ON MOTION BY EADIE AND SECOND BY FORD CONDITIONAL EXCEPTION NO. 74-33 WAS CONTINUED TO MAY 22, 1974 BY THE FOLLOWING VOTE: AYES: Eadie, Spencer, Ford NOES: None ABSENT: None REGULAR AGENDA ITEMS: OIL WELL ACTIVATION PERMIT NO. 74-5 Applicant: Huntington Beach Oil Company To permit the activation of an oilwell (Clark #2) pursuant to S.2392 of the Huntington Beach Ordinance Code located on the north side of Ellis, between Goldenwest and Edwards in an RA-0-CD residential agricultural civic district combined with oil production. Minutes: H.B. Board of Zoning Adjustments Wednesday, May 15, 1974 Page 4 Mr. Marion, the applicant, was present. The Chairman informed the Board that the Environmental Review Board granted Exemption Declaration No. 74-47 on May 7, 1974 with the following additional information: The Board offers the following recommendations to enhance the project: 1. The Board recommends that the developer does not oil any of the service roads because of the detrimental effect this practice has upon water quality. 2. The operation shall remain in full compliance with all provisions of the oil ordinance. Board discussed proposal with applicant. Mr. Herb Day, Oilfield Superintendent, submitted a transmittal to the Board of Zoning Adjustments stating that the applicant was in violation of certain ordinance code requirements, which must be rectified prior to permitting the activation of oilwell Clark #2. The Board explained to the applicant that it was unable to take action on the proposal until such time that all ordinance code violations have been corrected. The applicant agreed to correct all code violations and asked to be reviewed by the Board of Zoning Adjustments at that time. To permit the construction of a four (4) unit apartment building pursuant to S.9231.6 of the Huntington Beach Ordinance Code located on the east side of 20th Street, approximately 200 ft. north of Walnut in an R-4, high density residential district. Mr. Jim Foxx, the applicant, was present. The Chairman informed the Board that this application is a categorical exemption, class 3, California Environmental Quality Act, 1970. A plan check revealed that the proposal meets ordinance code requirements. Board discussion followed. Conditions of approval were discussed. ON MOTION BY FORD AND SECOND BY SPENCER ADMINISTRATIVE REVIEW NO. 74-64 WAS APPROVED WITH THE FOLLOWING CONDITIONS AS OUTLINED BY THE FOLLOWING VOTE: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The revised plot plan received May 14, 1974 shall be the approved layout. 2. 20th Street and Alley right-of-way shall be dedicated to City standards at the time each parcel is developed. 3. Elevations of the proposed plan shall be submitted to the Planning Department for review and approval action. 4. Soil and compaction reports as required by the Building Department and the Department of Public Works shall be submitted and approved by the City. B. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. 20th Street and Alley right-of-way shall be fully improved including street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 2. All utilities shall be installed underground. 3. Water supply shall be through the City of Huntington Beach's water supply system. 4. IN CONJUNCTION WITH: DIVISION OF LAND NO. 74-11 Applicant: Hopkins Development Company To permit the division of one parcel into two parcels pursuant to S.9811.3 of the Huntington Beach Ordinance Code located on the southwest corner of Bolsa Chica Street and Edinger Avenue in a C-2, community business district. Mr. Jeffrey Garner, Mr. David Garrison of Carl's Jr. Restaurants, and Mr. Steve Hopkins, Developer, were present. The Chairman informed the Board that the Environmental Review Board granted Exemption Declaration No. 74-59 on May 14, 1974 with the following additional information: No environmental impact report has been prepared for this project, and the Negative Declaration issued for the project has been properly posted in the office of the City Clerk. Findings are based upon the material contained in the declaration request, supplementary information submitted thereto, and discussion taking place at the meeting. Board discussed findings of Exemption Declaration No. 74-59. Parking for the proposed restaurant (Carl's Jr.) was discussed. A reciprocal agreement with adjoining property for a common driveway use was discussed. ON MOTION BY SPENCER AND SECOND BY EADIE ADMINISTRATIVE REVIEW NO. 74-56 WAS APPROVED WITH THE FOLLOWING CONDITIONS AS OUTLINED BY THE FOLLOWING VOTE: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan received May 15, 1974 shall be the approved layout as amended. 2. A revised Plot Plan shall be submitted to the Board of Zoning Adjustments by May 22, 1974. Said plan shall incorporate the following amendments and shall be subject to approval by the Board: a. A revised parking and landscaping layout as demonstrated on the approved conceptual plot plan as amended. 3. Bolsa Chica and Edinger right-of-way shall be dedicated to City standards at the time each parcel is developed. 4. Elevations of the proposed plan shall be submitted to the Board of Zoning Adjustments for review and approval action. 5. Soil and compaction reports as required by the Building Department and the Department of Public Works shall be submitted and approved by the City. 6. Plans depicting the fire protection systems including automatic sprinkler systems, fire hydrants, fire alarms and any required fire protection device shall be approved by the Fire and Public Works Departments. 7. The following plans shall be submitted to the Planning Department for review and approval. a. Landscaping and irrigation plan b. Rooftop mechanical equipment screening plan c. Wall or fencing plan 8. Easements for utilities or walkways shall be provided to Department of Public Works standards. B. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. The height of said wall shall be such that the top will be six (6) feet above the highest ground surface within twenty (20) feet of the common property line. 4. There shall be no fence, structure or landscaping constructed or maintained over 3 1/2 feet high within a 10 ft. by 10 ft. triangular area at the intersection of driveways and streets or within a 25 ft. by 25 ft. triangular area at the inter- section of streets. 5. Water supply shall be through the City of Huntington Beach's water supply system. 6. Sewage disposal shall be through the City of Huntington Beach's sewage system. 7. No structures other than those shown on the approved plot plan, shall be constructed within the project. 9. The sewer system shall be approved by the Department of Public Works and Fire Department. GENERAL: 1. All signs for the proposed development shall be submitted to the Building Department if such signs are in conformance with the drawings submitted to the Board of Zoning Adjustments and approved in concept on May 15, 1974. No additional pole signs shall be built for the total center. 2. All required fire hydrants shall be installed, accessible and operable prior to the construction of any permanent structures using combustible material. IN CONJUNCTION WITH: DIVISION OF LAND NO. 74-12 Applicant: John A. Alexander To permit the consolidation of two (2) lots pursuant to S.9811.3 of the Huntington Beach Ordinance Code located on the south side of Research Drive, approximately 750 ft. west of Graham Street in a 100-M1-A, 15,000 restricted industrial district. Mr. John Flick and Mr. Harding, representing the applicant, were present. The Chairman stated that Conditional Exception No. 74-31, Use Permit No. 74-20, Administrative Review No. 74-61, and Division of Land No. 74-12 are exempt from Environmental Review Board requirements due to the adoption of Environmental Impact Report No. 73-16 adopted by the City Council on March 18, 1974. Board of Zoning Adjustments Wednesday, May 15, 1974 Page 11 The Chairman opened the public hearing on Conditional Exception No. 74-31 and Use Permit No. 74-20. The Chairman informed the Board that Conditional Exception No. 74-31 and Use Permit No. 74-20 were improperly filed, and further stated that these applications were not necessary for the proposed use, therefore, suggested the withdrawal of these two applications. As there were no parties present to speak in favor or oppos- ition to Conditional Exception No. 74-31 and Use Permit No. 74-20, the Chairman closed the public hearing. Board discussed Administrative Review No. 74-61 and Division of Land No. 74-12 with the applicant's representatives. A shortage of landscaping was noted. It was pointed out to the applicant's representatives that applications must comply with all conditions of tentative map No. 6948. Pertaining to the Division of Land, the applicant's represent- ative stated that the owner purchased two separate lots and wished to combine them into one to facilitate a larger building. Elevations were discussed. Conditions of approval were discussed. ON MOTION BY EADIE AND SECOND BY SPENCER ADMINISTRATIVE REVIEW NO. 74-61 WAS APPROVED WITH THE FOLLOWING CONDITIONS AS OUTLINED BY THE FOLLOWING VOTE: A. The Board of Zoning Adjustments encourages signs which reflect a common theme with respect to design materials and colors which are compatible with the architectural theme of the proposed project. 2. All required fire hydrants shall be installed, accessible and operable prior to the construction of any permanent structure using combustible material. 3. Board of Zoning Adjustments Wednesday, May 15, 1974 Page 14 To permit 15 ft. encroachment into the required 30 foot interior side yard setback for two industrial buildings and two lots in lieu of 5.9513.3 of the Huntington Beach Ordinance Code located on the south side of Research Drive at the intersection of Container Lane in a 100-M1-A, 15,000 restricted industrial district. I IN CONJUNCTION WITH: ADMINISTRATIVE REVIEW NO. 74-62 Applicant: Edwin A. Robinson To permit the construction of two industrial buildings pursuant to S.9511 of the Huntington Beach Ordinance Code located on the south side of Research Drive at the intersection of Container Lane in a 100-M1-A, 15,000 restricted industrial district. Mr. Robinson, the applicant, and Mr. Harding, were present. The Chairman informed the Board that Conditional Exception No. 74-32 and Administrative Review No. 74-62 are exempt from Environmental Review Board requirements due to the adoption of Environmental Impact Report No. 73-16 adopted by the City Council on March 18, 1974. The Chairman opened the public hearing on Conditional Exception No. 74-32. Mr. Robinson presented his hardship for the granting of Conditional Exception No. 74-32 in the nature of utilizing a small lot to a greater advantage. Mr. Robinson stated if he were required to build strictly in conformance with ordinance code requirements, his building would have to be greatly reduced in size. The Chairman informed the Board that a specific plan of development standards for the Lusk Industrial Park has been discussed at the Planning Commission. It was the wish of the applicant to withdraw Conditional Exception No. 74-32 and Administrative Review No. 74-62 pending disposition of a Code Amendment to be introduced to the Planning Commission to alter development standards for the Lusk Industrial Park. As there were no parties present to speak in favor or opposition to Conditional Exception No. 74-32, the Chairman closed the public hearing. It was Mr. Smith's opinion that additional 15 gallon plants to those shown on the plans should be used. He further felt that the planting would blend in with the present architecture. Mr. Smith further offered to inspect plants prior to planting to be sure they are of an acceptable quality. It was Mr. Smith's opinion that the plant material would not provide the immediate screening a wall would, and it would probably be about 2 years before that would happen.
