Beach Blvd. in an M-1, light industrial district. ON MOTION BY FORD AND SECOND BY EADIE ADMINISTRATIVE REVIEW NO. 74-55 WAS APPROVED.WITH THE FOLLOWING CONDITIONS AS OUTLINED BY THE FOLLOWING VOTE: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The plot plan received April 23, 1974 shall be the approved layout. 2. Garfield Avenue right-of-way shall be dedicated to City standards at the time each parcel is developed. 3. Soil and compaction reports as required by the Building Department and the Department of Public Works shall be submitted and approved by the City. 4. Plans depicting the fire protection systems including automatic sprinkler systems, fire hydrants, fire alarms and any required fire protection device shall be approved by the Fire and Public Works Departments. 5. The following plan shall be submitted to the Planning Department for review and approval. a. Landscaping and irrigation plan. B. TO BE COMPLETED PRIOR TO FINAL -INSPECTION: 1. Garfield Avenue shall be fully improved including street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 2. All utilities shall be installed underground. 3. Off-street parking facilities shall conform to Article 979. GENERAL: 1. All signs for the proposed development shall be submitted to the Board of Zoning Adjustments for approval. The Board of Zoning Adjustments encourages signs which reflect a common theme with respect to design materials and colors which are compatible with the architectural theme of the proposed project. King To permit a four unit apartment building pursuant to S.9231.6 of the Huntington Beach Ordinance Code located on the southeast corner of 12th Street and Walnut in an R-4, high density residential district. Mr. King, the applicant, was present. The Chairman informed the Board that this application is a categorical exemption, class 3, California Environmental Quality Act, 1970. Board discussed plans with applicant. Conditions of approval were discussed. ON MOTION BY FORD AND SECOND BY EADIE ADMINISTRATIVE REVIEW NO. 74-60 WAS APPROVED WITH THE FOLLOWING CONDITIONS AS OUTLINED BY THE FOLLOWING VOTE: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The plot plan received April 25, 1974 shall be the approved layout. 2. Walnut, 12th Street and Alley right-of-way shall be dedicated to City standards at the time each parcel is developed. 3. Elevations of the proposed plan received April 25, 1974 shall be the approved elevations. 4. All buildings on lots abutting a City easement shall be set back five (5) feet from the edge of such easement. 5. Soil and compaction reports as required by the Building Department and the Department of Public Works shall be submitted and approved by the City. 6. Plans depicting the fire protection systems including automatic sprinkler systems, fire hydrants, fire alarms and any required fire protection device shall be approved by the Fire and Public Works Departments. Board approved landscape plans with modification for partial landscaping of the frontage until such time that the Department of Public Works establishes street grades. Mr. Daryl Smith of the Department of Public Works submitted the following: "In reviewing the above site, I found the trees shown on the plan to be very fine specimens and should be saved. It would seem reasonable to request and condition the developer to provide the city with a landscape plan once final street grades and drainage are established by the city. Plan should be approved by the Planning Department. Landscape should be installed within 60 days from plan approval." SIGNS: Applicant: Fisk Tire Center 72 SQ. FT.
