construction of a building addition pursuant to S.9730.17 of the
Huntington Beach Ordinance Code located on the northwest corner
of Huntington and Clay Streets in an M-1, light industrial district.
Mr. Dick Hammond, representing the applicant, was present.
The Chairman opened the public hearing on Conditional Exception
No. 74-27 and Use Permit No. 74-18 and further stated that he would
abstain from voting because of possible conflicts of interest.
The Chairman informed the Board that the Environmental Review
Board granted Exemption Declaration No. 74-55 on May 21, 1974
with the following additional information.
No environmental impact report has been prepared for this
project; the exemption declaration request has been properly
posted for the public input period.

1. The Board recommends that the warehouse portion of
the facility be constructed at the required front
setback; for continuity in design, however, con-
struction of the office portion of the facility at
a reduced front yard setback will not have a demon-
strable negative aesthetic effect, as the applicant
has proposed similar landscape treatment for such
office facility as is presently existing.
2. If complaints are received on the noise caused by
the compressor, the applicant should pursue con-
struction of a 6 ft. high masonry wall along the side
property line between the compressor and the street
right-of-way to partially attenuate the noise impact.
Board discussed recommendations of Environmental Review Board
and adopted recommendation number 2 as a condition of approval.

ADJUSTMENTS ADOPTED EXEMPTION DECLARATION NO. 74-55 BY THE
FOLLOWING VOTE:

Mr. Hammond outlined his proposal to the Board. He stated that
the proposal is for an addition to an existing building. Mr. Eadie
outlined previous administrative actions on the subject property
to the Board.
Mr. Hammond outlined his justification for the Conditional
Exception as due to setback changes which came into effect
after the initial development. He further stated that the
new setback requirement has put his project "out of continuity".
Visually, there is nothing gained by pushing back parts of the
building to conform to the 10 ft. setback requirement and he
feels that this situation imposes a hardship.
The Chairman stated that after conferring with Advance Planning
staff, the proposal is in conformance with the Master Plan as
outlined in the Land Use Element, Phase I, at this point in time.
Board discussed Use Permit with applicant. Trash enclosure
and screening was discussed and the Chairman advised the applicant
that approval of the conceptual plan submitted did not waive
any ordinance code requirements.

Board discussed Administrative Review No. 74-50 with applicant.
The location of the proposed trailers was discussed. Mr. Hammond
stated that the trailers would be used for temporary office space.
As there were no parties present to speak in favor of or opposition
to Conditional Exception No. 74-27 and Use Permit No. 74-18, the
Chairman closed the public hearing.
Board discussion followed.
The Chairman outlined the Policy Plan for the City of Huntington
Beach to the applicant's representative.
Conditions of approval were discussed.
ON MOTION BY SPENCER AND SECOND BY CROSBY CONDITIONAL EXCEPTION
NO. 74-27 WAS APPROVED FOR THE FOLLOWING REASONS BY THE FOLLOWING
VOTE:
1. In that the existing building setback is six (6) feet, a
setback of ten (10) feet for the proposed expansion would
take away the continuity and aesthetic values that are being
incorporated into the project.
2. The granting of this Conditional Exception would not be in-
consistent with the currently adopted policy plan to encourage
expansion of existing industrial properties.
3. The granting of this Conditional Exception would not constitute
a grant of special privilege of the immediate vicinity.
4. The granting of this Conditional Exception will not adversely
affect the Master Plan of the City of Huntington Beach.

a. Landscaping and irrigation plan.
b. Rooftop mechanical equipment screening plan.
c. Wall or fencing plan (parking lot screening).
B. TO BE COMPLETED PRIOR TO FINAL INSPECTION:
1. All utilities shall be installed underground.
2. Water supply shall be through the City of Huntington
Beach's water supply system.
3. Sewage disposal shall be through the City of Huntington
Beach's sewage system.
4. The property shall participate in the local drainage
assessment district. (Contact Department of Public
Works.)
5. No structures, other than those shown on the approved
plot plan, shall be constructed within the project.
6. The sewer system shall be subject to approval by the
Department of Public Works and Fire Department.
GENERAL:
1. All required fire hydrants shall be installed, accessible
and operable prior to the construction of any permanent
structure using combustible material.
2. Applicant shall inquire at Department of Public Works
regarding reversal of parkway.
3. A maintenance agreement shall be filed with Department
of Public Works requiring applicant to incur any cost
of such maintenance.

CONDITIONAL EXCEPTION NO. 74-33
Applicant: Neill Neon, Inc.
To permit the placement of a wall sign for a commercial building
in lieu of S.9764.3.4 (Signs behind the setback line) of the
Huntington Beach Ordinance Code located on the northeast corner
of Pacific Coast Highway and 12th Street in a C-3 community
business district.
Mr. Buff, representing the applicant, was present.
The Chairman informed the Board that this application is a
categorical exemption, class 5, California Environmental Quality
Act, 1970.
The Chairman opened the public hearing.
Mr. Buff outlined his proposal to the Board. He further stated
that he has permission from the owner to place the proposed sign
on the building. He outlined his justification as traffic being
unable to see the building without the sign.
Mr. Andrews, adjacent property owner, addressed the Board in
opposition to the proposed sign. Mr. Andrews stated that the
sign would interfere with his business, and if the sign were
placed on the second floor it would interfere with view.

As there were no further parties present to speak in favor of
or opposition to Conditional Exception No. 74-33, the Chairman
closed the public hearing.
Board discussion followed.
It was the opinion of the Chairman that the proposed sign would
be encroaching on Mr. Andrews' privacy, and further failed to
see a justifiable hardship.
Mr. Spencer stated that signing was discussed prior to the
construction of the building, and that the owner of the develop-
ment at that time felt he could meet ordinance code requirements
for signing.
Mr. Crosby failed to see a justifiable hardship.
ON MOTION BY CROSBY AND SECOND BY EADIE CONDITIONAL EXCEPTION
NO. 74-33 WAS DENIED FOR THE FOLLOWING REASON BY THE FOLLOWING

To permit the construction of a ten unit apartment building
pursuant to S.9162.3.1 of the Huntington Beach Ordinance Code
located on the northwest corner of Garfield Avenue and Florida
Street in an R-2 medium density residential district.
Mr. Thomas Mallos, the applicant, and Mr. Kiter, the architect,
were present.
The Chairman informed the Board the Environmental Review Board
granted Exemption Declaration No. 74-60 May 14, 1974 with the
following additional information:

1. If the developer proposes to provide air conditioning, the
insulation in the exterior ceilings shall be a minimum of
R-19 and that in the exterior walls shall be a minimum of
R-11; if no air conditioning is to be provided, the
insulation in the exterior ceilings shall be a minimum of
R-13 and that in the exterior walls shall be a minimum of
R- 7 .
2. All building spoils, such as unusable lumber, wire, pipe,
and other surplus or unusable material, shall be disposed
of at an offsite facility equipped to handle them.
3. Natural gas and electricity shall be stubbed in at the
location of clothes dryers, and natural gas only shall be
stubbed in at the locations of cooking facilities, water
heaters, and central heating units.
4. Double -paned windows shall be installed within the units
facing onto the adjacent arterial highway.
5. A soils engineer shall be engaged to indicate the G-factor
due to earth movement for this location.
6. A structural engineer shall be engaged to compile calculations
for footings and structural members of the facility to with-
stand these G-factors.
The Board discussed the additional information transmitted by
the Environmental Review Board and incorporated the five
recommendations into the conditions of approval.

Location of fire hydrant, block wall in lieu of patio fences, and
trash location was discussed.
Mr. Harold Bragg, the adjacent property owner, addressed the Board
to inquire about fencing between the proposed units and his
existing apartment building.
Mr. Bragg was assured by the developer that a wall would be built
compatible with his architecture.

NO. 74-28 WAS APPROVED WITH THE FOLLOWING FINDINGS BY THE
FOLLOWING VOTE:
1. The Conditional Exception grants parity to other dwellings
which have incurred the same situation as to this provision.
2. The consolidated apartment standard code amendment has
been approved in concept to allow "0" property line
construction as is now allowed under Article 932 which
applies to certain portions of the City.

General:
1. A 6 ft. high decorate masonry wall shall be constructed
along Garfield Avenue in compliance with all ordinance
code requirements. A plan for said wall shall be
submitted to the Board of Zoning Adjustments for
approval action.
2. The construction of the garages on the "0" property
line shall be decorative stucco material.
FINDINGS:
1. The proposed apartment complex is consistent in construction
and architecture with other dwellings in the area.
2. The dwelling maintains quality control regarding seismisity
through the applicant's acceptance to implement the Conditions
of Approval regarding G-factor construction.
3. The proposal is consistent with the City's Policy Plan to
provide better building construction and good design.

The Chairman informed the Board that this application is a
categorical exemption, class 3, California Environmental Quality
Act, 1970.
Board discussed plans with applicant. The Chairman inquired
whether the proposed building was to be utilized as a duplex.
Mr. Clark stated that the additional room was to be utilized
as servants or guest quarters.

ON MOTION BY CROSBY AND SECOND BY EADIE ADMINISTRATIVE REVIEW
NO. 74-71 WAS APPROVED WITH THE FOLLOWING CONDITIONS AS OUTLINED
BY THE FOLLOWING VOTE:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The plot plan received May 15, 1974 shall be the approved
layout.
2. 19th Street and Alley right-of-way shall be dedicated to
City standards at the time each parcel is developed.

located on the east side of 9th Street, approximately 100 ft.

district.
The applicant was not present.
The Chairman informed the Board that this application is a
categorical exemption, class 3, California Environmental
Quality Act, 1970.
The Chairman informed the Board that the applicant has requested
a two week continuance to allow him time to submit a Use Permit
application to be heard in conjunction with Administrative
Review No. 74-66. Board concurred with continuance.

The Chairman informed the Board that this application is a
categorical exemption, class 1, California Environmental Quality
Act, 1970.
Board discussed the proposal with the applicant. Mr. Wichner
stated that he is requesting separate service from his tenants.
He further stated that the Edison Company would be able to add
one more drop wire to his existing facility to separate his
facilities. Mr. Wichner further stated that the surrounding
neighborhood is being served by overhead utility wires.

To permit an offsite pole sign in a parking area in lieu of

Beach Ordinance Code located on the east side of Beach Boulevard
approximately 50 ft. south of Atlanta Avenue in a C-4 highway
commercial district.
Mr. Guy Thull, representing the applicant,was present.
The Chairman informed the Board that this application is a
categorical exemption, Class 5, California Environmental Quality
Act, 1970.
The Chairman opened the public hearing.
Mr. Thull explained the proposal to the Board. He stated that
the proposal is for the construction of a pylon sign to be placed
on adjoining property. He further stated that the sign is to be
located in a planter.
The Chairman stated that the Conditional exception application
does not contain sufficient information for demonstration of a
hardship, and asked the applicant to expound on his justification
for the placement of the proposed sign.

northeast corner of Producer Lane and Research Drive in an
M1-A, 20,000 restricted industrial district.

Applicant: Huntington Beach Industrial Park
To permit the consolidation of three (3) parcels of land into
one lot pursuant to 5.9811.3 of the Huntington Beach Ordinance
Code located on the northeast corner of Producer Lane and
Research Drive in an M1-A, 20,000 restricted industrial district.
Mr. Harding, the applicant, Mr. Dave Ariss of Coldwell Banker
and Mr. Doug Goster of Galloway were present.
The Chairman informed the Board that these applications have
been considered by the Environmental Review Board under
Environmental Impact Report No. 73-16 adopted by the City
Council on March 18, 1974.

To permit a garden wall within the front yard setback in lieu
of S.9103.1 of the Huntington Beach Ordinance Code located on
the west side of Sunburst Lane, approximately 360 ft. north of
Chestnut Drive in an R-1, low density residential district.
The Board discussed reconsideration of subject application and
found that reasons as follows for reconsideration of Conditional
Exception No. 74-29.
REASONS FOR RECONSIDERATION:
After a field investigation and further statistical analysis
of the proposal, Mr. Spencer made a motion to reconsider
Conditional Exception No. 74-29.
